HomeMy WebLinkAbout20232606.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, SEPTEMBER 11, 2023 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, September 11, 2023, at the hour of 9:00 a.m. 1E1 ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Perry L. Buck, Pro -Tern Commissioner Scott K. James Commissioner Kevin D. Ross Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli MINUTES: There being no corrections to the Minutes of the Board of County Commissioners meeting of August 28, 2023, as printed, Commissioner Buck moved to approve. Commissioner James seconded the motion and it carried unanimously. IE AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Ross seconded the motion and it carried unanimously. PRESENTATIONS: 1) LIFE SAVING AWARDS, SHERIFF'S OFFICE - DAVID GRIJALVA AND ERIC LASE: Chair Freeman invited those being recognized to come forward. Steve Reams, Weld County Sheriff, thanked the Board and explained the purpose of the recognition of deputies in a public environment by those who work closest to them. Sergeant Jerry Porter, Sheriff's Office, introduced Deputies David Grijalva and Eric Lase, who performed exemplary life-saving measures on June 30, 2023, by assisting several citizens who drove around traffic barricades on County Roads (CRs) 73 and 16, to cross flood waters and subsequently became stranded and in need of rescue. He explained during the investigation of the first vehicle swept away by the flood waters, two (2) more vehicles had also become stranded, and due to Deputy Lase's quick thinking, he was able to save lives while utilizing spike strips for a family in distress, since his first rescue was still utilizing the floatation devices. Sergeant Porter noted that Deputy Lase was able to rescue two (2) families that day, therefore, he was awarded the Ribbon of Merit, in addition to the Life Saving Award, also presented to Deputy Grijalva. Each Commissioner, in turn, expressed their gratitude for their ingenuity, resourcefulness, and commitment to their service and utilizing lifesaving efforts for citizens of Weld County. IR WARRANTS: 1) GENERAL WARRANTS - SEPTEMBER 8, 2023: Commissioner Ross moved to approve the General Warrants, as printed. Commissioner Buck seconded the motion and it carried unanimously. El BIDS: 1) APPROVE BID #B2300167, SAND OIL TANK AND GREASE TRAP PUMPING SERVICE - FACILITIES DEPARTMENT: Carolyn Geisert, Purchasing Department, stated staff recommends selecting the lowest bidder who met specifications, Wright Choice, Inc., for a total amount of $64,319.00, annually. She noted the bid will permit up to three (3), one (1) -year renewals based on performance. Commissioner Buck moved to approve said bid. The motion was seconded by Commissioner James, and it carried unanimously. 2) PRESENT BID #B2300157, RECORDS RELOCATION AND REMODEL - FACILITIES DEPARTMENT: Ms. Geisert stated five (5) bids were received and staff will make a recommendation on September 25, 2023. 3) PRESENT BID #B2300172, CHASE BUILDING (822 7TH ST., GREELEY) CHILLER REPLACEMENT DESIGN AND ENGINEERING SERVICES - FACILITIES DEPARTMENT: Ms. Geisert stated four (4) bids were received and staff will make a recommendation on September 25, 2023. 4) PRESENT BID #B2300173, FLAMMABLE EXHAUST, FIRE ALARM AND FIRE SUPPRESSION UPGRADE FOR DACONO HOUSEHOLD HAZARDOUS WASTE - FACILITIES DEPARTMENT: Ms. Geisert stated one (1) bid was received and staff will make a recommendation on September 25, 2023. NEW BUSINESS: 1) CONSIDER CONTRACT ID #7349 EXPENDITURE AUTHORIZATION AND WORK PLAN FOR ADDITIONAL TRADE ADJUSTMENT ASSISTANCE (TAA) CASE MANAGEMENT GRANT FUNDS AND AUTHORIZE CHAIR TO SIGN ELECTRONICALLY: Tami Grant, Deputy Director of the Department of Human Services, stated this expenditure authorization allows for Employment Services of Weld County (ESWC) to provide reemployment and case management services to trade -impacted individuals, in the amount of $6,637.00, from June 1, 2023, through September 30, 2024. Commissioner Saine moved to approve said expenditure authorization and authorize the Chair to sign electronically. The motion was seconded by Commissioner Ross, and it carried unanimously. E 2) CONSIDER CONTRACT ID #7355 AMENDMENT #1 TO FACILITY USAGE LICENSE AGREEMENT AND RENTAL GUIDELINES FOR AREA AGENCY ON AGING (AAA) SENIOR NUTRITION PROGRAM (FRIENDLY FORK), AND AUTHORIZE CHAIR TO SIGN - ARCHDIOCESE OF DENVER AND GUARDIAN ANGELS CATHOLIC CHURCH: Ms. Grant stated this amendment allows for congregate meals through the Friendly Fork program to continue with a reduction of cost from $100.00, per week, to $50.00 per week, with a term of August 31, 2023, through August 30, 2024. Commissioner Ross moved to approve said amendment and authorize the Chair to sign. The motion was seconded by Commissioner Buck, and it carried unanimously. Minutes, Monday, September 11, 2023 Page 2 2023-2606 BC0016 IE 3) CONSIDER CONTRACT ID #7363 COMMERCIAL REAL ESTATE LEASE AGREEMENT FOR OFFICE SPACE (810 9TH STREET, SUITES 150 AND 200, GREELEY) FOR CHILD WELFARE FAMILY SUPPORT AND VISITATION CENTER (FSVC), AND AUTHORIZE CHAIR TO SIGN - BUCKINGHAM GORDON, LLC: Ms. Grant stated staff received notification the lease for the current location would not be renewed, and this lease agreement allows for a new location. She indicated the Department of Human Services is working diligently with the Facilities and Information Technology Departments to ensure the Family Support and Visitation Center (FSVC) will be in working order by November 1, 2023. Ms. Grant stated this contract is for an initial two (2) years, with a one (1) year renewal option, for the amount of $188,640.00, which is funded by the Child Welfare Block Grant from November 1, 2023, through October 31, 2025. Commissioner James moved to approve said lease agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Buck, carried unanimously. 4)CONSIDER STANDARD FORM FOR COOPERATIVE AGREEMENTS REGARDING PROTOCOLS FOR CHILD WELFARE NOTIFICATION AND INVESTIGATION REQUIREMENTS BETWEEN DEPARTMENT OF HUMAN SERVICES AND VARIOUS LAW ENFORCEMENT AGENCIES, AND AUTHORIZE CHAIR TO SIGN ANY AGREEMENT CONSISTENT WITH SAID FORM: Ms. Grant stated this allows formal relationships with local law enforcement agencies in the coordination of duties for allegations of child neglect and abuse. Commissioner Buck moved to approve said form and authorize the Chair to sign any agreement consistent with said form. The motion was seconded by Commissioner Ross, and it carried unanimously. EI 5) CONSIDER EMERGENCY TEMPORARY CLOSURE OF CR 31 BETWEEN CRS 84 AND 86: Amy Mutchie, Department of Public Works, stated this emergency closure began on August 30, 2023, due to two (2) collapsed irrigation culverts caused by an overweight crane crossing, and will go through September 22, 2023. She further stated the ditch company has been contacted and the party responsible for the damage is working with the County to share the cost to repair the damage. Commissioner Buck moved to approve said temporary closure. The motion was seconded by Commissioner Ross, and it carried unanimously. 6) CONSIDER TEMPORARY CLOSURE OF TWO RIVERS PKWY BETWEEN CR 54 AND SH 60: Ms. Mutchie stated this closure will begin September 24, 2023, and go through September 29, 2023, to allow for guard rails to be installed as part of the bridge finalization and completion of utility work. Commissioner Ross moved to approve said temporary closure. The motion was seconded by Commissioner Buck, and it carried unanimously. El 7) CONSIDER CONTRACT ID #7358 CHANGE ORDER #1 TO AGREEMENT FOR 2023 MATERIAL HAULING (EMERGENCY BID #62300075) - SO LOW TRANSPORT, INC.: Nate Gibson, Department of Public Works, stated this change order, in the amount of $1,631,957.00, will provide contract trucking services through the end of 2023. Commissioner Ross moved to approve said change order #1, which was seconded by Commissioner Buck, and it carried unanimously. El 8) CONSIDER RENEWAL APPLICATION FOR A VINTNER'S RESTAURANT (COUNTY) LIQUOR LICENSE AND AUTHORIZE CHAIR TO SIGN - SALT AND ACRES, LLC, DBA SALT AND ACRES: Matthew Conroy, Assistant County Attorney, reviewed the renewal liquor application for a vintner's restaurant located on County Road (CR) 25 and north of CR 20, which has had a liquor license since 2017, and the current applicants have owned the winery since 2022. He stated there are no concerns from referral agencies, and recommends approval. Commissioner James moved to approve said renewal application and authorize the Chair to sign. The motion was seconded by Commissioner Buck, and it carried unanimously. Minutes, Monday, September 11, 2023 Page 3 2023-2606 BC0016 9) SECOND READING OF CODE ORDINANCE #2023-14, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 3 HUMAN RESOURCES OF THE WELD COUNTY CODE (HFWA AND POWR ACT): Commissioner James moved to read Code Ordinance #2023-14 by title only. The motion was seconded by Commissioner Ross, and it carried unanimously. Bruce Barker, County Attorney, read the title for the record. Jill Scott, Director of the Department of Human Resources, stated there have been no changes since First Reading. No public input was offered concerning this matter. Commissioner James moved to approve Code Ordinance #2023-14 on Second Reading. The motion was seconded by Commissioner Ross, and it carried unanimously. el PLANNING: 1) CONSIDER VACATION OF PUBLIC FACILITY DIVISION, PFD22-0004, AND RECOMBINE LOTS INTO ORIGINAL ACREAGE - BARCLAY FARM PROPERTY, LLC, C/O RICHARD JOHNSON: Molly Wright, Department of Planning Services, stated the Public Facility Division, PFD22-0004, map was recorded on April 5, 2023, and gave a brief overview of the location of the approximately 40 -acre unplatted parcel. She indicated Code criteria has been met and staff recommends approval. Rich Johnson, applicant, explained he went through the process of subdivision for the Fire Department, but the site was not developed due to insufficient due diligence while working with their attorney. In addition, he stated after the Environmental Study was completed, a high-pressure oil pipeline was discovered to be too close in proximity to the proposed location for a new fire station. No public testimony was offered concerning this matter. Commissioner Ross moved to approve said vacation. The motion was seconded by Commissioner Buck, and it carried unanimously. IR PUBLIC COMMENT: There was no public comment offered. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2023-14 was approved on Second Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
