AUTHORIZE DEPARTMENT OF PUBLIC WORKS TO SUBMIT ELECTRONICALLY
WHEREAS,the Board of County Commissioners of Weld County,Colorado,pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County,Colorado,and
WHEREAS,the Board has been presented with a Grant Application for the Energy and
Mineral Impact Assistance Fund(EIAF)Program for the County Roads 6 and 13 Intersection
Roundabout Project(December Cycle-Tier II)from the County of Weld,State of Colorado,by
and through the Board of County Commissioners of Weld County,on behalf of the Department of
Public Works,to the Colorado Department of Local Affairs,Division of Local Government,with
further terms and conditions being as stated in said application,and
WHEREAS,after review,the Board deems it advisable to approve said application,a copy
of which is attached hereto and incorporated herein by reference.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County,Colorado,that the Grant Application for the Energy and Mineral Impact Assistance
Fund (EIAF) Program for the County Roads 6 and 13 Intersection Roundabout Project
(December Cycle-Tier II)from the County of Weld,State of Colorado,by and through the Board
of County Commissioners of Weld County,on behalf of the Department of Public Works,to the

SUBJECT:DOLA Application-2023 December Cycle
In accordance with Public Works'annual capital improvement plan work session held on
October 12,2023,staff is requesting the Commissioners submit two Energy and Mineral
Impact Assistance Fund(EIAF)grant applications to the Department of Local Affairs
(DOLA)for the 2023 December cycle.
The first application is for a Tier 1,$200,000 grant request for road improvements to WCR
21 from WCR 30(CO 66)for two miles to WCR 34.The total project cost is estimated to
be$499,000.
The second application is a Tier 2-$1,000,000 application to assist with the construction
.cost for the roundabout(RAB)at the WCR 6/13 intersection.The total construction budget
is estimated to be$11,699,920.Utility relocations will occur in 2024.RAB construction is
anticipated to begin in January of 2025 and be completed by the end of July 2025.
Staff recommends Board approval to submit both applications for the December DOLA
cycle.I am available to answer any questions you may have.

The Department of Local Affairs(DOLA)Energy and Mineral Impact Assistance Fund(EIAF)program was created to assist political
subdivisions that are socially and/or economically impacted by the development,processing,or energy conversion of minerals and
mineral fuels.Funds come from the state severance tax on energy and mineral production and from a portion of the states share of
royalties paid to the federal government for mining and drilling of minerals and mineral fuels on federally-owned land.The creation of
the fund is outlined in C.R.S.34-63-102(Federal Mineral Lease)and C.R.S.39-29-110(Severance).Grant dollars are to be awarded for
the planning,design,construction,and maintenance of public facilities and for the provision of services by political subdivisions.
Requests in this Cycle 24-03 may be for:
EIAF Tier I:up to$200,000 with a 1:1 match
EIAF Tier II:over$200,001 and up to$1,000,000 with a 1:1 match
More Housing Now&Land Use Initiative:up to$2,000,000 with a 25%match for implementation,10%for planning
Tier I award notifications are anticipated in early February 2024.All other application presentations are scheduled for late February 2024

Weld County is requesting funding to assist with safety improvements at the intersection of Colorado Boulevard(WCR 13)and WCR 6.
This location sees a large amount of oil and gas truck traffic,which is creating congestion on WCR 6 for vehicles turning safely onto
Colorado Boulevard.

will help ensure the realiability of both these regional corridors.

D.DEMONSTRATION OF NEED —
The statutory purpose of the Energy and Mineral Impact Assistance program is to provide financial assistance to political subdivisions
socially or economically impacted by the development,processing or energy conversion of minerals and mineral fuels.

Why is the project needed at this time?(1,000 character limit)
This intersection has had 20 crashes over the last 5 years(per the CIP Hot Spot Analysis report-2018-2022)ranking it as one of the
top most unsafe intersections in the county.Of the 20 crashes,twelve injuries are the result of these broadside accidents.There are
7,340 vehicles per day,on an annual average,using this intersection,with 40%being truck traffic.

We are hopeful DOLA will partner with Weld County on this project.However,if DOLA does not,Weld County can no longer delay
these very important safety improvements from being constructed.

We expect to see a reduced crash rate with these intersection improvements.The WCR 6 corridor is a significant east/west oil and
gas corridor in the county.The improvements will make the area safer for the residents of the communities located along the
Colorado Boulevard corridor,which also serves as a parallel arterial to 1-25.Roundabouts are proven to reduce fatality broadside
crashes,which is the predominate crash type at this location.

Weld County needs all the funding assistance it can have since we are the most impacted oil and gas county in Colorado.With 3,000
miles of road to maintain,Weld County cannot fund improvements to all impacted roads and appreciates strategic funding

Besides DOLA's partnership,we have been working with our small communities,such as the City of Dacono,to coordinate these
efforts.As well as the City of Thornton who has obtained a Highway Safety Improvements Program(HSIP)grant to design and
construct a traffic signal two miles south of this project on Colorado Boulevard and WCR 2(164th Avenue).

Weld County is the#1 oil and gas producing county in the State of Colorado and therefore by default is the most impacted county.
The majority of the county's traffic impacts directly result from heavy truck traffic related to the oil and gas industry.Weld County
currently has 17,021 active wells of Colorado's 48,243.

The life-cycle cost of this transportation project is significantly lower than most communities typically see because it is being
constructed with concrete materials rather than asphalt.Therefore,this improvement is attractive to smaller communities as a
benefit and we therefore anticipate this intersection being annexed by the City of Dacono in future years.

Within the first six months of receiving the grant,awardees must submit a self-assessment,such as the Colorado Growing Water
Smart:Community Self-Assessment,to include water supply and demand status and trends,existing water conservation and

assistance.
•The plan must include an action plan that prioritizes actions necessary to implement the plan,creates a timeline for
implementation,and assigns responsibility for actions.
•And,for municipalities only,a plan for three miles outside municipal boundaries,also known as the three mile plan,per
C.R.S.31-12-105(1)(e)(I).
The department strongly encourages the following:
• Land use code updates:Because the land use code implements a comprehensive plan,a land use code update is strongly
recommended to immediately follow a comprehensive plan update.
• Policies and strategies in the comprehensive plan and land use code to plan for the aging demographic of the community.
• Policies and strategies to address energy efficiency,reduce greenhouse gas emissions,and increase the use of renewable
energy sources where applicable.
• Intergovernmental agreement(s)(IGA)with neighboring jurisdiction(s)to cooperatively plan for areas of mutual interest
(e.g.,three-mile areas).In addition,the IGA will address how infrastructure will be provided or upgraded and maintained in
areas of mutual interest and engage major service providers/special districts,as applicable.
