RESOLUTION WHEREAS, a public hearing was held on December 13, 1971 in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Joyce Hayen, Route 1, Box 86, Berthoud, Colorado, requesting approval to locate a hog farm operation on the following described property, to-wit: A parcel of land located in the Southeast Quarter (SE4) of Section Nineteen (19), Township Four (4) North, Range Sixty-eight (68) West of the Sixth (6th) P. M. , Weld County, Colorado, and more particularly described as follows: Beginning at a point 584. 63 feet south of the northeast corner of the Southeast Quarter (SEt) of said Section Nineteen (19); thence West and parallel to the south section line of said section a distance of 302. 54 feet; thence south and parallel to the east section line of said section a distance of 332. 81 feet; thence east along the south section line of said section a distance of 302. 54 feet to a point; thence north along the east section line of said section a distance of 332. 81 feet to the true point of beginning, containing 2. 3 acres, more or less, and WHEREAS, there was some opposition to the request of petitioner for the location of a hog farm operation, and WHEREAS, according to Section 3. 3(c) of the Zoning Resolution of Weld County, said hog farm operation may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and WHEREAS, petitioner was granted ninety (90) days to meet the requirements of the State Health Department and the Weld County Health Department; and WHEREAS, petitioner has taken no action in response to said request of the Board. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that because no action was taken by petitioner within the ninety (90) days granted by the Board, the application of Joyce Hayen to locate a hog farm operation on the premises indicated above be, and it hereby is denied. It was the unanimous decision of the Board to allow you .90 days to meet the requirments of the State Health Department and the Weld County Health Department and unless these requirments are met the matter of your site approval location will be tabled. The Board suggests that perhaps you find a new location more suitable to your type of operation. The Weld County Health Department has refused approval on your present site. Mr. Paul of the Weld County Health Department suggested that you find a new location and that after this is done both he and the Weld County Planning Commission will be 1 ' more than willing to work with you. Mr. Lorenson stated this matter was tabled at the last meeting. because the Health Department in,Aicated they felt some . investigation should be made with regard °serving this area with a sewer system.' A letter from Mr. Karowsky was read stating he had been 'informed. by NHPQ that drainage conditions in Arrow • head sati`sfyin full all existing statutes pertaining to the use of septic tanks. Mr. Lorenson stated the plat meets the sub- division requirements subject to• the• following items being cor- rected: approval of the septic system by the Health Department; naming of easements between lots 4 and 5, Block 11 , Lots 15 and 16, Block 12, and lots Sand 6. A subdivision agreement or a performance bond of $23,500,00 for road construction., . A center line distance to be added to Pawnee , Circie and Ute Circle at • Cheyenne Drive. Mr. Paul stated there are 6 lots on the north • side that have a high water table. He recommended that it be approved for septic tanks with relocating .the 6 lots. Some of these have a high percolation test. Three lots could be made into two lots. There was discussion regarding a subdivision agreement which has not been approved also a discussion with . the County Commissioners regarding which streets in Arrowhead should. be paved first. MOTION: By Mrs. Watson to table the matter until the subdivision agree- ment is approved. Mr. Bowles recommended that the motion be with- . " drawn after Mr.. Karowsky' s objection to the matter being tabled. ' He asked that the application be approved subject to whatever condition will satisfy the County' s subdivision agreement • in what- , ever form it might take. Chilsorn opposing the operation was presented. Minimum lot size . would , be` a .minimum of 21/2 acres . This is in line with FHA' with 'the. minimum for a septic tank. Any lots less than 21/2 acres would have to be on a sewer system. There Would be a minimum number of animals allowed . SUBJECT: Interladto Corporation DISCUSSION : Mr. Lorenson stated the company is proposing a new town -just in side of Weld County, east of Kelim. Have approx • - imately 120 acres . The developers plan to apply for a Planned Unit Development. This type of development is not in agree- • ment with the Land Use Policy. SUBJECT: State Planning Proposal DISCUSSION : Mr. Lorenson stated the State Planning Office is asking the planning directors from the rural planning areas to aid them in- setting up a prog•ram. on how the State Planning Office should function with other agencies . • APPLICANTS : Sears , Rissler, Scott CASE NUMBER: Z-181 • DISCUSSION : Mr. Lorenson reported the Unit Development plan has not been signed by the County Commissioners because the motion was made that a contract for.: water and sewer before approval , the resolution did not read that way and he would like to haves it clarified. SUBJECT: Mineral production DISCUSSION: Mr. Lorenson read a report from the State of Colorado : Geological Surveys on the production of minerals in the state in 1970, particularly in Weld County. It was the unanimous decision of the Board to allow you .90 days to meet the requirments of the State Health Department and the Weld County Health Department and unless these requirments are met the matter of your site approval location will be tabled. The Board suggests that perhaps you find a new location more suitable to your type of operation. The Weld County Health Department has refused approval on your present site. Mr. Paul of the Weld County Health Department suggested that you find a new location and that after this is done both he and the Weld County Planning Commission will be more than willing to work with you. We have been notified that a hog operation will come before the Commission for approval on October 4. This operation concerns us greatly as we own property on three sides of this business. Their property consists of i.8 acres more or less and contains housing for two , families, numerous sheds and buildings and storage for a great amount of machinery, plus. the area for' the hogs. This --hog- area is now- arproximately 1/3 of above acreage. The only open , fields surrounding this property are ours. Two weeks ago I made inquiries about this operation' and was told the following: . 1. The R. Hayen's et al did not have to 20 before the . Pldnning Commission. This is only being done through courtesy on their part and there was nothing the property owners near this operation could do. It is already a fact that the hog business is established. 'Nothing whatever was mentioned about the decline in property values. It is difficult to believe people whe 'have worked so hard and endured hardships and self-denial now must also suffer financial loss. 'Even though our house is not complete. it has. already declined in value and the acreage surrounding the hogs could not be sold for a fair price. 2. The Planning Commission was not concerned with any health problems that. arise from such an operation. Already. ::here has been a tremendous increase in the fly population. There are seepage places directly downhill from- the hogppn in our - pasture. This seepage increases ;really during the irrigation season.. A lagoon has been started above• these seepage spots. What will prevent this lagoon from adding to the air pollution and seepage already experienced by us? Will this lagoon become stagnant. a breeding ground for disease and carriers of disease? What guarantees are there that this will be cleaned out at • specified times and where dumped? I understand ditching along the south part of their property is proposed. Since drainage onto us comes 'from that direction (north) , what will• prevent this drainage from becoming a problem to us expecially when heavy rains occur? Will the hogs continue to root in this lagoon and ditch area? What disposal will be made of dead animals? How long -will dead ani- mals be allowed to lay before disposed of? Will garbage be fed to these hogs? Will there be a problem with rats? • 3. It was ray understanding that there are actually no real limits as " to how many animals can be confined to this small area. , It is not clear to me what a "farm" is. ' I understand the term farm can be applied to an acre or more used for raising vegetables market. Is there a limit to the amount of land•used for raisin; animals? L4.. Odor from this operation would have to be measured by the Air Pollution Agency concerned and would probably not be too effective, depending on timing and weather conditions. Our house is situated downhill to the southwest of this hog pen. - 'he cur_'ents_.of air follow the contour of the. land and the odors become particularly offensive as the land cools in the' early after- noon and the bream thtaking odors remain through the night. 5. The Planning Commission is 'not concerned about proper containment for these hogs. • - This problem has' already arisen. There is constant worry about destruction of property, especially the alfalfa field from these rooting animals as the fences become more undermined each day. 6. It was brought out that, once approved, property Owners , can do nothin about this operation in the future. Since this business is already in full swing, why must the Planning Commission approve it at all? Is it •true that property owners must suffer great financial loss without benefit of being able to do anything to help thenselvos? What is to prevent anyone from starting an animal business, no matter how obnoxious or otherwise and if once started the property owners have no say? Finally, it has come to our attention that there has been discussion of and inquiry into our personal affairs, 1. 'e. , what the occupation of my husband is and who his - employer is. I do not - understand what bearin_z this -matter has on any decision of the board. The holding pens will be located on the Colby and Weld soils. These are deep, medium to moderately fine textured soils with good drainage. They are not subject to flooding. Any runoff which might occur from the holding pens is over the Otero soils. This is a deep, well drained, • moderately coarse textured soil. If a holding pond were needed it would be built on the Otero soil and would require a blanket of - impervious material. The soil survey is made on the basis of 40 inch borings, although in most cases the borings are made to depths of 50 to 60 inches..
