HomeMy WebLinkAbout20232530.tiffRESOLUTION RE: APPROVE LIMITED EVENT PERMIT, LEP23-0001 - JIM AND KIRSTEN HUMPHREY, CIO AMERICAN CANCER SOCIETY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Jim and Kirsten Humphrey, c/o American Cancer Society, presented to the Board of County Commissioners of Weld County, Colorado, an application for a Limited Event Permit on land within the unincorporated portion of the County of Weld, State of Colorado, to be held on September 23, 2023, from 5:30 p.m. until 11:59 p.m., outside the corporate limits of any town or city in the County of Weld at the location described as follows: Cattle Baron's Ball, 35496 State Highway 257, Windsor, Colorado 80550; being further described as Lot B of Second Amended Recorded Exemption, RE -1452; being part of the SW1/4 of Section 4, Township 6 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the fee for the filing of said Limited Event Permit has been waived due to the applicant concurrently applying for a Special Events Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and all of the exhibits and evidence presented in this matter, and having been fully informed, finds the following to support the issuance of the Limited Event Permit requested: 1. The submitted materials are in compliance with the application requirements of Chapter 23, Article IV, Division 18, of the Weld County Code. 2. The applicant has demonstrated that the request is in conformance with Section 23-18-80 of the Weld County Code as follows: A. The applicant has demonstrated that the limited event is compatible with existing and allowed land uses in the neighborhood; B. The applicant has demonstrated that the limited event will comply with all applicable requirements of the Weld County Code; C. The applicant has demonstrated that the limited event will result in no substantial adverse impact to other land uses and/or residences in the neighborhood, including environmentally sensitive areas or features or other lands; D. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Jim and Kirsten Humphrey, c/o American Cancer Society, for a Limited Event Permit, LEP23-0001, to be held on September 23, 2023, from 5:30 p.m. until 11:59 p.m., on the parcel of land described above, be, and hereby is, granted subject to the following conditions: 1. The Limited Event Permit shall adhere to the following Performance Standards: A. An adequate and safe supply of potable water meeting requirements set forth by the Colorado Department of Public Health and Environment. B. Toilets conveniently located throughout the property, sufficient to provide healthful facilities for the maximum number of people in attendance, and meeting all state and local specifications, as determined by the Weld County Department of Public Health and Environment. C. A sanitary method of disposing of solid or liquid waste, in compliance with state and local laws and regulations, sufficient to dispose of the waste production of the maximum number of persons allowed to attend the limited event. The applicant shall comply with its plan for holding and collecting such waste at least once each day of the event. The plan shall provide for trash cans, dispersed throughout the property, sufficient to prevent solid wastes from escaping the property. The plan must call for sufficient personnel to perform such tasks and collecting any wastes that do escape, and within forty-eight (48) hours of cessation of the limited event, the property shall be returned to its previous condition, including removal of all buildings and structures, trash, debris, signage, attention -attracting devices, or other evidence of the limited event. D. Two (2) certified emergency medical technicians and one (1) emergency ambulance for limited events with more than five hundred (500) persons. One additional certified medical technician provided for every additional five hundred (500) persons. An enclosed structure where treatment may be rendered. E. A licensed practical nurse or registered nurse, licensed to practice in the state, provided for limited events with more than one thousand (1,000) persons. If the limited event is to occur during hours of darkness, illumination sufficient to light parking and pedestrian areas shall be provided at the rate of at least five (5) foot-candles. No illumination shall be allowed to shine or reflect unreasonably beyond the boundaries of the property. G. No limited event shall extend past 12:00 a.m. H. No overnight camping is allowed either before or after the limited event. I. There shall be a parking area, either on -site or off -site, sufficient to provide parking space for the maximum number of persons allowed at any limited time to attend the limited event. At least one (1) parking space measuring at least nine (9) feet in width shall be provided for every four (4) attendees. If any parking is to be provided off -site, authorization from the property owner shall be required. The applicant shall provide a description of the surface material of the parking areas. J. There shall be a traffic circulation system sufficient to allow safe and efficient traffic and pedestrian circulation for the maximum number of attendees allowed at any limited time. The flow of traffic on roads shall not be blocked or hindered, and no cars, buses, or bicycles shall be allowed to park along the side of or in any public road right-of-way. The applicant shall provide a plan for handling traffic in conformance with the Manual on Uniform Traffic Control Devices and the Colorado Supplement. K. Access to and from the property shall be limited to access approved pursuant to provisions of Chapter 8 of the Weld County Code. Where an existing access shared with other property owners or lessees is to be used, authorization of each of the owners or lessees entitled to use the access shall be required. L. The applicant must provide adequate facilities for communication with emergency medical, police, and fire services. M. The applicant must provide security which, as determined by the Sheriff, is adequate to control any disturbances which might occur at the limited event. N. The applicant shall comply with all requirements of the applicable fire protection district. O. The applicant shall ensure that sounds from the limited event do not exceed the residential noise limits or carry unreasonably beyond the boundaries of the property. Sound created by the limited event which exceeds any limitations set by the Weld County Noise Ordinance (Chapter 14, Article IX, of the Weld County Code) shall be presumed to be unreasonable. 2023-2530 PL2891 LC0022 LIMITED EVENT PERMIT, LEP23-0001 - JIM AND KIRSTEN HUMPHREY, C/O AMERICAN CANCER SOCIETY PAGE 4 P. The applicant must provide for appropriate on -site dust mitigation. Q. Food service operations shall comply with the Colorado Retail Food Establishment Rules and Regulations. R. If required by the Board of County Commissioners, guarantees in the form of an irrevocable letter of credit, bond, or cash retainer in the amount of three thousand dollars ($3,000.00) to cover the cost of any required clean-up and restoration following the limited event where the maximum number of attendees is more than two hundred fifty (250), or five hundred dollars ($500.00) for any event where the maximum number of attendees is more than one hundred (100), but less than two hundred fifty (250). Any letter of credit or bond must be irrevocable for a period of thirty (30) days after the completion of the event. The letter of credit, bond, or cash retainer will be released by the County as soon as possible after the event, after determination that the site has been adequately cleaned up and restored from any impacts of the event, but no later than thirty (30) days following the event. S. Insurance in an amount determined to be adequate and reasonable in light of the risks and hazards relating to the limited event, but no less than five hundred thousand dollars ($500,000.00). Such Certificate of Insurance shall include the County of Weld, by and through its Board of County Commissioners, its elected officials, and employees, as Additional Named Insureds. T Limited events must occur or operate in compliance with the provisions of Section 23-18-90 of the Weld County Code, and all applicable provisions and regulations of Weld County, and applicable state and federal statutes and regulations. U. If electrical systems are not self-supporting, electrical systems installation and maintenance must comply with minimum county and state electrical standards. V The issuance of a Limited Event Permit shall not relieve the landowner or applicant of the responsibility for securing other permits or approvals required by Weld County, the applicable fire district, or other applicable public agency. W. Any other condition deemed necessary by the Board of County Commissioners to preserve the health, safety, and welfare of the public and surrounding properties, residences, and other neighboring land uses. 2. Inspection: pursuant to Section 23-18-100 of the Weld County Code, the employees of the Weld County Sheriff's Office, the Planning Department, and/or 2023-2530 PL2891 LC0022 LIMITED EVENT PERMIT, LEP23-0001 - JIM AND KIRSTEN HUMPHREY, C/O AMERICAN CANCER SOCIETY PAGE 5 Health Department may enter the property from time -to -time during the limited event to inspect and ensure compliance with the Limited Event Permit Performance Standards and to enforce the provisions of Section 23-18-90 of the Weld County Code. The Limited Event Permit must be available for inspection on the property at all times during the limited event. 3. Enforcement: A. Pursuant to Section 23-18-110.A of the Weld County Code, a Limited Event Permit may be suspended or revoked by the Board of County Commissioners at any time if any of the Performance Standards required of the permit are not complied with, or for violation of any provision of Section 23-18-90 of the Weld County Code, or any other applicable law, rule, or regulation, for violation of the specific permit conditions, or for any misrepresentation by the applicant, his or her agents or employees, or independent contractors under contract with the applicant. Upon revocation, the guarantee may also be forfeited. By signing the application, the applicant agrees that employees of the Sheriff's Office, the Planning Department, and/or Health Department may enter the property and cause the limited event to be stopped upon suspension or revocation of the Limited Event Permit. B. Pursuant to Section 23-18-110.B of the Weld County Code, violations of Section 23-18-90 of the Weld County Code will be enforced by the Weld County Sheriff and/or through the enforcement procedures set forth in Article X of Chapter 23 of the Weld County Code. The name of the event is Cattle Baron's Ball and has been taking place in Weld County for over thirty (30) years. The event will have up to nine hundred (900) guests with up to one hundred (100) volunteers. This event has been successfully held in the subject location for the past two (2) years. The applicant has also applied for a special event permit for liquor use through Clerk to the Board and is currently going through the approval process. The event is proposed for a single day being September 23, 2023 from 5:30 p.m. — 11:59 p.m. The applicant has EMS Service in place through Banner Health and Weld County Sheriff for onsite security. Windsor -Severance Fire Rescue performs a walk through the day before the event. The Colorado State Patrol has already given the applicant a permit for the event and the Town of Windsor police are aware of the event. The applicant will have food and bar service provided by University of Northern Colorado Catering and has already received a license through the State of Colorado Department of Public Health and Environment. Republic Services is contracted to provide port -o -lets and handwash units, poly carts, and a trash receptor. The Weld County Department of Planning Services sent notice to twelve (12) referral agencies, all referral agencies had either no concerns or did not return a referral. The Weld County Department of Planning Services also sent notice to thirty (30) surrounding property owners. No correspondence was received regarding the proposed event. Department of planning services' staff recommends that this request be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Chapter 23, Article IV, Division 18, of the Weld County Code. 2. The applicant has demonstrated that the request is in conformance with Section 23-18-80 of the Weld County Code as follows: A. The applicant has demonstrated that the limited event is compatible with existing and allowed land uses in the neighborhood. B. The applicant has demonstrated that the limited event will comply with all applicable requirements of the Weld County Code. C. A bond must be irrevocable for a period of at least 30 days following the date of the event. The financial guarantee will be released by the County as soon as possible after the event, after determination that the site has been adequately cleaned up and restored from any impacts of the event, but no later than 30 days following the event. If the permit is suspended o r revoked by the Board of County Commissioners for violations of applicable law, rule, or regulation, for violation of the specific permit conditions, or for any misrepresentation by the applicant, his or her agents, employees, or independent contractors, the financial guarantee may be forfeited. A signed Statement of Taxes from the County Treasurer showing no delinquent property taxes for the subject property. The Statement shall be from the current tax year. LIMITED EVENT PERMIT (LEP) Summary of Code Provisions Refer to Ordinance2023-09 or Chapter 23, Article IV, Division 18 of the Weld County Code. The complete application including proof of insurance and financial guarantee (if attendance will be more than 100 people) must be submitted to the Weld County Planning Department at least 30 days prior to the event. Submitting earlier is encouraged. In some circumstances, the Board of County Commissioners (BOCC) may continue the hearing to a later date. If you need other permits, such as building permits, additional time may be required in order to ensure inspections are complete prior to the event. A Limited Event Permit may be for up to three consecutive days. N o more than one event is allowed on a property in a single month. N o more than four events are allowed on a property in a single year. Each event requires a separate application and permit. A Limited Event Permit is required for events in unincorporated Weld County with more than 30 attendees, where the property is rented for the event or where attendees pay or donate to attend, u nless the property is zoned for such events. (For example, an event at a church where capacity will n ot exceed the maximum seating capacity of the church by more than 30 people does not require a permit.) Cattle Baron's Ball is an American Cancer Society fundraising event that has been taking place in Weld County for over 30 years. Over the course of its tenure, the event has raised more than $10million dollars. The event is once again taking place on the property of Jim and Kirsten Humphrey. The event is co -managed by ACS staff and a volunteer team. 3. In year's past we've notified surrounding neighbors through the Next Door app with a letter from the American Cancer Society. That has seemed successful the past two years and we plan to continue this year. 4. 9/23/23 5:30-11:59pm. 5. 900 guests/100 volunteers- tickets are pre -sold in advance 6. See #5 7. All structures are tents rented and assembled by FLEXX Productions as shown in layout. There are no permanent existing structures in the field where the event is taking place. 8. As part of their sponsorship, Banner Health provides onsite EMS service during the event. They are stationed at the event entrance during event hours. 9. Windsor -Severance Fire performs a walk-through Friday night, prior to the event so they are aware of the event details- hours, location, access, etc. Town of Windsor police is also aware of the event. Weld County Sheriff's Posse is providing security. EMS detailed in #8. 10. The field is cut down, the dirt is leveled, and roller packed and treated with dust suppressant. All tents equipped with fire extinguishers. No candles or open flames will be allowed onsite- other than limited kitchen appliances. 11. Shane Curtis -Weld County Sheriff Posse is contracted to provide onsite security, 25 staff: mounted unit, security patrol overnight (Thurs and Friday), uniform and plain clothes officers onsite. 12. The tents are equipped with and overhead sound system. We have the ability to send text messages to all attendees through our online donation system. 13. The tent is equipped with and laid out to meet egress safety standards. While the tents are clearspan structures to better withstand wind and inclement weather, we have a dedicated person charged with watching the incoming weather. 14. We have bottled water provided by Pepsi for drinking and potable water provided by UNC catering for and dish/kitchen needs. 15. (3) restroom trailers are secured from Bluemoon Rentals adequate for 1000+ people (alexis@bluemoonrentals.com) 16. Republic services is contracted to provide port -o -lets and handwash units, poly carts and dumpster. We have a volunteer clean up shift Sunday, 9/24 after the event. Republic Service is scheduled to pick up all items (including trash) post event. 17. The site will be returned to the same state it was in pre -event. As noted above, volunteers will do a thorough trash sweep the day after the event and all tent rental items will be removed. LL American Cancer Society 18. Attendees are provided a map to the location prior to the event and arrive in daylight hours. Light plants will illuminate the exterior of the event tents, parking lot, exit paths and roadways. 21. Having the same set up for two years already, we have not received any noise complaints and have the same layout plan. The stage is strategically placed within the tent to reduce noise traveling to surrounding areas. All tent walls are closed with further helps reduce noise. 22. Since this property is off State Hwy 257, we consulted with Captain Ian Whittington, CSP to see if we needed to follow special traffic management plans to attendee ingress. Per his email, CSP and CDOT Traffic engineers deemed no special traffic management plans are needed. See permit. We plan to have 196 parking spots for volunteers and 600 parking spots for attendees. Approximately 200 cars will be valet parked, while remaining will self -park. Parking staff will direct cars. To ensure vehicles do not back up on Hwy 257, we will stage cars waiting to park in the field. Temporary vehicle roads for traffic in the field will be roller packed and easily identifiable.
