HomeMy WebLinkAbout710461.tiff t 4 - RESOLUTION RE: AGREEMENT BETWEEN WELD COUNTY AND MOUNTAIN BELL TELEPHONE COMPANY. WHEREAS, it is apparent to the Board of County Commissioners, Weld County, Colorado, that there is an urgent need to provide more efficient and yet economical telephone service to the whole Weld County Courthouse complex, including the Weld County Court system, and WHEREAS, Mountain Bell Telephone Company has submitted a proposed agreement relative to providing such telephone services as required by Weld County, and WHEREAS, the Board believes it to be in the best interest of the County to enter into such an agreement on the basis recited therein. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners, Weld County, Colorado, that said agreement with Mountain Bell Telephone Company providing for such telephone services, copy attached hereto and made a part hereof by reference, be, and it hereby is approved. BE IT FURTHER RESOLVED, that the Board be, and it hereby is authorized to execute the agreement as submitted and to make the same effective forthwith. The above and foregoing resolution was, on motion duly made and seconded, adopted by the following vote on the 18th day of August, 1971. BILLINGS COURTHOUSE r COLORADO GREELEY, 80631 July 20, 1971 Mountain Bell Telephone 926 Tenth Street Greeley, Colorado Gentlemen: In connection with the application of the undersigned subscriber for Private Branch Exchange service at Greeley, Colorado, it is understood that the Company will provide such service subject to the obligations and regulations of the Company's General Exchange Tariff and the terms of this letter. The Private Branch Exchange equipment will be furnished to the subscriber for an initial contract period of Three (3) Years at the same location beginning the day following the installation date of the equipment. The subscriber agrees to pay the Company (a) monthly in advance for the system furnished hereunder, and exchange telephone service, at the rates lawfully in effect at the time such service is furnished or work performed; (b) monthly for all toll and long distance service sent paid from or received collect at the system furnished hereunder; and (c) for any service connection, move, change or other nonrecurring charges , at the rates lawfully in effect at the time such service is furnished or work performed. The subscriber acknowledges that he has been advised by the Company that there are other types of equipment and systems available from the Company other than the one chosen by the subscriber. If the application for service is canceled by the subscriber prior to complete installation, the subscriber will pay to the Company the amount of its non- recoverable engineering and other preparation costs directly attributable to this contract. This contract may be terminated by the subscriber prior to expiration of the initial contract period upon payment of termination charges based upon a basic termination liability of $10,800.00. The amount of the termination charges due shall be such proportion of the basic termination liability as the number of months in the unexpired portion of the initial contract period bears to the Mountain Bell Telephone -2- July 20, 1971 total number of months in the full initial contract period. Termination charges shall be in addition to all charges for local and long distance services and any other nonrecurring charges accrued to the date of termination. Changes in the equipment furnished under this agreement, or an in-service move requested by the subscriber, may result in the application of termination charges , or cancellation of this agreement without liability for termination charges and establishment of a new initial contract period, as provided in the Company's General Exchange Tariff. This contract may not be assigned by the subscriber without the consent of the Company, and it is understood that no assignment shall relieve the subscriber of its obligation for termination charges that may become due hereunder, and the subscriber shall be primarily and directly responsible to the Company for termina- tion charges due whether or not any third person has agreed to pay said charges. Lawson, State Court Administrator, do hereby authorize Mary M. Connell, Judicial District Administrator, to enter into a contract with the County of Weld for the installation of a new telephone system to include all county offices: the District Court, County Court, and Probation Department. Based upon estimates received from the telephone company for basic charges and our salary costs, the following figures represent the estimated cost for the County and the Courts: PROPOSED CHARGES: 19th Judicial District Weld County Basic Monthly Charges $ 831.02 $ 1,414.98 Salaries and Fringe Benefits 211.45 360.05 Total Costs $ 1,042.47 $ 1,775.03 Annual Costs $12,509.64 $21,300.36 ANNUAL SAVINGS $ 2,826.36 $ 3,269.64 All of the above costs would be exclusive of charges for direct Denver lines and toll charges for long distance calls.
