MEMORANDUM TO: Chris Gathman, Planning Services FROM: Melissa J King, PE, DRE DATE: September 23, 2022 SUBJECT: PUDF22-0004 Olson The proposed PUDF has been reviewed on behalf of the Weld County Department of Public Works and the Department of Planning Services. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during theremaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: FINAL PLAN FOR 5 -LOT PLANNED UNIT DEVELOPMENT (PUD) APPLICATION FOR FOUR (4) RESIDENTIAL LOTS FOR (E) ESTATE ZONED USES AND ONE (1) LOT FOR (A) AGRICULTURAL ZONED USES. This project is south of, adjacent to CR 42. Parcel No.: 105930000008 Lot B RE -2746. Access is from CR 42 and CR 15. ACCESS Development Review has reviewed the application materials related to access. Two access points are being proposed: one on CR 42 approximately 2,600 feet east of the intersection of CR 42 and Colorado Boulevard (CR 13); and one on CR 15 approximately 920 feet south of the intersection of CR 15 and CR 42. The applicant shall obtain access permits in these locations. Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We strongly encourage you to discuss your access location with Development Review prior to laying out your site plan. All "preliminarily approved" accesses are subject to change during the access permitting process. Per Sec. 24-8-40, when feasible, there shall be no net increase in the number of accesses to a public road. Minimum access spacing widths are shown in Weld County Code Sec. 8-14-30. Please refer to Chapter 8 of the Weld County Code for more information regarding access. ROADS AND RIGHTS -OF -WAY County Road 15 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate on the plat the future and existing right-of-way and the physical location of the road. If the right-of- way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. County Road 42 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate on the plat the future and existing right-of-way and the physical location of the road. If the right-of- way cannot be verified it shall be dedicated. Right -of -Way Use Permit instructions and application can be found at https://www.weldgov.com/Government/Departments/Public-Works/Permits Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. TRAFFIC There is not recent traffic data for the portions of CR 15 and CR 42 involved in this land use case. The applicant submitted a Traffic Narrative, stating that there will be residential traffic only from the five residential lots. This is approximately 9 passenger vehicle roundtrips per day per residence. No additional traffic information is required. IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT WITH UP -FRONT IMPROVEMENTS FOR INTERNAL PAVED ROAD An Improvements Agreement for on -site improvements for Subdivisions/PUDs (Chapter 27-2-80, Chapter 24-9-20) is required. This will include collateral to ensure the improvements, to include the internal paved roadways, are completed and maintained. Improvements/Road Maintenance Agreement: An example agreement is available at: https://www.weldgov.com/Government/Departments/Planning-and-Zoning/Development-Review. DRAINAGE REQUIREMENTS This area IS within a Non -Urbanizing Drainage Area: Non -Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON - URBANIZING areas. Detention Pond summarized in a Drainage Report: The applicant has submitted an acceptable drainage report that includes the detention exception Sec 8-11- 40. E.7. for residential developments of nine (9) or fewer lots. No additional drainage information is required. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. GRADING PERMIT A Weld County Grading Permit will be required if disturbing more than 1 acre per lot. Grading Permit applications are accepted after the planning process is complete (plat recorded). An Early Release Request Form may be entertained only after the applicant, Development Review, and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Development Review for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575. Show and label the approved access locations, and the appropriate turning radii on the site plan. (Development Review) 4. Show the vehicular and non -vehicular traffic circulation, including road classification, right-of-way width, road surface width and depth, and access to public right-of-way. (Development Review) 5. Show and label the drainage flow arrows. (Development Review) Prior to Construction: 1. Obtain access permits for the two development accesses for residential use only. (Development Review) 2. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the existing County right-of-way. (Development Review) 3. The PUD roadway shall be maintained to mitigate any impacts to the public road including damages and/or off -site tracking. (Development Review) 4. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire an approved Right -of -Way Use Permit prior to commencement. (Development Review) 5. Weld County is not responsible for the maintenance of onsite drainage related features. (Development Review) 6. The historical flow patterns and runoff amounts on the site will be maintained. (Development Review) 7. Weld County is not responsible for the maintenance on onsite subdivision roads. (Development Review) COUNTY WELD COUNTY DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT 1555 North 17th Avenue, Greeley, CO 80631 www.weldhealth.org Memorandum To: Chris Gathman From: Lauren Light, Environmental Health Services Date: September 28, 2022 Re: PUDF22-0004 Applicant: Olson Bros, LP and Spring Meadows Development, LLC Environmental Health Services has reviewed this PUD Final Plan for a 5 -lot planned unit development (PUD) application for four (4) residential lots for (E) estate zoned uses and one (1) lot for (A) agricultural zoned uses. The Town of Johnstown will provide water to lots 1 through 3 and Little Thompson Water District (LTWD) will provide water to lot 4. There is an existing LTWD tap that serves lot 5. On -site wastewater treatment systems (OWTS) will provide sewer. The minimum lot size of 4.79 acres coupled with an overall density of one on -site wastewater treatment system per 16.3 acres does meet current Department policy. The County Attorney's office has approved the water source. The application has satisfied Sections 27-2-176, 24-3-80 and 24-3-90 of the Weld County Code in regard to sewer service. A geotechnical engineering report from Terracon dated June 5, 2000, was supplied. Although the document is not a septic suitability report and soil borings were completed instead of test pits, as there was a previously approved development on the site Environmental Health will accept this report. Due to slow percolation rates obtained from some test holes, engineered systems may be required. The covenants should state that activities such as landscaping (i.e., planting of trees and shrubs) and construction (i.e., auxiliary structures, dirt mounds, etc.) activities are expressly prohibited in the designated absorption field site. Water Division 1, Water District 4 Dear Mr. Gathman: We have reviewed the above -referenced proposal to subdivide an approximately 78.82 -acre parcel into five lots through a planned unit development process. Lot 1 will be approximately 5.48 acres, Lot 2 will be approximately 4.79 acres, Lot 3 will be approximately 5.87 acres, Lot 4 will be approximately 6.52 acres, and Lot 5 will be approximately 54.61 acres. Lots 1 through 4 are currently vacant and are proposed to be used for residential purposes. Lot 5 currently contains an agricultural shed, a half -circle pivot irrigation system and an irrigation pond, and is proposed to continue to be used for agricultural purposes. Our office previously provided comments regarding this application in a letter dated November 30, 2021 indicating that this office was unable to provide an opinion regarding the adequacy of the water supply or potential for injury to existing water rights due to the lack of information regarding the water supply for the Town of Johnstown. Since that time, the Town of Johnstown has provided information regarding their water supplies and demands. This letter is to provide updated comments based on this additional information. Water Supply Demand The water requirements for this subdivision were not provided. The Little Thompson Water District requires a raw water dedication of 0.70 acre-feet per tap. The Town of Johnstown requires a dedication of 0.33 acre-feet for each lot for indoor use, and additional water based on the amount and type of irrigation proposed for each lot. The Town of Johnstown has estimated that the applicant will need to dedicate approximately 6.4 acre-feet to the Town to service the properties. Source of Water Supply The Little Thompson Water District is the proposed water supplier for Lot 4. Lot 5 is currently served by an existing tap, tap no. 584101. The referral materials included a water bill dated September 20, 2021 for the existing tap. The referral materials also included a letter of commitment from the Little Thompson Water District, dated March 11, 2021, for the proposed tap on Lot 4, subject to limitations identified in the letter. The commitment letter will expire two years from the date of the letter if the tap has not been purchased, paid for, and installed by the date of expiration. Spring Meadows PUD February 28, 2022 Case No. PUDK21-0002 Page 2 of 3 This office most recently received information from the Little Thompson Water District regarding their water supply in their Raw Water Master Plan dated November 2018. At that time, the Little Thompson Water District had a total firm yield of 6,228 acre-feet from their existing Colorado -Big Thompson units with an average yield of 7,343 acre-feet, and a projected demand of approximately 6,850 acre-feet by the end of 2021. The report found that the Little Thompson Water District had the ability to increase their total firm yield to 9,096 acre-feet as new storage projects come online and native water rights are changed or approved for new uses. The report recommended that the District allocate sufficient storage in Dry Creek Reservoir to allow the "firming" of their Windy Gap units to 40 acre-feet per unit, which would increase their firm yield by 640 acre-feet to a total of 6,868 acre-feet. By policy, new growth within the Little Thompson Water District requires developers to dedicate water rights sufficient to supply the anticipated demands within their development. Individual tap purchases may be allowed to pay a "cash -in -lieu" fee to satisfy the water right requirement, the cost of which was included in the standard residential tap fee quoted in Little Thompson Water District's letter of commitment for Lot 4. The Town of Johnstown is the proposed water supplier for Lots 1, 2, and 3. The referral materials included a letter of commitment from the Town of Johnstown, dated September 7, 2021, for the three proposed taps. The letter states that the Town of Johnstown is embarking on a major capital project to install a 16" water line along the east boundary of the subject property. In response to our letter dated November 30, 2021, in which our office had found that we did not have any information regarding the water supply for the Town of Johnstown, the Town provided the requested information in a letter dated February 22, 2022. The Town of Johnstown's water supply consists of multiple sources, with the largest single source being shares of the Consolidated Home Supply Ditch Et Reservoir Company that have been changed for municipal purposes. The letter indicates that the Town of Johnstown has an average water yield of 6,001 acre-feet and a total firm yield of 4,850 acre-feet. The report states that the demand in 2021 was approximately 2,800 acre-feet. The Town's demands are less than the estimated supplies in both average and dry year conditions. In addition, to receive water service from the Town of Johnstown, developers must annex their property to Johnstown and dedicate adequate water rights to supply the anticipated demands within their development. According to the submitted materials, annexation to Johnstown is not proposed at this time. An irrigation ditch runs along the southern and eastern boundaries of the subject property. According to records available to this office, the property has been historically irrigated with water from the Highland Ditch. The existing pivot -irrigated field will be preserved on Lot 5. Stormwater Detention The referral materials state that the proposed lots are greater than three (3) acres in size, the downstream roadway criteria will not be exceeded, and the post development imperviousness will not exceed ten (10) percent; therefore, the proposed subdivision will be exempt from stormwater detention per the provisions of the Weld County Storm Drainage Criteria.
