Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: A Site-Specific Development Plan and Use by Special Review Permit for Livestock Confinement Operations for up to twenty-five thousand (25,000) calves outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Parcel number: 07051210014; 07051210013; 07051210016 Lot B RE-4332; 07051210015 Lot A RE-4332. The parcels are owned by ABCD Landco LLC. The applicant is 5280 Cattle Company, LLC The authorized agent is THEngineering. LLC per ABCD Landco, LLC. (Travis Hertneky) Access is onto CR 25: AP11-00242 O&G; AP15-00105 O&G; AP11-00243 O&G. CR 84: APOG19-0091 O&G; AP21-00008 Ag; AP22-0004 Residential. ACCESS Development Review has reviewed the application materials related to access. This site has no permitted access point onto CR 23. However, in the platting of RE-4332, an agricultural access was called out. Based on the location shown on the plat for RE-4332, this access point does not meet the Minimum Access Spacing Criteria, as specified in Table 1 below. Specifically, it is not at least 330' from the intersection of CR 23 and CR 84. Aerial imaging indicates that this access has been constructed. This access point shall be "Closed and Reclaimed." The applicant has requested that the manure trucks, for the site, access onto CR 23 just north of the Pierce Lateral. This access point appears to be existing but not permitted. This access location meets the Minimum Access Spacing Criteria, as specified in Table 1 below. Therefore, an agriculture access permit shall be obtained for this location. The site has three permitted access points onto CR 84 (see above). In addition to these three access points, there appears to be an unpermitted agricultural access that is approximately 2,240 feet west of the intersection of CR 84 and CR 25. This location appears to meet the Minimum Access Spacing Criteria and should be permitted. The applicant has stated that vehicles from this facility will be using AP21-0008 onto CR 84. The site has three permitted access points onto CR 25 (see above). In the platting for RE-4332, an agricultural access was called out just south of the intersection of CR 25 and CR 84. This access location does not appear to have been constructed. Further, this access point does not meet the Minimum Access Spacing Criteria, as specified in Table 1 below. Per, Sec. 8-13-30.B, a Weld County Right-of-Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights-of-way or easement. Right-of-Way Use Permit instructions and application can be found at https://www.weldgov.com/departments/publicworks/permits/. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. TRAFFIC There are no recent traffic counts for this portion of CR 84. The applicant submitted a traffic analysis report stating that there will be an average, at full build-out/Phase II of 61 truck (manure, feed, and cattle) and 21 passenger vehicle (employee and vendor) roundtrips per day. The manure trucks (1 roundtrip per day) will access onto CR 23 just north of the Pierce Lateral and will travel north on CR 23, east on CR 84, and south on CR 25 to access SH 14. The remaining vehicles will access and travel east on CR 84 and south on CR 25 to access onto SH 14. This report has been reviewed by CDOT as the traffic will be using SH 14. CDOT determined that the applicant did not need an access permit. No additional traffic information is needed, at this time. TRACKING CONTROL Tracking control is required to prevent tracking from the site onto public roadways. For access to paved roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior to entering publicly maintained roadways. A variance request for alternatives to the tracking control requirement can be submitted to Development Review for review and consideration. This site requires double cattle guards and 100 ft. of road base or road base on all driving surfaces. ROAD MAINTENANCE AGREEMENT Development Review is requesting a Road Maintenance Agreement for dust control, and damage repairs to specified haul routes. Road maintenance shall also include the annual application of magnesium chloride onto CR 23 north of the Pierce Lateral to the intersection of CR 23 and CR 84 and onto CR 84 between CR 23 and CR 25. Improvements/Road Maintenance Agreement: An example agreement is available at: https://www.weld.gov/Government/Departments/Planning-and-Zoning/Development-Review . It will detail the approved haul route(s) and include a maintenance agreement for the haul routes. DRAINAGE REQUIREMENTS This area IS within a Non-Urbanizing Drainage Area: Non-Urbanizing Drainage Areas typically require detention of runoff from the 1-hour, 100-year,storm falling on the developed site and release of the detained water at the historic runoff rate of the 1-hour, 10-year storm falling on the undeveloped site for Non- urbanizing areas. Detention pond waived and a simple drainage narrative: The applicant has submitted a preliminary drainage narrative stating that the site meets drainage exception 14. Concentrated Animal Feeding Operation (CAFO), Animal Feeding Operations (AFO) and Housed Commercial Swine Feeding Operation (HCSFO) which are covered and approved by the Colorado Discharge Permit System (CDPS) regulations. Portions of the site not incl, etc. Located in Sec. 8-11-40. Drainage Policy. The completed registration form for the CAFO stated that the property owner is 5280 Cattle Company, LLC. County records state that the current owner is ABCD Landco, LLC. No CAFO registration number was provided. No additional drainage information is needed at this time. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. GRADING PERMIT A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant, Public Works and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Development Review for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. The facility will be served by a commercial on-site wastewater treatment system (SP- 2100219) which is sized for 19 employees. The permit has been applied for but has not received final approval. Water is supplied to the site through a North Weld County Water District commercial/industrial tap. There is also a livestock well 320721 located on the site. The facility is registered as a Large Non- Permitted Confined Animal Feeding Operation (CAFO) with the Colorado Department of Public Health and Environment, Environmental Agricultural Program. The applicant supplied a Nuisance Management plan to address conditions that may result from animal confinement operations. Those items include pest control, air quality, and noise. The waste storage pond is required to have a liner with seepage rates determined by a registered engineer. A manure management plan was provided which indicates 211 acres is available to land apply liquid at an agronomic rate and solid manure will be removed and applied off site for land application. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, Section 30-20-100.5, C.R.S. 3. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. Portable toilets shall be screened from existing adjacent residential properties and public rights-of- way. 8. The facility shall operate in compliance with Colorado Water Quality Control Commission Regulation 81 (5 CCR 1002-81) and 61 (5 CCR 1002-61). There shall be no discharge of manure or process wastewater, except as provided in the facility's Colorado Discharge Permit. 9. If required, a Stormwater Discharge Permit shall be obtained from the Colorado Water Quality Control Division, for construction activities. 10.Any manure or process wastewater applications shall be at agronomic rates and in accordance with the Nutrient Management Plan or Manure and Wastewater Management Plan. There shall be no discharge from land application areas, except for agricultural stormwater. 11.The facility shall be operated and maintained in a manner to prevent nuisance conditions, in accordance with the approved Management Plan for Nuisance Control. 12.The facility shall be operated in a manner to control pests at all times, in accordance with the current approved Management Plan for Nuisance Control. Additional control measures shall be implemented at the request of the Weld County Department of Public Health and Environment,in the event that rodents, which can be determined to be associated with the facility,are in such a number to be considered a nuisance condition. 13.The facility shall be operated in a manner to control flies at all times, in accordance with the current approved Management Plan for Nuisance Control. Additional fly control measures shall be implemented at the request of the Weld County Department of Public Health and Environment, in the event that flies, which can be determined to be associated with the facility, are in such a number to be considered a nuisance condition.Additional controls shall also be implemented in the event the Weld County Department of Public Health and Environment received a significant number of fly complaints associated with the facility, and in the judgment of the Weld County Health Officer, there exists a fly condition requiring abatement. 14.Odors detected off the site shall not equal, or exceed, the level of fifteen-to-one dilution threshold, as measured using methods set forth in Regulation 2 of the Colorado Air Pollution Control Regulations. Additional controls shall be implemented, at the request of the Weld County Department of Public Health and Environment, in the event odor levels detected off site of the facility meet, or exceed, the level of fifteen-to-one dilution threshold, or in the judgment of the Weld County Health Officer, there exists an odor condition requiring abatement. 15.The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The surface beneath the manure storage areas shall be of materials which are protective of state waters. These areas shall be constructed to minimize seepage or percolation of manure contaminated water. In no event shall the facility impact or degrade waters of the State, in violation of Colorado Water Quality Control Commission Regulation Number 81. 16.The facility shall operate in compliance with applicable Colorado Air Quality Control Regulations.
