The meeting was called to order by Chair Gene Stille at 11:00 a.m. Roll Call. Present: Karl Kohlgraf, Lonnie Ford, Gene Stille, Todd Baker, Kathryn Wittman. Also Present: Chris Gathman, Department of Planning; Karin McDougal, County Attorney; and Michelle Wall, Secretary. Motion: Approve the September 6, 2022, Weld County Board of Adjustment minutes, Moved by Lonnie Ford, Seconded by Todd Baker. Motion passed unanimously. Case Number: BOA23-0001 Applicant: Aristocrat Ranchette Water Project, Inc. Planner: Chris Gathman Request: Application for an offset and setback variance from the A (Agricultural) Zone District for a water storage tank and pump station building. The applicant is proposing to construct a 57 foot tall water storage tank 4 feet into the required offset of 1 foot for every 3 feet of building height from the east property line for a proposed offset of 15 feet. Additionally, the applicant is proposing to construct a pump station building 15 feet into the required 20 foot setback from Good Avenue for a proposed setback of 5 feet. Legal Description: Lot 1-A Block 62 Aristocrat Ranchettes 2"d Filing Replat, being part of Section 27, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado. Location: South of and adjacent to Good Avenue; approximately 165 feet west of Woodruff Street. (See Legal Description for precise location.) Chris Gathman, Planning Services, presented Case BOA23-0001, reading the recommendation and comments into the record. The current USR (USR-819) was approved in 1988; however, additional platted lots have been built upon particularly in the 3rd filing and this has increased the demand/need for water. The Department of Planning Services recommends approval of this application with the condition of filing for a minor amendment to USR-819 for the proposed water tank and pump station building. Lonnie Ford asked staff who owns the adjacent property to the backside of the property. Staff responded that it is a different private property owner other than the applicant. Mr. Gathman explained the applicant explored adjusting/replatting the boundaries of the lot to allow more area to accommodate the new improvements. However, the lender of the adjacent property was not amendable to expanding the boundary. Kathryn Wittman asked Mr. Gathman to explain the minor amendment process. Staff replied that referrals will be sent out to referral agencies and notices will be sent to surrounding property owners during the application process. If there are no major issues or concerns then the minor amendment can be administratively approved. If Planning received an abundance of issues or concerns from the referral process then the Planning Director can request that the case be heard by the Board of County Commissioners. Co mktun Co-i-;an $ O5 ho/23 2023-1287 Richie Cupp, Element Engineering, Good Avenue, Fort Lupton, Colorado. Mr. Cupp said he is representing the Aristocrat Ranchettes Water Project (ARWP). ARWP has plans to construct water system improvements in order to increase storage, increase distribution capacity, fire protection, and expand their service are to include the Filing 3 area of Aristocrat Ranchettes. Gene Stille asked Mr. Cupp which municipal utility that provides the water. Mr. Cupp replied that it would be ARWP who is the distributor, and the water comes from Central Weld County Water. The Chair asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Motion: Approve BOA23-0001 along with the Condition of Approval as proposed by Staff, Moved by Kathryn Wittman, Seconded by Karl Kohlgraff. Vote: Motion passed unanimously.
