BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
WEDNESDAY, OCTOBER 25, 2023
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, October 25, 2023, at the hour of 9:00 a.m.
• ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Mike Freeman, Chair
Commissioner Perry L. Buck, Pro-Tem
Commissioner Scott K. James — EXCUSED
Commissioner Kevin D. Ross
Commissioner Lori Saine
Also present:
County Attorney, Bruce Barker
Acting Clerk to the Board, Houstan Aragon
Chief Financial Officer, Cheryl Pattelli
J MINUTES: There being no corrections to the Minutes of the Board of County Commissioners
meeting of October 11, 2023, as printed, Commissioner Buck moved to approve. Commissioner Ross
seconded the motion and it carried unanimously.
El AMENDMENTS TO AGENDA: There were no amendments to the agenda.
• CONSENT AGENDA: Commissioner Ross moved to approve the Consent Agenda, as printed.
Commissioner Buck seconded the motion and it carried unanimously.
El WARRANTS:
1) GENERAL WARRANTS - OCTOBER 24, 2023: Commissioner Ross moved to approve the General
Warrants, as printed. Commissioner Buck seconded the motion and it carried unanimously.
• BIDS:
1) PRESENT BID #82300187, CHASE BUILDING (822 7TH ST, GREELEY) RENOVATION CABLING —
DEPARTMENT OF INFORMATION TECHNOLOGY: Ryan Rose, Director of the Department of
information Technology, stated three (3) vendors attended the mandatory pre -bid walk-through; however,
only one (1) bid was received, and staff will make a recommendation on November 8, 2023.
• 2) PRESENT BID #B2300188, FORT LUPTON ANNEX BUILDING (SOUTHEAST SUBSTATION)
CABLING — DEPARTMENT OF INFORMATION TECHNOLOGY: Mr. Rose stated three (3) bids were
received and staff will make a recommendation on November 8, 2023.

NEW BUSINESS:
1) CONSIDER TEMPORARY CLOSURE OF CR 40 BETWEEN CRS 15 AND 17: Kevin Hettinger,
Department of Public Works, stated the Department is requesting a closure to begin October 30, 2023,
and go through November 3, 2023, to complete a culvert replacement. He explained this closure was
previously approved by the Board on September 25, 2023, but due to conflicts with the irrigation schedule,
the repairs were not done, and the road remained open. Mr. Hettinger stated water will be used, as
needed, on the gravel portions of the detour route. Commissioner Ross moved to approve said temporary
closure. The motion was seconded by Commissioner Buck, and it carried unanimously.
PLANNING:
1) CONSIDER REQUEST TO WITHDRAW APPLICATION FOR A SITE SPECIFIC DEVELOPMENT
PLAN AND USE BY SPECIAL REVIEW PERMIT, USR18-0023, FOR ANY USE PERMITTED AS A USE
BY RIGHT, ACCESSORY USE OR USE BY SPECIAL REVIEW PERMIT IN THE COMMERCIAL OR
INDUSTRIAL ZONE DISTRICTS (TRUCK AND EQUIPMENT PARKING AND STORAGE FOR
CONSTRUCTION BUSINESSES) PROVIDED THAT THE PROPERTY IS NOT A LOT IN ANY
APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO
ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL)
ZONE DISTRICT, AND RESCIND RESOLUTION #2018-2843, DATED SEPTEMBER 19, 2018 -
LES MATSON CONSTRUCTION, INC., C/O BRIAN HARTMAN: Diana Aungst, Department of Planning
Services, gave a brief overview regarding Use by Special Review Permit, USR18-0023, for a construction
business that was approved by the Board on September 18, 2019; however, she stated the map was
never recorded. Ms. Aungst stated staff received a request to withdraw the application from the applicant,
dated October 4, 2023, as there is no longer a construction company onsite. She indicated staff
recommends approval. Luke Gildemeister, U.S. Solar representative, stated his company is working on
a proposed Solar Energy Facility (SEF) application, which will be heard by the Planning Commission on
November 7, 2023, and then likely before the Board in early December 2023. He noted per Weld County
Code, two (2) USR permits are not allowed on the same project parcel, thus the request to withdraw and
rescind USR18-0023 was made. Les Matson, applicant, was present and confirmed the construction
business is no longer in operation and the former permit is not needed. Commissioner Ross moved to
approve said withdrawal, and rescind Resolution #2018-2843, dated September 19, 2018. The motion
was seconded by Commissioner Buck, and it carried unanimously.
El PUBLIC COMMENT: No public comment offered.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:07 a.m.
