WHEREAS, the City of Greeley, Weld County, Colorado, has
requested permission for the installation of an industrial waste and sewage
treatment facility on the following described property, to-wit:
The Southeast Quarter (SET) of Section Thirty-one
(31), Township. Six (6) North, Range Sixty-four (64)
West of the Sixth (6th) Principal Meridian, Weld
County, Colorado, and
WHEREAS, the said requested sewage treatment facility is located
in an agricultural zone as set forth by the Weld County zoning resolution,
and
WHEREAS, according to the zoning resolution of Weld County, said
sewage treatment facility may be permitted on the approval of the Board
of County Commissioners of Weld County, and
WHEREAS, the Weld County Planning Commission has recommended
that such sewage treatment facility be granted by certification and approval
dated July 9, 1970, a copy of which is attached hereto and made a part
hereof by reference, and
WHEREAS, the Board of County Commissioners has studied the
request of the petitioner and studied the recommendation of the Weld County
Planning Commission and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of the City of Greeley, Weld County,
Colorado, to locate a sewage treatment facility on the premises indicated
above be and it hereby is granted under the conditions following:
1. That any and all sewage treatment facilities to be installed shall
be approved by the State Health Department.
2. That there be a screening of evergreens around said sewage
treatment facility and with a minimum of 100 feet setback from all road
rights of way.
3. That all applicable subdivision regulations and zoning regulations
shall be followed and complied with to the satisfaction of the Board of
County Commissioners, Weld County, Colorado.

Dear Mr. Stephenson:
At the request of Mr. William E. Bohlender, City Attorney for
the City of Greeley, Colorado, concerning site location for a
new sewage treatment facility of the City of Greeley, Weld
County,. Colorado, I wish to advise that pursuant to the Weld
County Zoning Resolution, site approval for said facility was
approved by the Board of County Commissioners, Weld County,
Colorado, on July 9, 1970.
For ready reference, I am enclosing herewith copy of Resolution
of the Board concerning site location for such facility which I
believe is self-explanatory.

Mr. Billings: We will call this meeting to order, as requested by
the City of Greeley they now have land known as Site VIII and they
request that this Board approve this site for the location for a
sewage treatment facility. The location of the facility is the
Southeast Quarter of Section 31, Township 6 North, Range 64 West
of the 6th P. M., Weld County, Colorado, as stated in the application
by the City of Greeley.
The site will also be utilized by the City of Greeley
for a regional sewage treatment plant. This Board having looked at
this site, find that it meets many of the conditions that we required
in denying the previous Site VII. That it actually is in a location
that is much more secluded from the public and it is also secluded
from the main artery or road better known as Eighth Street going
east. That the land is not prime agricultural land - it is what
you might call marginal agricultural lands.
That it also there is an adequate amount of land for
the type of regional facility which can be developed in years to come
for the City of Greeley. Also in many plannings that we have been
acquainted with in the last few weeks regarding sewage lagoon operations
and the type they should be, I might say at this time, we have been in
contact either personally or by representatives of the Weld County Health
Department and other people have been in contact with engineers from
throughout the United States regarding sewage lagoons and their operation
whether they are feasible or not. It seems a though almost all reports
coming back to us are the sewage lagoon type of facility. It is becoming
more throughout the United States and two other countries which had
engineering members at the hearing in St. Louis. That these systems
will work very satisfactorily, they will work as combination sites
also. They are used not only for industry but also for towns or cities
We have been pretty well assured by almost every engineer and the people
we had representing us gathering this data that such an operation if

I am trying to look over the many notes I have here. Basically
we found 4 points that almost all the engineers agreed on.
That such facility had, #1 - have enough land to operate correctly
and there is enough land in this area. #2 - with competent help
and competent personnel to operate such a facility that it would
work satisfactorily for everyone concerned along with the amount
of area that was needed for such a site. It was felt that depending
upon how great a use for such a facility such as this area needed
to be large enough so that a sub lagoon could be constructed in the
area ., to be used a good many years from now when the sludge needs to
be removed from the original lagoon. From all indications that we
were able to find as a Board of County Commissioners trying to insure
the people of Weld County, that whatever decision we made that we
were going in the right direction. That sewer lagoons were the
best feasible operation not only for packing house waste, industrial
waste, but also cities and towns.

The area is probably-as isolated 71 residential population as
could be found. Also the area is closer to the Monfort facility
which will increase the heat factor, which was one the four reasons
that most engineers debated that the heat factor transporting
sewage from such plants, as Monforts, back there their variable
was approximately 70 degrees for a most suitable operation of such
a facility. The new location would be approximately three fourths
of a mile closer, which will reduce any problem of the heat factor.
The other very important thing which we found which possibly
is the problem with the operation of the City sewer system now is
the great over-loading of this system. At any one time when it is
impossible for this type of system to handle where in a lagoon
can
system where it is built to an adequate size,/accept huge overloads
without any noticeable problem. It can also continue to pperate
very effectively with great fluctuations in the amount of sewage
sent to such lagoon.

This has been a pretty hard decision for this Board to
make. I can assure all those people who are interested that
we have wasted no effort in finding out all the information
that we could possibly find out.
How such a facility should be located and where it
should be located, how it should be operated this I would ask
the other Board members to elaborate or make any statements
Mr. Anderson.
Marshall Anderson: Mr. Chairman at this time I move that this application
be granted subject to the following: the approval of the Planning
Commission, engineering and soil tests - favorable reports from
the engineer on the soil tests on the available location.
Mr. Billings: A motion has been made by Mr. Marshall Anderson subject
to our County Planning Commission approving this location, the
approving
engineering study/of the soil conditions are alright for such
a facility as this. At this time what is your recommendation
Mr. Harold Anderson?
Harold Anderson: I will second the motion.
Mr. Billings: As Chairman of the Board I would make the resolution
of Mr Anderson unanimous - I would at this time ask for a voice
vote of this Board for the approval of location of the City of
Greeley request for a sewage treatment facility in that area.
Mr Marshall Anderson
Mr. Anderson: Yes.
Mr. Billings: Mr. Harold Anderson, how do you vote?
Harold Anderson: After all the consideration we have gone through for
this lagoon set-up this today which is the best: location
as far as being away from close residences, I will have to
move to vote in favor of granting this permit.

Mr. Billings: I think probably before make my decision and before we
actually act on this, at this time I ask if there any comments those
people in the room would like to make. We have representatives from
the City of Greeley, I believe we have the representative of those
people who live in the area. Mr. Cruce is there anything you would
to say.
Mr. Cruces Well Mr. Chairman, I can only tell you that we will wait
here until after lunch.
Mr. Billings: Mr. Wells, the engineer,do you have anything you would
like to say?
Mr. Wells: We are prepared to consult the people of the City of
Greeley to set up the requirements for the testing program.
Mr. Billings: Mr. Haley do you have anything you would like to state?
Mr_Haley: Only this Mr. Chairman, I dug through our files yesterday
and I am certain the decision - the summary you have made reflects -
it should be noted I think by the public - reflects the apparent
sincere effort on the part of the County Commissioners, and the
county officials in trying to find a solution not only just physically
proper but well basically I think you have done the same thing the
task force has been trying to do; and as a member of the task force
I would like to say we appreciate it. We have known for sometime
even though there has been a lot of delay that this is a difficult
question. This is one of the reasons we stood by to help out in
any way possible. We recognize it being difficult and we commend
the Commissioners and the Planning Commission and the other people
in the county who have worked so diligently to try to find a really
proper solution. I guess I am speaking primarily as an individual
representative
not as an official/of the task force, but I am sure they all share
my beliefs.
Mr. Billings: Mr. Burroughs.

Mr. Burroughs: Mr. Chairman, we too know the Commissioners spent considerable
time and appreciate the fact that you have spent considerable time considering
the location of the facility. It is truly indeed a regional facility
we request that the County Commissioners in the interest of the people
outside Greeley follow up and see that this is properly maintained
and operated for the protection of the people who have to live around
it.
Mr. Billings: I think Mr. Burroughs that your request is very valid
and since we do have people from the City of Greeley here and some
of their Councilmen, we hope that they will endeavor in every way
to see that the facility is operated as efficiently as a sewage
disposal can be operated in the State of Colorado or anywhere else.
We know that many people who live in the eastern area have a right
to be concerned with the many different stories that have been related
from one person to another. I think the Weld County Health Department
and the State Health Department will watch this facility very closely.
There are very definite guidelines as far as the State and County
Health Department are concerned. The City of Greeley, I am sure,
will in everyway build and operate a facility that everybody in
Weld County will be satisfied with. Is there anyone else who would
like to mtke any comments?
Roy Johnson: Why, I have been very calm as this started and I am
involved too - Glenn you stated the immediate area would have some
odor sometime - I happen to live in the immediate area and there are
several farms for sale now on account of the VII site and I would like
to ask Glenn - if this site was across the road from his farm -
Mr. Billings: I think I would have to say Ole I would probably be
as concerned as you - but the information we have gathered we can
make available to you anytime to read you want to. It states in there
about a good many engineers, I believe this one report was made up
by 12 of the very top engineers regarding this type of facility and
they state in there very definitely that it would probably be on the
site only basically. I know that with certain operations some of this
information we have - that before the lagoon is sealed over there will

be some odor. More ordor than normally. You never get anything
without an odor I guess rather it is a rose or what. Neither
can I tell you there will be no odor in the immediate area or
that there would be any odor that would actually effect you.
According to the information that we have it would be very very
slight. If I remember the area correctly your place will be
to the north
Mr. Johnson: Across from

Mr. Billings: From the northeast - the prevailing winds coming
out of the northwest. I think you would probably be like I am
with one of the major feedlots. Two or three times out of the
year I get a pretty good odor where I live normally with the
prevailing winds I don't. The indication in these reports, we
hope, we almost have to assume they are correct because they
were made by expert engineers who have worked with something like
this all their lives. Under only extraordinary circumstance would
there be any odor of any consequence. Now Mr. Wells and Mr. Haley
might elaborate on this some more if they would like to. We only
have information before us and we tried to compile this. I guess
we don't do anything or create anything without creating some
problem.
Mr. Johnson: I have a couple more questions I would like to ask
the City of Greeley or Mr. Haley or some of the Commissioners.
That land directly east of yoursewage disposal, that which you
have now, was that not available or could you not get it or did
you do anything - it is Great Western Land. Wouldn't that be
sufficient to build this thing 10 times bigger than what it is?
Or have you thought of that angle.
Mr. Billings: According to information we have received - according
as to information we have the size of this lagoon is that they
have more than adequate land to build the facility like I brought
out before a facility of this kind is very satisfactory even when
over or when
heavily/loaded/ there is very little sewage being disposed in
it. It is built adequate is that not correct, Mr. Wells?

Mr. Wells: Yes.
Mr. Johnson: Is both the city and the plant going out to this lagoon?
Mr. Cruce: Yes this is right eventually as we phase out the older
plant we will hope to put some of our sludge and other materials
out there as soon as we build the digest
Mr. Chairman to answer that question we did quite a bit of negotiations
with Great Western several years ago - we bought a little acreage
there and built our side plant and they were most reluctant and
they will not give up any land - so we are boxed in. We do not
have enough land.
Mr. Haley: To answer all these questions possibly about the nuid. or
one site - it would not conform in any way to the regional requirements
that is for a regional site. The geographical location feasibility
would not fit were it could be used as a regional site. A regional
site has to be includes the two rivers.
This is where all the emphasis has been in a matter of fact trying
to get federal participation we must qualify - it has to be out where
the 2 rivers are included in that area.
Mr. Johnson: I haven't been worried too much but I still feel that
the site you chose or I should say site VIII you would have to do
a lot of -I didn't see last nights paper
I had phone calls all this noon hour - that is the reason I came
down - how many acres do you plan to handle the lagoon?
Mr. Cruce: Ninety acres the first construction.
Mr. Johnsons Which side of the creek were you figuring on building on.
Mr. Cruces I don'.t think we are capable of answering that question
Mr. Wells: Part of that will of course depend upon the soil survey
the soil may not be uniform throughout the site.
Mr. Haley: In all probablity, Oly, you were not here this morning,
we are going to relocate the channel and then depending upon the
engineering features we uncover - the soils and surveys and the
factors that are involved in design it will probably be all on one
side or the other of the relocated channel.

Mr. Johnson: Well I just here by the grapevine that they paid $8000.00
and acre for it. I sure would sell mine.
Mr. Billings: This is something that would be between the City and
the people who own it. Is there anyone else who wants to make any
comments?
Mr. Burroughs: Mr. Billings, I might make one more comment, you gave
me the reports from which you based your decision or at least which
you considered and there was amoung them a report from the Department
of Interior concerning the pipe. I presume that is the same pipe
that is contemplated but I can't anywhere in the report where they
tested it for enviormental factors, pressure and other types of
substances there was no place that I could find it in the report,
concerning the temperature in talking about a great distance.
I hope that the County Commissioners in considering the engineering
for the site will also consider this pipeline.
Mr. Billings: Undoubtly Mr. Cruce can answer this as far as the
requirments they expect from the person who suppliesthe pipe.
Are there any more questions. I have a motion we approve this Site
VIII I have a second that we approve Site VIII. As Chairman of the
Board, and I am Glenn Billings, I will make this motion unanimous.
