This proposal has been reviewed on behalf of the Weld County Department of Public Works and
Department of Planning Services. Staff comments made during this phase of the application process may
not be all-inclusive, as other issues may arise during the remaining application process.
COMMENTS:
Parcel: 131108302002.
The project proposes: RESUBDIVISION OF LOT 11 IN ENCHANTED HILLS SUBDIVISION RESULTING
IN THREE (3) LOTS.
ACCESS:
Development Review has reviewed the application materials related to access.
The applicant has existing access onto CR 15. This portion of CR 15 is under the jurisdiction of the Town
of Firestone. The applicant shall contact the Town concerning access permitting requirements.
ROADS AND RIGHT-OF-WAY:
This portion of County Road 5 is under the jurisdiction of the Town of Firestone. The municipality has
jurisdiction over access to the road. The applicant shall delineate on the plat the future and existing right-
of-way and the physical location of the road. Pursuant to the definition of setback in the Weld County Code
Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware that physical
roadways may not be centered in the right-of-way. Please contact the municipality to verify the access
permit or for any additional requirements that may be needed to obtain or upgrade the permit.
DRAINAGE REQUIREMENTS
This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of
runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at
the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas.
Detention pond waived and a simple drainage narrative:
The applicant has submitted a drainage narrative stating that the site meets drainage exception 1. Use by
Right or Accessory Use in the A (Agricultural) Zone District. Located in Sec. 8-11-40. Drainage Policy.
No other stormwater management information is needed at this time.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
CONDITIONS OF APPROVAL:
The plat shall be amended to delineate the following:
1. This portion of County Road 15 is under the jurisdiction of the Town of Firestone. Please
contact the municipality to verify the right-of-way. Show and label the right-of-way. Show
the approved access(es) on the site plan and label with the approved access permit
number, if applicable. (Development Review)
DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1. The property owner or operator shall be responsible for controlling noxious weeds on the
site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development
Review)
2. Access on the site shall be maintained to mitigate any impacts to the public road including
damages and/or offsite tracking. (Development Review)
3. The historical flow patterns and runoff amounts will be maintained on the site.

Re: RES23-0001 Applicant: Steve Maas
Environmental Health Services has reviewed this proposal requesting a resubdivision of
Lot 11 in Enchanted Hills subdivision resulting in three (3) lots.
There is an existing residence which is served by Central Weld County Water District
and an on -site wastewater treatment system (OWTS) permitted for 5 bedrooms (G-
19721956).
The remaining lots will be served by Central Weld County Water District and OWTS.
We recommend the following appear as notes on the resubdivision plat:
1. Water service may be obtained from Central Weld County Water District.
2. The parcel is currently not served by a municipal sanitary sewer system.
Sewage disposal may be by on -site wastewater treatment systems designed in
accordance with the regulations of the Colorado Department of Public Health
and Environment, Water Quality Control Division, and the Weld County Code
in effect at the time of construction, repair, replacement, or modification of the
system.
3. Activity or use on the surface of the ground over any part of the on -site
wastewater treatment systems must be restricted to that which shall allow the
system to function as designed and which shall not contribute to compaction of
the soil or to structural loading detrimental to the structural integrity or capability
of the component to function as designed.
4. During development of the site, all land disturbances shall be conducted so that
nuisance conditions are not created. If dust emissions create nuisance
conditions, at the request of Weld County Environmental Health Services, a
fugitive dust control plan must be submitted.

as "access & utility easement" on final plat. Future tap purchases for rear lots will require meter pit and
service line placement within that easement.

Dear Mr. Nader:
I have reviewed the submitted material pertaining to the re -subdivision of Lot 11 in the Enchanted Hills
Subdivision recorded located at 10286Weld County Road 15 (Case Number: RES23-0001). The Fire
District does not object to the request, but does have the following comments and requirements should
future buildings be constructed on any of the parcels created:
• Water supply for fire protection may be required for any new dwelling that may be constructed or
moved on any of parcels created. Water supply for fire protection is not required for a single-family
residence that is not larger than 3,600 gross square feet. If a residence exceeds 3,600 gross square
feet water supply for fire protection requirements apply. All other structures or uses may require
water supply for fire protection depending on the use or structure. Generally, water supply for fire
protection is not required for private garages, barns, storage buildings and accessory buildings
provided the building is not being used as living space and hazardous activity will not be occurring
within the structure (i.e. woodworking, vehicle repair garage, spray painting with
flammable/combustible liquids, etc.).
• If water supply for fire protection is not available from fire hydrants for a residence, the installation
of a residential fire sprinkler system is accepted as an alternative to meeting the required fire flow for
residential structures.
