RE: APPROVE AGREEMENT REGARDING TRANSPORTATION OF CHILDREN IN LEGAL
CUSTODY OF WELD COUNTY AND AUTHORIZE CHAIR TO SIGN - LIFE STORIES
CHILD AND FAMILY ADVOCACY, AND COURT APPOINTED SPECIAL ADVOCATES
(CASA) OF WELD COUNTY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement Regarding the
Transportation of Children in the Legal Custody of Weld County among the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of
the Department of Human Services, Life Stories Child and Family Advocacy, and Court Appointed
Special Advocates (CASA) of Weld County, with further terms and conditions being as stated in
said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Agreement Regarding the Transportation of Children in the Legal
Custody of Weld County among the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Department of Human Services, Life
Stories Child and Family Advocacy, and Court Appointed Special Advocates (CASA) of Weld
County, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.

County Department of Human Services (WCDHS) by Life Stories/CASA of Weld
County Volunteers and Staff.

Brief description of the problem/issue:
The Department of Human Services requests to enter into an agreement with Life Stories/ CASA that would
allowthe staff and volunteers at Life Stories/CASA to transport children in the legal custody of WCDHS and
comply with National CASA/GAL ASSOCIATION standards.
What options exist for the Board?
• Approval of the Transportation Agreement.
• Deny approval of the Transportation Agreement.
Consequences: Transportation of the children will not be allowed.
Impacts: WCDHS would not be incompliance with National CASA/GAL Association Standard 6 - Elements of
Practice: NP 6.G.10.a.b.c.d.e policies.
Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years):
• This is a non -financial agreement.
Recommendation:
Approval of the Agreement and authorize the Chair to sign.

AGREEMENT REGARDING TRANSPORTATION OF CHILDREN IN THE LEGAL
CUSTODY OF THE WELD COUNTY DEPARTMENT OF HUMAN SERVICES BY LIFE
STORIES/CASA OF WELD COUNTY VOLUNTEERS AND STAFF
THIS AGREEMENT is entered into this 3O day of 06-00..&) 2023, by and
between Weld County Department of Human Services (hereafter referred to as the "County")
and Weld County CASA (hereafter referred to as "CASA") with a business address of 1640
25th Avenue, Greeley CO 80634.
WHEREAS CASA desires for their volunteers to transport children in the legal custody of
the Weld County Department of Human Services.
NOW THEREFORE, the parties mutually agree as follows:
1. CASA shall follow all National CASA/GAL ASSOCIATION standards (Effective January
1, 2021. Published by the National CASA/GAL Association. Standard 6 -Elements of
Practice: NP 6.G.10.a.b.c.d.e).when CASA volunteers transport children in the legal custody
of the Weld County Department of Human Services.
2. CASA shall ensure that CASA volunteers who are transporting children in the legal
custody of the Weld County Department of Human Services have a valid driver's license
and that all transporting CASA volunteers maintains automobile liability insurance that
meets the requirements of the State of Colorado. Initial proof of valid and current
vehicle/passenger insurance shall be emailed to Doug Hanley, Weld County DHS
Clinical Care Supervisor, at Hainlejd@weld.gov to verify and document coverage prior
to the performance of any services under this Agreement. Documents received will not
be retained by the County. CASA shall ensure that vehicle/passenger insurance is up to
date and effective at all times and will notify County of any lapse of coverage. County
shall have the right to verify coverage at any time.
3. CASA shall run annual Colorado Department of Motor Vehicles records checks on CASA
volunteers who are transporting children in the legal custody of the Weld County
Department of Human Services.
4. CASA shall indemnify and hold harmless Weld County and it's elected and appointed
officials, officers, employees, and agents from and against any and all losses, damages,
liabilities, claims, suits, actions, or awards, including costs, expenses, and reasonable
attorney's fee incurred or occasioned as a result of the acts of the CASA volunteer in
transporting children who are in the legal custody of the Weld County Department of
Human Services. This obligation to indemnify shall survive the termination of this
agreement. 2023-3223
5. Nothing in this agreement shall be construed as a waiver or substitution of any rights
conferred under the Colorado Governmental Immunity Act CRS 24-10-106, et seq.
6. The Weld County Department of Human Services agrees that CASA volunteers may
transport children who are in the legal custody of the Weld County Department of Human
Services so long as the provisions of this Agreement are complied with and adhered to.
7. This Agreement does not and shall not be deemed to confer upon any third party any right
to claim damages to bring suit or other proceedings against County because of any terms
contained in this agreement.
8. This Agreement will commence upon the date of the last signature and will run for one
(1) year with automatic renewals every year for up to five (5) years. Changes in the
Agreement may be made in writing at any time by mutual consent and either party may
terminate the agreement with or without cause at any time upon 90 days written notice of
its own convenience.
