HomeMy WebLinkAbout20232241.tiffRESOLUTION RE: APPROVE NON-REFUNDABLE QUOTE LETTER FOR RELOCATION OF HIGH PRESSURE GAS PIPELINE METER STATION FOR COUNTY ROAD 41 AND STATE HIGHWAY 52 INTERSECTION PROJECT AND AUTHORIZE CHAIR TO SIGN - XCEL ENERGY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Non -Refundable Quote Letter for the Relocation of a High Pressure Gas Pipeline Meter Station for the County Road 41 and State Highway 52 Intersection Project between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Xcel Energy, with further terms and conditions being as stated in said quote letter, and WHEREAS, after review, the Board deems it advisable to approve said quote letter, a copy of which is attached hereto and incorporated herein by reference. Wider shoulders and larger radii at the corners will also be installed. The intersection design was shifted to the east to avoid a house at the SW corner and a Western Midstream 20" process waterline, 8" gas line and 12" gas line next to the existing west ROW line. As a result, the shift to the east requires an Xcel Energy High Pressure Gas metering station at the NE corner to be relocated from its current location further east. Xcel Energy has provided staff with a cost estimate of $1,658,490.40 to do this relocation. The cost of acquiring ROW, easements for the process waterline and gas lines on the west side of the existing road is expected to cost more than $1.7 million. Xcel has also indicated in the email that the non -refund letter needs to be signed by the County to agree to this amount. The 2023 budget to do this relocation is currently at $1,100,000 which indicates an additional $558,490.40 would be required if the BOCC agrees to the relocation cost. This project has a CDOT/CMAQ grant for $953,445. What options exist for the Board? (Include consequences, impacts, costs, etc. of options): Option 1: The Board may choose to recommend approval of the Xcel Energy relocation cost and sign the letter. Option 2: The Board may choose to request Public Works staff to schedule a work session to discuss the issue. Recommendation: To keep the project moving forward and on schedule, Staff recommends the BOCC approve option 1 above which is to approve the Xcel relocation cost of $1,658,490.40 and sign the letter. This design is based upon High Pressure Gas relocation, as shown on the enclosed drawing. The cost to provide the requested High Pressure Gas relocation is $1,658,491.00, which is non-refundable. If the Applicant elects to have the Company advance the Construction Payment for the duration of the construction period, Applicant will be billed by the Company in accordance with the Company's tariffs, within 30 days after the construction of the Extension is complete. The Applicant shall pay the Company within ninety (90) days after the Construction Completion date. This proposal is contingent upon the following: • Alt work performed during our normal work hours. • Obtaining "Right -of -Way" at no cost to us. • Obtaining permits as needed. • No frost, in the ground, during construction or agreeing to pay for additional costs during frost conditions. • There is an additional charge to open the transformer. • Providing final grade elevations, at our equipment locations. • Grade at trench location to be within 6 inches of the final grade. If necessary our right-of-way agent will mail the right-of-way or easement documents to the appropriate landowners for their signature. This proposal is contingent upon receiving easements at no cost to us. Our right-of-way agent will need a copy of the Warranty Deed, the legal description, and the site drawing in order to prepare the easement for the landowner's signature. NOTE: You must personally contact the local telephone company, the local cable TV company and/or any other utility company to arrange for the installation and payment of any costs of their facilities if they need to be relocated or disconnected along with the relocation. If you accept the above costs and system design, please sign and date the second page of this letter and return this document to Public Service Company of Colorado, at the address shown below.
