WHEREAS, a public hearing was held on November 11, 1974, in the
chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing the petition of State Highway Department, c/o
Leo O'Connor, 1420 Second Street, Greeley, Colorado (Kenneth McEndaffer
land), requesting permission to locate a gravel pit operation on the following
described property:
A tract or parcel of land of the Division of Highways', State
of Colorado, containing 4. 62 acres, more or less, in the SW+
of the SW-n' of Section 19, Township 11, North, Range 56 West
of the 6th P. M. , in Weld County, Colorado, said tract or
parcel being more particularly described as follows:
Beginning at a point in the SW+ of the SWQ of Section 19,
Township 11 North, Range 56 West, of the 6th P. M. , from
which point the Southwest (SW) corner of Section 19, Town-
ship 11 North, Range 56 West, bears South 14°52'30" West,
a distance of 331. 1 feet:
1. Thence, S 77°10' E, a distance of 200. 0 feet;
2. Thence, S 86°20' E, a distance of 263. 0 feet;
3. Thence, S 88°20' E, a distance of 298. 0 feet;

WHEREAS, the Petitioner was present, being represented by Mr. Joe
Intermill of the Colorado Highway Department, and
WHEREAS, there was no opposition to the request of Petitioner for
the location of said gravel pit operation, and
WHEREAS, the said requested gravel pit operation is located in an
agricultural zone as set forth by the Weld County Zoning Resolution, and
WHEREAS, according to Section 3. 3(8) and Section 6. 1 (3) of the
Zoning Resolution of Weld County, said gravel pit operation may be authorized
upon the approval of the Weld County Planning Commission and the Board of
County Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all the testi-
mony and statements of those present; has studied the request of the Petitioner
and studied the recommendations of the Weld County Planning Commission,
and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of State Highway Department c/o Leo
O'Conner (Kenneth McEndaffer land), to locate a gravel pit operation on the
premises indicated above be, and it hereby is granted under the conditions
following:
1. That any water and sanitation facilities to be installed shall be

approved by the State Health Department.
2. That Petitioner shall proceed with due diligence to effect
construction of said gravel pit operation and that he shall have up to one
year from date hereof to begin the construction of same; otherwise, the
Board may, for good cause shown, on its own motion, revoke the permit
herein granted.
3. That when gravel extraction is completed said permittee shall
immediately notify the Board of County Commissioners and said permit
shall automatically be revoked without further action of the Board.
4. That the operation and development of each gravel pit excavation
and rehabilitation shall be limited to plans as submitted and in accordance
with the rules and regulations for the operation of gravel pits as adopted by
Weld County, Colorado.
5. That all applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the Zoning Resolutions
of Weld County, Colorado.

August 6, 1974 at 3:00 P.M. in the old Driver's Licensing Building, Island
Grove Park, Greeley, Colorado

MOTION: By Mr. Weigand to accept the minutes of June 18th as submitted.
Seconded by Mr. Rothe. A vote of "Aye" by Watson, Weigand , Heitman,

SUBJECT: Gravel Pit
LOCATION: Pt SW'-4 SW14 Sec 19 Tll R56
APPEARANCE: Mr. Joe Intermill , State Highway Dept.
DISCUSSION: Mr. Weigand stated that this was five miles west of the Logan
County Line, not the State line. Also, this pit is existing and Mr.
Weigand felt this was a good location. Mr. McEndaifer will retain
ownership of his land, the State Highway Dept. is only buying the sand
and gravel . The pit will encompass a creek bed and flood plain of the
tributary of the Two Mile Creek. This is Dry Creek. Gravel will average
about four to five feet deep. Area will be reseeded; dcn 't feel it would
be practical to seed the bottom of the pit, however, as the first big
rain would wash it out. This is very sandy ,oil , and any runoff should
dissipate through the sand. This is to be a maintenance-use pit. If
they should get a contract, they might want to move a contractor in
there. Nothing anticipated at this time. About 4.6 acres. Have applied
to the State Land Reclamation for the necessary permit. Weld County
Planning staff recommends approval for the following reasons: (1 ) Agrees
with the Weld County Comprehensive Plan for extraction of natural re-
sources; (2) supplements H.B. 1529 regarding extraction of sand and
gravel ; (3) the extraction and reclamation scandards are included within
the cover letter. SUBJECT TO: (1 ) Reclamation commencing immediately
after extraction; (2) Extraction limited to the plans submitted; (3)
County Engineer' s comments; (4) Extraction beginning within one years '
time from date of approval by the Board of County Commissioners and
limited to the use of the State Highway Department. This permit is to
terminate at the end of the State Highway Dept. use. Mr. Intermill

Istated that there would be no traveling on County roads from this pit.
State Highway 71 goes right by the pit and this will be used.
RESOLUTION: Be it therefore resolved to recommend approval to the Board of
County Commissioners subject to Planning staff recommendations. Motion
by Mr. Weigand, seconded by Mr. Rothe. A vote of "Aye" by Watson,
Weigand, Heitman, Rothe and Elliott. Motion carried.

SUBJECT: Zone Change "A-1 " to "E-UD" , Preliminary Plat
LOCATION: Pt S-2 NEa Sec 16 T5 R66
APPEARANCE: Ed Kelly, Engineer
DISCUSSION: Some comments by the County Engineer will be met for the Final
Plat. Mr. Kelly stated that he had talked with Glen Paul the week before
and he stated that he had forwarded a signed copy of a letter approving
the sewage proposal . Letter has not been received in the Planning
Office, however. Bounded on the Southeast and West by existing Westridge
4th Filing. Subdividing into minimum two and a half acre tracts. Changed
access on 23rd Avenue. Ditch presently wants sufficient easement to
maintain it. Mr. Carl Mekelberg stated that the City of Greeley would
take a 20' easement; would prefer the ditch tiled . Cannot get on North
side of ditch at all . Would need the easement on the South side. Some
more discussion regarding feasibility of tiling the ditch. There is
an existing access road around the ditch (around the south side) . Some
discussion stating that tiling would increase the value of the property.
Discussion on using the ditch water to irrigate the property after de-
velopment; could be difficult after roads are in, etc. The Company
Ditch has been discussing an agreement with Mr. Sears (Westridge 5th)
for over a year; still no definite agreement set up. Could possibly
work out some type of agreement where the property owner would buy the
tiling and maybe the City installing it for them. Mr. Fortner stated
that the following staff recommendations were based on the premis that
the ditch situation would be cleared up before the meeting; Approved
for the following reasons: (1 ) The proposed PAD is in conformance with
the intent of the Weld County Comprehensive Plan; (2) City of Greeley
recommends approval ; and (3) Count, Engineer recommends conditional
approval . SUBJECT TO: (1 ) Designation of right-of-way width on cul-de-
sacs; (2) County Engineer' s comments prior to final plat approval : (a)
More detailed drainage plan showing how drainage along roads will be
handled; (b) Grading to be performed in a manner which will not cause
erosion of soil into adjacent irrigation ditch; (c) Determination of
whether or not a pipe will be necessary unde, zccess road at 59th Street;
(d) Road arc lengths to be shown on the final plat; (3) Health Dept.
approval of percolation tests (Mr. Paul indicated that this had been
sent to us, however, we have not received it yet); (4) Designation of
Company Ditch and appropriate easements; (5) Modification of development
standards to become part of the PUD; (6) Signature of authorized indi-
vidual from City of Greeley on Utility Installation Agreement.
Mr. Kelly stated that Mr. Shaffer had signed the Clearance Record but
not the Installation Agreement.
MOTION: By Mr. Elliott, To table this until they check with the City and see
if something can' t be worked out regarding the ditch. Seconded by Mr.
Weigand. A vote of "Aye" by Watson, Weigand, Heitman and Elliott.
Motion carried.

APPLICANT: Earl Rice

SUBJECT: Replat Wiesner Sub for Single-Family Dwelling
LOCATION: SZ Lot 6 Wiesner Subdivision (Pt Sl Sec 7 T2 R65)
APPEARANCE: Mrs. Rice & Jay Freese, Engineer
DISCUSSION: Mr. Freese stated that they had taken the south half of Lot 6 and
split out a dwelling site. Originally, Mrs. Rice owned this property prior
to Mr. Wiesner' s subdividing the land. He, at that time, platted her
property as the south half of an entire lot. Total of about 9 acres.
Mrs. Rice stated that Lot B and Lot A had good drainage. Weld County
Planning staff recommends denial for the following reasons: (1 ) Lot 6,
as well as other lots in the subdivision, has already been split. Origi-
nally there were 13 lots in the Wiesner Subdivision; there are now over
30 lots. This is contrary to the intent of subdividing land in the Weld
County Subdivision Regulations. (2) There are over 3400 lots in subdi-
visions throughout Weld County. There are also many small tracts (5, 10
and 40 acre in size) in the County. The Conditional Use Permit should not
be used as a vehicle to subdivide or resubdivide these small parcels of
land. (3) Section 3.3.D of the Weld County Zoning Resolution states,
. .that the Planning Commission shall consider need for the proposed use
and its effect on future development of the area". No special need or
condition has been shown and the adverse effect on future development of
the area and the County could be considerable. (4) The land split would
require an additional and possibly dangerous access to the County Road.
The reason for this being, there is a hill right at the edge of the lot.
Needs to be gone over by the County Engineer regarding access.
Mrs. Rice stated that she had come up to the office about a year ago and
inquired as to the possibility of splitting up this lot and was told by a
staff member that she could do so. In February of this year (1974) they
put their home up for sale after checking again to make sure they could
split this property. After they sold the home, they again came back to
the Planning Office and this time was told, "no" , she couldn't do this.
She talked to the Director and the Zoning Administrator and was told that
if she would fill out the papers f)r a Conditional Use Permit, the Planning
Commission would not recommend denial . They would recommend it ok because
it was for a single-family residence.
Under the regulations, approval could not be recommended to the Planning
Commission. However, it was felt that Mrs. Rice had a case that might
possibly be reason for approval . But the staff could not recommend approval .
Mr. Freese had a meeting with Mr. Lorenson and Mrs. Lee about the 1st of May
and was told that a further split would not conform to the regulations.
After this, he was given confirmation to go ahead with the Conditional Use
Permit. Mr. Freese felt there were already lot splits out there, and one
more wouldn't hurt anything probably. Don' t wish to abuse the Conditional
Use Permit; that was the procedure suggested to them. Access would be over
600' from an intersection. Present staff felt Mrs. Rice was possibly a
victim of circumstances.
RESOLUTION: In view of the past conditions and time elapsed, make special
consideration for this and not to set a precedence in the future, recommend
this to the Board of County Commissioners for approval . Motion by Mr.
Weigand, seconded by Mr. Elliott. A vote of "Aye" by Watson, Weigand,
Heitman and Elliott.

SUBJECT: Zone Change "A" to "E-UD" (& Preliminary Plat)
LOCATION: Pt SW4 Sec 16 T5 R66
APPEARANCE: Doug Sears; Max Karner, Engineer
DISCUSSION: Mr. Fortner read minutes of July 2, 1974 meeting where this was
previously tabled. Mr. Karner stated that they have now supplied the
Planning Office with the Development Standards which capsulizes what is
indicated in the covenants (density - one unit for 2.5 acres minimum);
utilities that will be available; architectural building committee is
formed; building set-backs; streets; and have added a street cross-section.
Have Fire Chief' s signature for water stating that all the hydrants are
satisfactory. Have drainage design on plats. Mr. Straub made comments
(in writing) stating the drainage plan would be acceptable to him as long
as it was refined and corrected and amended prior to the final plat.
Mr. Sears further stated that they were requesting that no building permits
be issued without the plans showing and requiring a positive under-drainage
tied to the under-drain lines. He also stated that the sub-soil investi-
gation showed that a number of the lots would not require under-draining.
As a precaution, they have had the engineer design an entire under-draining
system. Each lot will be required to have a tile drain around the footing.
Has identically the same covenants as Westridge 4th. City' s obligation for
maintenance ends at the north line of this property. Have been working with
the City for over a year trying to get a recordable agreement regarding
the ditch and the City' s responsiblity on maintaining the ditch. The rights
to access to the ditch have been established by common law, state law, or
something like that. Mr. Sears stated they were ready to sign an agreement
granting sufficient easement so long as the existing property rights of the
owners of Westridge are not abused. Talking to other owners, the ditch
has silted in before with bad rains in the past before Westridge was there.
Some discussion regarding the legality of the Planning Commission to re-
quire the ditch agreement as a provision of approval . Did not feel there
was any big economic advantage to tiling the ditch.
MOTION: By Mr. Weigand, To table this and have the staff put forth their best
effort to get the City of Greeley and the respective people together to
put together an acceptable agreement. Seconded by Mr. Heitman.
DISCUSSION: Mr. Sears requested a time limit be placed on this so as to hurry
it along. Mr. Mekelberg stated the City would cooperate as best they
could. Mr. Sears did not feel that Westridge 5th would cause any more
problems than those that are already present and existing.
VOTE: A vote of "Aye" by Watson, Weigand, Heitman and Elliott. Motion carried.
MOTION: By Mr. Elliott, To set these cases back up on the agenda in 30 days
(Westridge 5th and 6th) . Seconded by Mr. Weigand . A vote of "Aye" by
Watson, Weigand, Heitman and Elliott.

Dear Sirs,
Attached is our application for a special use permit from Weld County,
a copy of an application for permit to operate open mining and a reclamation
plan, both of which we are submitting to the State Land Reclamation Board,
plus the extra copies of the sketch and map which you requested.
We are requesting permission to remove sand and gravel from an area
which has previously has these materials removed. The nit lays in the creek
bed and flood plain of a tributary of Two Mile Creek. This is a dry
creek that only flows during periods of run off. This area has no ap-
parent designation in Special Publication 5-B Atlas of Sand, Gravel,
and Quarry Aggregate Resources - Colorado Front Range Counties.
The floodplain and filler area is covered with grass. There is from
one to three feet of sandy overburden over the floodplain. The top 0.3'
of overburden will be stripped, stockpiled then spread over the backslopes,
with most of the remainder being utilized in the sand and gravel production
and any excess will be spread over the bottom of the pit. Useable gravel
depths will range from approximately four to five feet. Backslopes will be
left no steeper than 3:1 and will be seeded.
Any run off eater trapped in the bottom of the pit should dissipate in
a short period through the granular material which will be left in the
bottom of the pit.
The cravel —ill probably be removed from the pit by dozer or front end
loader, processed through a screening plant, then it will be stockpiled
and either processed through an asphalt plant or hauled to the road as
untreated sand and gravel.
We will conform to Weld County Zoning and Reclamation Regulations for
our gravel pit operation and the reclamation of the area.

13. Attach two copies of an accurate map of the area affected by the opening
mining which map shall include, but not be limited to, the following:
a. The map shall be made and certified to by a registered land surveyor,
professional engineer registered in the State of Colorado, or a
qualified person.
b. Identify the area on the map, with colored ink or some other manner,
which corresponds with the application.
c. Indicate adjacent deep mining and adjacent surface owners.
d. The map shall be to a scale of not less than one hundred (100) feet to
the inch and not to exceed six hundred sixty (660) feet to the inch.
e. Indicate the name and location of all creeks, roads, buildings, oil
and gas wells and lines, and power and communication lines on the area
of affected land and within two hundred (200) feet of all boundaries of
such area.
f. Indicate the total area to be involved in the operation including the
area to be mined and the area of land affected.
g. Indicate the topography of the area with contour lines of sufficient
detail to portray the direction and rate of slope of the land in
question. -
h. Indicate the general type, thickness and distribution of soil over
the area in question.
i. Indicate the type, character, and density of present vegetation
covering the area in question.

WITNESSETH THAT:
WHEREAS, the Department desires to obtain coc,truction materials of satis-
factory quality and quantity for use in construction, improvement and maintenance
of its highways, which material is available from land owned by the "Owner" and
described as follows, to-wit:

NOW, THEREFORE, IT IS AGREED BY THE PARTIES:
The Owner, for the consideration of One Dollar, receipt of which is hereby
acknowledged, hereby grants to the Department the exclusive right and option from
the date of this Agreement until the 1St day of June , 19 74
at 12:00 Noon, to purchase and remove from the subject premises.

or for a lump sum of $ If the Department exercises this Option
within the time aforesaid, the Department shall then have the right to purchase and
remove all material necessary for construction of Department projects in the area
and for adequate maintenance stockpile. If the Department exercises this Option,
the Owner shall be paid a minimum of $25.00.
The Department shall have the right of ingress and egress to and from the sub-
ject premises and to erect any temporary structures, such as: - screening and
crushing plants, and asphalt plants; and to employ any reasonable methods for remov-
al of material. After the Department has completed its removal operations, it will
leave the premises in a neat condition.

This Agreement is for removal of material for use on Department projects and 4
maintenance only, and removal by any other persons including the Department's u}
contractor or contractors for any purpose other than as herein provided, shall be
under a separate agreement with the Owner and only with written approval of the
Department.
It is understood and agreed that, upon the letting of a contract by the Depar
ment to a contractor for the construction, improvement and maintenance of highways E
the Department shall assign to the contractor all its right, title and interest
under this instrument, insofar as the same shall be applicable to the projects let
to the contractor, and the contractor may reassign such option to subcontractors
working on said projects. If the option is exercised by the contractor or any
subcontractor, said contractor or subcontractor shall have a right to extract all
material needed for the projects covered by the contract let by the Department, subg-
ject to all the terms of the Option.

Dear Adjacent Landowner:
As an adjacent landowner, you have previously received ,)
a notice of public hearing for the proposed State Highway
Department gravel pit (56-11-19, portion. ) This notice indicated
that the hearing would be held in the Weld County Commissioners '
office in the Weld County Court House.
Beginning October 29th, 1974 the Weld County Commissioners '
offices will be located in the Weld County Public Health Building
at 1516 Hospital Road (16th Street & 17th Avenue. )
The above mentioned hearing will be held at this new
location at the time specified in said notice.
