RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR RAPID HUMAN
IMMUNODEFICIENCY VIRUS (HIV) / HEPATITIS C VIRUS (HCV) / SYPHILIS TESTING
DISTRIBUTION PROGRAM AND AUTHORIZE CHAIR PRO-TEM TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for the
Rapid Human Immunodeficiency Virus (HIV) / Hepatitis C Virus (HCV) / Syphilis Testing
Distribution Program between the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Department of Public Health and
Environment, and the Colorado Department of Public Health and Environment, commencing
January 1, 2023, and ending December 31, 2023, with further terms and conditions being as
stated in said memorandum of understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Memorandum of Understanding for the Rapid Human
Immunodeficiency Virus (HIV) / Hepatitis C Virus (HCV) / Syphilis Testing Distribution Program
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Health and Environment,
and the Colorado Department of Public Health and Environment, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair Pro-Tem be, and hereby is,
authorized to sign said memorandum of understanding.

TITLE: CDPHE Sexually Transmitted Infection Rapid Test Kits Memorandum of Understanding

Brief description of the problem/issue:
For the Board's review and approval is a Memorandum of Understanding (MOU) between the
Colorado Department of Public Health and Environment and the Board of County Commissioners of
Weld County for the use and benefit of the Weld County Department of Public Health and
Environment (WCDPHE).
Colorado has seen substantial increases in sexually transmitted infections (STI) morbidity in recent
years. CDPHE has placed Weld County under an Alert Status for newly diagnosed HIV and Syphilis
cases. Increased access to testing, and appropriate and prompt testing of persons with STIs and
exposure is critically important in preventing health complications and interrupting disease
transmissions in communities.
This MOU will allow the Health Department to obtain no -cost, rapid point -of -care (POC)
screening/testing kits for HIV, Hepatitis C, and Syphilis directly from CDPHE. This support is made
available via one-time funding through CDPHE's Rapid Testing Distribution Program for Local Public
Health Agencies. The project term for this MOU runs till the end of 2023 (12/31/2023).
All testing/treatment activities will be conducted by current staff; no additional FTE is being
requested.
What options exist for the Board? (include consequences, impacts, costs, etc. of options):
With the approval of the Board, this will allow the WCDPHE to screen people in Weld County for HIV,
Hepatitis C, and Syphilis. The point -of -care rapid tests are free and convenient for our patients and
provided by CDPHE at no -cost.
If the Board declines approving this MOU, this free rapid diagnostic tool will not be available to our
clinical and outreach patients for our most at -risk populations that have barriers to accessing this
testing due to cost.
Recommendation: I recommend approval of this MOU with CDPHE.

Project Description:
Colorado has seen substantial increases in sexually transmitted infections (STI) morbidity. While the rate of
reported cases of chlamydia decreased by 4.7% from 2017 to 2021, the rate of gonorrhea increased 20.5% and
syphilis (all stages) increased 172.2%. In the same time period, the rate of reported cases of syphilis (all stages)
among women of reproductive age (15-44 years old) increased 494.2%. Increased access to testing, and
appropriate and prompt testing of persons with STIs and exposure is critically important in preventing health
complications and interrupting disease transmissions in communities.
One-time funds are available to expand the support of rapid point -of -care (POC) screening for HIV, Hepatitis C,
and syphilis. This support is made available by offering free rapid test kits to LPHAs and other covered entities
via CDPHE's Rapid Testing Distribution Program/

Under the terms of this agreement, CDPHE will provide access to no -cost rapid HIV/HCV/Syphilis tests to
partnering entities/agencies.
L Process and Protocol
This protocol is intended to explain the process of ordering HIV/HCV/Syphilis Rapid Tests purchased by CDPHE
for LPHAs, and other qualifying agencies in the State of Colorado. Funding is supported by the 1802 and 1901
Prevention Grants. All HIV testing conducted under this protocol will be considered "supported testing events" and
follow appropriate CDC reporting requirements.
• Agencies intending to receive rapid tests purchased by CDPHE must submit a distribution plan prior to
placing each order through the CDPHE: Rapid Test Order Form
o Agencies must submit both a signed MOU and CLIA waiver with their rapid test order form.
• Plans are reviewed within 5 business days of submission. CDPHE will notify the agency if their
distribution plan was approved.
• All orders will be placed by CDPHE and shipped directly to the agency.

H. Expectations Standards and Requirements
I. The Agency shall perform STI screening in accordance with current CDC screening guidelines available on the
following website https://www.cdc.gov/std/treatment-guidelines/STI-Guidelines-2021.pdf
2. The Agency shall maintain one (1) of the following for STI testing throughout the life of the project:
a. Valid, non -expired CLIA waiver certificate
b. Valid, non -expired CLIA certificate
3. The Agency shall comply with the data collection and reporting requirements stated in the Guidelines
Regarding Data Collection and Reporting. This document can be accessed at

this agreement by reference.
4. The Agency shall comply with the guidelines concerning data security and confidentiality stated in the Centers
for Disease Control 's Data Security and Confidentiality Guidelines for HIV Viral Hepatitis, Sexually
Transmitted Disease and Tuberculosis Programs. This document can be accessed at

5. The Agency shall comply with the following Standards of Prevention for HIV/STI/VH and Harm Reduction

6. The Agency shall submit an attestation form confirming receipt of their rapid test kits within 5 business days of
receipt.
7. The Agency shall complete a REDCap Survey within 30 days of rapid testing distribution.
IV. Contingency of change or loss of funding
The partnering Entity/Agency acknowledges that funding for this project is based on one time funds that
are available to the Colorado Department of Public Health and Environment and there is no guarantee of
continued or additional funding beyond the specified terms or allotted testing credits. In the event that any
of these sources of funding are reduced or eliminated prior to the end of the term, CDPHE has the right to
reduce, suspend or eliminate financial support for this project. CDPHE shall endeavor to give the
partnering entity/agency as much prior notice as is possible of any such situation.
