Home My WebLink About740367.tiff RESOLUTION WHEREAS, a public hearing was held on July 8, 1974 in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Public Service Co. of Colorado, P. O. Box 840, Denver, Colorado, requesting approval of site for the construction of oil storage tanks on the following described property, to-wit: The North 3/4 of the ENE1NE4 of Section 33 and the North 3/4 of the W+WZNW+NW4 of Section 34, all in Township 2 North, Range 66 West of the 6th P. M. , Weld County, Colorado, containing 22. 5 acres, more or less, and, WHEREAS, the petitioner was present and represented by Allan J. Miller, right of way agent for petitioner, and Larry Graber, super- intendent of mechanical engineering for petitioner, and WHEREAS, there was no opposition to the request of petitioner for the location of said oil storage tanks, and WHEREAS, the said requested location for said oil storage tanks is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(2) of the Zoning Resolution of Weld County, said location for said oil storage tanks may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Public Service Company of Colorado, P. O. Box 840, Denver, Colorado, to locate oil storage tanks on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That such oil storage tanks shall be limited to the item or items as shown on plan as submitted. 3. That the tanks when constructed shall not exceed the maximum height of 40 feet. 4. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. PL0794 7 40 367 5. Lupton sub-station . Installed in 1971 ; had approval of Weld County Utilities Board . At the time of installation , they were to be only temporary , but have found them to be quite useful and would like them to be permanent . Plans are to make them dual -fuel operation (the turbines ) and will operate on either natural gas or fuel . The two 22 million gallon fuel oil storage tanks will be used solely for the operation of these turbines . There will be a berm built around these tanks . Berm will be lined with a plastic liner which will be impervious to the oil . Do have a plat signed and approved by the State Oil Inspector . They are also installing a maintenance building and two smaller buildings . Unloading facility will be outside the fenced area . Trucks will not be on the roads . Planning staff recom- (•-,_ mends approval for the following reasons : ( 1 ) Ft . Lupton has no objections ; (2 ) Agrees with Weld County Comprehensive Plan and Weld County Zoning Regulations as a use permitted in the Agricultural zone . Miller stated that in 1962 they discussed this problem with the County Commissioners ( regarding the transmission line on the 1031 7 east side ) and at that time obtained a deed from the County Commissioners for that right-of-way through their property . Apparently , Ft . Lupton was not aware of this deed . The deed refers to the north-south road . Mr . Miller stated they were quite willing to cooperate with the Town of Ft . Lupton . DISCUSSION : Mr. Reitz presented a slide show providing background information . Their industrial effluent goes through a lagoon and in turn goes to the Town of Windsor treatment system. The sanitary waste from the plant by-passes this lagoon and goes directly to the Town of Windsor waste treatment facility. The overflow tunnel between their current lagoon and the Windsor waste treatment plant overflow in the sense that it will re- lieve the restrictions imposed by these ( ? ) during periods of high water . The change would be to increase the capacity of the lagoons on the property . Would be able to discontinue use of the Town of Windsor facility and they would discharge directly into the Poudre River . This was the essential agree- ment with the Town when arrangements were made with them to treat their ( Kodak ' s ) industrial wastes . In addition to the lagoon itself , their would be a proposed temporary treatment plant to be installed between the two lagoons . Its goal would be to provide a discharge that would have no adverse affect on the Poudre River. Located on about four acres . New one will have rubber lining . Mr. Anderson inspected the area as the representative . He stated that this whole area was subject to flooding . He felt that sufficient plans had been made to relieve the problem. Planning staff recommends approval for the following reasons : ( 1 ) Agrees with the Weld County Comprehensive Plan ; (2 ) Agrees with the Weld County Zoning Regulations in the fact that their Industrial -Unit Development allows for some A-1 uses including this use ; (3 ) Weld County Health Dept . recommends approval . Public Service Company became the owner of this tract of land in 1958 and substation facilities were installed upon this tract in 1963. In 1971, Public Service Company installed two 50-megawatt combustion turbine generators at this location. These turbines were to be a tem- porary installation when they were installed and only be used until Ft. St. Vrain Generating Station became operational. In 1971, Public Service Company obtained the approval of the Weld County Utilities Coordinating Board for the temporary installation of these two turbine - generators. At this time Public Service Company's plans call for these two 50-megawatt combustion turbine generators to become a permanent installation to be used as a back up source of generation for the entire system of Public Service Company. Also the plans call for the conver- sion of these units from natural gas to a dual fuel of natural gas and fuel oil. With the conversion of these units to operate on fuel oil, the plans call for the installation of two fuel oil storage tanks with the capacity of 22 million gallons each. The dimensions of the tanks will be 100 feet in diameter and 48 feet in height. With the installa- tion of the storage tanks a fuel oil unloading area and necessary pumps and piping will be installed. Also to be installed at this site will be a maintenance building and two small buildings to house pumps and electrical equip- ment. We have a permit to construct and convert the units to a dual fuel use from the State Health Department. A copy is attached to the application. The tank and unloading area will be built to meet the approval of the Colorado State Inspector of Oils. NO.OF SHEET 2 BLIC SERVICE COMPANY OF COLORADI DATE 4-17-74 Water for this installation will be furnished by wells which are now located on the site. The adjudication amount of water is 45 G.P.M. and the adjudication date is February 1, 1971. A 1500 gallon sewage tank will be installed for the disposal of sewage. This tank will be pumped out and hauled away as needed. There will be no personnel permanently stationed at this location but maintenance people will visit the site on a regular schedule. Contacts have been made with two of the landowners within 500 feet of the proposed facility and no objections were received. Mr. Breickler signed the petition supporting the Special Use Permit. Mr. Mel Anderson, who has power of attorney for the George Monson et al land, stated that the land was under option at this time and he did not think he should sign the petition. I also contacted Mr. N. J. McConahay, who is shown as the owner of lots in Aristocrat Ranchettes second filing. He informed me that the lots were sold on contract so he did not think he should sign the petition. I was unable to make contact with the other two owners.
