RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR SERVICES PURSUANT TO
WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) PROGRAM
THROUGH ONE -STOP OPERATOR CENTER, AND AUTHORIZE CHAIR TO SIGN -
WELD COUNTY WORKFORCE DEVELOPMENT BOARD
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for
Services Pursuant to the Workforce Innovation and Opportunity Act (WIOA) Program through the
One -Stop Operator Center between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Department of Human Services,
and the Weld County Workforce Development Board, commencing July 1, 2023, and ending
June 30, 2026, with further terms and conditions being as stated in said memorandum of
understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Memorandum of Understanding for Services Pursuant to the
Workforce Innovation and Opportunity Act (WIOA) Program through the One -Stop Operator
Center between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Human Services, and the Weld
County Workforce Development Board, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said memorandum of understanding.

Brief description of the problem/issue: The purpose of the Memorandum of Understanding (MOU) is to establish an
agreement between the Weld County Board of County Commissioners (BoCC), and the Weld County Workforce
Development Board (WCWDB) pertaining to the programs the Weld County Department of Human Services offers the public
and the delivery of those services through the WCWDBs One -Stop Operating Center.
What options exist for the Board?
Approval of the MOU between the BoCC and the WCWDB.
Deny approval of the MOU between the BoCC and the WCWDB.
Consequences: There would not be a MOU, which is required by the State of Colorado.
Impacts: The programs the BoCC offers the public through the Weld County Department of Human
Services and the delivery of those services through the WCWDB's One -Stop Operating Center
may not continue.
Costs (Current Fiscal Year / Ongoing or Subsequent Fiscal Years):
This MOU does not have any financial elements.
Recommendation:
• Approval of the MOU and authorize the Chair to sign.

MEMORANDUM OF UNDERSTANDING
BETWEEN
CHIEF ELECTED OFFICIAL
AND
WELD COUNTY WORKFORCE DEVELOPMENT BOARD
THIS MEMORANDUM OF UNDERSTANDING is entered into this q day
of0ct062023, between the Board of Commissioners of Weld County, hereinafter referred to as
"Governing Board", acting on behalf of the Weld County Department of Human Services, and
Weld County Workforce Development Board, hereinafter referred to as "WCWDB".
Purpose
The purpose of this Memorandum of Understanding (MOU) is to establish an agreement
between the Governing Board and the WCWDB, hereinafter referred to as the "Parties",
concerning respective roles and responsibilities for implementation of the provisions of Section
121(c) of the Workforce Innovation and Opportunity Act (WIOA) of 2014. Employment
Services of Weld County, acting as the One -Stop Operator and the American Job Center, as
designated by the Governing Board and WCWDB, is a party to the roles and responsibilities.
This MOU coordinates resources to prevent duplication and ensure the effective and efficient
delivery of workforce development services in Weld County. This MOU also establishes joint
processes and procedures which will enable the Parties to integrate the current service delivery
system, resulting in a seamless and comprehensive array of education, human service, job
training and other workforce development services to Weld County residents.
Parties to this document will coordinate and perform the activities and services described herein
within the Scope of Legislative Requirements governing the Parties' respective programs and
services. Parties to this document also agree to the responsibilities, obligations, and
accomplishment of the performance standards and desired outcomes described in this MOU.
Term of this Memorandum of Understanding (MOU)
This Memorandum of Understanding ("MOU" or "Agreement") shall be effective beginning July
1, 2023, through June 30, 2026.
Roles and Responsibilities of Governing Board
1. The Governing Board offers the following programs through the Weld County
Department of Human Services, which may include employment and training activities:
a. Community Service Block Grant Act (42 U.S.C. 9901 et seq)
b. Department of Housing and Urban Development — Community Development
Block Grant
c. Part A of title IV of the Social Security Act (42 U.S.C. 601 et seq.), subject to
subparagraph (C).
d. Section 6(d)(4) of the Food and Nutrition Act of 2008 (7 U.S.C. 2015(d)(4))
e. Section 6(o) of the Food and Nutrition Act of 2008 (7 U.S.C. 2015(o))

f. Colorado Child Welfare System
g. Colorado Child Care Assistance Program
h. Weld County Youth Conservation Corps
2. When appropriate, the aforementioned programs will
a. Train One -Stop Operator staff in the mission, goals, and philosophy of these
programs.
b. Provide opportunities for One -Stop Operator staff to attend program training.
3. Maintain a website that provides online information regarding the programs available
through the Weld County Department of Human Services.
Roles and Responsibilities of One -Stop Operator
1. Provide opportunities for participants of the aforementioned programs to:
a. Use of the One -Stop Resources.
b. Utilization of the open job orders list; distributed weekly.
c. Assist job seekers with accessing and completing applications in
ConnectingColorado.
d. Provide the following information regarding services available at the One -Stop
Center for customers co -enrolled in the Governing Boards programs:
i. Orientation to the programs.
ii. Intake and eligibility processing.
iii. Basic assessment.
iv. Career planning.
v. Case management.
vi. Coordinated job search, job development, and job placement activities.
vii. Hiring and career development events.
viii. Follow-up as required by funding sources.
2. Maintain a website that provides online information regarding services that are available
at the One -Stop Center.
Performance
The Parties jointly agree to high performance for employment and training activities, also
referred to as the workforce development system. It is the intent of each party to support
continuous improvement for program delivery and high -quality services through the workforce
system wherever customers access services.
Resources
The Workforce Innovation and Opportunity Act of 2014 authorizes the following programs,
some of which have eligibility requirements. The Governing Board may refer interested parties
to the One -Stop Center to receive services through:
1. Title I — Workforce Development Activities.
a. Youth Workforce Investment Activities.
b. Adult and Dislocated Worker Employment and Training Activities.
c. Migrant and Seasonal Farmworker.
d. Trade Adjustment Assistance.
2. Title III — Wagner-Peyser Act
3. Other programs and discretionary projects that may become available.
Modifications. This Agreement may be modified in writing, in whole or in part, upon approval
of the signers.
Termination. This Agreement may be terminated at any time by either party, giving thirty (30)
days written notice to the signers. No portion of this MOU shall be deemed to create an
obligation on the part of the County of Weld, to expend funds not otherwise appropriated, as this
MOU is subject to the availability of funding. Therefore, the County may terminate this MOU at
any time if the source of funding for the services made available to the Governing Board is no
longer available to the County, or for any other reason. Partner reserves the right to suspend
services to clients if funding is no longer available.
Entire Agreement. This MOU contains the entire agreement and understanding between the
parties with respect to the subject matter hereof and may not be changed or modified except as
stated herein. This MOU shall be binding upon the parties hereto, their successors, heirs, legal
representatives, and assigns. The WCWDB and Governing Board may not assign any of its rights
or obligations hereunder without the prior consent of both parties.
No Third -Party Beneficiary. It is expressly understood and agreed that the enforcement of the
terms and conditions of this MOU, and all rights of action relating to such enforcement, shall be
strictly reserved to the undersigned parties and nothing in this MOU shall give or allow any
claim or right of action whatsoever by any other person not included in this MOU. It is the
express intention of the undersigned parties that any entity other than the undersigned parties
receiving services or benefits under this MOU shall be an incidental beneficiary only.
Governmental Immunity. No term or condition of this contract shall be construed or
interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections
or other provisions, of the Colorado Governmental Immunity Act §§24-10-101 et seq., as
applicable now or hereafter amended.
Independent Organization. The WCWDB agrees that its members are not employees of the
County, nor entitled to any employee benefits from the County as a result of the execution of this
MOU. WCWDB members are not entitled to unemployment insurance or workers' compensation
benefits through the County and the County shall not pay for or otherwise provide such
coverage.
Severability. If any term or condition of this MOU shall be held to be invalid, illegal, or
unenforceable by a court of competent jurisdiction, this MOU shall be construed and enforced
without such provision, to the extent that this MOU is then capable of execution within the
original intent of the parties.
Nondiscrimination and Equal Opportunity:
As a condition to the award of financial assistance from the County of Labor under Title I of
WIOA, the grant recipient assures that it has the ability to comply with the nondiscrimination
and equal opportunity provisions of the following laws and will remain in compliance for the
duration of the award of federal financial assistance:
Section 188 of the Workforce Innovation and Opportunity Act, which prohibits discrimination
against all individuals in the United States on the basis of race, color, religion, sex (including
pregnancy, childbirth, and related medical conditions, transgender status, and gender identity),
national origin (including limited English proficiency), age, disability, or political affiliation or
belief, or against beneficiaries on the basis of either citizenship status or participation in any
WIOA Title I -financially assisted program or activity;
Title VI of the Civil Rights Act of 1964, as amended, which prohibits discrimination on the basis
of race, color and national origin;
Section 504 of the Rehabilitation Act of 1973, as amended, which prohibits discrimination
against qualified individuals with disabilities;
The Age Discrimination Act of 1975, as amended, which prohibits discrimination on the basis of
age; and
Title IX of the Education Amendments of 1972, as amended, which prohibits discrimination on
the basis of sex in educational programs.
The grant applicant also assures that, as a recipient of WIOA Title I financial assistance, it will
comply with 29 CFR part 38 and all other regulations implementing the laws listed above. This
assurance applies to the grant applicant's operation of the WIOA Title I -financially assisted
program or activity, and to all agreements the grant applicant makes to carry out the WIOA Title
I -financially assisted program or activity. The grant applicant understands that the United States
has the right to seek judicial enforcement of this assurance.
IN WITNESS WHEREOF, the parties hereto have duly executed the Agreement as of the day,
month, and year first above written.
