A public hearing was conducted on August 9, 2023, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated June 19, 2023, and duly published June 21,
2023, in the Greeley Tribune, a public hearing was conducted to consider the request of
Lazaro Lara Adame, c/o L&M Trucking, LLC, for a Site Specific Development Plan and Use by
Special Review Permit, USR23-0014, for Agricultural Support and Service and Oil and Gas
Support and Service (truck parking) outside of subdivisions and historic townsites in the
A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney, made this a matter of
record.
Chris Gathman, Department of Planning Services, presented a brief summary of the proposal,
described the general location of the site, and indicated 17 referrals were sent out and 13
agencies responded. He read the definition of Oil and Gas Support and Service, as well as
Agricultural Support and Service, which requires a separate Zoning Permit for certain uses in the
Agricultural Zone District (ZPAG); however, this particular ZPAG request is included with the USR
request. He noted the applicant lives onsite, outlined the on -site equipment and provided the
hours of operation. He explained the site is currently in violation under case
number ZCV21-00023, and associated court case, #21-C37029. He described the surrounding
zoning and USRs, mentioned notice was sent to eight (8) surrounding property owners (SPOs),
and a confirmed a letter of support was received from a nearby neighbor. Mr. Gathman stated the
site is within the three (3) mile Coordinated Planning Agreement area for the City of Fort Lupton
and the Towns of Firestone and Platteville, as well as within the three (3) mile referral area of the
City of Fort Lupton and the Towns of Firestone, Frederick and Platteville. He shared, per the
Development Review staff, there is an existing, permitted access onto County Road (CR) 20,

provided recent traffic counts in the area, and mentioned the site meets an exception to
stormwater detention. He entered the favorable recommendation of the Planning Commission
into the record as written and displayed images of the site and surrounding views.
El Lauren Light, Department of Public Health and Environment, stated the existing residence is
served by a domestic well and a septic system permitted for three (3) bedrooms. She indicated,
since there are no employees on the site, there is not a need for a portable toilet, but if there ever
were employees, the well would have to be permitted to a commercial use and the septic system
would need to be evaluated for business use.
Lazaro Lara, applicant, explained what he uses the trucks for and indicated he and his son
are the only drivers.
IE No public testimony was offered concerning this matter.
Chair Freeman suggested deleting Development Standard (DS) #3 (hours of operation) and
the Board agreed.
No public testimony was offered regarding change made to the Conditions of Approval and
Development Standards.
In response to Chair Freeman, Mr. Lara indicated he had reviewed, and agreed to abide by,
the Conditions of Approval and Development Standards, as amended.
Commissioner Ross moved to approve the request of Lazaro Lara Adame, c/o L&M Trucking,
LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR23-0014, for
Agricultural Support and Service and Oil and Gas Support and Service (truck parking) outside of
subdivisions and historic townsites in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval
and Development Standards, as amended. The motion was seconded by Commissioner Buck,
and it carried unanimously. There being no further discussion, the hearing was completed at
10:46 a.m.
