BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
WEDNESDAY, SEPTEMBER 27, 2023
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, September 27, 2023, at the hour of 9:00 a.m.
• ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Mike Freeman, Chair
Commissioner Perry L. Buck, Pro-Tem
Commissioner Scott K. James
Commissioner Kevin D. Ross
Commissioner Lori Saine
Also present:

• READ ORDINANCE BY AUDIO: Commissioner Ross moved to read Code Ordinance #2023-12 by
audio. The motion was seconded by Commissioner James, and it carried unanimously.
• AMENDMENTS TO AGENDA: There were no amendments to the agenda.
CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed.
Commissioner Ross seconded the motion and it carried unanimously.
• PRESENTATIONS:
1) COLORADO PUBLIC HEALTH ASSOCIATION (CPHA) 2023 LILLIAN WALD AWARD,
DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT - CYNTHIA HORN, LEAD NURSE
PRACTITIONER: Jason Chessher, Director of the Department of Public Health and Environment, read
the description of the Colorado Public Health Association's Lillian Wald Award, and explained it is
received by only one (1) nurse each year. He further explained that, during her 20 -year tenure with the
County, Cynthia Horn has exemplified leadership among her peers and in the community, she is creative,
resourceful and innovative with addressing public health concerns, and is caring in relationships with
colleagues and clients. Mr. Chessher stated Ms. Horn initiates, implements, and evaluates public health
interventions that focus on health promotion and disease prevention, and shares public health knowledge
with colleagues and the community. He stated she could work anywhere, but thanked Ms. Horn for
choosing to work with Weld County. Cynthia Horn thanked the Board for the recognition and
acknowledged her team of co-workers and leadership who have allowed her to be successful and earn
this honorable award. Each Commissioner, in turn, stated this accolade given is a testament to her
excellence and expressed their appreciation for Ms. Horn's leadership and dedication to her work for

providing the best care to the citizens of Weld County. (Clerk's Note: The group gathered for a photo

WARRANTS:
1) GENERAL WARRANTS - SEPTEMBER 26, 2023: Commissioner Ross moved to approve the General
Warrants, as printed. Commissioner Buck seconded the motion and it carried unanimously.
El NEW BUSINESS:
1) CONSIDER CONTRACT ID #7402 INDEPENDENT CONTRACTOR AGREEMENT FOR
LEGISLATIVE PROPOSAL DRAFTING AND AUTHORIZE DEPARTMENT OF HUMAN SERVICES TO
SIGN - TECHNICAL ASSISTANCE COLLABORATIVE, INC.: Jamie Ulrich, Director of the Department
of Human Services, stated this agreement provides technical assistance support to draft Weld County's
legislative system of care and to move forward with Colorado Counties, Inc. (CCI). Commissioner Buck
moved to approve said agreement and authorize the Director of the Department of Human Services to
sign. The motion was seconded by Commissioner James. In response to Commissioner Saine, Ms. Ulrich
explained the need for additional technical assistance from a national firm will ensure the language in the
legislative system of care is accurate and modeled after the states that have already implemented this
change. She further explained the cause for using outside council, rather than utilizing the County's
attorneys or those who are at the Capital, is due to this being a transformative systemic change, the time
constraints expediting this change, and presenting to the Child Welfare Interim Committee this past
summer; thus, it was imperative to get the language right. Commissioner James commented the
collaboration between the Department of Human Services and the Colorado Department of Human
Services has been encouraging and mentioned CCI conducted a straw poll where 11 out of 11 counties
present, and 21 out of 22 on-line were supportive of the CCI legislation. There being no further discussion,
the motion carried unanimously.
2) CONSIDER CONTRACT ID #7403 2023-2024 LOW-INCOME ENERGY ASSISTANCE
PROGRAM (LEAP) OUTREACH INCENTIVE PROGRAM AGREEMENT AND PLAN, AND AUTHORIZE
CHAIR TO SIGN: Ms. Ulrich stated this agreement and plan is with United Way of Weld County to offer
outreach efforts in the amount of $20,000.00. Commissioner James moved to approve said agreement
and plan, and authorize the Chair to sign. The motion was seconded by Commissioner Ross, and it
carried unanimously.
3) CONSIDER CONTRACT ID #7405 2024-2026 COMMUNITY SERVICES BLOCK GRANT
(CSBG) PROGRAM APPLICATION AND PLAN, AND AUTHORIZE CHAIR TO SIGN: Ms. Ulrich stated
this application and plan provides emergency assistance for households to move towards economic
stability. Commissioner Buck moved to approve said application and plan and authorize the Chair to sign.
Commissioner James seconded the motion, and it carried unanimously.
4) CONSIDER CONTRACT ID #7364 SUBAWARD AGREEMENT FOR THE DRIVE SMART WELD
COUNTY YOUNG DRIVER TRAFFIC SAFETY PROJECT AND AUTHORIZE CHAIR TO SIGN AND
SUBMIT ELECTRONICALLY: Jason Chessher, Director of the Department of Public Health and
Environment, stated this agreement is a renewal with the Colorado Department of Transportation
(CDOT), in the amount of $83,329.58, for the collaboration of traffic safety entities to reduce the number
and severity of traffic accidents. He stated the contract is from October 1, 2023, through September 30,
2024, with said funding to support current levels. Commissioner Ross moved to approve said agreement
and authorize the Chair to electronically sign and submit. The motion was seconded by
Commissioner James, and it carried unanimously.

5) CONSIDER MEMORANDUM OF UNDERSTANDING FOR ADULT TREATMENT COURT (ATC)
PROGRAM WITH VARIOUS ENTITIES AND AUTHORIZE DEPARTMENT OF JUSTICE SERVICES TO
SIGN: Doug Erler, Director of the Department of Justice Services, stated this memorandum of
understanding was written by the courts to allow the Department of Justice Services to sign on behalf of
the county. Commissioner James moved to approve said memorandum of understanding and authorize
the Director of the Department of Justice Services to sign. The motion was seconded by
Commissioner Ross, and it carried unanimously.
PLANNING:
1) FIRST READING OF CODE ORDINANCE #2023-12, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING OF THE WELD COUNTY CODE
(FLOODPLAIN REGULATIONS): Diana Aungst, Department of Planning Services, gave an overview of
the proposed changes in Chapter 23 of the Weld County Code, regarding floodplain regulation
requirements from the Colorado Water Conservation Board and Federal Emergency Management
Agency (FEMA). She indicated the proposed changes in Section 23-11-230 are to adopt language to
accept the new floodplain maps that will be effective November 30, 2023. Ms. Aungst further stated the
revisions will also allow septic systems in the floodplain and offer clarification to the Code. She noted the
Planning Commission recommended approval of the adoption of the proposed language changes.
No public testimony was offered concerning this matter. Commissioner James moved to approve
Code Ordinance #2023-12 on First Reading. Seconded by Commissioner Buck, the motion carried
unanimously.
PUBLIC COMMENT: No public comment was offered.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2023-12 was approved on First Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:18 a.m.
