This violation was initiated due to the presence of more than 4 (four) dogs, the presence of a sign advertising a commercial business prior to USR23-0004 being recorded as well as the parking of passenger vehicles inside an Agriculturally Exempt structure. This case has not yet been forwarded to the County Attorney's Office; therefore, an investigation fee NOT required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff -initiated complaints without there being a safety component to the complaint. If this application is approved, all conditions of approval completed and the final (USR) map is recorded as well as all building permits obtained and finalized, the Code Violation (CCV21-00023) would then be closed. If this application is denied, within 30 (thirty) days of denial, all but 4 (four) dogs could be on the property at any given time. all commercial signage would need to be removed and the buildings would either need to be returned to their permitted use or appropriately permitted for their current usage; otherwise, the violation case would progress accordingly. Melissa has been a blessing in our lives. It is so important to us that our beloved puppy is well taken care of when we travel and our girl loves spending time with Melissa. We first met Melissa when she worked at the Erie Veterinary clinic. Melissa went above and beyond with our pet's care. We later learned that Melissa had successfully showed her dog that happened to be the same dog breed as ours. Many times I have personally witnessed Melissa's calm, kind, yet commanding presence with many other breeds of dogs. They (the dogs) and we all love her. We are especially pleased with the double gated safe entry/containment to the well -designed dog pen. At all times our dog and other dogs present have behaved and played well together. Room to exercise. Room to be country! Then I met Mel. She was kind, considerate, knowledgeable, and fully engrossed in the business of loving the animals around her. You could tell they loved her. You could tell she loved each one of them. It didn't take long to feel this was a place for both our Holly and Lena. I can't imagine having to locate another place for my animals to feel at home away from home. The energy they get to release when they are there helps me feel ok with the fact that I can't be home with them daily. I'm not sure why someone would have a grievance toward her or her daycare. She has waited so long to have just this kind of place...her place. A place where she could do what she loves with the animals she loves. Is it any different than someone out there with horses, or cattle, or tractors? Aren't they all trying to do what they love in a country setting'? The benefits of Mel's Place are tremendous. She is one of the very few exceptional doggie day cares in our area. So far, she has been the only one I trusted. Melissa Kitler chose her home to be the sanctuary for all dogs small and large. We brought a new puppy, Granger, into our home last fall, and I knew that we would need to have some help outside of the house; my husband and I work outside of the home, and we don't have any family near us. I asked around as well as toured numerous facilities before settling on Mel's Dog House. It was a convenient location for our house and by far the best laid out, well -run and clean facility I saw. I took Granger for a trial play date and knew upon dropping him off that this would be my choice. She has a very well -thought-out design that helps to keep not only the dogs safe but also the owners who are dropping them off and picking them up. It is always immaculately clean; I have never seen any sign of dog feces or trash. She is always outside with the dogs when I drop them off and pick them up. I am reaching out concerning the Special Use Permit being sought by Shannon Kemp and Melissa Kittler for the dog kennel. I understand that they are seeking a permit for a 45 -dog kenneling business. This will greatly decrease property values, will cause distress to local livestock, and will disrupt the occupants of the homes near the kennel. It is incompatible with the area. Our family has lived on our several properties in the neighborhood since 1976. We have watched the area change as more homes are built around us. Throughout this evolution, Weld County, to its credit, has consistently maintained the zoning as intended. The surrounding roads were not built to withstand commercial traffic and the intersection of County Road 3 and Highway 66 is dangerous enough without the added traffic. Ms. Kittler has made it clear that she has little to no concern for the surrounding neighbors and has no respect for the permits required for this sort of establishment. From the beginning, she has been boarding more dogs than she stated to the planning board and seems to have no issue ignoring the proper procedures and protocols set by the county. Her blatant disregard for the permitting requirements and the occupants of the homes around her proposed facility will no doubt devalue the surrounding properties. Beyond disturbances from the dogs and depressed resale values of the surrounding properties, Ms Kittler doesn't seem to understand that permitting is not just bureaucratic hoops to jump through but are put in place as safety measures. There are no proper facilities for the staff required to run a 45 -dog facility, and she seems to have no concerns about the water pollution that comes from a facility containing so many dogs in an area that relies on irrigation water. Also, she does not seem to be concerned about the stress this can put on the already established livestock as well as the stress of increased traffic. Her blatant disregard for the surrounding neighbors and the environmental consequences of her actions are concerning to say the least. (1) Every activity to which this article is applicable shall be conducted in a manner so that any noise produced is not objectionable due to intermittence, beat frequency, or shrillness. (5) Construction projects shall be subject to the maximum permissible noise levels specified for industrial zones for the period within which construction is to be completed pursuant to any applicable construction permit issued by proper authority or, if no time limitation is imposed, for a reasonable period of time for completion of proje .:. (6) All railroad rights -of -way shall be considered as industrial zones for the purposes of this article, and the operation of trains shall be subject to the maximum permissible noise levels specified for such zone. (7) This article is not applicable to the use of property for purposes of conducting speed or endurance events involving motor or other vehicles, but such exception is effective only during the specific period of time within which such use of the property is authorized by the political subdivision or governmental agency having lawful jurisdiction to authorize such use. (8) For the purposes of this article, measurements with sound level meters shall be made when the wind velocity at the time and place of such measurement is not more than five miles per hour. (9) In all sound level measurements, consideration shall be given to the effect of the ambient noise level created by the encompassing noise of the environment from all sources at the time and place of such sound level measurement. (10) This article is not applicable to the use of property for the purpose of manufacturing, maintaining, or grooming machine -made snow. This subsection (10) shall not be construed to preempt or limit the authority of any political subdivision having jurisdiction to regulate noise abatement. (11) This article is not applicable to the use of property by this state, any political subdivision of this state, or any other entity not organized for profit, including, but not limited to, nonprofit corporations, or any of their lessees, licensees, or permittees, for the purpose of promoting producing, or holding cultural, entertainment, athletic, or patriotic events, including, but not limited to, concerts, music festivals, and fireworks displays. Mowers can actually chop up the waste into smaller pieces and spread it further throughout your yard where you, your children and your pets continue to step in it and then bring it into your home. 4. Dog fecal matter is a major contributor to stormwater pollution. One out of three households have at least one dog, and all that dog poop left out can be blown into storm drains which lead to our waterways. Whn in water, the liquified waste consumes the oxygen and releases ammonia which contaminates our water resources and contibutes to algal blooms. This makes it harmful to fish and other aquatic life, and potentially to humans as well. 5. If you don't pick it up, it piles up...fast. The average dog discards approximately three quarters of a pound of waste per day, which adds up to 275 pounds per year. Your yard may be more polluted than you think! 6. The Centers for Disease Control (CDC) confirms that hookworms, ringworms, tapeworms and Salmonella can be spread by contact with infected dog waste. The slope from the backend of my property is on a south-southwest plane. This photo is the front end of my property facing directly West. Drainage (storm water) is shown flowing down in a SSW direction and emptying both onto my neighbors to the south and into a/irrigation ditch which flows down hill and empties into Union Reservoir.
