RESOLUTION WHEREAS, a public hearing was scheduled on January 24, 1972, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of W. D. Farr, 707 7th Avenue, Greeley, Colorado, requesting site approval of excavation operation on the following described property, to-wit: A tract of land located in the Northwest Quarter of the South- west Quarter (NWjSW4) of Section 30, Township 5 North, Range 65 West of the Sixth Principal Meridian, Weld County, Colorado and being more particularly described as follows: Commencing at the West Quarter Corner (W± Cor) of said Section 30 and considering the North Line of the Southwest Quarter (SW4) of said Section 30 to bear South 88°38'51" East, and with all other bearings contained herein being relative thereto: Thence South 00009'42" West, along the West Line of the Southwest Quarter (SW4) of said Section 30, 296. 00 feet to the True Point of Beginning: Thence South 88°38'48" East, 754. 83 feet; Thence South 00° 15'42" West, 361. 55 feet; Thence South 89°04'44" East, 228. 39 feet; Thence South 00°18'45" West, 655. 78 feet; Thence North 89°30'51" West, 97. 07 feet to a point on the North edge of the Evans No. 2 Ditch; Thence Northerly and Westerly, along the North edge of said Evans No. 2 Ditch by the following seven (7) bearings and distances: North 80°41'00" West, 156. 24 feet; North 69°51'36" West, 199. 13 feet; North 49°15'06" West, 109. 82 feet; North 66°21' 24" West, 81. 46 feet; South 79°13'48" West, 81. 56 feet; South 62°42'54" West, 208. 75 feet; South 67044'54" West, 128. 48 feet to a point on the West Line of said Section 30; Thence North 00°09'42" East, along the West Line of said Section 30, 999. 37 feet to the True Point of Beginning. Said tract of land contains 19. 290 acres, and WHEREAS, it was brought to the attention of the Board that pursuant to the Weld County Zoning Resolution Chapter 3. 3(8) USES PERMITTED IN THE "A" AGRICULTURAL DISTRICT, "gravel pits, quaries and open mining operations are subject to approval as to location by the Weld County Planning Commission . . . , " and WHEREAS, by Resolution dated December 15, 1971, the Weld County Planning Commission did approve said excavation operation. NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that because the application of W. D. Farr to locate an excavation operation on the premises indicated above was approved by the Weld County Planning Commission pursuant to Chapter 3. 3(8) of the Weld County Zoning Resolution, the Board has no jurisdiction to hold said 720:3 1# meeting as advertised and the matter is dismissed. SUBJECT: Indianhead Subdivision DISCUSSION : Mr . Lorenson stated he had prepared a letter and a list of requirements for a Planned Unit Deveropement as requested by the County Commissioners . Mr. Lorenson stated from the staff' s viewpoint ,' the less number of people in the area the better. 737 SUBJECT : Larimer County Planning Commission request for recom- mendation regarding the preliminary plat of Powder Horn-Frontier. DISCUSSION : Mr . Simpson stated the plat has been reviewed by the Utility Board of "Larimer County and found there were so many questions unanswered they took no action. It is split by two different school districts , it is served by a fire district out of Windsor, it has to be served by Loveland-Ft. Collins Water District by a minimum of an 18" water line for which they have not contracted to build nor have they obtained the necessary Big-T water agreement they also have to sign an agreement to build a sanitation plant on the Poudre river , construct the nec- essary water mains , in addition to all the necessary facilities dedication . If they incorporate into a city , dedication of the necessary facilities for a police department , fire department city hall etc . will be necessary. MOTION : By Mr. Nix to recommend the plat be tabled as they have not met the requirements of the Utility Board and of insufficient information . Second by Mr . Anderson . A unanimous vote of "Aye" Motion carried . Honstein , Dave Hergert , Melvin Schmunk , Richard Nashland and Carl Winter Jr. DISCUSSION : Mr. Bowles read the recommendation of the staff for denial . Approved by the Health Department. Poses a problem because of the nearness of homes to the proposed feeding operation . Petition signed by surrounding property owners opposing the oper- ation was presented . Mr. Bragdon stated he felt it is an ideal location , the soil type and drainage are excellent. Mr. Bowles stated it appears most of the objection is regarding the odor from this size feed lot. It was brought out that there are other feeding operations in the area . Mr. Honstein stated he under- stood there were to be approximately 200 head of cattle and pos- sibly some for grazing . If he had known there were to be 2500 head of cattle and 15 ,000 head of lambs he would not have signed the petition for approval . Mr. Hergert stated he represented the two ditches and he is concerned about the run-off into the ditches . Other persons present were opposed to the operation and were con- cerned regarding the trash from the area . MOTION : By Mr. Anderson to take the matter under advisement. Second by Mr. Clark . A vote of "Aye" by Anderson , Bowles , Clark , Nix and Watson . Motion carried . Gurtler DISCUSSION : Mr. Lorenson read some recommendations of Mr. Doke stating not enough information is available and recommended the application be tabled . Mr. Gurtler stated the hours and rules and regulations are set by the State Game and Fish Parks Department. For every four guns that go out a guide will accompany them. They are also restricted to certain months of the year . A trained retriever will accompany the hunters . The shooting hours would be 9 , 11 , 1 and 3 o ' clock . The kennel will be for their own dogs and professionally trained dogs . There will be approximately 30 dogs at all times . Mr. Lorenson stated he felt if the gun club is governed by the Game and Fish Department, the only question is the kennel and the operation of it. He recommended it be approved since the surrounding property owners have signed the petition . MOTION : By Mr . Nix to take matter under advisement. Second by Mr. Anderson . Felt that Mr. Farr did not have de- finite plans for the rehabilitation. Mr. Bowles read a statement amending their application giving the slope ratio , the depth of the excavation , that it will be a dry pit and the rehabilitation plans . Any land fill or similar use would have to be reviewed by the Planning Commission and County Commissioners . Mrs . Casey voicedg'Kpinian regarding the dust that will be created . Mr. Bowles stated he didn ' t feel this would be a problem asthere . . will not be continous excavation and had every reason to believe it will be rehabilitated as stated in their amendment to the application . SUBJECT : State Highway Department plans DISCUSSION : Mr . Wayne Capron presented a map showing the plans of the State Department of Highways for Highway 34 from 1-25 east past Greeley. The State Heaii.h Department has approved essentially the same thing subject to implementing the plan to lower the water table level in the area and drilling a 7 to 8 ° hole in aldition to the percolation test hole on each prc;:rased sept ; c tai,k site and setting a plumbing elevation so that as future enlargement of the sue- division dictates , public sewer for this first part can be tied in to such a system. A drainage recommendation was made by NHPQ on how to lower the water table which should be follow- ed . Mr . Ewing explained the road system and the trade agree- ment on same with the County. He would like to have it shown on the plat where it will tie in with the County road . `7r. Collins explained how the drainage will be accomplished . Mr. Lorenson stated he would like to have the cost of the drainage included in the agreement to construct the street. Deyoe stated it is recommended for approval . All re- requirements have been fulfilled . The irrigation ditch in question is private and drainage into it has been okayed . Drainage report has been submitted and checked . If approved , it should be subject to the Subdivision Agreement for the construction of roadway improvements . Mr. Sears stated ile;' will have city water plus they will a11 obtain an ownership in irrigation water rights . There was discussion on hog•: the street system fits into Greeley ' s Comprehensive Plan . Mr . Deyoe stated the road agreement will be for $20 ,522 . 50 . SUBJECT: Gas inspections DISCUSSION : Mr. Deyoe read a recommendation regarding gas inspections by the County Building Inspectors . Suggested that the natth a' gas suppliers make the gas inspections and sign the card . How- ever , propane gas is a different situation and should continue to be checked by the department . Test tags to be furnished to the natural gas installers . It was agreed this would be an ir office change on new buildings . 733 y SUBJECT : Special Use Permit for Farr Farms DISCUSSION : There was discussion regarding applicants that appeared before the County Commissioners in opposition to the appli - cation and were not permitted to be heard . The attorneys de- termined that the regulations state approval by the Planning Commission is all that is necessary for this type of use . Mr . Lorenson stated Mr , Witwer has filed an amendment to the application of Farr Farms Company stating the slopes of the area to be excavated will be not less than two for one , the depth of the excavated area will not be greater than 12 feet. SUBJECT : NHPQ Proposal DISCUSSION : NHPQ are proposing to purchase 7 lots on the east side of Clubhouse Drive , directly across frnm their present build- ing . They are proposing a Transitional zone to erect a building containing 30 ,000 to 60 ,000 square feet to expand their present facility; Mr . Lorenson stated there are two home; south of NHPQ which would be directly across from their proposed building . He suggested to them rather than extend the "T" zone that far to the south , leave the 3 lots to the south as residential and expand the "T" zone to the east and south of the present "T" zone . The City would have to release the covenants before applying for a zone change . Lorenson asked what procedure should be followed when a preliminary plat is denied by the Planning Commission . The developers of Indianhead wish to go to the County Commissioners with this problem. . Larry Simpson gave a report on what will be required by the Little Thompson Water District and what the Fire Underwriters are going to require regarding fire hydrants . The Utility Board in Larimer County recommended for adoption that a minimum fire underwriting requirement for fire pro- tection be required in all subdivisions . This includes 6" water mains , 500 gal per minute capacities at adequate pressures for the fire trucks . In an effort to protect insurance rates throughout Larimer County , an effort is being made to have adequate fire protection . Mr . Telep recommended the proposed subdivision be presented to the Regional Planning Commission . Mr. Billings stated the County Commissioners have informed the developers they would not approve the development for one-half acre lots without adequate water total subdivision , adequate sewer for the total subdivision , package sewer plant , all roads in according to county specifications , (asphalt , curb and gutter) and the utilities installed according to the Utility Board ' s requirements . This would have to be a Planned Unit Development requiring a zone change. Mr. Lorenson sug- gested the Planning Commission send a resolution to the County Commissioners suggesting the action the Commissioners take on the preliminary plat. They would like the cooperation of the Planning Commission on a moratorium, Mr . DISCUSSION : Mr. Lorenson discussed a proposed agreement for Sub- divisions for the improvements in the form of a bond , cash , certified check , a letter of credit or a note . Eichhorn stated a group of individuals are interest- , ed in developing an area approximately 2 miles north of Erie . This would be a non-profit organization of persons owning their 709 own planes . Lots would be platted for their homes with an air strip for landing . In choosing the location , they had to consider prevailing winds and proximity to existing control zones and airways . The area is not prime agricultural land . The smallest lot would be 2'- acres , the total area is 160 acres . About 30 acres will be in common ownership . The air strip would be paved . Mr . SUBJECT : Poudre River - Trout Unlimited APPEARANCE : Walker Miller , George Brooks and No Lindhauer , Bill cell . DISCUSSION : Mr . Miller stated that during the past year studies of the water in the Poudre have been made to determine the ouality of the water of which there are indications of pollution and stream channel disturbance or destruction . Their findings show that the riverwould support trout . The river is more polluted as it nears Greeley. Mr . Miller requested funds , equipment and material from the County to continue the efforts of Trout Unlimited to improve the water quality of the Poudre . He also requested that the County do all it can through planning , zoning and regulations to prevent pollution of the Poudre . He expressed the interest of Trout Unlimited in participating in any studies and efforts by the County and other governmental agencies to im- prove the water quality of the Poudre to the point that it can support trout . The Planning Commission decided to present a resolution to the Board of County Commissioners supporting the efforts of Trout Unlimited . Farr for excavation approval Docket No. 74 Gentlemen: It is necessary that I write on this matter since I must be out of town the day of the Public Hearing. I am directly concerned with this application as an owner of the Colony Park Project Planned Unit Development, approved by the Board of Commissioners last August, which development is adjacent on the west to the property as described in Mr. Farris application. In as much as (1) , the Colony Park Development will constitute a multi- million dollar permanent investment in Weld County; (2) , the emphasis of the Development is on family housing; (3) , great time and expense has already been expended, with literally hundreds of thousands yet to be spent, in providing the atmosphere and the ammenities within this development to insure full comfort and pleasure of the future residents; (4) , the Colony Park Project has been in careful planning on a co-ordinated basis with the concerned officials of Weld County and the Town of Evans for the past eighteen months; I, therefore, feel the questions here put forth merit the full attention of all concerned with this application by Mr. Farr. 1. The very act of developing Colony Park will cause the value of land surrounding this Development to appreciate considerably. This appre- ciation will make it possible to redevelop these surrounding lands in such a manner as would be compatible with Colony Park. The redevelop- ment would remove marginal and undesirable uses now existing on these lands. Question: Would an excavation operation planned for several years duration be consistent with the indicated development for the area? FARMS-RANCHES, BUSINESSES, HOMES, APPRAISALS January 15, 1972 -2- 2. Greeley's and Weld County's master road plan requires that 23rd Avenue will ultimately be extended southward and across the Platte River as an arterial. Question: Will adequate Right of Way be reserved for construction of this arterial extension when it becomes needed? 3. The Town of Evans is presently considering new„treatment facilities west of U.S. highway 85 to serve Evans' residents in the more westerly portion of that community, along with the newly developing areas west of the present Town Limits, one of these newly developing areas being Colony Park. Question: Will land for public utility easement purposes be reserved along all outer boundaries of the subject excavation site? 4. The soils in this area are highly unstable from the standpoint of wind and water erosion. Question: Assuming that so long as excavation is in progress, which process I understand will take several years, what are the plans by the Petitioner for controling objectionable dust which would likely originate from this site? 5. Because of Colony Park and another near-by development, which I understand is now in planning, substantial new population will generate within the immediate area in the ensuing one to five years. Question: I understand that the ultimate excavation may involve a pit about twenty feet in depth. What security from a safety standpoint does the Petitioner plan to provide through fencing and/or constant on-site supervision? I neither oppose nor support the subject petition. I do, however, feel each of the above questions bear importantly on the develop.-ent of the area in question. If you concur, I will appreciate the Petitioner being requirec to take such actions as will insure the proper positive performance as regards these potential problems.
