RESOLUTION
WHEREAS, a public hearing was held on March 11, 1974, in the
chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing a petition of Theo J. Rademacher, Route 1,
Longmont, Colorado, requesting a change of zone from "A" Agricultural
-� District to "C" Commercial District, Planned Unit Development, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the change of zone, and
WHEREAS, The Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request of petitioner and studied the recommendations of the Weld County
Planning Commission as submitted, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petition of Theo J. Rademacher, Route 1,
Longmont, Colorado, for change of zone from "A" Agricultural District
to "C" Commercial District, Planned Unit Development, said area being
more particularly described as follows:
That portion of the Northwest Quarter (NWT'-) of Section
Twenty-Six (26), Township Three (3) North, Range
Sixty-eight (68) West of the Sixth P. M. , Weld County,
Colorado, being more particularly described as follows:
Beginning at the North Quarter Corner (N1Cor) of said
Section 26, and considering the North Line of the North-
west Quarter (NW 4) of said Section 26 as bearing South
89° 25' 00" West with all other bearings contained herein
being relative thereto;
Thence South 89° 25' 00" West along said North line,
742. 68 feet to the True Point of Beginning; Thence South
00° 13' 00" West, 1319. 97 feet; thence South 89° 25' 10"
West, 528. 08 feet; Thence North 00° 13' 00" East,
1319, 94 feet to a point on the North line of the Northwest
Quarter (NW+) of said Section 26; Thence North 89° 25'
00" East along said North line 528. 08 feet to the True
Point of Beginning; Said described parcel contains
16. 000 acres, more or less, including a strip of ground
40 feet in width along the North side for State Highway
right-of-way purposes,
is hereby granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2, All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the zoning
resolutions of Weld County, Colorado.

3, That said change of zone herein granted is conditional only for
a period of twelve months from date hereof, on condition that developer
proceed with due diligence to begin development of the area rezoned and
submit plans for such development for the approval of the Weld County
Planning Commission and subsequent recording of said plans in the office
of the County Clerk and Recorder of Weld County, Colorado; and that
major construction shall commence thereon within said twelve month
period; otherwise, the County may take action to rezone the property to
its present classification.

Reasons for Approval :
•
It agrees with Weld County Comprehensive Plan as stated
on pages 48 and 61 : (a ) Page 48(2 ) , "The expansion and develop-
ment of agri -business and agriculturally oriented industry will
beencouraged , provided these enterprises do not adversely affect
the total economy or environment . " ( b ) Page 61 (2 ) , "Commercial
development designed to serve the agricultural base of the county
should be located wherever practical within a municipality ;
however , whenever distance from a municipality makes this an
impractical or unprofitable establishment of such commercial
service , facilities within easy access to each agricultural area
will be encouraged . " ; Utility Board recommends approval and
State Highway Dept . has no objections to the rezoning application .

Dear Burman:
We have reviewed the rezoning application Case #2-234:73:24 (Theo Rademacher)
and have no objections to the rezoning application. However, in reviewing the
preliminary layout of the development plan, we note that there is presently 80
feet (40 feet from centerline) of -right of way on S.H. 66. In checking the traf-
fic volumes along the -section of S.H. 66, we note that the minimum right of way
required for the future improvement of S.H. 66 would require _atotal of 150 feet
of right of way (75 feet from centerline) . This would indicate the need for an
additional 35 feet of right of way that should be taken into consideration either
by reservation, set-back, or dedication. This would be above and beyond that re-
quired for any -provisions for a frontage road.
The preliminary layout does not show the provisions for drainage which we
would like to review when the final plans are submitted for this _development.
Also, we would like to make a field check of the proposed point -of access onto
S .E. 66 as actual conditions of sight distance may indicate that this access
point should be located on the east side rather than the west side of the develop-
ment.
