The proposal has been reviewed on behalf of the Weld County Department of Public Works and the
Department of Planning and Zoning. Staff comments made during this phase of the application process
may not be all-inclusive, as other issues may arise during the remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site -Specific Development Plan and Use by Special Review Permit for a Solar Energy
Facility (SEF) outside of subdivisions and historic townsites in the A (Agricultural) Zone District.
This project is north of and adjacent to CR 66 and is east of CR 47.
Parcel number: 080324000009.
Access is onto CR 66.
ACCESS
Development Review has reviewed the application materials related to access.
The proposed access for the SEF is onto CR 66 at an existing unpermitted access point for oil and gas tank
battery. Reaching this access point involves using the driveway within the oil and gas tank battery
easement.
The parcel appears to have one other access onto CR 66 at an unpermitted location on the southeastern
corner of the property.
An access permit shall be obtained for the proposed SEF access location onto CR 66.
Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We
strongly encourage you to discuss your access location with Development Review prior to laying out your
site plan. All "preliminarily approved" accesses are subject to change during the access permitting process.
Per Sec. 24-8-40, when feasible, there shall be no net increase in the number of accesses to a public road.
Minimum access spacing widths are shown in Weld County Code Sec. 8-14-30. Please refer to Chapter 8
of the Weld County Code for more information regarding access.
ROADS AND RIGHTS -OF -WAY
CR 66 is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate
and label on the site map the future and existing right-of-way (along with the documents creating the existing
right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated.
Pursuant to the definition of setback in the Weld County Code, Sec. 23-1- 90, the required setback is
measured from the future right-of-way line. Be aware that physical roadways may not be centered in the
right-of-way. This road is maintained by Weld County.
Per, Sec. 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be
occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way
or easement. Right -of -Way Use Permit instructions and application can be found at
https://www.weldgov.com/departments/publicworks/permits/.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
No recent traffic counts are available for this portion of CR 66.
Traffic information submitted with the application materials indicates that construction traffic will be 25
roundtrips per day of which 5 may be heavy duty trucks and that the operation traffic would be 4 vehicle
roundtrips per year.
No additional traffic information is needed.
TRACKING CONTROL
Tracking control is required to prevent tracking from the site onto public roadways. For access to paved
roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For
access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road
base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction
unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not
allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior
to entering publicly maintained roadways. A variance request for alternatives to the tracking control
requirement can be submitted to Development Review for review and consideration.
This site requires approved tracking control during construction.
ROAD MAINTENANCE AGREEMENT (Construction)
Development Review is requesting a Road Maintenance Agreement for Construction including, but not
limited to, dust control and damage repair to specified haul routes.
Improvements/Road Maintenance Agreement: An example agreement is available at:
https://www.weldgov.com/Government/Departments/Planning-and-Zoning/Development-Review .
It will detail the approved haul routes and include a maintenance agreement for the haul routes.
DRAINAGE REQUIREMENTS
This area IS within a Non -Urbanizing Drainage Area: Non -Urbanizing Drainage Areas typically require
detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON -
URBANIZING areas.
The applicant has submitted a preliminary drainage report. An acceptable final drainage report and a
Certificate of Compliance shall be submitted. Both shall be completed by a professional engineer licensed
in the State of Colorado.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
CONDITIONS OF APPROVAL
A. A Road Maintenance Agreement (Construction) is required at this location. Road maintenance
includes, but is not limited to, dust control and damage repair to specified haul routes during
construction. (Development Review)
B. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional
Engineer registered in the State of Colorado is required. (Development Review)
C. The USR map shall be amended to delineate the following:
1. CR 66 is a gravel road and is designated on the Weld County Functional Classification Map as an
local road which requires 60 feet of right-of-way at full buildout. The applicant shall delineate and
label on the site map the future and existing right-of-way (along with the documents creating the
existing right-of-way) and the physical location of the road. All setbacks shall be measured from
the edge of right-of-way. This road is maintained by Weld County. (Development Review)
2. Show and label all existing access points onto CR 66 and the usage type(s) (Agriculture,
Residential, Commercial/Industrial, or Oil and Gas). Development Review will review the access
locations as a part of the plan submittal. (Development Review)
3. Show and label the drainage flow arrows. Show and label the accepted drainage features.
Stormwater ponds should be labeled as "Stormwater Detention, No -Build or Storage Area" and
shall include the calculated volume. (Development Review)
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Planning Department has reviewed the referral and surrounding
property owner comments. The Early Release Request may or may not be granted depending on referral
comments and surrounding property owner concerns. Contact an Engineering representative from the
Development Review for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
Prior to Construction:
A. The approved access and tracking control shall be constructed prior to on -site construction.

B. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off -site tracking. (Development Review)
3. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire
an approved Right -of -Way Use Permit prior to commencement. (Development Review)
4. The Property Owner shall comply with all requirements provided in the executed Road Maintenance

Environmental Health Services has reviewed this Site -Specific Development Plan and Use by
Special Review Permit for a Solar Energy Facility outside of subdivisions and historic
townsites in the A (Agricultural) Zone District.
As no employees will be located at the site, permanent water and sewer is not required.
Screened portable toilets, hand washing units and bottled water can be utilized during
construction. A dust abatement plan was submitted which indicates water will be used during
construction and revegetation or chemical methods will be utilized during operation. Sheep,
miniature cattle, or chickens will be utilized for vegetation control. A noise study was
completed by TRC Companies, and it was determined that based on typical solar energy
facility equipment, it is expected that the noise levels from the project facility will comply with
the Weld County Noise Ordinance and state statute requirements.
Environmental Health Services recommends the following requirements are incorporated into
the permit as development standards:
1. During construction, all liquid and solid wastes (as defined in the Solid Wastes
Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. During construction, no permanent disposal of wastes shall be permitted at this site.
This is not meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.

3. During construction, waste materials shall be handled, stored, and disposed in a
manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and
other potential nuisance conditions. The facility shall operate in accordance with
Chapter 14, Article 1 of the Weld County Code.
4. Fugitive dust and fugitive particulate emissions shall be controlled throughout the
duration of construction and operation of the facility.
5. During construction, adequate toilet facilities and handwashing units shall be provided.
Portable toilets shall be serviced by a cleaner licensed in Weld County, contain hand
sanitizers, be screened from public view, and removed when construction is
completed.
6. The facility shall comply with the Air Pollution Emission Notice (A.P.E.N.) permit
requirements as stipulated by the Air Pollution Control Division, Colorado Department
of Public Health and Environment, as applicable.
7. The facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S.
8. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

The Staff of the Weld County Oil and Gas Energy Department (OGED) appreciates the opportunity to
comment on the captioned planning case. Staff has completed review of the proposal and have no
conflicts with the proposed activity. We have included additional comments below:
1. There are no active or proposed 1041 WOGLA Permits on the associated parcel. There are
several oil and gas well sites in the area surrounding the parcel.
2. The parcel does not include active oil and gas wells.
3. The parcel includes one three (3) plugged and abandoned (PA) well listed in Table 2 below.
Additional information regarding these plugged and abandoned wells is available from the
Colorado Oil and Gas Conservation Commission (COGCC). OGED recommends that the
Applicant review this information and contact the responsible operator regarding well
infrastructure that may have been abandoned in place prior to conducting operations in
proximity to the wells.

Dear Ms. Lorenz,
Thank you for the opportunity for Colorado Parks and Wildlife (CPW) to comment on Cloudbreak
Energy Partners, LLC's (CBEP) proposed Darling Ranch Solar Project. It is our understanding that
this Solar Project would be at most 56.8 acres to produce 7.22 megawatts of alternating current
(MWac), and is currently slated to begin construction in the second (2"d) quarter (April 1St -June
30th) 2023 with a Commercial Operation Date (COD) of second (2"d) quarter (October 15t_
December 31st) 2024.
CPW appreciates that CBEP and TRC have initiated early consultation with CPW because it can
lead to a responsibly -developed project that works toward achieving state solar goals1 while
protecting sensitive wildlife species, habitats, and time frames. We recognize renewable
energy development is important to meeting the State's greenhouse gas reduction goals and
improving our climate resiliency.
The mission of CPW is to perpetuate the wildlife resources of the state, to provide a quality
state parks system, and to provide enjoyable and sustainable outdoor recreation opportunities
that educate and inspire current and future generations to serve as active stewards of
Colorado's natural resources. CPW has a statutory responsibility to manage all wildlife species
in Colorado; as such, we encourage protection for Colorado's wildlife species and habitats
through responsible energy development and land use planning. One way we achieve this goat
is by responding to referral comment requests, as is the case for this project. CPW encourages
developers to afford the highest level of protection to Colorado's High Priority Habitats (HPHs)2.
HPHs are defined as sensitive wildlife habitats where CPW has sound spatial data3 and

scientifically -backed best management practice recommendations to help developers with the
siting process to minimize any impacts.
RECOMMENDATIONS FOR THIS PROJECT
CPW appreciates that this Solar Project is located entirely outside of HPHs. Therefore, CPW
encourages the following recommendations for this Solar Project to avoid and minimize their
impact on these likely occurring wildlife species:
• Pre -construction Nesting Surveys
O Please complete pre -construction nesting bird surveys in the disturbance areas
(panels, layout yards, access roads, transmission lines, etc.) for the following
species and send us the results prior to construction:
■ Burrowing Owls4 (if prairie dog towns are present) between March 15 to
August 31.
■ Tree and ground -nesting raptors5 - if construction begins between
December 1 to July 15 (depending on the species observed).
■ Migratory songbirds - if construction begins between April 1 to August 31.
• Fencing
O Minimize fencing to the maximum extent practicable, and use wildlife -friendly
fencing6 as much as possible.
O For specific wildlife exclusion fencing specifications around the Solar Project,
CPW recommends that any installed fencing should be eight feet in height, have
round -capped posts (e.g., so wildlife isn't impaled), smooth top wire to the fence
(e.g., no top barbed wire) (or if two top strands are needed, ensure they are at
least six inches apart). The bottom wire can be barbed but should be four inches
or less from the ground.
O Also, CPW recommends that other non -security fencing in the immediate vicinity
is removed to the extent practicable and with landowner consent.
O CPW recommends that the solar facility is checked weekly (or escape structures
are installed inside the fenced area) to allow deer to escape if one becomes
trapped within the facility.
• General habitat recommendations
O Avoid development near mapped streams and wetlands.
O Develop a noxious weed management plan prior to construction and regularly
implement it so noxious weeds do not spread to adjacent habitats.
O Please use CPW's restoration seed mix for mule deer HPH (with landowner
permission) (we can email it to you separately if desired).

Dear Mr. Ogle:
We have reviewed the above referenced application for a Site Specific Development Plan and
Use by Special Review for a Solar Energy Facility. The submitted material does not qualify as a
"subdivision" as defined in section 30-28-101(10)(a) of the Colorado Revised Statutes ("C.R.S.").
Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to
county planning directors, this office will only perform a cursory review of the referral information
and provide informal comments regarding the proposed water supply. The comments do not state an
opinion on the adequacy of the water supply plan for this project or the ability of the water supply
plan to satisfy any County regulations or requirements, and cannot be used to guarantee the physical
availability of water.
The application seeks to construct a community solar garden on a 78 -acre parcel located
northeast of Greeley, Colorado. The community solar garden will cover approximately 60.59 acres.
The site has historically been used for irrigated agriculture and oil and gas production. The site also
contains two single-family dwellings and multiple outbuildings. The community solar garden will
replace the irrigated fields, but the dwellings and oil and gas infrastructure is proposed to remain.
Construction is anticipated to last for up to half a year, during which time up to 50 workers may be
on -site at a time. Maintenance crews of 2-4 people will visit the site approximately twice a year once
construction has been completed. In addition, a maximum of 500 sheep or mini cows will be used at
the site for vegetation management, tended by a small group of shepherds. This site will be one of
many fields the flock of sheep will rotate between.
Bottled water and portable toilets will be provided for workers during construction. The
application states that water for dust mitigation will be brought in from an external source. Any
water used for dust control purposes must be obtained from a source permitted or decreed for such
uses, such as a water hauling company or bulk municipal tap.
The application states that the properties existing water rights will be utilized for the grazing
animals as well as to provide drip irrigation for the native seed mixture. According to records
available to this office, the property has historically been irrigated with water from the Greeley No.
2 Canal and water from a well registered under permit no. 10675-R. The Greeley No. 2 Canal is an

acceptable source of irrigation water provided that the property owner has shares or rights that
entitle them to the use of water from the ditch. Well permit no. 10675-R was decreed in Division 1
Water Court Case no. W-3558 as the Anderson Well No. 2-10675 for the irrigation of 80 acres in the
E1/2 of the SW1/a of Section 24, Township 6 North, Range 65 West, 6th P.M., which matches the legal
description of the subject property. The Anderson Well No. 2-10675 is included in the Lower Poudre
Augmentation Company, the New Cache la Poudre Irrigating Company, and the Cache la Poudre
Reservoir Company augmentation plan decreed in case no. 04CW0025. The well may continue to be
used for irrigation purposes in accordance with the terms and conditions of its well permit and
decree(s). Under the terms of the decreed augmentation plan, drip irrigation is assumed to be 100%
consumptive. The well owner is responsible for coordinating with the Lower Poudre Augmentation
Company, the New Cache la Poudre Irrigating Company, and the Cache la Poudre Reservoir Company
to ensure that depletions from the well are being accounted for appropriately since this would be a
change in irrigation practice (from flood irrigation to drip irrigation). Neither the Greeley No. 2 Canal
nor Anderson Well No. 2-10675 are decreed for the watering of domestic animals or livestock, and
cannot legally be used to supply water for grazing animals at this site.
The application states that the property has a well that will meet the property's water needs
during the non -irrigation season. According to records available to this office, this property is served
by an existing well with permit no. 328581. Well permit no. 328581 allows the use of water from the
well for ordinary household purposes inside two (2) single family dwellings, fire protection, the
watering of domestic animals, poultry and livestock on a farm or ranch, and the irrigation of not
more than one (1) acre of home gardens and lawns. Well permit no. 328581 would be an acceptable
source of water supply for grazing animals at the site.
The existing storm water flow characteristics of the site are expected to remain unchanged,
therefore no stormwater detention facilities are proposed as a part of this project. The application
proposes to install two grass swales. All water collected by any swales must be released to the
stream system or have infiltrated into the ground within 72 hours, otherwise the applicant will need
to obtain a substitute water supply plan or plan for augmentation to make replacements for
evaporation.

CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit does not
ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking
relief in a civil court action.
2) Construction details for this existing well have not been provided to this office; therefore, it is not known if the construction of
this well is in compliance with the Water Well Construction Rules, 2 CCR 402-2. The issuance of this permit does not relieve the
well owner of responsibility or liability in the event contamination of the groundwater source results from the construction or
use of this well, nor does the State Engineer assume any responsibility or liability should contamination occur.
3) The date of first beneficial use, as claimed by the applicant, is March 1, 1950.
4) This well is recorded and permit approved in accordance with CRS 37-92-602(5) for historical use as indicated herein and
described in CRS 37-92-602(1)(b), being a well producing 15 GPM and used for ordinary household purposes inside two (2) single
family dwellings, fire protection, the watering of domestic animals, poultry and livestock on a farm or ranch, and the irrigation
of not more than one (1) acre of home gardens and lawns.
NOTE: The uses identified in condition #3 above are based on the Applicant's written claim regarding the historical use of this
well prior to May 8, 1972. These uses have not been verified or confirmed by field inspection from DWR staff. Any expanded use
of this well occurring on or after May 8, 1972, or any use that had been abandoned by 10 or more consecutive years of non-use,
shall not be covered by this permit.
NOTICE: This permit has been approved with a change to the permit application as submitted by the applicant. The applicant
clarified that the well has historically served two dwellings and was also used for the watering of livestock. You are hereby
notified that you have the right to appeal the issuance of this permit, by filing a written request with this office within sixty
(60) days of the date of issuance, pursuant to the State Administrative Procedures Act. (See Section 24-4-104 through 106,
C.R.S.)

Public Service Company of Colorado's (PSCo) Right of Way & Permits Referral Desk
has reviewed the documentation for Darling Ranch Solar Project. Please be aware
PSCo owns and operates existing underground electric distribution facilities along the
north property line and overhead electric distribution facilities along the south property
line. The property owner/developer/contractor must complete the application process for
any new electric service, or modification to existing facilities via
xcelenergy.com/InstallAndConnect. It is then the responsibility of the developer to
contact the Designer assigned to the project for approval of design details.
For additional easements that may need to be acquired by separate document for new
facilities (i.e. transformer), the Designer must contact a Right -of -Way and Permits
Agent.
As a safety precaution, PSCo would like to remind the developer to call the Utility
Notification Center by dialing 811 for utility locates prior to construction.
