RE: EXPRESSION OF OPPOSITION TO PROPOSITION HH
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Senate Bill SB23-303 was signed by Colorado Governor Jared Polis on
May 24, 2023, and
WHEREAS, SB 23-303 requires "Proposition HH" ("Prop HH") to be on the November
2023 statewide General Election ballot, and
WHEREAS, the passage of Prop HH would trigger conditions within SB23-303,
authorizing the State of Colorado to circumvent the provisions of Colorado Constitution Article X,
Section 20, known as "The Taxpayer's Bill of Rights" or "TABOR," and
WHEREAS, TABOR, if allowed to work properly without being circumvented by SB23-303,
provides the tax relief desired by Colorado taxpayers, as authorized by the voters of Colorado in
1992, and
WHEREAS, the TABOR refund was never intended to be used for the purpose of
backfilling the loss of revenue to local governments caused by the property tax reductions of
SB23-303, which would be triggered by the passage of Prop HH, and
WHEREAS, the backfilling would not benefit most local governments in Weld County
because SB23-303 prohibits backfilling once the local government's assessed property valuations
are twenty percent greater than they were on January 1, 2022, and
WHEREAS, Prop HH does not restrict the General Assembly in future years from
changing the use of the excess revenues to some purpose other than backfilling the loss of
revenue to local governments caused by the property tax reductions of SB23-303, and
WHEREAS, to obtain the "Primary Residence Real Property" or "Qualified -Senior Primary
Residence Real Property" tax reductions set forth in SB23-303, the property owners would be
required to disclose their Social Security Numbers (SSNs) to the Assessor, who would then be
required to disclose those SSNs to the Colorado State Registrar, and
WHEREAS, such disclosure of SSNs risks unauthorized disclosures to the detriment of
the property owners, and

WHEREAS, the Board supports the efforts of the Petitioners in the case of Steven Ward,
et. al., vs. State of Colorado and Jen Griswold, Denver District Court Cas No. 2023 -CV -31432.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Board hereby expresses its opposition to Proposition HH for the
reasons stated above.
BE IT FURTHER RESOLVED that the Board encourages the voters to vote "No" on
Proposition HH in November, 2023.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 5th day of June, A.D., 2023.
