RESOLUTION
WHEREAS, a public hearing was held on Wednesday, September 21,
1970, at 2:00 P. M. in the chambers of the Board of County Commissioners
of Weld County, Colorado, for the purpose of hearing four petitions of
College Green, Inc. and Country Club Acres, Inc. by Jake Pfleiger, Vice
President of both corporations, 918-11th Avenue, Greeley, Colorado,
requesting four changes of zone from "E" Estates District to the following
districts, to-wit:
1. Business District, Unit Development;
c.
2. High Density District, Unit Development;
3. Residential District, Unit Development;
4. "E" Estates District, Unit Development;
• in accordance with official development plat and plan, copy attached, to be
recorded in the office of the Weld County Clerk and Recorder, and
WHEREAS, the petitioners were present, and
WHEREAS, there was no opposition to the changes of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request of the petitioners and studied the recommendations of the Weld
County Planning Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petitions of College Green, Inc. and Country
Club Acres, Inc. by Jake Pfleiger, Vice President of both corporations,
918-11th Avenue, Greeley, Colorado, for changes of zone from "E"
Estates District to the hereinabove mentioned districts, unit development,
said area being more particularly described as follows:
A tract of land located in the West Half of Section 11, Township
5 North, Range 66 West of the Sixth Principal Meridian, Weld
County, Colorado and being more particularly described as
follows:
Beginning at the North Quarter corner of said Section 11,
and considering the North line of the East Half of the

As per the request of the Count*l Commissioners, a joint meeting was
held November 17, 1970 in the Greeley Council chambers to discuss
the drainage of Country Club Acres with the presence of the Greeley
Planning Commission, the Weld County Planning Commission, the Greeley
engineer, the Weld County engineer and the engineer for the developer
-and myself. Mr. Eberhardt presented a letter stating that the drainage
report of the developer is an acceptable solution to the problem and
the letter was signed by both the Director of Public Works and the
City Manager of Greeley.
Action was taken by the Greeley Planning Commission to accept the
solution and the letter has been sent to your office confirming the
action. Mr. Ewing, the County engineer, stated no objections and has
been requested to provide a memo to this effect to be sent to your
office. The Weld County Planning Commission did not have a quorum
present, but the three members that were present reaffirmed. their pre—
vious acceptance of the drainage plan after reviewing the new drainage
report.
It is my recommendation that the County Commissioners do accept the
drainage report as a solution, and that the rezoning be granted subject
-to the official Planned Unit Development being finalized before recording
by the -County Clerk. I also recommend that the drainage report be
considered as a part of the official development plan.

Gentlemen:
The Northwest Quarter (NA) of Section Two, Township Five North, Range
66 West, located on the North side of 4th Street and lying 1/2 mile north
• of the Country Club, is owned by Mary Priscilla Murphy and Janet Lucille
Sampson, as to the westerly portion, and by Roma Mason as to the easterly
portion. I am acting as agent and attorney-in-fact for Mrs. Murphy and
Mrs. Sampson, and have discussed with Mr. Mason our mutual problem of the
encroachments on this property incident to the• diversion into housing and
urban use of the areas lying in elevation above, and located to the South
r '
and Southwest of this .land.
On the boundary between the Murphy-Sampson and the Mason lands is a
depression in the ground, which in irrigation season carries off some
quantities of agricultural tail water and in times of rain carries off
flood waters, and discharges these waters into the Greeley No. 3 ditch.
( • A geological survey or any contour map of the area will disclose the
drainage area into this depression carries waters primarily lying just
F• northerly of the Country Club, and just a small area west of the Country
Club. The present slope of the terrain will not drain into this depression
any areas east of the West boundary of the Plumb land. In other words, all
lands in the East Half of said Section Two drain to the east, and only lands
West of the center of Section Two drain into this depression between the
Murphy-Sampson and the Mason lands.
A complicating factor is that there is no ditch, waste-way or depression
north of the Greeley No. 3 ditch to discharge. waters into the• Poudre River
from the point where the depression runs into the Greeley No. 3 ditch.

Realizing the inevitability of some change of use from agricultural
of the Murphy-Sampson and Mason lands, it was considered prudent to call
to your attention this storm-drainage or run-off problem which will arise
when a more intense use involves the lands drainirw into this depression.
To avoid damage due to silting in the depression, Mr. Mason and the oper-
ator of the Murphy-Sampson lauds have always had eonstant problems with
maintenance of the water carrying facilities in the depression, and it
. would be nearly impossible to expect some developer to assume the added
burden of maintenance of the water carrying facilities in the depression
• occasioned by the increased burden of the water carrying facilities due
to the increased run-off from the development.

Although no actual developments have been commenced in the actual
drainage area, caution must be exercised that no new areas not now so
draining, are drained into the depression from the East Half of Section
Two. Prior to any developments in the drainage area, advance planning
should be undertaken to work out this storm drainage problem before it
imposes an unfair burden on the Murphy-Sampson and Mason lands. It ha:;
recently been announced that the School District may locate school
facilities within the drainage area of this depression. This letter is
written with the sole motivation of having the appropriate planning and
• zoning agencies alerted to the situation so hardship can be avoided, and
-cooperative advance planning can be accomplished.

In answer to your request on Country Club Acres drainage. It was
my feeling that the drainage consideration should be a city consideration
in as much as the city will very likely be annexing the area within a
few short years. The -city has approved the drainage study as you can
.see in the accompanying copy. The city has approved the study and
proposals.
I do not agree with the citys two year criteria, however, the
accompanying report answers their requirements:"

The drainage rep'ort dated November 1.1, 1970, submitted

has been reviewei.
The drainage study anticipates . a two year storm as
being the governing criteria . The two year storm has
been the design storm in all other areas of the City
of. Greeley for many years . The designer has figured
the storm runoff by the rational method using storm
intensity curves supplied by the Colorado Department
of Highways for the State of Colorado which are
based on actual conditions for this area .
The designer has then recommended retention ponds of
certain size which figure to be large enough for a
five year storm based on the same rainfall intensity
curves .
I recommend that the drainage recommendations be
accepted as a reasonable solution to the drainage
problems of Country Club Acres.

Gentlemen:
At your request and for presentation to the Weld County Commissioners , the
County Engineer, and the City Manager, and the -City Engineer of the City of
Greeley, Colorado, we have prepared this storm drainage renort on the
approximately 1 ,000 acre water shed presently known as the 16th Street
Drainage Basin. Previous reports have been made on this drainage basin for
the City of Greeley under a different set of conditions . A detailed report
using conditions specified and for presentation to the Federal Housing
Administration has also been prepared on this subdivision urea. The entire
water shed area has been considered in all the calculations and throughout
this report including the master .devel opment plan of the Aims College site
presently being engineered by this company.
The intent of this report is to describe in detail the anticipated storm
drainage conditions during a 2 year design storm under the existing conditions ,
and secondly, to determine and outline the steps necessary for the developers
of Country Club Estates and the -College Green subdivision -area to meet
several basic requirements as outlined by the approving agencies of -both the
County of Weld and the -City of Greeley. It is also understood that all phases
of this sub-division will be constructed in accordance with the requirements of
these governing agencies .
DESIGN CRITERIA
Recent discussions with County Officials have indicated their concern of any
development increasing storm runoff and the uncontrolled discharge of this
runoff to downstream areas . Also, _City of Greeley Officials have indicated
a present City policy in regards to storm drainage from this basin is one of
"refusal" to accept any more storm drainage from this area than would presently
run off from a 2 year design storm in the undeveloped condition . With these
conditions in mind, the rational method of storm drainage design as outlined
in the Data Book for Civil Engineers by Elwyn E. Seelye, Vol . 1 , .Sec. 18-01 to
18-02, Third Edition was used throughout the design. This method calls for a

basic equation of Q = t I A with the Toll-owing explanation:
Q = The discharge of storm water in cubic feet -per second
C = A runoff factor (The runoff factor is a coefficient that -approximates
the amount of rainfall running off a particular area and takes into
consideration various ,factors- that affect this runoff such as soils
features and -type of improvements. For this report a runoff factor
of 20 -percent was used for all land that is presently used for
agricultural purposes or is vacant. For the proposed residential
multi-family and commercial areas, runoff factors of 50 percent, 70
percent and 90 percent respectively have been used. )
I = Intensity rate of rainfall (For this study we have used a graph
presently being used by the -City of Denver. This graph shows that
for a 2 year design storm with a duration of 1 hour, the intensity
is D.E0 inches of rainfall per hour. Information from the State
Highway Design Manual and Engineering Design Manual by Seelye for
stone drainage are comparative and justify the rates shown on this
graph.)
A = The area contributing storm water runoff to a particular point
EXHIBITS
Exhibit No. 1 is a. reproduction of the U. S . Geologic-al Survey Map and shows
the drainage areas that are being considered in this report.
Exhibit No. 2 is -a -Preliminary Plat that shows the entire subdivision and has
been utilized to show more specific information as to the storm runoff concen-
trations and storm drainage facilities proposed to control the storm runoff.
EXISTING TOPOGRAPHY
The general drainage of the watershed is to the Northeast with the major
portion of the discharge running Easterly along proposed 16th Street to a
point on 35th Avenue and thence N-ortherly e.long 35th-Avenue to the Cache La
T'oudre River. The specific drainage direction of each of the areas considered
is shown on Exhibit No. 1 .
STORM DRAINAGE DESIGN
Following is an outline of the areas their location and specific affect on
stone drainage runoff as determined by a study of the U. S. Geological Survey
Topographic Maps and various field inspections.
Area A
Area A which lies in Section 15 is Southwest of the proposed subdivision and
contains -a total 203 acres. Runoff fran this area is intercepted the Grape-
vine Ditch. Field inspection reveals that the Grapevine Ditch divides within
the water shed area with approximately half of the water carrying capacity of

the Ditch being -drained Westerly with no affect on this water shed. Therefore,
we have used 102 acres as a contributory area from Area -A.
Area B
Area B containing 120 acres, lies in the Northeast Quarter of Section 15 and
the Northwest Quarter of Section 14, ,and drains directly into the proposed
subdivision area.
Area C
Area C is located in the Southeast Quarter of Section 1n, and contains 83 acres.
This is the portion of the Aims tollege site that contributes atone runoff to
this water shed.
Area D
Area D is located in the Southwest Quarter of Section 11 , contains 233 acres,
and contains most of the prop-osed Country Club Estates and College _Green
subdivision area.
Area E
Area E lies in the Northwest Quarter of Section 11 , and is located South of
U. S. Highway No. 34. There is 74.2 acres in this area and is the Northerly
portion of the Country Club Estates development.
All of the above areas are presently farm land except for a small _portion 9f
Area A in which the Highland Hills Subdivision is developing. Ito special
consideration has been given this area due to its size, location andlow
density factor.
EXISTING DRAINAGE CONDITION
Calculations used in determining the storm water runoff under the existing
conditions are shown on calculation sheet Cl . Discharge Point 1 is located on
the Easterly line of the Southwest Quarter of Section 11 and is located at the
low point of the -existing drainage swale. The proposed plan indicates that
16th Street parkway will -generally traverse this section along this existing
drainage swale. Discharge -Point 2 is at the extreme Northeasterly corner of
the proposed development. As previously mentioned, a runoff coefficient of
20 percent was used for all land in this existing drainage condition. Over-
land flow time was obtained from charts in the Data Book for Civil Engineers.
For the 2 year design storm, we have determined that at Discharge Point 1
there is 63.5 cfs of storm runoff and -at Discharge Point 2, there is 14.1 rfs
of storm runoff.

FUTURE DRAINAGE CONDITIONS FtQ AP4A D
On the basis that all future developments within the water shed will have the

same conditions of acceptance, we have considered only to accept through the
subdivision area the storm water runoff of an existing 2 year design storm.
These flows from Areas A, B, and C are calculated and shown on sheet _Cl .
Aims College (Area C) is presently proposing the construction of 5 retention
ponds on its campus along the fast Grapevine Ditch. These -ponds are to pro-
vide stor-age and control of storm water that is -being intercepted by the
Grapevine Ditch. Present plans also call for the construction of a relief
structure near the intersection of the last Grapevine Ditch and 47th Avenue.
This relief structure is being planned to have a controlled discharge of
30.6 cfs, at the intersection of 47th Avenue and 16th Street Parkway.
To provide additional protection to the downstream drainage basin, we have
made detailed calculations within the subdivision boundaries (Area D & -E) on the
basis of a 5 year design storm.
Area D will collect storm water runoff along 16th Street, and the storm water
will te controlled through a series of retention ponds with controlled dis-
charge structures for -peak flows so the runoff v-clues as shown on sheet C2
are a maximum under the design conditions . Retention pond locations and area
breakdown of -Area Dare shown on Exhibit No. 2. Calculations for this area
are shown on sheet L2.
An analysis of the retention iponds and discharge points in Area D is as
follows:

Retention Pond I
Capacity of Retention Pend I is: .
1 .26 acres x 2.5 feet (average depth) = 2.5 acre feet
3.13 acre feet x 43560 sq.ft./acre = 137,214 cubic feet
137,214 cubic feet t 3600 sec/hr 38.1 cubic feet/second
Retention Pond I has a design capacity of 38.1 cfs for a 1 hour storm duration
with an incoming flow of 1J2 cfs from Areas A, 13, C and Areas D1 , D2 and D3.
64 cfs will have tote discharged -downstream to Retention III .
Retention Pond II
Capacity of Retention Pond II is:
2.95 acres x 2.5 feet (average depth) = 7.38 acre feet
7.38 acre feet x 43560 sq.ft./acre = 321 ,255 cubic feet
321 ,255 cubic feet t 3600 sec/hr = 89.2 cubic feet/second
Retention Pond II has a capacity of 89.2 cubic feet per second fol a 1 hour
duration storm. Areas D4 and t5 contribute a runoff of 32.1 cfs to this
retention _pond leaving an excess capacity of -51.1 cfs. Presently this report
is considering this only as a safety factor and further detail study and final
drawings may provide a better balance of retention pond and controls.

We are planning a control discharge of 5 cubic feet per second from Retention
Pond II to provide -for complete drainage of this pond after the stone. The
equivalent discharge area (Column AC of the calculation sheets) for this 5 cfs
discharge is as follows:
5 cfs t 32.1 cfs x 21 acres -= 3: acres equivalent discharge area
Retention Pond III
Capacity of 'Retention Pond III is :
3.17 acres x 2.5 feet (average depth) = 7.93 acre feet
7.93 acre feet x 43560 sq.ft./acre = 345,213 cubic feet
345,213 cubic feet t 3600 sec/hr = -95.9 cubic -feet per second
Retention Pond III receives storm runoff from Retention Pond I (64 cfs) ,
Retention Pond II (5 cfs) and from Area D6 for a total -incanin?i -flow of 107 cis.
We plan on providing a discharge from this Retention Pond for the excess 11 cfs
and for an additional 34 cfs making a total of 45 cfs control discharge. For
further calculations, the equivalent discharge area (Column AC on the calcula-
tion sheet) is as follows:
45 cfs t 107.1 cfs x 133.-9 acres = 56.3 acres
DISCHARGE POINT I
Storm water runoff received at discharge point I is the control discharge from
Retention Pond III and the runoff from Areas D7 and DE. The calculation sheet
shows a total accumulation at this point of -62.8 cfs. This is approximately
equal to the existing runoff -Frain a 2 year design storm of 63.5 cfs.
PROPOSED DRAINAGE CONDITIONS TOR AREA I
This portion of Country Club {states will be developed as estate and multi-
family areas. -The stone water runoff will be collected on proposed 43rd Avenue
and carried Northerly as street flow to U. S. Highway No. 34 and thence Easterly
to Retention Pond IV. The capacity of Retention Pont IV is as follows:
1 .5 acres x 2.5 feet (average depth) = 3.75 acre feet
3.75 acre feet x -43560 sq.-ft./acre- 163,350 cubit feet
163,350 cubic feet t 3b90 sec/hr = 45.4 cubic feet per second
Calculation sheet shows that the inflow to Retention Tend IV is 53.4 cfs. We
plan on providing a controlled discharge structure to allow all the excess 3 cfs
plus an additional 6 cfs to be discharged. This total controlled discharge
equals 14 cfs which is equal to the existing discharge from a 2;year design
storm of 14.1 cfs.
According to our analysis, all storm drainage runoff from a 5 year design
storm with the subdivision area itself completely developed can be controlled

in the drainage facilities as outlined in this -report. The retention ponds
used are -the same ones as originally outlined on the Preliminary -Plat, and
utilize the irregular 16th -Street Parkway concept which provides detention
ponds and park areas.
A basic -assumption -of this report is that the upstream contributory areas will
be required -to provide similar retenti-on ponds and control structures to limit
the storm runoff to an existing 2year design store basis.
It must also -be acknowledged that there -is the possibility that a store may
occur at any -time with an intensity and/or duration that could cause greater
storm water runoff than considered in this report. Under this condition,
flooding would occur whether or not this subdivision or others in the water
shed are developed.
REC0N ENDATICNS
1. That the outlined drainage facilities be constructed as required by the
development within the specific areas and that such construction can be
controlled by the issuance of -building permits.
2. That -the City of Greeley continue to study this drainage basin and provide
any -additional storm drainage rqrotection possibl-e -that tan be made ovai Table
when -the drainage fees colleztti:•;ithin and for use within this water shed. A
projection of -the drainage fees to be collected within this subdivision are
as follows:
334 Residential Lots x $150.-00/lot = X50,100
107 Acres Non-Residential Area x $0.D2/Sq.Ft. = $93,220
Total Drainage Revenue -from Country Club
Estates and tollege _Green Subdivision Area -= $143,320
Considering the total water shed which includes all drainage basins ttest
of 35th -Avenue and contributory to drainage North along 35th Avenue, we
have an additional 750 acres projecting that 75 percent of this area will
be residential and 25 percent ca7: ercial development, we find -that _the
following revenue will be generated:
560 Acres x 3.5 Units/Acre = 1960 Residential Units x $150 = $294,000
190 Acres Co uercial or 'lulti-Family x 41560 Sq.Ft./Acres x
$0.02 Sq.Ft. _ $165,000
This combined with -the revenue gen-er-ated from the Country Club Estates -and
College Green Subdivision areas provide approximately $-600,00D to provide
drainage facilities within this water shed.

Dear Mr. Houtchens :
As per our conversation of October 12, 1970, I am notifying
you that at a meeting between the Greeley City Administration,
the County Commissioners, County Engineer, County Planning
Department, Jake Pfleiger and adjacent land holders to the
Country Club Estates project where there was a discussion of
the drainage problem that would occur by the development of
Country Club Estates. After due consideration, it was de-
termined by the County Commissioners that an additional study
would be required. Agreement is needed between the County
Engineer, City Engineer and NHP&Q as to what constitutes
proper drainage. The County Commissioners will delay any
action on approval or denial of your zoning application
until the new proposal is acceptable to the City and County.

Subject: BITTERSWEET DRAW.
This memorandum is to tall your attention to the importance -of Bittersweet
Draw as a permanent drainage facility to West Greeley.
This draw now -serves as ii -major drainage of several hundred -acres including
the new _campus Df Aims Lollece. When the campus is developed with roofs
and drives the run-off will be much larger than most laymen realize.
This is the same _drainage -facility that -passes through Hunter Heights -and
Franklin subdivisions. Past developers failed to realize the amount of
of storm water that later property owners -had to worry with.
Several large storm sewers mow cross Hunter Heights and Westwood, and
Stotts trailer court. A large holding pond is located in Franklin sub-
division.
A drainage facility from G5Lh Avenue to 47th Avenue at least sixty feet
• wi_le would not be too -much. A hol-di-ng pond just west of 35th Ave. is also
needed.
Please consider this as an important requirement when reviewingthe proposed
plat of Country Club _Estates and any other land subdivisions along
Bittersweet Draw. -

OLD BUSINESS: COLLEGE GREEN INCORPORATED
Mr. Billings: Under old business, Change of Zone for College Green,
we have gentlemen here - I might explain first that this Board will
not be making any approval of the change of zone until this has gone
throught the County and City Planning Commission and has been approved
by them. At a previous these people, the City of Greeley, found that
there was a discrepancy in how the drainage facility was going to work
out there. It is the feeling of this Board that this has to go through
regular channels to be approved, dot only the Greeley Planning Commission
but the Weld County Planning Commission and would it be possible for
those two Commissions to sit as one Board and the decision of this
might be the quickest route to get something decided. This Board will
never act on a change of zone until it has been passed through the
County Planning Commission and the County Planner and has been
approved by them. Mr. Lorensen do you have any comment?
Mr. Lorensen: Yes, I agree with some of your remarks, but necessarily
all of them, Mr. Chairman, the Planning Commission has reviewed changes
on Sixteenth Street and those changes when reviewed were supposed to
be put into Planned Unit Development. The plan itself. They haven't
done this to this point but they have been instructed to take that
type of action and I feel that the Planning Commission in reality and
in concept has reviewed what they are proposing and has approved of it.
As far as the City I can't state what action they have taken. But as
far as our Planning Commission goes they have reviewed Sixteenth Street and
the retention ponds and I felt that our only concern now was the City
brought up the problem - is there enough land set aside for the purpose
of this and so it is my contention that the Commission has taken action
on this.

Mr. Billings: What have they done as far as this 72 inch drainage
tile that is going to run from that area to the Poudre River?
Mr. Lorensen: They haven't taken any action regarding the 72 inch
tile. The proposal that is being taken or made by the developer
was that the amount of water that is run-off from that site now
would be no greater if developed and they are asing their land or
they are proposing their land be used this way to retain the water
so if the land were vacant that you would get a certain amount of
water coming down Thirty-fifth Avenue and if you develop it then
according to them and this is supposed to be verified by the City
through
and our County Engineer -/the calculations - if developed no more
water would go down there than now what exists as coming down now
on the vacant land. And I feel that the Planning Commission has
approved this - this type of concept so it would be my recommendation
not to send it back to the Planning Commission because I think they
have already made their mind clear on this.
Marshall Anderson: What kind of an agreement have you got with Stevens?
Mr. McRae: Let me say just briefly review it from the engineering
aspect after our last meeting and one subsequent to that here that
we had between the engineers involved. We had gone ahead and prepared
not a supplemental report just a separate report in regards to the
criteria established by the City and the County in regards to a
storm drainage system according to as I say the criteria established.
We have this report available unfortunately neither the County nor
the City Engineers have had any time to review this as of yet.
But briefly our discussion with the City and County
Engineer was to establish two things; (1) the existing run-off
on a two year design storm. So when we talk about storm drainage
we always have to stop at some level of analysis. As you are
familier with now we stop at a two year storm which is one that
will probably occur every two years on a frequensy basis. We
have a 10, 25, and a 50 and an infinity type of storm. Our
conclusion with the engineer is that we establish as a base load
in this drainage system a 2-year design storm which as of now
is in this undeveloped condition. That we have established

Mr.McRae: in this report at the points of discharge - two points of
discharge on this property. One at Sixteenth Street proposed - on the
east side of the larger basin and the second one at the extreme northeast
corner along Highway #34. There is a small portion of this property
at the north end that drains to the northeast corner.
In the analysis of the storm water after the area was
one
developed we again made two or made some assumptions that/all the
outlying or contiguatory areas to this property be accepted in the
same fashion that is contributing to this property - no more than
a two year storm undeveloped conditon and on that basis we analysied
the facility as proposed within the subdivision, the three detention
ponds that were exisitng, plus we proposed one additional pond that
was existing at the northeast corner.
As an additional feature or a safety factor, but really
just because the ponds were just there in size according to a larger
report. We found that the existing ponds plus one additional one
would contain the control discharge of a five year design storm in a
developed condition. The assumptions being that very little water
or exisiting water have come in. We could take care of the storm
water run-off that was generated within the subdivision in the
detention pond proposed within the subdivision and discharge on
a control basis no more than is presently running through the Stevens
farm and along the highways. Those are the points of discharge. So
our conclusion is that the developers have taken or can take according
to this concept adequate steps in the detention ponds as orginally
proposed to accomplish the purposes you laid out.
There are still a lot of questions to be answered Such as
stage development, when they are to be put in, but I thin we are reasonalbe
enough to agree that they can be put in in steps in accordance with where
the property is developed and so forth. The developers also have a
committment to make with the City in reg&rds to what these things cost,
what kind of they can get against their drainage fees
We also have a final detailed drawings on the specific structural or
pond or pipe but the basic report here , I think , has established
the fact that these developers are under this proposal actually
able to and I am sure they will agree to provide the necessary

protection on a minimum of a two and as the report states probably
a five year design storm and I think that is well within the criteria
that the City would accept on an urban design storm basis.
Mr. Billings: Burman, you haven't seen this final report have you
yet?
Mr. Lorensen: No sir, not at all.
Mr. Billings: You haven't had it with the City yet?
Mr. Eberhart: It came in this morning and I have not had a chance to
study it. It is set up right all I have to do is see what the mechanical
things on it
Mr. Billings: I think what we would do then - will you Burman and the
Planning Commission go through this report, you said you had a lot
of design,maps that need to be brought up to date - this needs to
be done and meet with the City and the City Planning Commission - get
their recommendation after you have gone through this report and then
pass on this report then we will be in a position to act on it.
Mr. Lorensen:- Then Mr. Chairman, as I understand it - you want the
Planning Commission to review this report and the new maps.
Marshall Anderson: I don't know how we can pass on:something that nobody
has seen.
Mr. Lorensen: No, I think what I was saying though is that the
Planning Commission has accepted the concept and it now lies in
the hands of the professionals and at particularly at the County
level - the County Engineer's professional opinion on whether this
will work.
Mr. Billings: I talked to the County Engineer a little while ago
and he has indicated that he has one of these reports and he has
had not had time to look at it right now.
Mr. McRae: Yesterday being a holiday it slowed the delivery service
down - the time has been at a minimum - we haven't completely revised
all the drawings, the planned unit concept, the preliminary plat.
We have been through it a couple of times and I guess we are getting
a little gun shy as to preparing all the maps and finind something
else is required or a revision is necessary. I think there are

maps available, the drainage reports is the key to the whole thing
and once the engineers and perhaps if necessary the Planning Commission
have had a chance to review it then we will proceed with getting the
paper work, the plats, the description and so forth in order.
Marshall Anderson: Does Stevens have a copy of this?
Mr. McRae: No because the report indicates br we have not designed
beyond our boundaries. Our upstream boundary and our downstream
boundary and there is no - under a five year design storm there is
no additional water put on to the Stevens farm than is presently
existing under a two year design storm. I think you would have to
accept this as a normal occurance and something that because of its
frequency is not unusual to expect. So we haven't given him one
because our report will indicate that under these criteria, there
is no particular damage to his property. The only thing I could
see of advantage to him was when he developed his property be will
be faced with the same thing. It does give the affluent to his up
stream side and he will of course be required to consider the type
and the development of his property plus the discharge on the south
side.
Mr. Billings: You have indicated that the developers would be willing
to - as this area develops - to put in adequate storm drainage. Are
you still coming back to the original report where you they are going
to run some type of storm sewer to the Poudre River because this is
going to have to be done sometime?
Mr McRae: No - well this report is based with that not in mind
the - we refer to as -the study - in this 1961 report by NHPQ - at
that time the report was prepared on a two year design storm - all
the City
basins developed. As Mr. Cruce pointed out - hasn't accepted that yet
and their preeent policy from this drainage basin is one of refusal of
additional storm waters. They are willing I guess to accept a normal
two year undeveloped conditon runoff - at that point I haven't checked
to see what the existing facility would require that. I would certainly
hope that in a brief portion of this report and the summary it points
out that there will be in the neighborhood of $600,000.00 from drainage
fees when this watershed is developed. Now a xertain portion of that

win be needed to develop the retention ponds/connecting the
control structures and so forth and how much is available to
do - to provide additional protection - we haven't gone into the
detail. We are again sticking within the boundary of our subdivision
and I am sure the City is aware of the fact that if the money is
available and the timing is right, additional protection could be
provided. It is a matter of economics.
Mr. Billings: I think - it looks to me like the best way to expidite
this is this is the right word would be for our Plahning Commission
to meet with the City Planning Commission so that the two agencies
can arrive at all the steps and will all be agreeable. So it will
be required for the City to say yes we will accept this this way
and our Planning Commission say yes we are in total agreement. I
think this running back and forth between the two agencies is not
going to get the job done on a legal basis. Do you agree with me
as far as the City is concerned?
Mr. Eberhards: Yes - I think so - But as Jerry say basically is true
and that there has been no move on the part of the City to accept
the NHPQ Report that said we had to have a 72 inch storm drain
Council
until as such a time the City/accepts this report and want to
set aside the money to construct this. I have to assume that and
so does NHPQ that this thing is not going to be built. So this
report and I do know that it is the policy of the Public Works
Committee , which is made up of the Councilmen, that the developers
take care of the run-off at the present time and do whatever is
required of them within the boundary of that area being developed.
Mr. Billings: Well then Burman, I think that you should contact the
Chairman of the County Planning Commission and the City Engineer
and set up a meeting where you can agree on any recommendations
that you might want or the County might need and if you have some
time to study this final report, then at that time, jointly with
the City and County Planning Commission come to -this Board and
make a recommendation, then set a date for the hearing. I think
we need to eliminate all the legal problems and technical problems.

It was tabled in regards to the acceptance to the drainage and
the resolving of the drainage problem.
Marshall Anderson: I think we had the hearing, Sam?
Mr. Telep: Yes but we didn't get the report - we are waiting for
you Planning Commission. We didn't get the report from your Planning
Commission - we don't have one
Marshall Anderson: We have a whole new concept - here now than we had
before.
Mr. McRae: Not in regard to planning and zoning.
Marshall Anderson: No. But I mean I am not going to vote on this until
we get it in writing from both Planning Commissions - and both
Planning Commissions agree - lets let the engineers look at this
thing.
Mr. McRae: Oh I agree.
Marshall Anderson: I am not going to ask those guys to give us an opinion
and then
Mr. McRae: No
Marshall Anderson: and then get a report this morning and then want us
to go over it an hour later.
Mr. McRae: We are just all trying to define the necessary steps
I just mention that I don't think - we have had it on the hearing
and on the zoning.
Mr. Telep: Like you say they have passed on it — because if they do
it they are going to have conditions and are -trying to resolve in
their own minds what these conditions are - what conditions there
will be.
Marshall Anderson: I don't think we need to hold another hearing - all we
need to do is find out the conditions and resolve this.
Mr. Eberhardt: You want a recommendation from me regarding the drainage.
Mr. Billings: Right.

Mr. Eberhardt: That should be addressed to the County Planning Commission.
Mr. Lorensen: Mr. Chairman, I would like to review the action of the
Planning Commission has taken - now this item has come before them
twice on this - and I would like to read the minutes of the last one
and this is Page 465 of the Weld County Planning Commission minutes
and this was on September 22, and the item would be-the subject would
be Sixteenth Street Parkway - discussion - Mr. Lorensen presented
alternate
an/proposal for the Sixteenth Street Parkway - the Country Club Unit
Development Plan. The letter from the City was read approving the
new proposal providing for drainage and park purposes. This is
designed to accomodate a 50 year flood. Motion: Mr. Watson
recommended the alternate storm drainage plan be approved. Seconded
by Mr. Anderson and the unanimous vote of Aye - Motion carried.
The only difference between the action here that has
come up is just to determine if there has been a change. I mean
the proposal and the report had some inadequacies in it - but the
concept is identically the same. Now we will go through and
represent it to the Planning Commission so that they are aware
of it but I want you to be aware to that this is the third time
it will be back to them. And that they have looked at it.
Mr. Billings: Sure, but I want you to meet with the City or both
groups so that both of you can get what you want so this does not
go back and forth. Next to the City - we want to know exactly the
Cit/'s feelings and we want to know yours. The two groups can meet
together along with the engineer and then they can come back to this
Board with the recommendation - yes we accept this - with the final
changes that have been put in here or we will require these other
additional things so that we know where we are at. I am not going
to approve something that our Planning Commission says is fine and
the day after we have approved it, the City and County
I want the answer from both of them at the same time. Is there
any other discussion on College Green?

Mr. Billings: We will call this meeting to order.

to about32nd then it goes into a fear inch and goes north. As
far as I know the City Council agreement has set this as the maximum
drainage pipe that is to be put in, therefore they have abondon this
study and that was why I wrote letter to the County Planning Commission
the County Commissioners, the City of Greeley Planning Commission and
the City Council of the City of Greeley to call their attention to
the fact that the development west of 35th was taking place and
that drainage definitely would be a problem if the matter was not
studies at this time.
I personally appreciate your concern on this
and I appreciate your calling all of us together here to discuss
it and to get something on record because I think - the mere fact
that a drainage study was made - a recommendation was made - has
been taken by some people as being, " the program", that is not
the case.
Marshall Anderson: Ben in our meeting the other day it was brought
out - as I understand it - Thirty-fifth Avenue and the bridge,
where the gulley comes in,
Mr. Cruce: That is about Thirteenth Street - somewhere
betweeen Twelfth and Thirteenth Street.
Marshall Anderson: So we know what we are talking about at that point
it picks up there with a 6 foot drainage tile.
Mr. Cruce: That is not true - this study says that -brit that
is not true.

Marshall Anderson: In other words all that is a study.
Mr. Cruce: Thats right - all this is a study and this is why
I wrote you that letter because I didn't want you to do something
and suddenly we find the old problem back on our taxes.
Marshall Anderson: That is why I think this meeting is in order.
so that we know what you people are thinking. I was under the
impression the other day after that hearing that this was already
in the making.
Mr. Cruce: I was not at that hearing it is probably a good
thing I wasn't because I might not had all the facts and since have
had a chance to look at all of this.
After this was turned down by the property owners
and the Council decided on the smaller pipe then they started looking
west
for holding ponds/of Thirty-fifth. About the time this was done
I can't recall the exact date, Mr. Stevens and I worked out an option
on a park and holding pond up to 20 acres. This was submitted to City
Council - the City Council let the option die without buying any of
the land. It was - I would say - at least five yeaars ago. So since
-that time there has no attempt on the part of the City of Greeley
to purchase land for holding ponds west of 35th. After that option
was drawn the City Council purchased what we call the Franklin
Holding Pond which is about 6 acres. This was because the Greeley
Irrigation Company, who owns Number Three Canal in Greeley and the
City of Greeley got together and protested this water being dropped
into their canal.
The holding pond at Franklin we thought was
sufficient to take care of the problem as long as the area west
of 35th was farms: The 15 inch pipe that goes down through the
subdivision and the 8 inch pipe that goes down 35th Avenue come
together at about 10th Street and 32 Avenue and then go into a
48 north and then that goes into an open ditch later on, and
then finally into Franklin Pond.

Mr. Cruces Franklin Pond is designed to hold the water back
that is going into Number Three Canal so that we don't have lawsuits
or problems with the irrigation company.
Now along this same time when this was being
studied City Council approved a plan of a drain basin which now
goes through what is what we might call the Albertson property
the old farm. This goes into a pipe of approximately
42 inch partically into an open ditch when it gets to 6th Street
and 26th Avenue it goes into 2 thirties - those 2 thirties go
down and angle over to Number Three Canal and go under Number Three
Canal a distance of approximately 5 or 600 feet in a fifty-six
inch steel pipe until they hit the drainage ditch that goes north
to the river. They go under the canal completely under their
boughs and so forth and go out into this drainage ditch to the
river. So there are really two basins and because I have had so
much trouble with the people in these areas and I can't blame
them for protesting when they get flooded. I felt that it was
very important that I notify everybody and then we would try to
develop something that would take care of this water.
Now the quantities of water are on the map
and I have been in conference with Keith on two or three ocassions
to try to determine whether or not sufficient holding ponds or
other plans are being developed. It appears that they are not,
Mr. Chairman. This I think - once we lay this thing aside I
think we should let the engineer discuss the quantities and the
recommendations to take care of this water assuming that the
tubing that is in-is it-as far as I know with the City of Greeley.
I am glad that Mr. Wells is here with Council because we talked
to George Hall this morning and we have tried to advise the City
Council of this - of what will eventually occur with the property.
Mr. Billings: Alright, probaly along these lines we should
let Nelson, Haley, Patterson and Quirk explain their proposal
for draining this area which will make a complete subdivision

Mr. Billings: if this whole area is developed, I am sure it will be,
we will be takling about 600 acres on the hillside there that
drains into that. Do you want to place the maps up here on
the bulletin board so everyone can see it.
Wayne Wells: If I might speak, City Council, In 1947 or in
1967 when I came on -Council we had a drainage problem then and
at that time I tried to fight for a 35th Avenue Drainage District.
If you go back into the record we stated a 2 million dollar project
and this is what the decision was at that time. So they dropped it
and went after the holding pond and with Franklin. Then we went
ahead back when we were on Council we went ahead with the holding
pond on 20th Street. The Houston I have always
-felt we should go out and create drainage districts and we tried that
we talked that in Hillside and got shot down real quick. Well I
didn't think it would go but everybody who drains into this area
a drainage district so even though they are not developing today
they will be in the next 10 to 15 years.
Marshall Anderson: That is what concerns this Board, -I think,
Aims College, College Green - there are about 500 acres there
I imagine that total area there would measure up between 500 and
a 1000 acres. It would be everything under the Grapevine Ditch
wouldn't it. That is the reason I think this meeting is in order
because I was under the impression that this pipeline was in the
future-, the near future, was in the feasibility study. But we
should get together and make sure the City of Greeley knew what
we were doing as well as the adjacent landowners.
The College Green people, their meaning and intent
is good. They have offered to foot a lot of this bill. But they
-are at the headwaters but what are we going to do between there
and the river. I think for the protection of everybody we should

Mr. Cruce: Marsh, over on the east side - on 1st Avenue
the big trailer park - the mobile home court - Hoffman and Brenckle
we met with them - we told those 2 people - you either must run
your own pipe all the way to the river or you develop a holding
pond and you hold the water off the adjacent property owners and
-at
let it flow into First Avenue -/a very small flow so First Avenue
will take care of it.
Marshall Anderson; There isn't a place on First Avenue.
Mr. Cruce: Well they would have to get an easement, this is
true - so they said they would put in a small pipe from Hoffman
Ar 20
all the way to the river - maybe)a 15 or 18/inch pipe but still
would fill their holding pond that would hold the water - Gordon
Brenckle property and the Max Hoffman property. This is what is
in the mill over there. In talking with George Hall this morning
George said that he felt the City and the County should try to
work out a similar arrangement to the west. Now the only pipe
they have to the west is an 18 inch pipe. Okay if that isn't
big enough somebody has to pay for it. It is as simple as that
and the City of Greeley is not going to tax themselves to drain
the water from the west side of 35th Avenue. It will have to be
-a district the property owners will have to hold the water back
as it drains into the present system. The present will not be
over taxed.
Now this may stop some growth until somebody
comes up with an answer it certainly is the situation.
Mr. Billings: Along these lines it is my understanding that
in regards to this 72 inch pipeline - it was indicated to us
that you would build probably in future not now - down 35th Avenue
to carry off all this water. It is going to have to fall off on
the developers of this property and not the City of Greeley, is
that correct?
Mr. Cruce: Thats right. Whatever size it it

Mr. Anderson: I think -these developers, Mr. Chairman, it was
their meaning and intent as proposed to us - south - there is an
area between them and where this pipeline is - the Stevens property
- Dave's not raised anything yet.
Mr. truce: Then it would be incumbent upon the -property
owners to the west, of Dave -Stevens, to hold the water so that
it goes through the natural draw and the natural way If
they increase the quantity and the flow it is their responsibility
and if Dave Stenvens get flooded it is still a metter between he
and the adjoining property owners. We are not accepting any responsibility
Mr. -Billings: Then along these line -Ben - it was brought before
us at a previous hearing that there would be an assessment on each
acres of land in this development. If the figures are correct it would
-be two percent?
Marshall Anderson: Two cents a square foot.
Audience: or per lot.
Mr. Billings: For the construction of this pipeline. Our question
definitely
then would be that it would/not be very advisable for a firm constructing
a subdivision to (1) put in a pipeline.
Mr. Cruce: I am sorry I can't hear because of the noise
behind me.
Mr. -Billings: Our thought along this line would be (1) the firm
developing this subdivision (1) first put in this drainage system to
take care of this problem which they are definitely going to create
the minute they start developing. With this price tag they are
going to put on each square Toot in the development they would Tirst
be out the pipeline and drainage system but they would be recovering
their costs at they develop the property. At this time it is the
feeling of this Board it is going to be pretty hard for us to approve
thin development and know we are going to have -a drainage problem
that is going to very definitely involve the property owners below,
its going to involve the property owners in the Franklin Subdivsio n

Mr. -Billings: At this time they have pretty well taken care of
that problem it would be right back in just as serious situation
than it was before. You have indicated that you _only have -a 13 inch
pipe starting out to drain that - you say 15 inch,
Mr. Cruce: It is a 12 inch. It is a 42 going in and a 24 coming
out.
Mr. Billings: This definitely is no where near the 72 inch
line that they are saying they need.
Mr. Cruces The pipeline is so designed that if it overflows
it overflows into the streets. That 24 what it doesn't carry flows
in so somebody is going to get flooded.
Mr. Billings: Then very -definitely there aren't facilities now
to carry any excess water from another subdivision.
Mr. Cruce: Right.
Mr. Billings: We wanted to bring out these things at this meeting
We are going to have to arrive at a way to develop and add in place
drain tile — 72 inch drain tile down 35th -Avenue to take care of the
run off from some BOO to 1000 acres of development before the
development starts. Now if there are thoughts contrary to this
this is the time to discuss them - the City Council - Wayne Wells should
expressed his thought alohg this line, you Ben, the representative
from Nelson, Haley, Patterson and Quirk and also these people who
below
own the property along/this line - we should know their feelings.
Shey are the ones who are going to get it. We know we have got to
-have this type of a subdivision and we definitely feel that it is
a good subdivision but if it isn't developed right it is not going
to be an asset to Greeley and the people in the area - it will be
a liability. We are dealing with two entities - the County and the
City and we are not about to say yes we are going to dump all this
water on-the City of Greeley.so we can develop a subdivision in the
County. IT one of you would like to express your _opinion.

Mr. Cruces I might add a little more and then jet Wayne
talk andturn it over to the engineer In the subdivision on
the east side - due to the fact that there are also plans for
other - there was a recommendation and another :report for a
larger pipe to go in — we made an agreement with Max Hoffman
that he would evolve a retention pond of a certain size but
when installations were made to take Pare of the water - from
his property to the river — part of this retention -pond would be
- the 1-and - would be recovered by Max Hoffman or by the owners
whoever they(night be. This would not be -deeded to the City of
Greeley. He would have a much greater areathan used in the vary
but
beginning/then would be anticiapated 5 or 10 years hence but the
definitely had to take rare of his own water problem and thi-s was
handled in this way. This -might be a solution out in this area. If
this particular property owner and the headwaters want to develop
his perhaps he should take rare of it with sufficient retention
ponds not to damage the owner lower down. Then when that property
owner or owners develop lower they would have to -do likewise.
I will say we have been trying to solve the problem and we got
into it before the County had a planner and the City had a planner.
We want to continue to work with the Countyl'Planner but we don't
feel we should take the complete responsibility of slevelping the
drainage outsi-de. We have also done this in the south of Greeley
where the drainage out of Greeley We no longer take the attitude
- why you Lave to take the water - we told the property owners
south of Greeley that look - you have got to take cr.re of the water
yourself and not slump it on the town of -Evans. I think this is
what has to be done. Political entities have really got to look out
somehow for the other political entities.
Wayne I am sorry you weren't at our meeting this
morning - we met with George Hall - Keith and I
Mr. Wells: I didn't get called - I know — my feeling is that
the whole area
it is an area problem. It is -, drainage of that area/ should be
brought in to it somehow. The Franklin people - we could not sit

Mr. Wells: there and tell them they had to pay $400.00 per house to
put in drainage down to them - it was just unthinkable. Any
time - like Max Hoffman - he is putting in hie own and we give
him back we do not charge him but we credit to him the 2 cent
per square foot - $150 - $200 per unit on a house or 2 cents
per square foot if you bring it in like he is bringing it in.
We are giving him credit back he does not pay the City because
he is doing his own.
The same way would work on drainage on this we
would not - this would be a -credit to them - they would not pay
the city any drainage fee and if they put in parks they will
get paidout of the park fund. So they pay one way or the
other. Many times on these larger projects there is not enough
money in our charge to do the project and we can't go into our
general -fund for the City of Greeley to pick up the difference.
The difference has to come from the people who will drain into
it at some later date, like Max, when it develops above him -
we ask him to make a bigger pond than he actually needs for his
own water. But we asked him to make it bigger and he will recover
this when the people above him start coming into the City
and start de' eloping and breaking their land out. They will
have and we will xredit it back to Max. Eventually he will
recover 100 percent of his money. Maybe not fully.
The Stevens holding pond back in 1965 when
the Council -on a 3 to 3 vote split -that night and turned it down
— it option — then we got into trouble again 67 because we didn't
have the holding pond there for this area. -Had we bought that
then we would have used the money for these people now to quay
that _pond off. We would have it ready to go - the Launch did
not have foresight then to go ahead and buy it. We would had
the problem just about licked, right Ben.
Mr. Cruces Well it would have helped.
Mr. Wells: It would have help a lot - it depends up the size
of the pond. It is a matter of working together i -think evenutally
Ghosty sits back there and he drains into it. When he starts

Mr. Wells: breaking out land and want water we charge him a drainage fee
and that goes to pay this Whole holding pond or the system.
Harold Anderson: I have a question, now as I understand it - that
a 72 inch pipe has been recommended to take care of the drainage
from wherever it ha^, 35th Avenue north.
Mr. Cruces Yes sir.
Harold Anderson: Alright that is recommended, now how can we
go ahead and approve a district without this being carried out.
Mr. Cruce: Either that or some other system, Mr. Anderson,
either the 72 inch pipe or holding pond or some other alternate
must be implemented.
Harold Anderson: These holding ponds are just to hold the water
back for a controls problem.
Mr. Cruce: It is a control pond - it is controlled drainage.
-Harold Anderson: Yes, but they are going to get full and they are
going to run over. I have seen quite a lot of these flood control
ponds - very similar to this setup and I am expressing my own opinion
I feel like recommendation of the engineers is for a 72 inch pipeline .
I am not saying the City should pay for it, you understand that, but
to me it should be put in prior to the
Mr. Cruce: Mr. Anderson, let me correct one statement, you
say the 72 inch pipe was recommended prior to the holding pond at
20th Street. That 20th Street Lake as we call it - this was also
to drain into the 72 inch. The City of Greeley paid $80,000 to
Houston for that 40 acres of land and then paid about $30,000 to
build the dike. This was completely at the expense of the citizens
of Greeley. Now part of that was to develop a future park as well
as a holding pond, but you see because that water will never go into
that 72 inch pipe - this 72 inch might be considerably lower or less
than 72 inches. So conditions have changed somewhat and you may need
a smaller pipe even the 18 inch and the 42 inch across Scotty's Trailer
Court have been put in since this was recommended. So conditions have
changed considerably.

Mr. Billings: A question back there -
Delbert Anderson: I am Helbert Anderson and I have 80 acres out there
beyond this Stevens property and as I see it the mistake was made when
Hunter Heights was engineered or the City passed that subdivision for
blocking the natural force that this water
Mr. Cruces It was outside the City limits.
Delbert Anderson: Then the second mistake was made when this 6 inch
or foot tube here was recommended by the engineers to put in and
now go ahead and make another mistake and develop this thing and don't
take in the entire 1000 acres in this engineering survey to take care
of this - then we are going to have burnt passed on again. I don't
see why this subdivider here should pick up the difference between
- because the City of Greeley went ahead and approved the smaller
tube instead of putting it in correct first to take care of the entire
1000 acres. Now they are coming back and making all the people coming
in here to be responsible for this water coming down on the City of
Greeley.
Mr. Wells: You've got to go back - when we were digging foundations
back in 57 or 47, I dug them for Mr. Hunter, and he was not in the City
we had no jurisdiction of the City over that - I Was on the Council -
he was outside the City of Greeley. The County had no planning at
that time and it goes back further than any of sitting in this room.
To control - what they did there was a mistake - you are right - but
the City had nothing to say about it, the County at that time did not
control these things so you have to go back and dig up Mr. Hunter.
_Delbert Anderson: Wayne, doesn't the responsiblity still lie with the
-City of Greeley when they took them into the City there was no arrangement
with the property owners to say - now you've got to take tare of this
water - its a problem. Nothing was done.
Mr. Wells: They've got their water taken care of right now
They have.

Mr. Wells: I think this is tecnhical point with the lawyers
you have your normal drainage and then--
Mr. Cruces Let Mr. Eberhardt, the engineer say a word.
Mr. Eberhard: Mr. Chairman, I am Keith Eberhardt, City of Greeley
-I think at this point we should have some background to clarify what
actually has happened. Two weeks ago at the Utility Board Meeting
this map was presented to the Board for its tentative approval
for a changing of the green belt which had been proposed by a
comprehensive plan along 16th Street Parkway. This map which you
all have a copy of was presented at that time as a possible alternative
to the green belt area in which the width of the 16th Street was
changed from 300 foot to 100 foot and the same comporable area was
put into something like parks which would be developed as retention
ponds holding back the runoff.
Now at this time and this was a very very brief
discussion I think Mr. torensen was there, Mr. Ewing, Dennis was
there. They asked is this idea acceptable? At that time I told
them that this idea was acceptable and the idea is acceptable.
Now the thing that happens when this land is developed for housing,
for business, commercial property, college grounds or for anything
else is that we increase the runoff of this land considerabley over
what it has now. This is the problem. I think those people down
at 35th Avenue below 13th Street have at the present time taken
care of themselves for handling the runoff which they have received
from this undeveloped land.
Now the developer, and I don't care who he is,
it is his responsibility to take care of that additional runoff.
This is basically the problem at this meeting. Now since that time
I have had a chance to read this mapand the map is good, whoever
has spent the time on tie study has figured up the -quantities of water
which is going to run into this college acres development from all
different angles. He has tried to take care of it here with the idea
in mind that at 35th Avenue and 13th Street there would be a 72 inch
storm sewer which would _carry this water to final disposition at the
river.

Mr. Eberhardt: Now in researching the records that we have at
City Hall it is apparent that at the present time and the present
thinking this 72 inch storm drain will never be built or at least
not tuilt under the sponsorship of the City of Greeley and therefore
it falls back on these developers to take care of the additional
runoff which they are going to contribute to the basin. The idea
of the retention pond is the simplest and the cheapest.
Now I have done some studying on these quantities
which put out here. The plan as it is presently laid out 'does not
have sufficient area for detention ponds to take care - does not
have sufficient area in the detention pons to take care of the
drainage, if the 72 inch pipe were already there. So from this
standpoint I think the plan needs to be refigured. I think we need
to do -a little bit more thinking on it. My suggestion to you is
that the south portion of this Country Club Estates - that you do
not permit to be developed at this time until the proper drainage
facilities are installed. The north half of it from the ridge north
I see not problem there at the present time.
Now it is unfortunate that we do have runo₹f,
however, I think it is fortunate at the present time we are cognizant
of this fact. Now is the time that this c-an be corrected and there
are several alternatives this is not saying that this can not ever
be developed until this pipe is put in. I think these are pretty
strong words and I think there should be an engineer scheme devised
to retain this water, let it down slowly so that nobody gets hurt
by it and eventually the problem will solve itself.
Marshall Anderson: Now on this study you made are you talking about
the 240 acres or the 1000 acres
Mr. Eberhardt: We are talking about the whole base of it. 'his
map here has taken into consideration the runoff which is going to be
contributed from the lands above and so I called out at NHPQ this
morning and asked them to bring us the proposed layout of the area
below this land which shows only one large detention pon. I don't
have any figures on this tut there is not question as to that the

Mr. Eberhardt: detention pond could be constructed, I guess it is your farm,
to take care of that runoff. Now this could be accomplished by
the developers of _Country Club Acres buying the land from Mr. Stevens
and building the pond if necessary. If they insist with going ahead
with the development. This is a possible alternative I am not saying
this should be done. But this could be done.
Marshall Anderson: What are you basing that on about 4 inches of
rainfall?
Mr. -Eberhardt: Well this plan here is based on a fifty year storm
which you will get one probably every ten years. Now Mr. McRae can
tell you more about the derivation of these figures. The drainage
report itself, which you have -here and which was devised in their
office based on the assumptions which they used is technically
correct. I think they are a little bit 'conservative in the prediction
of runoff that is all. But the idea and the assumptions which they
used is taken direct. I wan't aware of this either until I got
into discussions with Mr. Cruce, that the 72 inch storm drain will
probaly never be 'constructed. S discovered this when 1 asked him
for some money to start some of these improvements. Now we all
know what happens, now Delbert Anderson has tome good points which
are correct, but the people at City Hall change, Councilmen change
We are fortunate Mr. Cruce has been here 17 years so he remembers
these things that happen. But anyway this is the situation at the
present time and I think this area aan be developed with the revision
in the drainage plan. It isn't an Impossibility. We all know that
it is not all going to be developed in a one year span but the area
should be reserved for adequate retention ponds to control this runoff
and it can be done. We are doing it in other areas in the City of 2reeley
it is not the best in the world but we are living with it. We are not
at this point damaging anyone materially.
Mr. Billings: I would like to -ask one question - since they
have put; -an assessment per square foot on this property and we were
lead to believe that this assessment on the property was -for -the
constuction of this 72 inch line - you say it will probably -never be built

Mr. Billings: what are you going to use this assessment for?
Mr. Eberhardt: Under the _present setup this building of the
retention ponds is taken out of the drainage assessment.
Marshall Anderson: Well in other words you will work it similar
to what you did with Max tut here.
Mr. Eberhardt: Right. It would be on the same basis.
Marshall Anderson: Well I think gentlemen, this is why we had this
meeting - it isn't our intent to cut the City _of Greeley out. We
would like to go ahead with progress. I think that is why we are
here today is try to figure out what we can do - there was a lot
brought out -here that wan't brought out at the hearings. Actually
we were only developing 240 acres at this hearing that was all that
was reported. Now with this coming up we have almost
five times as -much area. You talk about flood water. I believe we
are at the goat right now where we have to sit down and everybody
have a meeting of the minds and get all the facts on the table
Mr. Cruce: Mr. chairman, it is just exactly like the City of
Greeley 20 years ago dumped a lot of water on -Rosedale and Garden
City without any regards to the 'guy on down below. Today I send the
engineers down and met with the Town Board of Evans because we don't
want to do that again and we have got to think about the _overall
p.00blem and we have all got to get together—
Mr. Billings: Along this same line I would then like to have
a recommendation from you and from you engineer as to 'exactly how
much area should be set aside for -retention ponds and building
retention ponds to control not just 200 some acres that we orginally
saw but so we know we have Tull control on almost this 1O00 acres.
Your recommendation as the City of Greeley as to what you Teed to
put in this de* elopment to protect the citizens of Greeley.
Mr. Cruce: The citizens that are now east of 35th that
are inside the City limits of Greeley feel that they are protected
and they have put sufficient money into a drainage system. I think
that you are exactly sight that we need to sit down and have the
engineers tell us what is the total price In dollars for the thousand
acres if that is it because as you say when I saw it it was 200 acres

Mr Cruce; or less.
Mr. Billings: One ether question I would like to ask I am not
real sure that this Board won't require a 72 inch line. If we
did where it it going to sun with a 72 inch line will you be able
to construct it and along 35th Avenue and the barrow piton City
property or down 35th Avenue under the road. T-his is something
we need to know because where - because we have got the school
district involved in that area and we also have residents of
real nice -homes if we _get on the west side. About the only you
have got for this line as I see it down 35th Avenue to the river
is down tither City or _County right—of-way. 1 don't know what
you have nndeground there right now whetter or not you could Tut
it underground there.
Mr. Cruce: Mr. Chairman I think you are right and the fact
that at one time when Broadview was being developed we required some
additional right-of-way from the Broadview Subdivision or Franklin
Subdivision — I guess the Franklin subdivision and also from the
subdivision that is immediately adjacent to the -school. We do not
have additional right-di-way adjacent to the school. We do not
have additional right-of-way adjacent to the old -Hunter Heights
and Westwood. 1Right-of-way would have to be acquired on the west
side for part of it perhaps crossing over at 10th street and 35th
going north in this direction because I think at one time the
recommendations were for 120 foot street from 10th Street to the
river. This was to take rare of either an open ditch or a future
tile -but that has not been acquired.
Mr. Billings: Actually all you would have is a 100 foot right-of
way which is the atreet --
Mr_. Cruce: Between 4th street and the Franklin School
we probably have a 100 foot right-of-ways yes sir. the old 60 foot
and then we have a 40 foot on the other side.
Mr. Billings: Are there any comments from anyone else?

Mr. McRae: As I listen to this first of all this report
was based on the minimum protectiv'e conditions - I think it
was based on a 2 to 5 year storm. That is normally what municipalities
would set as a minimum to what storm drainage Improvements they
logically
could pessib}y finance in course DI development for the proper
fee structures, drainage structures and so forth. So this is
minimum. its area as =defined , the drainage area - they have used
a 1000 arras and that is correct. The proposed runoff based on a
a 2 year storm is correct. If you layout out procedure as he has
said it is technically correct and consequently we have in the
past used it for a basis for study -because it is the background
information that we have needed upon the total area. The, area
lying west of 35th Avenue, is the only area according to the report
is the only area designed to use the -72 inch pipe. We are not
including anything east of 35th, therefore we _considered the
improvements on this area - we are onlycrosidering the people to
the west who will be using it. And rightfully so they will -be the
-ones who 'eventually in some fashion will pay ±or it.
Now we are looking at something this is a little bit
unusual in the form of general planning the fact that 2 or 3 developers
have gone together and have come up with a general plan irrsgardless
of the property lines more in line with good planning and good
drainage to -facilitate these two items. So we have a good basis to
work on. We are looking at a project that is because of this is of
great magnitude. If we looked at this smaller we may not be nearly
so Averaued at the complexity of the problem but because of it we
have a chance to sit down and do a little thong range planning.
The report that we parepared for -County Club Acres
was done to FHA standards. -FHA requires that we do the 50 year
design storm. Hydrologically speaking this is a storm that you could
expect once in 'every 50 years. Everybody knows that this isn't
scheduled this way you might get the same 50 year storm 2 dr
3 years every other year or something. But normally speaking
based on the records that are existing and projections that these
knowledgeable people made that if you -did get this occurance
you could expect 100 years before the next one. It is a design
basis. The 50 year design basis used in this report is about

Mr. McRae: 35 to -40 percent than a 10 year storm. I don't know -the
exact figure of what it is larger than a 2 year storm of which
this report is based. So we have to keep that in mind -relatively
speaking that we are -talking -about one date when we are talking
about what the City has set -as a minimum protective standard
and what FHA is requiring fora minimum protective standard.
The City is concerned with the general property owners tut so
is the -FHA it is just a matter of degrees. FHA has a committment
on their houses and everybody all the way along the line will
agree that under a 50 year storm there is going to be some
damage expected. You just can't finance a system on a municipal
basis that will take care of this 50 year storm completely.
Another thing -beside - because of the size of
this thi-ng,I think Keith menti-oned it,and we do have to keep in
mind that this is a _progressive development. We aren't going
to need the 72 inch pipe tomorrow. We have selected area here
that won't even drain into it. If they start in that area maybe
we shouldn't even consider them. But the overall plan sloes
encompass a drainage area and that is what we are concerned with.
Progessive development does become a big factor on a parcel of this
size.
The financing - I have down here - because of the
size it has -to long range of nature to accomplish the over-all purpose.
Otherwise to put in a 10 or 50 year design storm tomorrow , because
this is what the report says is needed - you are getting way out on
your capitalization and I am not _familiar with all those terms.
But I know that you don't go out and buy something that you are not
going to use for 5 or 10 or 15 years. Particularly when you are
on minimum budget standards. So the financing - I am s-aying has to
be set up on a long range basis or at least considered.
This property will generate income over its period
of development now maybe that is 10 years. It will continue to
develp income over that period of time. All of which should be

Mr McRae: reapplied or _applied directly to the -drainage problem. Now
the drainage fees that I mentioned were -those that were exisitng
established by the City on -the areas that they are annexing .
Now we talk about the area -east of _Greeley - Hoffman and Brenckle
mobile home parks those areas are different to the extent that
they are being annexed and they are immediately coming under -the
control of the City and their fee structure.
As we mentioned in the hearing the otherday
this area is several years - maybe not that long - but it is
sometime in the future of being annexed, but we will all expect
it to be eventually to come under the City of Greeley's fees and
drainage structure, and so forth - when we haven't determined.
In fact we were trying to figure out some way to _reach a compromise
at that time.
Backing up a little bit, I was like Keith,
I found out that in reviewing this in our own -office that where
this plan tadbeen presented it wasn't accepted as a master drainage
plan of the City. So _I have to stand corrected on the f-act that
of referring -that these things will automatically be built. -They
were design structures and we have -been using those in the past on
Broadview and on Edwards and several other areas within this drainage
report. Maybe it was just the fact that we weren't working in here
however, Edwards still fills into this 72 inch pipe. I was uninformed
up until yesterday that this - the fact is that this is not the master
drainage plan accepted. But I still feel that it is a good basis
for engineering decision to be on the areas and the runoffs.
In this _report because of the 50 year storm
because of the area involved we have called these retention ponds.
The are not complete control ponds when this is completely developed
under a 50 year storm all -thes retention ponds tend to do is is
absorb the peak load. There is going to runoff in a 50 year storm.

Mr. McRae: As the basis shown on the report some 495 CFS
will go through the detention ponds and run on down to some
collection point - to some collection system. If in discussion
or as a result of this meeting if we , required to contain.all
the water on the property we will have to go back and look back
through our drainage figures and come up with a detention pond
- not retention - dentention pond of such size that will hold this
amount. Hopefully Aims Colleges will do the same west of us
We are presently working in their drainage plan - I am not
specifically familiar with it. I do know they have drainage pond
or retention ponds on their campus area to protect their own
property. Now how much will run off in the same fashion that
would run off of this property I am not sure. But here again
this is County jurisdictional area again and each property owner
should be considered in the same light that eventually they will
furn'.>ch so much water and that they should retain it on their
own property until such time a drainage system is constructed
to take care of it. So as I say if that is the decision we can
redesign the pond - whether it becomes economically feasible
is something we would have to determine once we have take- a
good look at it.
I think our meeting the other day was based on
a fact that this is a long range problem there are several entities
involved the City, the County and the developer and the engineer
I suppose. In resolving the problem I thinkwe have defined the
problem and proposed perhaps that their are a few alternates
the City has some alternates in mind, the developer has to take
a look at it. Once all these alternates are discussed to see if
any of them are economically feasible. I think in our meeting the
other day we went on the basis that Greeley really did a good fee
structure established something that would generate the income
required to finance this project. On that basis we said that
eventually that this will be financially feasible. This is why
I used those figures in saying that the developer would normally

Mr McRae: pay that if they were in the City. If they pay that same amount
in the County this fund would be generated and eventually the kitty
would be there to build the project.
Now I don't know if it has to be an improvement
district because it is outside the City. Iithink the other day we
were just looking to the fact that if there was some feasible arrangement
because the City is a corporate structure at the present time.
They have extended their water facilities and made arrangements
and if they could _do the same thing in the drainage basis. I am-
sure the developer is willing to contribute to this as you normally
do in the City. The feasible thing about it comes from the fact
that if it is handled as a general drainage district. If each
owner has to put in their own pipe capable of handling the total
runoff from their section you can probably triple or quaddriple
the cost and so it is economically feasible to pull together and
work together on it. As I say hopefully we were thinking of at a
meeting like this financial arrangements could be made to procede
in a progressive fashion with this thing.
I haven't run complete figures on it but on the
basis of the City of Greeley drainage fees complete development
of this Country Club Estates property would generate in the
neirh'iorhood of $150,000 worth of drainage fees. If the developer
takes $50,000 and puts in the detention ponds that would suffice
for a certain period of time in his development. I don't know
what the progress statement is.
Marshall Anderson: Jerry I think right there is where rather than
create another Franklin situation - right there is where we need
an understanding with the City of Greeley, the developer and the
County.
Mr. Mc Rae: Right.
Marshall Anderson: If you are going to put $50,000 in kind or in
work or in service to take care of that water. What I am wondering
this is in the County - are we going to issue County building permits
- we are going to collect that Ben. Can you put a drainage fee on
a water tap?
Mr. Crude: That is the way it is done outside the City limits.

Audiesce: Does that mean that this fee is essentially being
collected now.
Mr. Cruce: It can either be colledted or be levied by the
City Council. But this is the way it would be collected would be
when they made a water tap.
Marshall Anderson: In our own mind we wanted a clarification on that
and---
Mr. Cruce: Inside the City limits we collect it with a building
permit
Marshall Anderson: But here we are starting on our side of 35th
Avenue and if we can't work out some of these details because eventually
that is going to be in Greeley - they won't be in the County very long
Audience: Are these -drainage fees specifically part of the
drainage basin?
Audience: (City of Greeley) Yes - they are earmarked - we set this up several
about 2 years ago.
Mr. Billings: But these fees from this area would be earmarked
for
Mr. McRae:._ Now here again I would mention this is the last
thing on this financing - we are talking about 1000 acres to be
developed a portion of this Edwards 6th Addition - 128 homes-
is presently under construction - is part of this district. What
we have started here is a part of it. Overall on the basis of I
think 3 acres per unit plus the normal development I think this
total drainage area will generate in the neighborhood of $750,000
worth of drainage fees.
Marshall Anderson: Is that taxed on lot basis or does that include
streets?
Mr. Cruces Per lot or in a commercial area or a family area
on a per square foot basis

Mr. McRae: This report and I am sure it would have to be
up-dated but the cost of that 72 inch line at the time of this
report was $250,000 or lets say $300,000 so we are rot talking
about anything that is financially unobtainable. I think the
fees will generate the income needed to provide a minimum drainage
protection as engineered in this report.
Mr. Billings: You are saying there is enought money there to
(1) while they start thi-s development to start the development
to build retaining ponds sufficiently large enough tgiandle almost
50
any situation except your major/year flooding in which you said
there would definitely major runoffs.
Mr. McRae: Well I don't have the figures because there would
be progressive development on this thing. I don't know what a
system
complete detention th4Rg on this would do, but I think the $50,000
would certainly protect the downstream side.
Mr. Billings: The thing I am trying to arrive at if your figures
are correct and you are generating -somewhere around &700,D00 for ---
Mr. McRae: That was for the 1000 acres
Mr. Billings: right, well then you generate this you generate
enough funds for the retention ponds plus the 72 inch line at a later
date.
Mr. McRae: As I say the total drainage fee will cover the
total drainage improvements required.
Mr. Billings: I think this i-s an important point. Burman.
Mr. Lorensen: I noticed that the study said that the 1960 study
said that the 72inch line was based on a 2 inch storm then wouldn't
it be true if this was based on a 50 year storm that the 72 inch
line would not longer be big enough or large enough to take a 50 year storm?
Mr. McRae: Correct — a 50 year storm a 72inch line is no going
to handle it. The storm drainage - a 50 year storm - the City of
Greeley - in general - is going to be flooded and there i-s going to

Mr. McRae: be damage every place except on top of the hill.
Mr. Lorensen: What percent increase or what she increase would
off the top of your head would be required rather than the 72 inch
to cover this type of flood?
Audience: — (Poudre River)
Mr. McRae: True, but the 72 inch line you are talking about
is going to take care of a 2 year situation.
Mr. Lorensen: Maybe if you went to a 10 year system would you
feel that generally the amount of money being pulled out of this
basin be enough to supply for a 10 year drain situation at the lower
end?
Mr. McRae: I haven't looked at it that closely.
Dave Stevens: Mr. Chairman, I am Dave Stevens and at the moment
I don't want any retaining ponds on my place because I have seen the
one out on — what they call Greeley West Lake. What that has done
is just seeped up the area all the way around and made a real poor
looking area. I don't think it has enhanced the land in that area
at all. I _don't know how many ponds you are talking about or where
your ponds are going to be but right now I don't want ponds on my
place. I am happy farming.
Harold Anderson: These detention ponds as you call them - there
would be water running through them? You understand wh,t I mean
there would be an outlet?
Mr. McRae: No a retention pond is to absorb the peak load
and let off a regulated amount of water continually they will drain
dry after the peak is passed. Under a 50 year storm the retention
pond shown on here will fill up and overflow and continue its way
downstream. We are trying to level the peak runoff.
Harold Anderson: Yes 1 know what you are talking about. The
question in my mind is will these retention ponds be in succession
one after another?

Mr. McRae: That depends upon the layout in the design and use
of them. The ones shown on the plan are side by side - we don't run
one into the other we figure the total retention. There is a certain
amount of streets that will run into one and a certain amount into
the other. But on the design of a storm drainage report we have
figured 16th Street as a major arterial and a major carrying way
of the storm drainage water
Mr. Cruce: It drains down to 35th.
Mr. McRae: down to 35th. At 35th we have got to do something else
with it.
Harold Anderson: Well the point I was trying to make would be
the detention pond holding enough water so that the smaller ponds
Mr. McRae: No we have not made that comparision because
of the difference in the report - one is on a 50 year basis and
the other is on a 2 year basis. We have not tried to mix

Mr. Billings: If we all start our own conssrva-tion we are
not going to be able to record this meeting.
Mr. Cruce: Mr. Chairman there are several types of retention
or detention ponds in Greeley - Glenmere Park is one type. That
pond there is a retention pond of the drainage up above and it
has a fluctuation of about 1 foot. It will hold water during a
storm and then will let it out. That drains part into Number Three
Canal and during other year-s we have a pipe that runs west - well
east
I say it runs north to Number Three or it can run 4k to Number Three
The ponds at Luther Park are dry ponds they completely empty after
every storm. The one at Franklin was intended to be a small holding
pond in order to catch the silt and to try to develop an attractive
park there The one out in West Greeley has really never been
developed and it also has an additional problem of having to hold

Mr. Cruce: water for irrigation purposes. The Houstons still have
irrigation right into that and we have to fill it to satisfy,
those irrigation rights. So there are many ways of doing
it depending upon the circumstances.
Dave Stevens: Ben let me ask you a question - why do you
drain that clear dry ocassionally? Its an eye sore when you do
that.
Mr. Cruce: To repair. that is how it works - just to
repair most tho we just want to shape it up - we have never
intended to shape .it up.
Mr. Stevens: Isn't it also true when you put that lake in
there you raised the water level and the man who owns the property
around there _can not get FHA approval because of.
Mr. Cruce: This could be right - just like Glenmere
Pond it raise the water level too. Its been there since 1930
something.
Mr. Stevens: So when you are talking about puttingond in
Mr. Cruce: Now now, Mr. Stevens don't get me into that kind
of an argument I am not interested whether it is a pond or whether
it is a pipe. I am just interested in not flooding the people
east of 35th Avenue. Who drains the stuff to the river or how
you do it I don't think that is my problem here. My problem
is to try and to protect the citizens of Greeley.
Marshall Anderson: I think at this point Mr. Chairman we had
better have a meeting of the minds here and the County work with
the City and also with the developer to see if we can't come up
with a solution. I think maybe we had better go back and look
at this thing and visit with the City of Greeley a little bit
and find out what they want. Get with Mr Pfleiger and his people

Marshall Anderson: I don't think all of us have all set aroung a table at
once and try to see if we can get a solution to the problem.

Now I know a 6 foot pipe is big enough/that you can run it
out
Audience: its a variable problem.
Marshall Anderson: so if you want to hold retaining ponds you can
drain it out in 50 inch pipes to the river - maybe we can save some
money there. But 3s it possible for you fellows to get together
and come up with a solution - we know just as we are sitting here
that someday that is going to be in the City of Greeley so lets
try to get it right before we create another Franklin situation.
Mr. McRae: I think we have 2 defined problems probably
the engineering problem which is sizing and piping and discharge
and so forth. I think the other problem is financing.
Marshall Anderson: I think Jake and his group hoe come up with
their fair share of $871 per acre as I figure it - if you don't
charge for streets but that is something else but anyway is there
anyway we can sit down and have a meeting of the minds so we don't
have another Franklin situation or another south 8th Avenue
situation.
Mr. Cruce: Mr. Anderson I think you are right and that
should be easy between this engineer, this engineer and maybe
your County Engineer get together and submit to the legislative
group a suggested recommendation.
Marshall Anderson: Would you be in accord with that Jake?
Mr. P£leiger: Yes - I have another question Mr. Anderson
I don't know if I should direct it to you or Mr. Cruce? As far
as coming into the City - they are asking for 3 feet of water
per acre. Do we give this to the County or do we give this to
the City?
Mr. Cruce: That is a complete different thing from what
we are tailing about here.

Mr. Pfleiger: Yes, but we are still going to have to do it.
Mr. Cruce: But that is domestic water that is not drainage
water. The 3 acre feet is whoever you get water from if you get
it from North Weld - you give it to North Weld - if you get it
from the City of Greeley you give it to the City of Greeley.
Mr. Anderson: Lets get something down on paper that will work.
Mr. Billings: I think that in conclusion. Did you have another
question Mr. Pfleiger?
Mr. Pfleiger: The second one was on the 2 percent per square
foot on drainage fee - is this paid to the City or the County?
Mr. Wells: That goes on your water bill - whomever you
get your water from.
Mr. Cruce: Mr. Pfleiger that is charged by ordinance the
City of Greeley makes that levy if you get a water tap from the
City of Greeley. If you do not get a water tap from the City of
Greeley there is no way we have of collecting drainage fees.
But that fee can be negoiated either waved if you put in your
facility or it could be given to the County or it could - it is
merely a vehicle in which we try to control some effort in solving
the drainage problem:

Mr. Billings: This is why I asked the question if it was
earmarked for this area. I think in conclusion we have had
a change of zone hearing on this subdivision so this
Board would like a recommendation as soon as possible and we
don't want to make it hasty - we would like a recommendation
from the City, Nelson, Haley Patterson & Quirk, our Rlanning
Conccission - so we know exactly what has to be done to solve
the drainage problem so that when we make a decision on the
hearing we will know what has to be done.

Mr. Pfleiger: If the 3 acre feet is given to the County
does the County give it back to the City when we come into
the City - we can not give it to the City at the time
because we are not in the City.
Mr. Cruce: That 3 acre feet is based on domestic
water Jake and not any annexation or drainage per say
but it is on the use of water. If you expect to get any
use of City of Greeley domestic water you give 3 acre
feet per acre of land, to the City of Greeley water system..
Mr. Telep: I only have one observation here - you say
you couple this drainage fee with the water tap - right
Mr. Cruce: With the water tap.
Mr. Telep: This is fine and I would - think about the
building permit too - then all you have to do is to remit to
the County.
Mr. Cruce: We can't collect the building permit outside
we use to have it that way but we changed our ordinance when
the County started collecting for permits.
Mr. Telep: You cotild draw up another ordinance couldn't you?
Mr. Cruce: If you collect the fee - we would say okay you
take the drainage problem.
Mr. Telep: Well the State of Colorado collects sales taxes
and remits - I think it can be arranged.
Mr. Cruces Oh sure - it just happens this way.
Mr. Telep: One thing about it as much as you are collecting
for the water tap the drainage fees could be included in there
and just for the little additional bookkeping in there -
Mr. Cruce: Oh the building permit we could remit that to the
County.

Mr. Billings: We will call this hearing to order. In accordance with the
zoning laws of the State of Colorado, a public hearing will be held
in the Office of The Board of County Commissioners of Weld County,
Colorado, Weld County Court House, Greeley, Colorado, at the time
specified. All persons in any manner interested in the following
proposed Change of Zone are requested to attend and may be heard.
Docket #42, dated August 19, , 1970, at the hour of 2:00 P. M.
The request is made by College Green Incorporated, for the Change
of Zone from "E" Estate District to "B" Business District, Unit
Development. Mr. Telep would you like to make a statement at this
time.
Mr. Telep: Let the record show that these causes came before the Board
for hearing this day, September 21, 1970, beginning at the hour of
2:00 P. M. and continuing until terminated.
Let the record further show that we have four separate requests
for Change of Zone by Collge Green Incorporated, Jake Pfleiger, Vice-
President, 918 Eleventh Avenue, Greeley, Colorado, for a change of zone
of a parcel of land from "E" Estate District to "B" Business District,
in accordance with the Unit Development Pland of a parcel entitled
Tract "A" and containing a parcel of land more particularly described
in metes and bounds as was duly published as required by law, containing
7.277 acres mor or less.
Let the record further show that we have still a request for
a Change of Zone of an additional parcel of land entitled Tract "B"
by College Green, Incorporated, Jake Pfleiger, Vice-President
requesting a Change of Zone on Tract "B" from "E" Estate District
to "H" High Density District in accordance with the Unit Development
Plan and this Tract "B" is a tract described in metes and bounds
containing approximately 46.726 acres, more or less, as was
published in accordance with the law.

Mr. Telep: _Let the record further show that there is an additional
_request for Change of Zone for a tract entitled Tract "C" and this is
a petition for a Change of Zone from "E" Estate District to "R"
Residentail District, also in accordance with the Unit Development
Plan by the same petitioner, College Green -Incorporated. This
particular tract "C" was published as required by law and contains
123.251 acres more or less. Included with Tract "C" an additional
tract known as Tract "E" said tract "E" contains 32.472 acres more
or less as included in the legal description.
Now, let the record further show that there is another
tract known as Tract "F". The petitioner now being Country Club
Zcres, Jake Pfleiger, Vice-President. This is a request for a
Change of Zone as said Tract "F" from "E" Estate District to "H"
High Density District. Also, in accordance with the Unit Development
Plan, said Tract "F" carrying the metes and bounds description also
containing 23.563 acres, more or less, as shown in the legal
publication that was in fact published twice, in the Greeley Tribune
and the Greeley Booster along with all of the other tracts mentioned.
Let the record further show that the peitioner is present
being represented by counsel, S. Robert Houtchens.
Let the record further shoe that in each instance there
is a resolution on file of the Weld County Planning Commission recommending
favorably as to the Changes of Zone with their reasons contained therein.
Mr. Chairman, I believe we are ready to proceed.
Mr. Billings: At this time I think we are ready to hear from Mr. Houtchens.
Mr. Houtchens: I think I would lkie to basically describe the plan and
some of the elements of it. This is a drawing, a rather reduced scale
of volume that we have here. Tenth Street or U. S. 1#34 is on this side
Forty-seventh on the top, Twentieth Street.

Mr. Houtchens: The apartment zoning or "E" zoning is located out here
on Tenth Avenue and here along Forty-seventh. Thr "R" zoning follows
this line, the Country Club _area along Twentieth and the extension
of Sixteenth Street. The "E" zone exists primarily in this location.
The intent is to primarily put the higher density development out near
the highway and the condominium development or the low density near the
-C-ourtry Club. The "E" zone is to contain 13,000 square foot lots
while the "R" zone is about 7,500 square foot lots. The the development
proposed for the green belt described here will be later. The park
area sites are on the _corner of Forty-seventh and Twentieth. The
-first school site is adjacent to the park forming for the most part,
all of the various elements of a community.
The Green Belt which runs from Aims College at Forty-seventh
down to the east side of the site parallel to Sixteenth Street. This
has been recently approved by the City of Greeley Planning Commission
and has the concept of alignment with the green belt along Sixteenth
Street from Thirty-fifth Avenue through Forty-seventh. At this point,
Sixteenth Street continues on to Aims College.
Marshall Anderson: Bob is this going to a free-way affair?

Mr. Dressler: This will be/divided street with two lands of traffic
plus parking on each side of the landscape media. We have a minimum
right-of-way shown which is to be 123 to 125 feet; at this section
then it widens out. The concept is to provide varying widths of the
open space to allow somewhere parcels to utilize for recreational
facilities, particularly to get through here at the center and adjacent
to the school -site. Possibly to have a trail system or pedestrian
-system adjacent to the Sixteenth Street, going into all of these
recreational sites, to the area from here on over this would continue
further to the east at the bottom of this particular plat.
Marshall Anderson: Actually you are talking about 160 acres that was farmland
isn't that far east of that---

Mr. Britzman: Coming this direction - this goes through what is now
a field, connecting it to an extension of Sixteenth rather than to
what is now Thirty—fifth. -If you are aware - it is a general alignment
connecting it to an -extention of Sixteenth _rather than to what is
now Thirty-fifth. If you are aware the Existing utilities follow
basically this aligmmnet the sewer goes out to Highland Hills following
a drainage along Sixteenth Street. We whos on here a
cross section indicating that there will -be a paved ditch which will
parallel Sixteenth Street hopefuly carrying the drainage from the site.
We will have Uerry McRay discuss many of our details. In addition to
providing a recreational space it does permit a buffer of green space in
landscaping of the adjacent residential areas, as traffic goes through
Aims College. The Aims College study indicated that almost 9Qpercent
of the traffic to Aims College will be coming from the Greeley area
and goin g west of the site and a large portion of that will be going
along Sixteenth Street. Sixteenth is the only through street -through
Greeley east-west at the present that goes close to Aims College.
I think it is appropriate that Jerry talk about drainage
or someone here from Grove to tell in detail about -the apartment area.
Marshall Anderson: One more question on Sixteenth Street is that going to
be -developed or is it going to be extended to Aims College and be an
extnesion of this project.
Mr. Sritzman: it will just extend through this site at this time
until property to the east is developed.
I have a small sketch from Aims College Study which is also -going
on through our office. We are able to have some communication back
and forth and line these things up. This -Aims College area - this
sketch - above here - at this Entrance is maximum here to the Aims
College Site so you -have a major entrance from the entrance of the
college on down to this green belt - I call it an irregular green
belt system. This reduced drawing is a drainage study. We discussed
one of the features - one of the advantagesof this type of a green
belt area - is that we -have the free use of these wider park areas
to provide retention pond areas for temporary storage of the, ground
that is created.
A major problem severalhundre-ds of acres -continues through this one
drainage fill- The West Greeley Drain Study which was completed for
the city in 19_61 initially {pointed out this problem and of -course things
have -been devel-oping initially around it and we still have it in mind
in all -these other studies.
The Aims College area also has taken into consideration drainage
that they are developing on their own site and they are providing
foursmaller retention ponds, which will also aliviate and cast some
peak
of this/storm run-off until it can be more -regulated in the area.
This whole Swale will come down 16th Street Parkway. We do have a
natural -division point here, this area will Tun to the north and
the northeast corner I think that the developers probably could
explain there better their construction schedule and how they wish
to approach this project. Probably in answer to the question is to
the development - when will 16th Street be devel-oped - initially the
first stage of construction is going to be over -here on the -north end.
If there are any questions I will answer them now or later as they
occur.
on 47th Avenue
Marshall Anderson: I have one/- have there been any arrangements for rights-of
way or anything along that on 47th Avenue besides the golf course? That
is pretty tight through there — how about a traffic poll through there -
have any arrangements been made with the golf course or the property
owners along there?
Mr. McRae: Not that I know bf — it was one area that was platted and put into
use before the County was requiring or insisting on 100 loot right of
ways on a section line. We are providing a _crossed area _under this
development - a 50 foot right-of-way - and 1 am sure that Aims will
cover that with 50 feet to basically at the present time considering
100 foot right-of-way along -47th or the area.
Marshall Anderson: That is south?
Mr. McRae: That is south.
Mr- Anderson: As 1 see it, Ben and I was over it yesterday, we were
talking about this very thing — that is too tight up there - that is
awfully close - it is a problem
Mr. McRae: I think the _County Planner has been doing some planning on that
as a major arterial running from 34 to the by-pass at 34 and leading
southerly from that point.
Mr. Lorensen: It is somewhat _contingent upon the Greeley Throughafare Plan
and Comprehensive Plan and the Proposal as is -before the city now
as this being a major arterial and so
Mr. Billings: You haven't made any contact though with the Country Club
or anyone living on the west side as far as acquiring more right-of-way
through there.
Mr. Lorensen: Na , we have not.
Mr, -Fallings: You've got little roads through there - widening out to a
100 foot right-of-way this traffice starts pulling back toward the
north and on to 34 you will -have a bottle neck.
Mr. Lorensen: It is a distinct'problem unless this right-of-way is picked up
on the golf course.
Mr. McRae: I think, I don't recall the hilltop flat exactly - but I would
think that they probably have 50 foot of right-of-way dedicated
on the west side. So there would onlybe the county club site to
pick up the 1-00 feet. Now whether you need more or less S don't know
it depends upon like you say on the City traffic plan, the County,
Aimes of course they are going to -have a prime _interest in the area.
Getting into this area and onto the 34 By-Pass on the -South. The area
part of the plan
we are involved here is high density planned units certainly/is to hold
any of those buildings back far enough that a right-of-way could be made avail-abl
without getting into improvements. Of course Aims College Plan
shows nothing, of 'course, being -built close to 47th Avenue.
There building at 47th Avenue is here and is to have the parking
area in this corner and the major entrance — all their -buildings
are centered a considerable distance from 47th.
Mr. Lorensen: Could you point out the retention areas - or the retention
areas with the ponds on them.
Mr. McRae: There is one area here — in this area - and in this area
and this area. Now these are permanent ponds as far as the landscaping
is concerned. There will be -a certain amount of water i-n there at all
times. -Rut they will to designed with additionalcapacity to take
storm water at peak loads. There is also - they are primarily interested
as you can see
in regulating the _flow of this ditch/that tomes through the area
and also Creaks up into this area. They plan on paving this ditch
throughr the site so that maintenance is at a minimum. They wash a
dragline coming in and -maintaining. Thera probably will to a part of
this _control alignment and improvement of the ditch and probably the
way it looks right now is that the feasible thing to do is put an
over flow structure at this point and bring any access overflow back
into this area and maybe with a couple more small detention ponds
there and then entering across into Sixteenth Street where we can
provide major paved streets for drainage plus additional drainage
area here. This is one - we have a large one here - we have provided
-three areas - I think in the neighborhood of seven acres of detention
pond in this area.
The original West Greeley Drainage Area Study called for one
closer to
large detention pond in this general area./ Here-en 35th — it is
still and it still may -be the thing. We have attempted to at least
on the upper end take care of a portion of it there rather than to
let it all get down to the lower end. I can see with this -plan
with one specifically _called for but I would guess that a couple of
these smaller areas -could be made into similar to what we have here.
A few more of and not so big.
Mr. Lorensen: What frequency storm will this system handle?
Mr. McRaeY In this report we prepared for Country Club Estates is or
was prepared for FHA approval and FHA requires -a _50 year design.
the neighborhood
. Most municipalities deal in/five to ten
years design storms for their major drain structure - main channels
detention ponds - underground storm sewer systems. So the flows
we show on here are based on a fifty year storm which is considerably
higher than what the city would normally be able to design -and finance.
Mr. Lorensen: I have one more question - what is the total number of detention
ponds you all the way from Aimes down to Thirty-fifth?
Mr. McRae: The area between our easterly boundary and Thirty-fifth which
is another one-half mile. We haven't gone into any preliminaries
Mr. Lorensen: Well okay on Aimes ColLge and on the south.
Mr. McRae: On Aimes College they show four major ponds -and they are
willing to (swiggle) this area for another pond - I suppose-under
a temporary condition plus the -approximately 7 acres we show here.
Mr. Lorensen: So you are providing about 7 ponds in these areas to control
the drainage.
Mr. McRae: Right. The problem in drainage is to delay the run-off from
one area into getting into the system - its the peak fl-ow for which
If
you have to design your drain system on./ you can delay the water in
this area until it run through this area - east of it - then when
it fills up and runs over this water below it will have gotten into
and out of the drainage system. So it is going to stagger this water.
This is why we detain it — not permanent ponds in this case — they
are at Aimes -because they have the advantage of the campus -atmosphere
to work with. In this area we are considering them as temporary
storage. We want this to be a green space and a useable one at
all times except during the storm.
Marshall -Anderson: Do you think it will go through that 4 foot pipe out'
there on 10th Street ?
Mr. McRae: Well existing there is a 4 foot pipe -a 48 inch pipe . -that picks

up along on 35th and runs through west Hunter Heights and follows
the Broadview
Highway 34 and then eventually through / detention pond. That
is a part of this system that was put in primarily to aliveate
the soil conditions in Hunter Heights and so forth and pick the
smaller amounts of irrigation and drainage water that developed
on this part that was undeveloped. What is proposed in the West
Greeley Drain study is that when this area west is developed -
Piedalue and Stevens and the Sountry Club area here - is that
there will be a 72 inch line running north-south along 35th.
It will commence at approximately 13th Street and 35th Avenue
to the river
and run from there clear north/ :This was part of the West Greeley
Drain Study, which was initiated by the problems they were having
in the Westwood area and that is when this first detention pond
west of 35th was developed - the idea for detention pond - in that
area.
The water that developed after this is developed will have
to be taken care of in a new drainage system. Presently - as 1
say - this 72 inch line proposed will run north along 35th Avenue.
Harold Anderson: Do I understand this sight - these ponds with the water
will be -retained in there and will not be strictly be a flood control
set-up.
Mr. McRae: On the Aimes College area these are permanent ponds
and have a capacity for storm run-off. They will be, of course,
on the college property operated and maintained by the college.
They want permanent ponds there for their campus atmosphere. In
this subdivision area - in this developed area here - it is the
intent that they be detention ponds only. They will drain dry
in a reasonable time after the storm flow. They will be completely
grassed and Till up during a -storm condition. So they will be dry
at normal:
Now a larger area down here depending upon how it is
developesrif it developes around a park and the City thinks it would
be nice to have a permanent pond and retention pond with additional
capacity for storm run-off -that is a possibility It is just a
matter size and how it fits into the whole system — it is flexible.
I think in a park area you can provide for a sprinkling
system and a permanent pond along a parkway here, I think because
of the road base and so forth that it was probably our decision
we use these as a detention pond as temporary.
Mr. Anderson: More of a flood control.
Mr. McRae: More of a flood control - right and it works out as
I say real well with the use of this irregular green belt area.
Because we do have additional acreages that c-an be used temporarly
to help us with the storm drainage without any problem. Z don't
think it islander the system we have developed btrt there is a lot
of water from the acerages involved under complete development.
Here again in the report we have come up with and have considered
all of the surrounding contributory areas as being developed
residentially. fifty percent of the ground is run-off only 50
percent has some grass and absorbant area. So it will be sometime
before we reach this capacity at this point. Certainly by then,
I would gather, the rest of the drainage system can develop.
Marshall Anderson: Who's going to pay for this drainage line?
Mr. McRae: The City has basically taken primarily responsibility
in their collection of drainage fees and itla pointed out in their
drainage report. They fully realize that all of this area west
will eventually will be in the City. They have their designated
drainage basins. This land is certainly designated as being as
and contributing toward that - use of that 72 inch line. Any
drainage fees collected within a drainage basin are to be used
for drainage improvements within the area. What is not used
on site of course - it will be only a email percentage of it-
will -be used in developing the retendion pond - would be accumulated
until the 72 inch line could be constructed.
As long as the initial phase is developed and is on
the north end , we are not talking about any additional contribution
to this 16th Street Parkway. As soon as development starts over here
in this area - if it starts along the western boundary here - we
have the undeveloped ground in this area - you could rub out this
detention pond at that time. Include them only as you got down to
the complete use of that area, which again is a stop gap measure
to provide for the run-off created by this development. Its.a natural
drainage soil. Therm is going to be water running down it - there
always has been. But what we propose: to do with these detention
ponds is to absorb the additional run-off created by higher use
of the land.
Marshall Anderson: (not audible)
Mr. McRae: The only precedent of course that has been established
that it is an existing drainage swale - there are exisitng utilities
in any area and the City has basically accepted this as master
planning _for the development of 16th Street. So I feel reasonalby
sure that any developer that has developed this one-half mile to
the east - more and more -the City would require or request some
compliance to this master planso that we would -have a workable
system when we are done.
Marshall Anderson: Being designed up above---
Mr. McRae: Thats right - we may be building backwards but I think
we are taking care of our problems if they -don't get dis-developed.
We propose to run along side this irregular parkway a medium strip
roadway we also propose a paved medium strip which should go down
or have to be extended on into the other retention ponds -and eventually
to to 35th Avenue
There are other areas that contribute to the construction
of that new Edwards annexation area there drainage
report which is preparedc is based on the use of this 72 inch line.
There will also be drainage fee starting _immediately in that area.
No doubt part of the Plumb farm _is included plus the -area here from
35th to 47th that fits this drainage basin.
But the city has instigated a program to collect drainage
fees they arm a little behind in a few areas - they were developed before
they had the drainage fee _collected. They have been working with the
developers - the developer cancput these facilities _in and subtract
that amount of money from what would be generally required for drainage.

So without waiting _for the city the money accumulated to get
with it - '-;s also working with the developers. The developer tan make
the improvement on his own property rather than waiting for the city to
accumulate
some of the final systems, probably you ought to start with the
alternate.
Mr. Anderson: (not audible)
Mr. McRae: Down -by the church?
Mr. Anderson:
Mr. McRae: Well I don't think there will be a marked increase
in the water, because we are stoppi-ng the water that is generally
run here. There will be some, of course there is some now, it
is a drainage awell there is no flood damage there is certai-nly
crop and property damage if we were to get a fifty year flood
prior to the time of construction but it is no different than if
it happened today. If it happened today - if we had a fifty year
contrary as it is
storm water/would find its way right down the eastern slope.
I think that even starting on the upper and improvements
are being made to control. The dimes College is quite concerned
with their campusdevel-opment.This 'drainage study which is based
on a fifty year storm rather than a 10 year which might be a normal
engineering consideration for this area - plus the fact that we are
phase developing. As I said I don't know what the exact rate of
development is - certainly if this develops in 3 years then they
are not 'going to be 1-0 years on this piece inbetween.
I have a copy of the map here it is a small area map
of Tartof the West Greeley Drainage Study, but they propose -
thin is our point of collection 13th Street and 35th Avenue - we
tube
propose to run a 72 inch line here and an 84 inch -at this point
under Number Three Canal where it will go to 84 inches and back
to 72 from there. Right down 35th:Avenue all the way. It has so
far worked out real well because if you will remember -along 35th
Avenue - the Jackson School Area - and the Broadview area they
hams about 150 feet of right-of-way through there because of the
high lines and the additional road right-of-way
Mr. Billings: Does the City feel that a 72 inch line is enough to
handle all that run-off?
Mr. McRae: They have thin report - with a quick review of the report
to the methods
prepared on thi-s area - they didn't have any objections/presented scheduThe 72 inch line is based on a 10 year design study. This is normal:.
neighborhood
for the City to develop over a/five to 10 year period frequency storm.
Mr. Billings: You don't have to be -here very long to realise that a
subdivision clown there a few years ago until they got bigger lines in.
This whole area in here was under water - they seemed to have solved
that problem now. We surely don't want to create the same problem for residents
in that area again by not having a big enough line.'jThe city is
aware of their obligation- they no doubt have had a number of phone
calls before they got the improvements made and also would have
the same number of . At this time there is no time
table for putting in that 72 inch line is there?
Mr. McRae: No there isn't it depends capon the drainage fee, the use
amount
of the land, the/water generated . It is my feeling that by the time
the area is developed to the point to :vhere we have a -serious amount of
run-off they will by that time because of the amount of drainage rees collected
have enough money to initiate the drainage facility. At $150.00 a lot
or 2 cents a square foot is a lot of money. Alternately the money is
available for drainage facilities. Time-wise
Harold Anderson: Do you have any figures on the difference in the run-off
between an undeveloped area and a developed area? It is a tremendous
lot of difference. I was wondering if you had any figures to tell us
percentage wise the difference.
Mr. McRae: Well the drainage report FHA requires that we use a "C"
factor which is a run-off factor applied 10 on residentially developed
areas. In a commercial area,a parking lot area, or something similar
to that we are up in the neighborhood of One of the forces being
that no water penetrates it all runs off. In an undeveloped area
say farmland area I don't know we very seldom use it - so I imagine
it would be in the area of .1 or .2. So we are talking about 2 or
2.5 times as much and at 10 it would be 5 times as much water going
off.
Mr. Billings: If my computer over here is right - it looks like at a
two percent charge it would be somewhere around a quarter of a million
dollars for drainage fees for that area.
Mr. McRae: It sounds like that is what the city wants to do is to
form a drainage basin because they know - they don't want to get into
this Hunter Height situation.
Mr. Billings: No, I am sure that they don't - they wouldn't want to
create this situation again.
Mr. McRae: I don't know what arrangements have been made - say for
annexing this area - if the city would collect the drainage fees or
the county would collect those drainage fees for them.
Mr. Billings: We do have a note from ourCounty Engineer who could not
be here because of a previous meeting - this is one of the suggestions
that he does have that - I myself didn't know about the drainage fees
it might not be to far off for the city to annex that part so that the
bonds
Mr. McRae: Whether they collect the drainage fees now or later upon
annexation of this area - what they haven't collected up to that time
will be paid for - contingent to annexation. That would be my _guess,
roads
just as they were required that/water and sewer are put in by the
developer in each phase. As far as when it starts and who collects it
and what the -negotiations are at annexation - I can't answer that.
Mr. Billings: We don't have anybody here from the city. I have one
other question that our County Engineer asked and that would be
because undoubtly it will be annexed into the City before too long
of a period because we are spread out pretty thin as f-ar as our
-County Engineer is concerned at this we were hoping that the City would
be able to provide inspectors to see that this was developed according
to their codes anri;w`lt;out someone representing the City - we will
have to talk to them later I guess.

Mr. McRae:
It was part of the discussion and our/system and so forth
is based on City standards, basically we have started at least in the
engineering design and from the engineering design standpoint, street
widths and water and sewer, curb and -gutter all are -run through the
City Lode.
Mr. Lorensen: Mr. Chairman, on the roadways we have been making the
developer submit cross sections of the propos-ed street to the City
for approval. That is being done.
Mr_. Billings: Are there any more questions? -Bob are there any more
aspects of this that you want to bring out at this time or have you
covered everything that you wish to cover?
Mr. Britzman: l don't have eny-more.
Mr, T. K. Ward: I am with Globe Construction, I am president of Globe
Construction Company to further the conversation - you ell have
three exhibits in front of you. The first one is the official
development plan that is -what we have entitled exhibit "1". To
give you a little further explanation as to the building, we would
start on 47th Avenue. This would be the area of 16th Street -entrace
and across the street from Aimes College. We have by agreement with
Aimes College the -agreement containing the fact that we will develop
area "A" which is the shopping center and area B-1" with an artectural
exterior that would be in conformance with their construction and those
final -plans in that area would be approved by Aimes College. So the
relationship to the architectural for 47th Avenue we would work that
in conjunction with -Aimes College. We have seen their architectural
renderings, we have seen their layout and are familiar with what their
architecture will be and -have coordinated that phase of it.
Area "B 1" is a high density area which will contain
apartment units. From an economical standpoint at this time on today's
market thos-e apartment units would be in the rental range of $175.DD.
The "A" area shopping -center would Lontain an enclosed mall completely
enclosed and -completely -air conditioned with approximately 34,000 square
feet of building area enclosed in the mall.
The exterior of the shopping center area which is designated as
area "A" on exhibit 1 in the center of the drawing give us our
ingress and egress areas. It lays out the parking, parking being
relative to the ratio of this area versus parking spaces for the
City of Greeley.
We have to the bottom of the enclosed mall an egress
and ingress for loading and zoning of trucks which will be behind
a closed fence at all times closed off to the green belt area
between the enclosed mall and the area "B-1" which will be the
shopping center area. We would also have a perimeter fence of
architecture that fits the shopping center that ties back to the
Aimes College architecture and this is the development of the total
mall and the apartment area in "B-1".
To the left of area B-1" and "A" on your exhibit 1
the perimeter of the school site and also across the street from
16th Street Parkway coming south - this would be a housing development
area of homes that we now contemplate in the bracket of about $30,000
in that vacinity. There would be some 280 homes in that immediate
area.
As we move to the north we get into the"D" area which
minimum
is the estate home area. The estate lots/size is a little over
14,000 feet and they run up to 27,000 square feet. I think our
minimum in the areas will be 13,000 square foot per lot - so we
are from 14,000 to 27,000 square feet.
If you had seen what we have seen on Aims College
you have an idea of the architecture that will be along 47th Avenue
so we have here - this book here has pictures of the estate homes.
We have a copyright on those plans and this is the quality and the
type of homes we will be building in the "D" area estate area which
has has 60 lots in the south 30 acres.
In the area on your front sheet that is marked"E"
this is the condominium area and on your exhibit 3, the third
sheet behind the front sheet we have a layout of the condominium area

a proposed layout. In the proposed layout and immediately adjacent
to the golf course - as on the top part of the condomimium layout -
now this is a basic layout for 132 condomimiums in this area. To
the right of your drawing is the townhouse area. The front sheet
would be area "F" and F-4 on the front sheet.
Now in the condomimium area, as I say this is a basic layout
to develop streets and to allow the establishment of sewer, gutter
and all facilities and drainage. Our concept of condominiums are
both townhouse and single unit condominiums home. For an example
you have on Exhibits 3-A, 3-B and 3-C, behind your front sheets,
large scale
the/layouts of the condomimium areas on the front sheet.
Marshall Anderson: Are these four units?
Mr. Tate: These would be - that you are looking at now - there
will be four units in that given area along the golf course. Those
are esentially one story homes broken up into four portions of a piece
of land which is to give them the condominium concept. The maintenance
and other items will be held at a normal condominium concept.
They are approximately 900 feet apart. They are
2,250 feet - I imagine thats about a 1,200 foot - its about a fourth
of a mile.
Mr. Anderson: Is there any provision for right of way along that
property?
Mr. Tate: There is a 50 (?) foot proposed
Mr. Lorensen: We propose that it will be 100 foot width along 20th
Avenue and they are dedicating or what would be platted - dedicating
their 50 feet as their half of it.
Harold Anderson: I was wondering about this 20th Street where they will
dedicate 50 more feet, or 20 more feet?
Mr. Lorensen: There is an additional 20 more feet to be dedicated by
plat.
Mr. Billings: We will have a 50 foot right-of-way on that side and
we don't on the other side.
Mr. Lorensen: Thats right.
Mr. Tate: I am going through this briefly if you want any more
detail - we do have all the detail you want. Going back to the official
development plan on U. S. 34 - we have areas F-3 and F-4 in which you
get into high density. Now you all have the second sheet there which
we call exhibit 2. This gives basic concepts - we have it on the cover
sheet and also on exhibit 2 - anticipation concepts of layouts. These
concepts tell about the two reasons - the first reason is to establish
a layout that will provide the density and the second is to provide a layout
that will establish the population of the units. So we have several
concepts in the drawings that you all have concerning the F-3 and F-4
areas, and also the high density area that will parallel 47th Avenue.
These are just basic layouts to establish the quantities of buildings
and to establish the density arrangements for parking to be met.
Between the condominimum area and the estate area there
will be a green belt area provided. Between the high density area
and the estate houses there will be a green belt area provided. We
the
would have within the area of the apartments / high density area
recreational areas - playgrounds established. We have sufficient area to provide
for all necessary parking - the quanities of units allowed by the
rebuilding building and still have the green belts and
playgrounds areas.
Within the units themselves, we will have also, swimming
pools and the adjacent recreational area around the swimming pools
all will be provided without destroying the integrity of our ratio of
apartments - to meet the mimimum apartment requirements. The rental
area of running the
rates we anticipate right now in the area of/the condomimium or the
area adjacent to the country club will be in the area of $220.00 -
$260.00 per month depending upon the size that people might want.
This will be commanded by the square feet that people might want whether
it be three bedrooms or one bedroom units. In this we have from the
pictures that I have passed you all, we have established the archecture
for the estate housing. The condominium archetecture will be comporable'
the apartment units will again be comporable to that. From the 47th
Avenue ed that portion of the development has to be worked out with
the Aimes College people and since we are familiar with their archecture
and we thought it ought to be compatabile.
As to timing our basic thinking of everything we have
been able to project to date that this program can be started and
finished in about six years. We talked about drainage fees and park
will
fees our numbers are at the quantities of units involved/vary in the
amount of moneies to establish the sport^system, the streets, everything
necessary. This is from our cost factors in all the streets, the storm
areas, the drainage areas that Bob and Jerry have been talking about.
-So we have generally within the project itself sufficient monies for
what we think will handle that problem. Now for the overall of it,
we are working now in a market analysis which will cover the Greeley
area. The present information we have - that we have - tells us that
we can start in the area of condominiums and estate homes and this
high density apartment area. We have not generated at this time enough
information from our basic market analysis to tell us what this program
here will be. Although we believe that in "71" early "71" we will be
able to start consideration for the high density area here and for
housing here in this area. The thought being to develop this area
here and develop this area so that we bring the green belt area in
all at the proper timing. It would be impossible to start with this
area and develop the green belt first. So we work our way in to this
green belt area as the last phase of the development. That gives us
maximum use of the drainage and eliminates the problem as long as the
possible.
Now if our is correct that the other phases
of your county planning and all of this will tie together in about six
years - there should be no major problem of drainage in that area.
So timewise 2:re are talking at this point about a six year project.
We will have available in about six weeks a complete marketing analysis
that will tell us the apartment situation in and around Greeley. The
needs that are to be met today for the type of project that we comtemplate
here. This will tell us the time factors involved within our range
estimate of six years. It will allow us an orderly planned development
so that if the market analysis said that it could all be done in two
years we still wouldn't generate that much of a problem in a two year
period. We are looking at the basic six year program. This is a
completed planned unit development with the five phases of construction
including the shopping center and from the basic six year program
this is the way we intend to work on it.
Now if the market is not such that it is a six year program
then it could become and eight year program. We are pledged to be
bound by the market. We can't build something that people don't presently
need. All the back research we have done - and we have talked to a good
number of people in the Greeley area - which are in real estate and
real estate consultants and marketing people we thinking the timing
need
is now right for this type of a growth. We think the will continue
and that we have an area in this program that will satisfy a portion
of that present need and to carry into the future.
Mr. Billings: Are there any other questions?
Marshall Anderson: Can we collect drainage fees?
Mr. Telep: No.
Mr. Tate: Your figures are not far off Mr. Anderson - They will be
somewhere around $240,00 to $250,000.
Mr. Anderson: I am wondering are you going to be able to work out with the
City on it making sure that money is available - if I remember right a
tunnh of us got stuck on this West Greeley deal out here, when they got
into trouble.
Mr. Telep: The only thing you Ban do is form some type of an
improvement district.
Marshall Anderson: I am wondering where we stand we are talking about this
quarter of a million dollars and who is going to collect it and who
is going to keep til the time is right. Is this going to be
a City problem with the County running the show. Where do we go
from here? I don't want to pour cold water on the thing but I think
it should be laid out here today
that is what this hearing is for.
Mr. Houtchens: Can it be escrowed, Sam ?
Mr. Telep: I am sure it can, Bob. There is no question about that.
We can do anything along that line.
Marshall Anderson: Do we have the authority to collect it that is what I
want to know - or the City?
Mr. Houtchens: It would be collected by the County, not the City
Mr. Telep: Right.
Mr. Houtchens: At such time until this is turned over to the City, then it
tecomes the City's problem.
Mr. Telep: The City has nothing to do with it at this point Marsh.
Marshall Anderson: No what I am getting at they are talking about 240 acres
of surface drainage.
Mr. Houtchens: No it breaks up at the top there.
Marshall Anderson: Yes, but----
Mr. Telep: That is quite a drainage area there is not question about it
more than that of course to me that is up to the developer.
Marshall Anderson: Its going to take all this money to make this drainage thing
work. Say that if we go in and develop it and don't collect that money
who is going to pay for that drainage problem? I already paid for one
of them in Greeley I don't want to pay for another one.
Mr. Telep: Well the City of Greeley passed on this didn't they?
Mr. Lorensen: -They adopted the plan, yes.
Mr. Telep: Did they talk about drainage and all that ---
Mr. Houtchens: We discussed that.
Mr. Telep: Did they find any solution to it - I think Marsh it
-behooves the Board to talk, to the City to find out what plans
they have - if any.
Marshall Anderson: I wondering about this money - who is going to be the
keeper of it-til the time comes.
Mr. Telep: We can always figure some way out to take care of the
money.
Mr. Houtc.kens: They are established it is just a matter of
Marshall Anderson: well don't they follow building permits as I understand
Mr. Telep: I think it will have to be something that is looked into
Mr. Telep.
Mr. Lorensen: Mr. Chairman, isn't it possible that we can adopt a light
policy to the City with regard to these areas requesting a drainage
fee on the same basis as they do?
Mr. Tate: A park fee.
Mr. Loreasen: And a park fee.
Mr. Billings: I think we will pursue this and set up a meeting with
the City.
Mr. Tate: (?) I have to ask a question that has been in the back of
my mind - is the matter of when or where but the matter of how---
Marshall Anderson: well thats what I think you 2 cents a square foot
br a dollar an acre.
Mr. Tate: Right then 257 acres that is 245,000 dollars.
Marshall Anderson: I am wondering when you know its going to take almost
all of that to build that drainage through there.
Mr. Tate: Well with this respect if I might add a comment on economics
the way Bob did it and they did a beautiful job on it
he has blocked the park area and the drainage area in the wrong
concept - so we are not going to be duplicating the - as far down
in the one program so that is going to make a lot of dollars work
twice. This is why I was agreeable to this concept - I think
you have done a beautiful job. . The park fees and you talk
about a drainage system for your water retention ponds that he is
and
talking about you are really able to use drainage money/at the same
time use the park money - so for economics reasons the same dollar -
you have $2.00 to do one job with where we only have a $1.00.
Marshall Anderson: One thing is when we get that money where are we going
to put it. It will work in concept and everything.
Mr. Telep: I thinkthere is a way — we can escrow it, Marsh, I think it
is just a matter of working out the mechanics.
Mr. Billings: I am sure we can get together with the City.
Marshall Anderson: Bob you are working on both side of this - maybe I am
asking something
Mr. Britzman: No, I think there -should be a reasonable approach.
Marshall Anderson: I mean it should be in agreement - because it might be a long
time
I think this is a problem, Marsh,
Mr. Britzman: Quite frequently these things are reviewed by the City
Planning Commission who is it is not their concern to say about fees
it is the City Council and the Planning Commission the City
Council and the Planning Commission gets their approval of the plan
actually they are not concerned about the mechanics so I think you
-people have a responsibility maybe to communicate with what the City
Council since they are concerned with the fee that comes out of it.
If you arrive at a mutual agreement without any burden for the whole
area that exists around Greeley - maybe the first thing is that the
same questions are going to arise.
Mr. Billings: I -think this is something we can take up with the City
Council, to figure out a mutual agreement way of collecting these
fees - holding them in escrow or whatever we want to. Are there
any other questions?
Harold Anderson: My question is when this starts developing we are going
-to have run-off. It looks to me - now this area doesn't go clear out
to 35th Avenue.
Mr. Britzman: No sir.
Harold Anderson: But the point was from 34th - or 10th Street you would
go down 35th Avenue to the river with this flood.'*ater.
Mr. Billings: That is what that - 2 percent is for Harold. Fees to
be collected
Mr. Tate: Economically the approach to the development to the north
and the west and coming in from the south. This begins generating
Which means
fees immediately for the problem of the drainage area here. By the
time we have worked into this hearing we have generated this money
that is available, which means we are talking 4 or 5 years and on that
basis and on that basis a lot of other things can happen in t:.e
general area that will contribute to the continuation of 16th Street
by that time. So we planned it to minimize the problems and start
accuring the income to take care of it when we are in that position.
Harold Anderson: Well now the drainage from this portion here which you
talked about developing first - which is sight south of 34th - Highway
34 -
Mr. Tate_ This is within this area right here - that is a natural
drainage area, Mr. Anderson, which feeds right into this road'. '-
area here. so the moisture stneetin this area will take
care of the normal drainage. The sewer system and all the systems
there will be actually no problem in this area.
Mr. Anderson: We have a lot of problems in that particular area
west of 35th Avenue - we have that number Three Ditch isn't it
that goes through there fron the west.
Mr. Billings: -That is your Greely-Loveland across the bridge up there.
Mr. Harold Anderson: That takes care of some of - the ditch does -
But now this would come clear down to 34 Highway, where would it
go from there.
Mr. McRaei Basically all this drainage is going to end up on 35th
whether it be at 13th Street, 10th Street or 4th Street. It all
ends up someplace along 35th and that is why the location of this
storm
large 72 inch/storage drain system. A portion of the
will run easterly on on the north side will get
to 35th Avenue. The portion that runs across 34 to the north will
be diverted when it gets to 4th Street and again in part to 35th
Avenue. -The general drainage on the area West of 35th is north or
to the river and at some time hopefully a street system can be
ilirectly
developed in that area which would carry some of that water/north
and take care of a portion of it,that waid now run down naturally to
35th.
Mr. Anderson: That was the point I was referring to. Now this water from
the first development on 35th Avenue at the present time there is
nothing that goes north that would carry any amount of water along
35th Avenue.
Mr. McRae: A portion of the water will drain to 35th - a portion of it
will drain northerly into the open ditch there. I don't know what
irrigation system is developed in that area but those farms all do
drain toward 4th Street.
Mr. -Anderson: What I had in mind was if there was any control — it should
be started at the lower end because that is where the flood water
regardless of how much comes - is going to end up. I think that
should be one of the first parts of a drainage system is to take care of
after that - you understand - there will be more and -more coming in
Mr. McRae: Zf we could design residential under a fifty year design
storm - where a normal design is ten - we would accumulate about 92 CFS
at this intersection.
Mr. Anderson: Is that the intersection of 35th?
Mr. McRae: No it is the intersection of 42nd and Highway 34 - just
from the drive-in - and that is maximum fifty year design storm
grade
fully developed area - we have a map of/it right here. Now we are
concerned at this point that we are looking at in the neighborhood
of 93 CFS and we can take a further look and see as this develops
of it along this irrigation ditch
by stages what portion/will run northerly/what portion of it might
run along the highway and if so how many points will it cross the
highway under a storm condition. And also you can arrive at how
it will eventually end up at 35th Avenue. It will only be a _portion
of that I don't know how much.
Mr. Anderson: No but that portion should be taken care of, you understand
what I mean, at the present time there is nothing - on the west side
of 35th Avenue going north
Mr. McRae: No and the drainage system proposed along 35th would come
actually there is a small amount of drainage -facility in the Franklin
School area - there is an open ditch at present that any water coming
from the west - that catty corners at that corner - and getting into
the Broadview Detention Pond because there is no ditch available in
that area.
Mr. Billings: This is probably a _problem that when we do meet with the
City on the over all drainage that we will have to concentrate and
discuss this with the City and see what provisions they plan on making.
Mr. Lorensen: The maximum density of dwelling units with entire dfficial
development plan -shall not exceed the density of five units per acre
average.
The purpose of this item this thing right here is that when it is
approved by both the Planning Commission and the County Commissioners
that it will be recorded an any development subsegent developer as
the land changes hands has to meet the requirements hereon specified.
It has also indicated parking plots, areas "E" -and "F" they are
talking about parking So if we have a
( not audible) and also a parkway and parksites and schools to do
a little bit of realignment. I am say that if they are going to do
this - that their plat if approved should be changed to show these
changes within the plat. 1 would say that their plan should be subject
to modification ]before final approval.
We do have a letter from the city that was written today
and it is regarding their 'drainage plan that they have submitted
and it is directed to me and it is signed by Mr. -Eberhart, Director
of -Public Works, City of Greeley. This is the -content, " I -have
Whirl
reviewed the submitted drainage report written by Mr. Wkrl of
Nelson, Haley, Patterson and Quirk, and the revised plat entitled
"Drainage Report Exhibit #2", if all the recommendations of the
drainage report are implemented the proposed facility should -be
adequate to handle the runoff from the area ad the area above.
The revised plat show a narrow street with retention ponds and
concrete ditches interconnected - we believe this -to be a more
accepthble method of handling the drainge problem. Since what
he is really saying there is that rather than having a 300 -foot
width for your drainage area going -down 16th Street, it would be
realigned into this type of plan. This plan has been approved by
the City Planning Commission and it has also been submitted to
our County Engineer for his comments.
Mr. Tates It is my understanding gentlemen, the retirment community
area will have a separate builder who will design the qualities of building
-a retirment community - 3t is our understanding that our layout here is
1,288 unit density excludes the retirment community.
Mr. Lorensen: It does not — it includes the area of the retirment community
I believe. It covers the legal descriptionproposed as contained right
here and this legal description At the way we wrote it end requested it
contains this entire area here, which also includes your retirement
community. They have submitted a soil study and there is only one
problem area and the recommendation of the soil study is related
to a sewage drainage problem within your area and really there is
no significant problem that _can't be solved enginerly, econominally
indicated Trom the soil report. They already have on the first
portion of this in area "D" a filed plat clearance record on ell the
utilities. The Utilities Board has seen the entire plat and -have no
adverse comments.
I personally feel after seeing the study and the response
from the City that this type of drainage they are proposing is better
than what is shown on the Planned Unit Development - a 300 foot wide
area and it should be implemented to the new proposal, and the propos-al
be placedon the plan for approval.
Mr. Billings: What has been the recommendation of -the County Planning
Commission on this - in total or in part?
Mr. Lorensen: The County -Planning -Commission has recommended approval
on the total they have not seen the change on the 16th Street design.
Mr. Billings: When is your next Planning Commission Meeting?
Mr. Lorensen: Tomorrow.
Mr. Billings: It might be wise that this new change be presented to them
tomorrow and worked i-n so they will be up to date on this,Burman,
Then you can come back to us with a recommendation to us :regarding
that they have approved this in total and since they haven't seen
this change I think they should see it. i also think that before
this Board takes -any definite action that we should as soon as possible
set up a meeting with the City Council anddiscuss the drainage problems
the problems of the fees so that we know exactly where we are at.
