DETERMIED TO BE EXEMPT FROM THE DEFINITION OF SUBDIVISION
RANGE " WEST, TOWNSHIP 4 NORTH, SECTION 10
PART OF THE WEST HALF OF THE SOUTHWEST QUARTER (W'SW4) :
WHEREAS , on May 5 , 1972 , the General Assembly
of the State of Colorado , enacted Senate Bill #35 as relates
to Chapter 106 of the Colorado Revised Statutes , and
WHEREAS , on August 30 , 1972 , the Board of County
Commissioners of Weld County, Colorado , adopted Subdivision
Regulations for Weld County, Colorado to comply with the
prescribed Senate Bill #35 , and
WHEREAS, the Weld County Planning Commission
has recommended to the Board of County Commissioners for
recording of plat number 1055-10-3-RE122 as provided in
Section 9 of the Subdivision Regulations (exemption rules and
regulations) for Weld County, Colorado.
Said division of land determined to be exempt
from the definition of subdivision is more particularly
described as follows :
The West Half (W'A) of the Southwest Quarter (SW4) of
Section 10 , Township 4 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as
follows :
Beginning at the Southwest Corner (SWCor) of said Section
10 , and considering the West line of said Section 10 as
bearing North 00°00 ' 00" East, with all other bearings
contained herein relative thereto;
Thence North 00°00 ' 00" East, along the West line of said
Section 10, 2653. 03 feet to the West Quarter Corner (WaCor)
of said Section 10 ;
Thence South 89°43' 28" East, 1313.00 feet;
Thence South 00°17' 13" East, 2646 . 32 feet to a point on the
South line of said Section 10 ; Thence South 89°58 ' 53" West,
along the South line of said Section 10, 1326 . 20 feet to the
Point of Beginning;
Said described parcel of land contains 79 . 269 acres, more or
less including a strip of ground 30 feet in width along the
West line of said Section 10 , reserved for County Road
right-of-way purposes and is subject to any rights-of-way
or other easements as recorded by instruments of record or
as now existing on said parcel of land.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners of Weld County, Colorado , that the
Chairman be and he is hereby authorized to sign the plat of a
division of land determined to be exempt from the definition
of Subdivision No . 1055-10-3-RE122 , for recording .
The above and foregoing resolution was , on

Fee Agreement for Tap No 764 located on the Roy R. Lee and
Howard M. Lee property in the W 1/2, SW 1/4, Section 10,
Township 4 North, Range 65 West of the 6th P.M.
This property is now being served by Central Weld County
Water District with Mr. Richard Stroh as the tenant and the
individual to whom the water service billings are sent.

TAP FEE AGREEMENT
THIS AGREEMENT, made and entered into this 9th day of March , 19 73
by and between the CENTRAL WELD COUNTY WATER DISTRICT, hereinafter called the
District, and Roy R. Lee and Howard M. Lee
hereinafter called Customer, WITNESSETH:
WHEREAS, District has been organized as a legal body and is known as the
Central Weld County Water District, and
WHEREAS, Customers are taxpaying electors within said District, or desiring
to join said District, or - and,
WHEREAS, Customers are desirous of purchasing one water tap of 5/8"
- inches in diameter from the said District,
NOW, THEREFORE, in consideration of the nremises and the terms of this agreement,
- it is mutually agreed as follows:
'1 . Customer agrees to pay the plant investment fee of $ 700,00
Seven hundred and no/100 •Dollars
2. In the event it is not economically feasible to extend the water to the
property line of Customer, which matter is in the entire discretion of District,
then all sums paid hereunder shall be returned to Customer and the agreement shall
be null and void. - -
3. The description of the premises for which these taps are being purchased
is as follows:

W 1/2, SW 1/4, Section 10, Township 4, Range 65
4. This agreement, when annroved by the Board of Directors, shall become a
legal and binding contract upon all parties hereto.
5. Customer further agrees to execute any and all easements needed by District ` • '
at no expense to District, across Customer's property for the purpose of installing
any pipelines constructed by District. District shall be responsible for restoring
' surface area back to reasonable condition at District cost.
6. It is further mutually agreed that this agreement shall extend to and be
binding upon the heirs, executors, administrators and assigns of the parties hereto.
7. Customer further agrees to the following special provisions:
