RE: APPROVE SIX (6) INTERGOVERNMENTAL AGREEMENTS FOR SCHOOL
RESOURCE OFFICER SERVICES AND AUTHORIZE CHAIR TO SIGN-VARIOUS
ENTITIES
WHEREAS,the Board of County Commissioners of Weld County,Colorado,pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County,Colorado,and
WHEREAS,the Board has been presented with Six(6)Intergovernmental Agreements
for School Resource Officer Services between the County of Weld,State of Colorado,by and
through the Board of County Commissioners of Weld County,on behalf of the Sheriff's Office,
and the various entities listed below,commencing upon full execution of signatures,with further
terms and conditions being as stated in said agreements,and
1.Weld County School District 6(Greeley/Evans)
2.Weld County School District RE-10J(Briggsdale)
3.Cardinal Community Academy Charter School(Keenesburg)
4.Weld County School District RE-2(Eaton)
5.Weld County School District RE-11(Prairie,New Raymer)
6.Weld County School District RE-12(Pawnee,Grover)
WHEREAS,after review,the Board deems it advisable to approve said agreements,
copies of which are attached hereto and incorporated herein by reference.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County,Colorado,that the Six(6)Intergovernmental Agreements for School Resource
Officer Services between the County of Weld,State of Colorado,by and through the Board of
County Commissioners of Weld County,on behalf of the Sheriff's Office,and the various entities
listed above,be,and hereby are,approved.
BE IT FURTHER RESOLVED by the Board that the Chair be,and hereby is,authorized
to sign said agreements.

Brief description of the problem/Issue:
Weld County Sheriffs Office has started a School Resource Officer Unit(SRO)for six schools In unincorporated Weld County.This provides an
uniformed Deputy and a Supervisor within the schools for,deterrence,teaching.community engagement and criminal issues.These schools(except for
Bella Romero)are located in very rural areas.and response to them during a critical incident would be extended without the SRO's.
What options exist for the Board?
-Approve the IGA,as this program has started and is in use.Sic deputies and one supervisor have been added to the Sheriffs allocation specifically for
this unit.They area currently In the schools,with enthusiastic reception and partnership.
-Deny,and SRO's will be removed from the six schools,placed back into Patrol's rotation and eventually lost through retirements/attrition.
Consequences:
A void will be left in those particular schools,making them more vulnerable g a critical incident occurs.
Impacts:
Strong partnerships have already been forged with the Schools and School Districts.Positive impacts have been made with students and
teachers.
Cost(Current Fiscal Year/Ongoing or Subsequent Fiscal Years:
FY2024 Budget reflects an operating budget of$998,616 for this program,funded out of general funds.
Recommendation:
Keep SRO's in the schools as currently designed.

INTERGOVERNMENTAL AGREEMENT BETWEEN THE WELD COUNTY BOARD
OF COMMISSIONERS ON BEHALF OF THE WELD COUNTY SHERIFF'S OFFICE
AND THE GREELEY-EVANS SCHOOL DISTRICT FOR SCHOOL RESOURCE
OFFICER SERVICES
THIS Intergovernmental Agreement(hereinafter"IGA")is made by and between the
Board of County Commissioners of Weld County(hereinafter"County")by and on behalf
of the Weld County Sheriffs Office,(hereinafter"WCSO"),and the GREELEY-EVANS
School District(hereinafter"GREELEY-EVANS")(collectively the"Parties").
WITNESSETH:
WHEREAS,WCSO,GREELEY-EVAN,,and the community are significantly
impacted by the demands placed upon them to address incidents and situations directly or
indirectly related to juveniles and the schools,and
WHEREAS,the problems of safety,alcohol and substance abuse,gang involvement,
and other crime related problems which negatively affect the community and the school can
best be addressed in a proactive and preventive manner,and
WHEREAS,County,WCSO,and GREELEY-EVANS desire to implement a School
Resource Officer program to provide a school-based approach to the development of a
positive relationship between students and peace officers,and
WHEREAS,such programs are recognized as being effective in the development of a
positive relationship between law enforcement,faculty,and young people and in the
prevention of crime.
NOW,THEREFORE,FOR AND IN CONSIDERATION of the mutual
covenants and agreements below appearing,the Parties agree as follows
I.DEFINITIONS
The following terms shall be defined as follows for purposes of this IGA:
1. SRO:School Resource Officer.A Colorado certified peace officer employed as a
deputy sheriff by County and WCSO.
2. School Year: The period of time beginning in mid-August when students first attend
school and continuing through the last day students are in attendance at school in late May.
By way of example,the School Year for 2023-2024 shall be defined as
beginning X123 ,and running through 5/31/24

H.IGA TERM
1. INITIAL TERM AND AUTOMATIC RENEWAL.The initial term of this IGA shall
be from 8/1/23 ,and continue through 6/30/24 ,unless sooner terminated
pursuant to Section V.of this IGA.Subsequent to the initial term,this IGA shall
automatically renew for one-year terms beginning 7/1/24 of each year and ending
6/30/25 of the next year,unless any party to this IGA provides written
notice of its intent to not renew this IGA sixty days prior to the automatic
renewal.
2.EXTENSTION OR AMENDMENT.Any renewal term of this IGA may be subject to
changes in services provided.Should a change in services be determined by County and
WCSO,WCSO shall notify GREELEY-EVANS in writing of the proposed revision(s)at
least ninety days prior to the end of the then current term.Any modification of the
services shall be memorialized as a written amendment to this IGA.Any amendments or
modifications to any of the terms or conditions of this agreement shall be in writing signed by
both parties.
III.SCOPE OF SRO SERVICES
1. SRO SERVICES.WCSO shall assign one SRO to work with the administration,faculty,
and students of GREELEY-EVANS.The SRO shall provide the following services during
the School Year subject to the conditions set forth in Section III(2)and any other qualifying
terms set forth in this IGA:
A. Assist in the prevention and control of crime and disorder on the campus and in
the immediate area of the school.
B. Conduct or assist in the investigation of offenses on campus.
C. Provide presentations and available educational resources in the following
areas:alcohol and substance abuse,law-related education,criminal justice
system orientation,safety,crime prevention,gang involvement and awareness,
community responsibility for students and other groups associated with the
school.
D. As requested by school staff,provide instructional resources for classroom
presentations as time permits.
E. Enforce state statutes and county codes as appropriate.
F. Appear in court and assist in prosecution and other judicial processes as
appropriate.
G. Assist in the coordination of efforts of other enforcement agencies on the

campus.
H. Provide visible presence on the campus.
I. Assist security personnel with appropriate monitoring and enforcement in the
parking lots and other assets of the school.
J. Attend school-related functions during normal classroom hours.Officers may
be asked to adjust their hours from time to time to attend social events such as
presentations,public meetings,and sporting events,etc.This will not replace
security and off-duty work already in place.
K. Contribute to the positive police-school-community relation efforts,especially
as these efforts relate to students and faculty.
L. At the request of GREELEY-EVANS,additional functions may be provided at
the sole discretion of WCSO on a one time or continuing basis.In no case,shall
WCSO be bound under this IGA to provide any additional requested function
not listed herein and WCSO may discontinue any such additional function once
provided at any time thereafter.
2.WORK SCHEDULE.The SRO will work a schedule consistent with WCSO
ordinances,policies,procedures and subject to the Fair Labor Standards Act.Except as
otherwise provided in this IGA,the SRO shall work a schedule mutually established
among the Parties.The obligation of County and WCSO to provide the services set forth
in Section III(1)is subject to the following terms:
A. During times the SRO is absent due to illness or utilization of benefits,
County and WCSO shall not be required to provide services pursuant to this
IGA.
B. Except for the services described in(B)and(F)of above Section III(1),
County and WCSO shall not be responsible for providing services pursuant to
this IGA during spring break,holiday breaks and other days when school is not
in session.During times when the SRO is not responsible for providing
services pursuant to this IGA,or when the SRO is not scheduled to provide
services,WCSO reserves the right to assign duties to the SRO.
C. The SRO shall be required to attend training mandated by WCSO scheduled
throughout the year.During such training,County and WCSO shall not be
required to provide services pursuant to this IGA.
D. In the event of an emergency,as reasonably determined by WCSO,the SRO
may be required to perform general law enforcement duties.County and

WCSO shall not be obligated to provide the services pursuant to this IGA
until such emergency ends.
3.SRO SUPERVISION.The SRO is subject to WCSO chain of command and the
supervision of the assigned WCSO supervisor(s).Day to day supervision will be assigned
to the assigned WCSO supervisor(s).The assigned WCSO supervisor will be responsible
for maintaining contact with the school administration.The SRO will work closely with
the school administration and faculty to determine the most effective use of the SRO's
time and expertise.At no time,however,shall the SRO be subject to the supervision or
direction of GREELEY-EVANS,or their officers,agents,or employees.The SRO will
comply with the policies and regulations of GREELEY-EVANS to the extent that such
policies and regulations are not in conflict with those of WCSO,are not in conflict with
other terms contained herein or direction of WCSO,and are not in conflict with federal,
state,or municipal laws.
4.PERFORMANCE APPRAISAL.The SRO's performance will be evaluated consistent
with WCSO policy and procedures by the assigned supervisor and will accept input from
the schools'designee(s).
5.VEHICLE.WCSO shall provide the SRO with a WCSO vehicle for on-duty use during the
term of this IGA.
IV.CONSIDERATION FOR SRO SERVICES
The Parties agree that the Weld County Board of Commissioners will cover all expenses of
the SRO in consideration of the benefits received by the GREELEY-EVANS School District of
enhanced school safety and fostering law enforcement relationships with Weld County
Schools and their students.
V.TERMINATION
This IGA may be terminated without cause or for convenience by any Party upon 60
days written notice to the other Party.
VI.ADDITIONAL TERMS
1. EMPLOYMENT STATUS AND RELATIONSHIP OF PARTIES.
The SRO shall at all times during the term of this IGA be considered an employee of
County and WCSO and shall maintain the status of independent contractor with respect
to GREELEY-EVANS.The SRO will be subject at all times during the performance of this
IGA to the ordinances,policies,procedures,rules,regulations,directives,and orders of
County and WCSO.
Furthermore,it is mutually agreed and understood that nothing contained in this IGA is

mtended,nor shall be construed m any way,to establish the relationship of co-partners or a
Jomt venture between the County,WCSO,GREELEY-EVANS.It shall also not be -
construed that GREELEY-EVANS mcludmg their officers,agents,volunteers and
employees,are employees or agents of the County or WCSO GREELEY-EVANS shall not
represent that the SRO is an employee or agent of the school in any capacity.The SRO
shall not represent that he/she is an employee or agent of GREELEY-EVANS in any
capacity
2 HOLD HARMLESS.Each party to this IGA shall be responsible for its own acts and/or
omissions and those of its officers,employees,and agents in the performance of this IGA.
No party to this IGA shall be responsible for the acts and/or omissions of entities or
mdividuals not a party to this IGA.
3 PROOF OF INSURANCE.All parties to this IGA shall maintain general habihty
insurance dung the term of this IGA for protection from claims for bodily injury,death,
property,damage,and personal injury which may arise through the execution of this IGA.
Upon request any party shall provide a copy of such general liabihty coverage then m effect
b the requesting party.
4 ATTORNEY'S FEES.In the event of litigation or other action brought to enforce the
terms of this IGA,each party shall bear its own attorney's fees and costs.
5.ENTIRE AGREEMENT.This IGA contains the entire understanding of the Parties with
respect to the subject matter hereof,and all other understandings or agreement shall be
deemed merged mto this IGA.Amendments of this IGA may be made only in writing and
signed by all Parties hereto
6 THIRD PARTY BENEFICIARIES.None of the terms or conditions in this IGA give or
allow any claim,benefit,or right of action by any third person not a party hereto Any
person or entity other than County,WCSO,GREELEY-EVANS receiving services or
benefits under this IGA is an incidental beneficiary
7.GOVERNMENTAL IMMUNITY No term or condition of this Agreement shall be construed
or interpreted as a waiver,express or implied,of any of the immunities,rights,benefits,
protections or other provisions,of the Colorado Governmental Immunity Act§§2410-101 et
seq.,as apphcable now or hereafter amended
S.FUND AVAILABILITY.Financial obhgations of the County payable after the current fiscal
year are contingent upon funds for that purpose being appropriated,budgeted,and otherwise
made available.Execution of this Agreement by County does not create an obligation on the part
of County to expend fimds not otherwise appropriated in each succeeding year
Services provided pursuant to this Agreement,whether m whole or m part,is subject to and
contingent upon the continuing availability of said funds for the purposes hereof.In the event that
said funds,or any part thereof,become unavailable as detennmed by the County,the County may
unmediately temunate the Agreement or amend it accordingly

9 BOARD OF COUNTYCMVIESSIONERS OF WELD COUNTY APPROVAL This
Agreement shall not be valid until it has been approved by the Board of County Commissioners
of Weld County,Colorado,or its designee
10 ACKNOWLEDGE1VIENT.Weld County;WCSO,and GREELEY EVANS acknowledge that
each has read this agreement,understands it and agrees to be bound by its terms Both parties
further agree that this agreement,is the complete and exclusive statement of amt between
the parties and supersedes all proposals or prior agreements,oral or written,and any other
communications between the parties relating to the subject matter of this Agreement.
11 NOTICES Any notice provided form this IGA shall be m wntmg and shall be served by
personal delivery or by certified mail,return receipt requested,postage prepaid,at the addresses
set forth below,until such time as wntten notice of change is received from a party wishing to
make a change of address Additionally,notice shall be sent by email Any notice mailed and/or
served as set forth above,shall be deemed delivered and effective upon receipt or delivery

B. Except for the services described in(B)and(F)of above Section III(1),
County and WCSO shall not be responsible for providing services pursuant to
this IGA during spring break,holiday breaks and other days when school is not
in session.During times when the SRO is not responsible for providing
services pursuant to this IGA,or when the SRO is not scheduled to provide
services,WCSO reserves the right to assign duties to the SRO.
C. The SRO shall be required to attend training mandated by WCSO scheduled
throughout the year.During such training,County and WCSO shall not be
required to provide services pursuant to this IGA.
D. In the event of an emergency,as reasonably determined by WCSO,the SRO
may be required to perform general law enforcement duties.County and

WCSO shall not be obligated to provide the services pursuant to this IGA
until such emergency ends.
3.SRO SUPERVISION.The SRO is subject to WCSO chain of command and the
supervision of the assigned WCSO supervisor(s).Day to day supervision will be assigned
to the assigned WCSO supervisor(s).The assigned WCSO supervisor will be responsible
for maintaining contact with the school administration.The SRO will work closely with
the school administration and faculty to determine the most effective use of the SRO's
time and expertise.At no time,however,shall the SRO be subject to the supervision or
direction of WELD RE 10J ,or their officers,agents,or employees.The SRO will
comply with the policies and regulations of WELD RE 10J to the extent that such
policies and regulations are not in conflict with those of WCSO,are not in conflict with
other terms contained herein or direction of WCSO,and are not in conflict with federal,
state,or municipal laws.
4.PERFORMANCE APPRAISAL.The SRO's performance will be evaluated consistent
with WCSO policy and procedures by the assigned supervisor and will accept input from
the schools'designee(s).
5.VEHICLE. WCSO shall provide the SRO with a WCSO vehicle for on-duty use during the
term of this IGA.
IV.CONSIDERATION FOR SRO SERVICES
The Parties agree that the Weld County Board of Commissioners will cover all expenses of
the SRO in consideration of the benefits received by the WELD RE 10J School District of
enhanced school safety and fostering law enforcement relationships wills Weld County
Schools and their students.
V.TERMINATION
This IGA may be terminated without cause or for convenience by any Party upon 60
days written notice to the other Party.
VI.ADDITIONAL TERMS
1. EMPLOYMENT STATUS AND RELATIONSHIP OF PARTIES.
The SRO shall at all times during the term of this IGA be considered an employee of
County and WCSO and shall maintain the status of independent contractor with respect
to WELD RE 10J .The SRO will be subject at all times during the performance of this
IGA to the ordinances,policies,procedures,rules,regulations,directives,and orders of
County and WCSO.
Furthermore,it is mutually agreed and understood that nothing contained in this IGA is

intended,nor shall be construed in any way,to establish the relationship of co-partners or a
joint venture between the County,WCSO,WELD RE LW _ It shall also not be
construed that WELD RE lOJ including their officers,agents,volunteers and
employees,are employees or agents of the County or WCSO WELD RE IOJ___ „shall not
represent that the SRO is an employee or agent of the school in any capacity The SRO

2 HOLD HARMLESS.Each party to this IGA shall be responsible for its own acts and/or
omissions and those of its officers,employees,and agents in the performance of this IGA
No party to this IGA shall be responsible for the acts and/or omissions of entities or
individuals not a party to this IGA
3 PROOF OF INSURANCE.All parties to this IGA shall maintain general liability
insurance during the term of tlus IGA for protection from claims for bodily injury,death,
property,damage,and personal injury which may arise through the execution of this IGA.
Upon request any party shall provide a copy of such general liability coverage then in effect
to the requesting party
4 ATTORNEY'S FEES.In the event of litigation or other action brought to enforce the
terms of this IGA,each party shall bear its own attorney's fees and costs.
5 ENTIRE AGREEMENT.This IGA contains the entire understanding of the Parties with
respect to the subject matter hereof,and all other understandings or agreements shall be
deemed merged into this IGA Amendments of this IGA may be made only in writing and
signed by all Parties hereto
6 THIRD PARTY BENEFICIARIES.None of the terms or conditions in this IGA give or
allow any claim,benefit,or right of action by any third person not a party hereto Any
person or entity other than County,WCSO,WELD RE 10.1 receiving services or
benefits under this IGA is an incidental beneficiary
7 GOVERNMENTAL IMMUNITY No term or condition of this Agreement shall be construed
01 interpreted as a waiver,express or implied,of any of the immunities,lights,benefits,
protections or other provisions,of the Colorado Governmental Immunity Act-§§2410-141 et
seq,as applicable now or hereafter amended
8 FUND AVAILABILITY.Financial obligations of the County payable after the current fiscal
year are contingent upon funds for"that purpose being appropriated,budgeted,and otherwise
made available Execution of this Agreement by County does not create an obligation on the part
of County to expend funds not otherwise appropriated in each succeeding year
Services provided pursuant to this Agreement,whether in whole or in part,is subject to and
contingent upon the continuing availability of said funds for the purposes hereof In the event that
said funds,or any part thereof,become unavailable as determined by the County,the County may
immediately terminate the Agreement or amend it accoidingly

Brief description of the problem/Issue:
Weld County Sheriffs Office has started a School Resource Officer Unit(SRO)for six schools in unincorporated Weld County.This provides an
uniformed Deputy and a Supervisor within the schools for,deterrence,teaching.community engagement and criminal issues.These schools(except for
Bella Romero)are located in very rural areas,and response to them during a critical incident would be extended without the SRCJrs.
What options exist for the Board?
-Approve the IGA,as this program has started and is in use.Six deputies and one supervisor have been added to the Sheriffs allocation specifically for
this unit.They area currently in the schools,with enthusiastic reception and partnership.
-Deny,and SRO's will be removed from the six schools,placed back into Patrols rotation and eventually lost through retirementsfattritions.
Consequences:
A void will be left in those particular schools,making them more vulnerable if a critical incident occurs.
Impacts:
Strong partnerships have already been forged with the Schools and School Districts.Positive impacts have been made with students and
teachers.
Cost(Current Fiscal Year/Ongoing or Subsequent Fiscal Years:
FY2024 Budget reflects an operating budget of$998,616 for this program,funded out of general funds.
Recommendation:
Keep SRO's in the schools as currently designed.

THIS Intergovernmental Agreement(hereinafter"IGA")is made by and between the
Board of County Commissioners of Weld County(hereinafter"County")by and,gp behalf
of the Weld County Sheriff's Office,(hereinafter"WCSO"),and,t e(1cyid /(400,u,4,44/4'4"/
Schcralllistrict(hereinafter GC / ")(collectively the"Parties").
WITNESSETH:
WHEREAS,WCSO, Se boo/ ,and the community are significantly
impacted by the demands placed upon them to address incidents and situations directly or
indirectly related to juveniles and the schools,and
WHEREAS,the problems of safety,alcohol and substance abuse,gang involvement,
and other crime related problems which negatively affect the community and the school can
best be addressed in a proactive and preventive manner,and
WHEREAS,County,WCSO,and Se he,/ desire to implement a School
Resource Officer program to provide a school-based approach to the development of a
positive relationship between students and peace officers,and
WHEREAS,such programs are recognized as being effective in the development of a
positive relationship between law enforcement,faculty,and young people and in the
prevention of crime.
NOW,THEREFORE,FOR AND IN CONSIDERATION of the mutual
covenants and agreements below appearing,the Parties agree as follows
I.DEFINITIONS
The following terms shall be defined as follows for purposes of this IGA:
1. SRO:School Resource Officer.A Colorado certified peace officer employed as a
deputy sheriff by County and WCSO.
2. School Year: The period of time beginning in mid-August when students first attend
school and continuing through the last day students are in attendance at school in late May.
By way of example,the School Year for 2023-2024 shall be defined as
beginning 41,3///5/-2.023 ,and running through/u1cy 2-7 2G2' .

IL IGA TERM
1. INITIAL TERM AND AUTOMATIC RENEWAL.The initial term of this IGA shall
be from/47/3/J 1572023,and continue through/1/.,25,2p2 y,unless sooner terminated
pursuant to Section V.of this IGA.Subsequent to the initial term,this IGA shall
automatically renew for one-year terms beginning Firs"bayef /of each year and ending
Ls,/At er S/r./of the next year,unless any party to this IGA provides written
notice of its intent to not renew this IGA sixty days prior to the automatic
renewal.
2.EXTENSTION OR AMENDMENT.Any renewal term of this IGA may be subject to
changes in services provided.Should a change in services be determined by County and
WCSO,WCSO shall notify c f / in writing of the proposed revision(s)at
least ninety days prior to the end of the then current term.Any modification of the
services shall be memorialized as a written amendment to this IGA.Any amendments or
modifications to any of the terms or conditions of this agreement shall be in writing signed by
both parties.
III. SCOPE OF SRO SERVICES
1. SRO SERVICES.WCSO shall assign one SRO to work with the administration,faculty,
and students of Se Aoo/ .The SRO shall provide the following services during
the School Year subject to the conditions set forth in Section III(2)and any other qualifying
terms set forth in this IGA:
A. Assist in the prevention and control of crime and disorder on the campus and in
the immediate area of the school.
B. Conduct or assist in the investigation of offenses on campus.
C. Provide presentations and available educational resources in the following
areas:alcohol and substance abuse,law-related education,criminal justice
system orientation,safety,crime prevention,gang involvement and awareness,
community responsibility for students and other groups associated with the
school.
D. As requested by school staff,provide instructional resources for classroom
presentations as time permits.
E. Enforce state statutes and county codes as appropriate.
F. Appear in court and assist in prosecution and other judicial processes as
appropriate.
G. Assist in the coordination of efforts of other enforcement agencies on the

campus.
H. Provide visible presence on the campus.
I. Assist security personnel with appropriate monitoring and enforcement in the
parking lots and other assets of the school.
J. Attend school-related functions during normal classroom hours.Officers may
be asked to adjust their hours from time to time to attend social events such as
presentations,public meetings,and sporting events,etc.This will not replace
security and off-duty work already in place.
K. Contribute to the positive police-school-community relation efforts,especially
as these efforts relate to students and faculty.
L. At the request of CAer)/ ,additional functions may be provided at
the sole discretion of WCSO on a one time or continuing basis.In no case,shall
WCSO be bound under this IGA to provide any additional requested function
not listed herein and WCSO may discontinue any such additional function once
provided at any time thereafter.
2.WORK SCHEDULE.The SRO will work a schedule consistent with WCSO
ordinances,policies,procedures and subject to the Fair Labor Standards Act.Except as
otherwise provided in this IGA,the SRO shall work a schedule mutually established
among the Parties.The obligation of County and WCSO to provide the services set forth
in Section III(1)is subject to the following terms:
A. During times the SRO is absent due to illness or utilization of benefits,
County and WCSO shall not be required to provide services pursuant to this
IGA.

Brief description of the problem/issue:
Weld County Sheriffs Office has started a School Resource Officer Unit(SRO)for six schools in unincorporated Weld County.This provides an
uniformed Deputy and a Supervisor within the schools for,deterrence,teaching,community engagement and criminal issues.Ttese schools(except for
Bella Romero)are located in very rural areas,and response to them during a critical incident would be extended without the SRO's.
What options exist for the Board?
-Approve the lGA,as this program has started and is in use.Six deputies and one supervisor have been added to the Sheriffs allocation specifically for
this unit.They area currently in the schools,with enthusiastic reception and partnership.
-Deny,and SRO's will be removed from the six schools,placed back into Patrol's rotation and eventually lost through retirementstattritions.
Consequences:
A void will be left in those particular schools,making them more vulnerable if a critical incident occurs.
Impacts:
Strong partnerships have already been forged with the Schools and School Districts.Positive impacts have been made with students and
teachers.
Cost(Current Fiscal Year/Ongoing or Subsequent Fiscal Years:
FY2024 Budget reflects an operating budget of$998,616 for this program,funded out of general funds.
Recommendation:

OF COMMISSIONERS ON BEHALF OF THE WELD COUNTY SHERIFF'S OFFICE
AND THE Eaten school District SCHOOL DISTRICT FOR SCHOOL RESOURCE
OFFICER SERVICES
THIS Intergovernmental Agreement(hereinafter"IGA")is made by and between the
Board of County Commissioners of Weld County(hereinafter"County")by and on behalf
of the Weld County Sheriff's Office,(hereinafter"WCSO"),and the Eaton school District
School District(hereinafter"Eaton school District ")(collectively the"Parties").
WITNESSETH:
WHEREAS,WCSO,Eaton School District ,and the community are significantly
impacted by the demands placed upon them to address incidents and situations directly or
indirectly related to juveniles and the schools,and
WHEREAS,the problems of safety,alcohol and substance abuse,gang involvement,
and other crime related problems which negatively affect the community and the school can
best be addressed in a proactive and preventive manner,and
WHEREAS,County,WCSO,and Eaton School District desire to implement a School
Resource Officer program to provide a school-based approach to the development of a
positive relationship between students and peace officers,and
WHEREAS,such programs are recognized as being effective in the development of a
positive relationship between law enforcement,faculty,and young people and in the
prevention of crime.
NOW,THEREFORE,FOR AND IN CONSIDERATION of the mutual
covenants and agreements below appearing,the Parties agree as follows
I.DEFINITIONS
The following terms shall be defined as follows for purposes of this IGA:
1. SRO:School Resource Officer.A Colorado certified peace officer employed as a
deputy sheriff by County and WCSO.
2. School Year: The period of time beginning in mid-August when students first attend
school and continuing through the last day students are in attendance at school in late May.
By way of example,the School Year for 2023-2024 shall be defined as
beginning August 14,2023 ,and running through May 24,2024

II.IGA TERM
1. INITIAL TERM AND AUTOMATIC RENEWAL.The initial term of this IGA shall
be from August 14,202.3 ,and continue through May 24.2024 ,unless sooner terminated
pursuant to Section V.of this IGA.Subsequent to the initial term,this IGA shall
automatically renew for one-year terms beginning August of each year and ending
May _ of the next year,unless any party to this IGA provides written
notice of its intent to not renew this IGA sixty days prior to the automatic
renewal.
2.EXTENSTION OR AMENDMENT.Any renewal term of this IGA may be subject to
changes in services provided.Should a change in services be determined by County and
WCSO,WCSO shall notify Eaton School District in writing of the proposed revision(s)at
least ninety days prior to the end of the then current term.Any modification of the
services shall be memorialized as a written amendment to this IGA.Any amendments or
modifications to any of the terms or conditions of this agreement shall be in writing signed by
both parties.
III.SCOPE OF SRO SERVICES
1. SRO SERVICES.WCSO shall assign one SRO to work with the administration,faculty,
and students of Eaton School District .The SRO shall provide the following services during
the School Year subject to the conditions set forth in Section III(2)and any other qualifying
terms set forth in this IGA:
A. Assist in the prevention and control of crime and disorder on the campus and in
the immediate area of the school.
B. Conduct or assist in the investigation of offenses on campus.
C. Provide presentations and available educational resources in the following
areas:alcohol and substance abuse,law-related education,criminal justice
system orientation,safety,crime prevention,gang involvement and awareness,
community responsibility for students and other groups associated with the
school.
D. As requested by school staff,provide instructional resources for classroom
presentations as time permits.
E. Enforce state statutes and county codes as appropriate.
F. Appear in court and assist in prosecution and other judicial processes as
appropriate.
G. Assist in the coordination of efforts of other enforcement agencies on the

campus.
H. Provide visible presence on the campus.
I. Assist security personnel with appropriate monitoring and enforcement in the
parking lots and other assets of the school.
J. Attend school-related functions during normal classroom hours.Officers may
be asked to adjust their hours from time to time to attend social events such as
presentations,public meetings,and sporting events,etc.This will not replace
security and off-duty work already in place.
K. Contribute to the positive police-school-community relation efforts,especially
as these efforts relate to students and faculty.
L. At the request of Eaton School District ,additional functions may be provided at
the sole discretion of WCSO on a one time or continuing basis.In no case,shall
WCSO be bound under this IGA to provide any additional requested function
not listed herein and WCSO may discontinue any such additional function once
provided at any time thereafter.
2.WORK SCHEDULE.The SRO will work a schedule consistent with WCSO
ordinances,policies,procedures and subject to the Fair Labor Standards Act.Except as
otherwise provided in this IGA,the SRO shall work a schedule mutually established
among the Parties.The obligation of County and WCSO to provide the services set forth
in Section III(1)is subject to the following terms:
A. During times the SRO is absent due to illness or utilization of benefits,
County and WCSO shall not be required to provide services pursuant to this
IGA.
B. Except for the services described in(B)and(F)of above Section III(1),
County and WCSO shall not be responsible for providing services pursuant to
this IGA during spring break,holiday breaks and other days when school is not
in session.During times when the SRO is not responsible for providing
services pursuant to this IGA,or when the SRO is not scheduled to provide
services,WCSO reserves the right to assign duties to the SRO.
C. The SRO shall be required to attend training mandated by WCSO scheduled
throughout the year.During such training,County and WCSO shall not be
required to provide services pursuant to this IGA.
D. In the event of an emergency,as reasonably determined by WCSO,the SRO
may be required to perform general law enforcement duties.County and

WCSO shall not be obligated to provide the services pursuant to this IGA
until such emergency ends.
3.SRO SUPERVISION.The SRO is subject to WCSO chain of command and the
supervision of the assigned WCSO supervisor(s).Day to day supervision will be assigned
to the assigned WCSO supervisor(s).The assigned WCSO supervisor will be responsible
for maintaining contact with the school administration.The SRO will work closely with
the school administration and faculty to determine the most effective use of the SRO's
time and expertise.At no time,however,shall the SRO be subject to the supervision or
direction of Eaton school District ,or their officers,agents,or employees.The SRO will
comply with the policies and regulations of Eaton School District to the extent that such
policies and regulations are not in conflict with those of WCSO,are not in conflict with
other terms contained herein or direction of WCSO,and are not in conflict with federal,
state,or municipal laws.
4.PERFORMANCE APPRAISAL.The SRO's performance will be evaluated consistent
with WCSO policy and procedures by the assigned supervisor and will accept input from
the schools'designee(s).
5.VEHICLE. WCSO shall provide the SRO with a WCSO vehicle for on-duty use during the
term of this IGA.
IV.CONSIDERATION FOR SRO SERVICES
The Parties agree that the Weld County Board of Commissioners will cover all expenses of
the SRO in consideration of the benefits received by the Caton School District School District of
enhanced school safety and fostering law enforcement relationships with Weld County
Schools and their students.
V.TERMINATION
This IGA may be terminated without cause or for convenience by any Party upon 60
days written notice to the other Party.
VI.ADDITIONAL TERMS
1. EMPLOYMENT STATUS AND RELATIONSHIP OF PARTIES.
The SRO shall at all times during the term of this IGA be considered an employee of
County and WCSO and shall maintain the status of independent contractor with respect
to Eaton school District .The SRO will be subject at all times during the performance of this
IGA to the ordinances,policies,procedures,rules,regulations,directives,and orders of
County and WCSO.
Furthermore,it is mutually agreed and understood that nothing contained in this IGA is

intended,nor shall be construed in any way,to establish the relationship of co-partneis or a
joint venture between the County,WCSO,Eaton school District It shall also not be
construed that Eaton School Distnct including their officers,agents,volunteers and
employees,are employees or agents of the County or WCSO Eaton School Distnctshall not
represent that the SRO is an employee or agent of the school in any capacity The SRO
shall not represent that he/she is an employee or agent of Eaton,School District in any
capacity
2 HOLD HARMLESS.Each party to this IGA shall be responsible for its own acts and/or
omissions and those of its officers,employees,and agents in the performance of this IGA
No party to this IGA shall be responsible for the acts and/or omissions of entities or
individuals not a party to this IGA
3 PROOF OF INSURANCE.All parties to this IGA shall maintain general liability
insurance during the tern of this IGA for protection from claims for bodily injury,death,
property,damage,and personal injury which may arise through the execution of this IGA.
Upon request any party shall provide a copy of such general liability coverage then in effect
to the requesting party.
4 ATTORNEY'S FEES.In the event of litigation or other action brought to enforce the
terms of this IGA,each party shall bear its own attorney's fees and costs
5 ENTIRE AGREEMENT.This IGA contains the entire understanding of the Parties with
respect to the subject matter hereof,and all other understandings or agreements shall be
deemed merged into this IGA Amendments of this IGA may be made only in wasting and
signed by all Parties hereto
6 THIRD PARTY BENEFICIARIES.None of the terms or conditions in this IGA give or
allow any claim,benefit,or right of action by any third person not a party hereto Any
person or entity other than County,WCSO,Eaton school District receiving services or
benefits under this IGA is an incidental beneficiary
7 GOVERNMENTAL IMMUNITY No term or condition of this Agreement shall be construed
or interpreted as a waiver,express or implied,of any of the immunities,rights,benefits,
protections or other provisions,of the Colorado Governmental Immunity Act§§24-10-101 et
seq,as applicable now or hereafter amended
8 FUND AVAILABILITY.Financial obligations of the County payable after the current fiscal
year are contingent upon funds for that purpose being appropriated,budgeted,and otherwise
made available Execution of this Agreement by County does not create an obligation on the part
of County to expend funds not otherwise appropriated in each succeeding year
Services provided pursuant to this Agreement,whether m whole or m part,is subject to and
contingent upon the continuing availability of said funds for the purposes hereof In the event that
said funds,or any part thereof,become unavailable as determined by the County,the County may
immediately terminate the Agreement or amend it accordingly

9 BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY APPROVAL This
Agreement shall not be valid until it has been approved by the Board of County Commissioners
of Weld County,Colorado,or its designee
10 ACKNOWLEDGEMENT.Weld County,WCSO,and Eaton School astre acknowledge that
each has read this agreement,understands it and agrees to be bound by its terms Both parties
further agree that this agreement,is the complete and exclusive statement of agreement between
the parties and supersedes all proposals or pnor agreements,oral or written,and any other
commumcations between the parties relating to the subject matter of this Agreement
11 NOTICES Any notice provided form this IGA shall be in writing and shall be served by
personal delivery or by certified mall,return receipt requested,postage prepaid,at the addresses
set forth below,until such time as wntten notice of a change is received from a party wishing to
make a change of address Additionally,notice shall be sent by email Any notice mailed and/or
served as set forth above,shall be deemed delivered and effective upon receipt or delivery

2 HOLD HARMLESS.Each party to this IGA shall be responsible for its own acts and/or
omission and those of its officers,employees,and agents in the performance of this IGA
No party to this IGA shall be responsible for the acts and/or omissions of entities or
individuals not a party to this IGA
3 PROOF OF INSURANCE.All parties to this IGA shall maintain general liability
insurance during the term of this IGA for protection from claims for bodily injury,death,
property,damage,and personal injury which may arise through the execution of this IGA.
Upon request any party shall provide a copy of such general liability coverage then in effect
to the requesting party
4 ATTORNEY'S FEES.In the event of litigation or other action brought to enforce the
terms of this IGA,each party shall bear its own attorney's fees and costs
5 ENTIRE AGREEMENT.Tlus IGA contains the entire understanding of the Parties with
respect to the subject matter hereof,and all other understandings or agreements shall be
deemed merged into this IGA Amendments of this IGA may be made only in writing and
signed by all Parties hereto
6 THIRD PARTY BENEFICIARIES.None of the terms or conditions m this IGA give or
allow any claim,benefit,or nght of action by any third person not a party hereto Any
person or entity other than County,WCSO,PRAIRIE receiving services or
benefits under this IGA is an incidental beneficiary
7 GOVERNMENTAL IMMUNITY No term or condition of this Agreement shall be construed
or interpreted as a waiver,express or implied,of any of the immunities,rights,benefits,
protections or other provisions,of the Colorado Governmental Immunity Act§§24-10-101 et
seq,as applicable now or hereafter amended
8 FUND AVAILABILITY.Financial obligations of the County payable after the current fiscal
year are contingent upon funds for that purpose being appropriated,budgeted,and otherwise
made available Execution of this Agreement by County does not create an obligation on the part
of County to expend funds not otherwise appropriated in each succeeding year
Services provided pursuant to this Agreement,whether in whole or in part,is subject to and
contingent upon the continuing availability of said funds for the purposes hereof In the event that
said funds,or any part thereof,become unavailable as determined by the County,the County may
immediately termmate the Agreement or amend it accordingly

Brief description of the problem/issue:
Weld County Sheriffs Office has started a School Resource Officer Unit(SRO)for six schools In unincorporated Weld County.This provides an
uniformed Deputy and a Supervisor within the schools for,deterrence,teaching,community engagement and criminal issues.These schools(except for
Bella Romero)are located in very rural areas,and response to them during a critical Incident would be extended without the SRO's,
What options exist for the Board?
-Approve the IGA,as this program has started and is in use.Six deputies and one supervisor have been added to the Sheriffs allocation specifically for
this unit.They area currently in the schools,with enthusiastic reception and partnership.
-Deny,and SRO's will be removed from the six schools,placed bads into Patrol's rotation and eventually lost through retirements/attritions.
Consequences:
A void will be left in those particular schools,making them more vulnerable if a critical incident occurs.
Impacts:
Strong partnerships have already been forged with the Schools and School Districts.Positive impacts have been made with students and
teachers.
Cost(Current Fiscal Year/Ongoing or Subsequent Fiscal Years:
FY2024 Budget reflects an operating budget of$998,616 for this program,funded out of general funds.
Recommendation:
Keep SRO's in the schools as currently designed.

INTERGOVERNMENTAL AGREEMENT BETWEEN THE WELD COUNTY BOARD
OF COMMISSIONERS ON BEHALF OF THE WELD COUNTY SHERIFFS OFFICE
AND THE Pawnee(RE-12) SCHOOL DISTRICT FOR SCHOOL RESOURCE
OFFICER SERVICES
THIS Intergovernmental Agreement(hereinafter"IGA")is made by and between the
Board of County Commissioners of Weld County(hereinafter"County")by and on behalf
of the Weld County Sheriffs Office,(hereinafter"WCSO"),and the Pawnee(RE-12)
School District(hereinafter"Pawnee(RE-12) ")(collectively the"Parties").
WITNESSETH:
WHEREAS,WCSO,Pawnee(RE-12) ,and the community are significantly
impacted by the demands placed upon them to address incidents and situations directly or
indirectly related to juveniles and the schools,and
WHEREAS,the problems of safety,alcohol and substance abuse,gang involvement,
and other crime related problems which negatively affect the community and the school can
best be addressed in a proactive and preventive manner,and
WHEREAS,County,WCSO,and Pawnee(RE-12) desire to implement a School
Resource Officer program to provide a school-based approach to the development of a
positive relationship between students and peace officers,and
WHEREAS,such programs are recognized as being effective in the development of a
positive relationship between law enforcement,faculty,and young people and in the
prevention of crime.
NOW,THEREFORE,FOR AND IN CONSIDERATION of the mutual
covenants and agreements below appearing,the Parties agree as follows
I.DEFINITIONS
The following terms shall be defined as follows for purposes of this IGA:
1. SRO:School Resource Officer.A Colorado certified peace officer employed as a
deputy sheriff by County and WCSO.
2. School Year: The period of time beginning in mid-August when students first attend
school and continuing through the last day students are in attendance at school in late May.

II.IGA TERM
1. I.NIJ14L TERM ANA AUTOMATIC RENEW L The initi term of this IGA shall
be from XV t t, .3 ,and continue through, .,t t vt 1nless sooner terminated
pursuant to Section V.of this IGA.Subsequent to the initiafen,this IGA shall
automatically renew for one-year terms beginning of each year and ending
of the next year,unless any party to this IGA provides written
notice of its intent to not renew this IGA sixty days prior to the automatic
renewal.
2.EXTENSTION OR AMENDMENT.Any renewal term of this IGA may be subject to
changes in services provided.Should a change in services be determined by County and
WCSO,WCSO shall notify Pawnee(RE-12) in writing of the proposed revision(s)at
least ninety days prior to the end of the then current term.Any modification of the
services shall be memorialized as a written amendment to this IGA.Any amendments or
modifications to any of the terms or conditions of this agreement shall be in writing signed by
both parties.
III.SCOPE OF SRO SERVICES
1. SRO SERVICES.WCSO shall assign one SRO to work with the administration,faculty,
and students of Pawnee(RE-12) .The SRO shall provide the following services during
the School Year subject to the conditions set forth in Section III(2)and any other qualifying
terms set forth in this IGA:
A. Assist in the prevention and control of crime and disorder on the campus and in
the immediate area of the school.
B. Conduct or assist in the investigation of offenses on campus.
C. Provide presentations and available educational resources in the following
areas:alcohol and substance abuse,law-related education,criminal justice
system orientation,safety,crime prevention,gang involvement and awareness,
community responsibility for students and other groups associated with the
school.
D. As requested by school staff,provide instructional resources for classroom
presentations as time permits.
E. Enforce state statutes and county codes as appropriate.
F. Appear in court and assist in prosecution and other judicial processes as
appropriate.
G. Assist in the coordination of efforts of other enforcement agencies on the

campus.
H. Provide visible presence on the campus.
I. Assist security personnel with appropriate monitoring and enforcement in the
parking lots and other assets of the school.
J. Attend school-related functions during normal classroom hours.Officers may
be asked to adjust their hours from time to time to attend social events such as
presentations,public meetings,and sporting events,etc.This will not replace
security and off-duty work already in place.
K. Contribute to the positive police-school-community relation efforts,especially
as these efforts relate to students and faculty.
L. At the request of Pawnee(RE-12) ,additional functions may be provided at
the sole discretion of WCSO on a one time or continuing basis.In no case,shall
WCSO be bound under this[GA to provide any additional requested function
not listed herein and WCSO may discontinue any such additional function once
provided at any time thereafter.
2.WORK SCHEDULE.The SRO will work a schedule consistent with WCSO
ordinances,policies,procedures and subject to the Fair Labor Standards Act.Except as
otherwise provided in this[GA,the SRO shall work a schedule mutually established
among the Parties.The obligation of County and WCSO to provide the services set forth
in Section III(1)is subject to the following terms:
A. During times the SRO is absent due to illness or utilization of benefits,
County and WCSO shall not be required to provide services pursuant to this
IGA.
B. Except for the services described in(B)and(F)of above Section II[(1),
County and WCSO shall not be responsible for providing services pursuant to
this IGA during spring break,holiday breaks and other days when school is not
in session.During times when the SRO is not responsible for providing
services pursuant to this IGA,or when the SRO is not scheduled to provide
services,WCSO reserves the right to assign duties to the SRO.
C. The SRO shall be required to attend training mandated by WCSO scheduled
throughout the year.During such training,County and WCSO shall not be
required to provide services pursuant to this IGA.
D. In the event of an emergency,as reasonably determined by WCSO,the SRO
may be required to perform general law enforcement duties.County and

WCSO shall not be obligated to provide the services pursuant to this IGA
until such emergency ends.
3.SRO SUPERVISION.The SRO is subject to WCSO chain of command and the
supervision of the assigned WCSO supervisor(s).Day to day supervision will be assigned
to the assigned WCSO supervisor(s).The assigned WCSO supervisor will be responsible
for maintaining contact with the school administration.The SRO will work closely with
the school administration and faculty to determine the most effective use of the SRO's
time and expertise.At no time,however,shall the SRO be subject to the supervision or
direction of Pawnee(RE-I2) ,or their officers,agents,or employees.The SRO will
comply with the policies and regulations of Pawnee(RE-12) to the extent that such
policies and regulations are not in conflict with those of WCSO,are not in conflict with
other terms contained herein or direction of WCSO,and are not in conflict with federal,
state,or municipal laws.
4.PERFORMANCE APPRAISAL.The SRO's performance will be evaluated consistent
with WCSO policy and procedures by the assigned supervisor and will accept input from
the schools'designee(s).
5.VEHICLE. WCSO shall provide the SRO with a WCSO vehicle for on-duty use during the
term of this IGA.
IV.CONSIDERATION FOR SRO SERVICES
The Parties agree that the Weld County Board of Commissioners will cover all expenses of
the SRO in consideration of the benefits received by the Pawnee(RE-12) School District of
enhanced school safety and fostering law enforcement relationships with Weld County
Schools and their students.
V.TERMINATION
This 1GA may be terminated without cause or for convenience by any Party upon 60
days written notice to the other Party.
VI. ADDITIONAL TERMS
1. EMPLOYMENT STATUS AND RELATIONSHIP OF PARTIES.
The SRO shall at all times during the term of this IGA be considered an employee of
County and WCSO and shall maintain the status of independent contractor with respect
to Pawnee(RE-12) .The SRO will be subject at all times during the performance of this
IGA to the ordinances,policies,procedures,rules,regulations,directives,and orders of
County and WCSO.
Furthermore,it is mutually agreed and understood that nothing contained in this IGA is

No party to this IGA shall be responsible for the acts and/or omissions of entities or
individuals not a party to this IGA.
3.PROOF OF INSURANCE.All parties to this IGA shall maintain general liability
