RE: ACCEPT REQUEST TO WITHDRAW APPLICATION FOR A SITE SPECIFIC
DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR23-0009,
FOR A KENNEL (FOR UP TO 40 DOGS OVER THE AGE OF SIX [6] MONTHS)
IN A SUBDIVISION OR HISTORIC TOWNSITE (SCOTTS ACRES), IN THE
A (AGRICULTURAL) ZONE DISTRICT - ANTONIO AND EVE RIOS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 28th day of
June, 2023, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose of hearing
the application of Antonio and Eve Rios, 2904 County Road 12, Erie, Colorado 80516, fora Site
Specific Development Plan and Use by Special Review Permit, USR23-0009, for a Kennel (for up
to 40 dogs over the age of six [6] months) in a subdivision or historic townsite (Scotts Acres) in
the A (Agricultural) Zone District on the following described real estate, to -wit, and:
Lot 1 of Scotts Acres; being part of Section 9,
Township 1 North, Range 68 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, at said hearing, the Board was presented with an email, received on May 24,
2023, from the applicant requesting the withdrawal of the application, stating they no longer intend
to pursue the operation, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and all of the exhibits and
evidence presented in this matter and, having been fully informed, deems it advisable to grant the
applicant's request and thereby accept the withdrawal of the application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Antonio and Eve Rios to withdraw the application for a Site
Specific Development Plan and Use by Special Review Permit, USR23-0009, for a Kennel (for up
to 40 dogs over the age of six [6] months) in a subdivision or historic townsite (Scotts Acres) in
the A (Agricultural) Zone District, on the parcel of land described above, be, and hereby is,
accepted and the matter is dismissed.

The above and foregoing Resolution was, on motion duly made and seconded, adopted

Hello Chris,
I am writing this email because Antonio and I would like to withdraw our application for the special use permit for the
kennel. We have decided to shut down the kennel and not operate. We have already started the process of finding homes
for the dogs most of them already have found homes. We have some puppies left in a couple of adults so just wanted to
give you a heads up if you have any questions please give me a call 303-669-3310 Thank you for all your time and helping
this matter.
