INTENDED/PROPOSED USES
COMPREHENSIVE PLAN
ANALYSIS
The applicant, Richmark Real Estate Partners, is
requesting to annex approximately 108.018 acres of
unincorporated property to the City of Greeley (see
Exhibits A & B). The intended use is to continue the
existing oil and gas development for the next
approximately 15-20 years. No further plans for the site
are proposed at the time of annexation, but the Land Use
Guidance Map indicates natural uses for the site, so it is
likely to remain open space following completion of the
oil and gas development.
Following the annexation, the establishment of zoning
for Holding — Agriculture (H -A) zoning will be completed
at the April 4th Council meeting. The property must be
zoned within 90 days of annexation. The zoning request
will be evaluated during that process.
The property is entirely within the City of Greeley's Long -
Range Expected Growth Area (LREGA) and complies with
City of Greeley Comprehensive Plan policies. Portions of
the annexation are in the floodway, 100 -year floodplain
and 500 -year floodplain.
The proposed annexations have 23% combined
contiguity with existing municipal limits which meets the
State of Colorado one -sixth (16.67%) contiguity standard
regarding annexations.
The annexations provide growth in the northeast part of
Greeley, which has not grown as much as the western
portion of Greeley. It provides balance to the City's
growth and land use pattern.
The annexations would be consistent with present
growth patterns and Comprehensive Plan policies. There
is evidence that this site shares a common interest with
the City's future. The requirements of State statutes and
City of Greeley guidelines for annexation appear to have
been met by this requested annexation.
Since the site is currently used for oil and gas
development, there should be zero additional students
coming to School District 6 as a result of these
annexations.

1. Not less than one -sixth (1/6 = 17%) of the perimeter area proposed to be annexed is contiguous
with the City of Greeley;

In order to annex the existing parcels, 3 annexations are needed, however the parcel boundaries were not
manipulated (i.e. sawtoothed) to extend contiguity. In all cases contiguity exceeds 1/6 of the perimeter being
annexed. Perimeters shown are based upon measured dimensions. Please refer to the attached closure report.
2. A community of interest exists between the territory being proposed to be annexed and the
City of Greeley;
The subject property is within a Weld County Opportunity Zone, however since the site is located less than 1 mile of
the City of Greeley, Weld County does not support re -zoning the property for development. Weld County recognizes
these parcels to be within the City of Greeley's Community of interest.
3. The territory sought to be annexed is urban or will be urbanized in the near future;
Weld County shows these parcels to be urban in their Comprehensive Plan, and shows the existing zoning as 1-3,
Industrial, an urban zoning designation. The site is currently being used for oil & gas production.
4. The territory sought to be annexed is integrated or is capable of being integrated with the
City of Greeley;
The parcels are physically contiguous and adjacent to the City of Greeley. No other City or Town could integrate this
area as well as Greeley. Access, utilities, emergency services can all be provided to this area by the City of Greeley.
See Appendices D -H for graphic depictions of the City's public facilities analysis.
Evaluation Criteria after Determination that Petition Meets State Eligibility Requirements
1. The proposed annexation is in conformance with the City's Comprehensive Plan.
GC -1.2 The annexation form is compact and contiguous to the city limits with no leap frog annexation, with
contiguity which exceeds the state requirement with a total average contiguity of 23% (17% being required). Three
annexations are needed to annex the four parcels, however the parcel boundaries were not manipulated (i.e.
sawtoothed) to extend contiguity. In all cases contiguity exceeds 1/6 (17°%a) of the perimeter being annexed.

GC -1.1 The "2060 Comprehensive Plan Land Use Guidance Map" (see Appendix A), a supporting document for the
Comp Plan, anticipates that most of this area will be used as a natural area in the future which will provide buffering
areas along this tributary to the Cache la Poudre River corridor.
The area is shown on the "Land Use Area from the 2060 Plan Available for Future Growth" (see Appendix B) as "open
space". The land is currently developed as oil and gas production sites.
The area is shown on the "Land Available for Future Growth" map as within the Long Range Expected Growth Area. It
is composed of "Land Suitable for Future Development, Highly Sensitive Area, and Moderately Sensitive Area". Land
to the north and east of the site is shown as suitable for future development so it is anticipated that the surrounding
area will develop in the next 15 years.
GC -1.4 Growth north of the Cache La Poudre River is to be encouraged, and the above designations support the goal
of providing open lands on a portion of the proposed annexation. The annexation form is compact and contiguous to
the city limits with no leap frog annexation, and with contiguity which exceeds the state requirement.
GC -2.1 The LREGA map was referred to and it identifies that most of the land is to be reserved, and only a portion is
Land Suitable for Future Growth.
2. The proposed annexation promotes geographical balance of the City's land use pattern.
Recent growth of the City has been concentrated on the southern and western boundaries. These annexations may
prompt growth along the Highway 85 corridor and prompt growth in Northeast Greeley.
3. Adequate services are or will be available to support the development expected to result
from the proposed annexation.
The property is not anticipated to re -develop for at least 5 years within the limitations of the oil and gas setbacks. At
this time no city -level utilities are needed. When city level utilities are needed they can be extended as demonstrated
in Appendices D -H and in text below.

Transportation: North 6th Avenue adjacent to the property provides access to the south and provides a bridge over
the Cache La Poudre River. There is access to "0" Street to the north via 6th Avenue. Access points exist on the north
end of the property on the east and west sides of the Highway 85 By-pass and physical access exists to "F" Street on
the east side of the Highway 85 By-pass. While there is currently no bus service to the area, the Highway 85 -bypass
is intended to have multi -modal transportation options in the future. The Adequate Public Facilities Transportation
Map (Appendix E) shows this area as "accessible to major streets".

Sanitary: City sanitary sewer is located less than 300' from the western boundary of the site. The Adequate Public
Facilities Sewer Map (Appendix G) shows Annexation #3 as within the area labeled "near an 8" or larger sewer line",
while Annexation #2 is contiguous to areas labeled "near and 8" or larger sewer line". The portion of Annexation #1
west of the 85 By-pass is likewise contiguous to areas labeled "near an 8" or larger sewer line". The small portion of
Annexation #1 lying east of the 85 By-pass is within 1/2 mile of areas which are "near an 8" or larger sewer line".
Water: There is a 12" water main in North 6th Avenue, adjacent to the site. Fire hydrants are located along North 6th
Avenue. The Adequate Public Facilities Water Map (Appendix F) shows Annexations #1, 2, and 3, except the small
portion of Annexation #1 lying east of the 85 By-pass as being "near an 8" or larger water line".
Fire: City fire service is shown as "adequate" over 1/3 of the site (all of Annexation #1, and the SW 1/2 of Annexation
#2) with service from Fire Station #1. The balance of the site falls outside the radius of "adequate" fire protection,
but 6.1 miles closer to a station than that currently provided by the Eaton Fire Department (portion located east of
the Highway 85 By-pass) and will be the same as that provided by the Western Hills Fire Department which contracts
fire protection through the City of Greeley. Through a mutual aid and support agreement with the Greeley -Weld
Airport, additional support can be provided to this area from approximately 4 miles away. See Appendix D for more
details.
Parks: No City parks existing on the site, however the site has no residents and no regular workers. Island Grove
Regional Park is within 2.2 miles by road. The site also hosts a portion of the Eaton Draw, which is identified as a
riparian corridor. The Northern reach of the Eaton Draw will have future trail access from the site. See Appendix H for
park locations and Appendix K for future trail locations. No future parks are currently planned for this area.
Storm facilities commensurate with the current property uses exist.
Schools: The area is entirely within Weld District 6. This site will not generate any students at this time.
4. The proposed annexation provides fora continual and rational boundary.
This is not a flagpole annexation and provides a continual and rational boundary for the City of Greeley.
5. The proposed annexation is needed to accommodate future land use requirements.
The City's Comprehensive Plan shows an open or natural areas designation over most of the site which can provide
connection to other planned open/natural areas along the Cache La Poudre Corridor and Eaton Draw. Annexation of
this area provides City -level overview of how the land develops in the future.

5. Narrative Statement:
a. Conformance with the City's Comprehensive Plan;
GC -1.2 The annexation form is compact and contiguous to the city limits with no leap frog annexation, with
contiguity which exceeds the state requirement with a total average contiguity of 23°%o (17% being required).
Three annexations are needed to annex the four parcels, however the parcel boundaries were not
manipulated (i.e. sawtoothed) to extend contiguity. In all cases contiguity exceeds 1/6 (17°%") of the
perimeter being annexed. Perimeters shown are based upon measured dimensions. Please refer to the
attached closure report.
GC -1.1 The "2060 Comprehensive Plan Land Use Guidance Map", a supporting document for the Comp
Plan, anticipates that most of this area will be used as a natural area in the future which will provide
buffering areas along this tributary to the Cache In Poudre River corridor.
The area is shown on the "Land Use Area from the 2060 Plan Available for Future Growth" (see Appendix B)
as "open space". The land is currently developed as oil and gas production sites.
The area is shown on the "Land Available for Future Growth" map as within the Long Range Expected
Growth Area. It is composed of "Land Suitable for Future Development, Highly Sensitive Area, and
Moderately Sensitive Area". Land to the north and east of the site is shown as suitable for future
development so it is anticipated that the surrounding area will develop in the next 15 years.
GC -1.4 Growth north of the Cache La Poudre River is to be encouraged, and the above designations support
the goal of providing open lands on a portion of the proposed annexation. The annexation form is compact
and contiguous to the city limits with no leap frog annexation, and with contiguity which exceeds the state
requirement.
GC -2.1 The LREGA map was referred to and it identifies that most of the land is to be reserved, and only a
portion is Land Suitable for Future Growth.
The area is shown on the Land available for Future Growth Map as within the Long Range Expected Growth
Area. Land to the north and east of the site is shown as suitable for future development so it is anticipated
that the surrounding area will develop in the next 15 years.
Portions of the property are in the 100 -year Floodway, 100 -year Floodplain, and the 500 -year flood plain.
The City's Comprehensive Plan shows an open space buffer here and this provides connection to other
open areas and City -level overview of how the land develops in the future.

b. Intent to include the property in the Northern Colorado Water Conservancy District and
Subdistrict;
The parcels will petition for inclusion in the Northern Colorado Water Conservancy District and
Subdistrict
c. Information on ecological or land use conditions which maybe hazardous, including oil
and gas operations, dumps and landfills, underground storage tanks, steep slopes,
wetlands, irrigation ditches, bodies of water and flood areas.
Please refer to the Site Analysis Map for a graphic depiction of the existing oil and gas operations, flood
delineation, and access points.
Oil and gas operations are on -going and are planned to continue for the next 15-20 years. Once operations
cease, there will be a reclamation period including revegetation plan as filed with the State of Colorado.
There are no known dumps, landfills, or underground storage tanks on site.
The site has one irrigation lateral that does not appear to be in use.
The Eaton Draw runs through the site and the site is adjacent to the Cache la Poudre River. With the
proximity to the river the site is in the 100 -year Floodway, 100 -year Floodplain, and the 500 -year flood plain.
Because no development is proposed wetlands delineation has not been performed and we request that
analysis be deferred until a different use is proposed on site. In lieu of waiving the requirement entirely, the
City of Greeley has requested that we do some wetlands and soil research using publicly available data and
try to give an indication of the current status of the site without hiring a professional wetlands biologist or
Geotech.
ANX2022-0008
Wetlands discussion:
The Colorado Wetlands inventory indicates that the site is located in the Cache la Poudre River basin and
that the Eaton Draw is a wetland "riverine" feature. It also depicts a standing pond on the northwest comer
of the annexation property. There is a depression north of the Eaton Draw that may hold water in wet
seasons but this area is currently dry. Some wetlands soils or vegetation may still exist in the low areas
within and north of the Eaton Draw since this area appears to be relatively undisturbed. Both areas have
been added to the Site Analysis Map. The balance of the site was recently farmed for corn but was
historically used as a sugar beet farm.
Riparian Discussion:
The Colorado Wetlands inventory did not show any riparian areas within the boundaries of this annexation.
Geologic Discussion: The southwest area of this annexation area is composed of modern alluvial material
(sands and gravels deposited by the meandering of the Cache La Poudre River) and the northeast portion is
characterized by gravels and alluvial deposits from the last ice age (30,000 to 140,000 years ago).

Wetlands discussion:
The Colorado Wetlands inventory indicates that the site is located in the Cache la Poudre River basin. It also
depicts a standing pond on the northwest corner of the annexation property which is shown on the Site
Analysis Map. City of Greeley gravel mapping indicated that this was a remnant of gravel mining on the site.
Riparian Discussion:
The Colorado Wetlands inventory shows riparian areas within the boundaries of this annexation, however
most of the site has been stripped of vegetation for development of a small oil and gas facility developed in
the 1980's and since removed, and a large oil and gas pad built between 2016 and 2021. This site was
characterized as "marsh" on the 1961 CDOT map for the Highway 85 by-pass.
Geologic Discussion: This annexation area is composed of modern alluvial material (sands and gravels
deposited by the meandering of the Cache La Poudre River) which have not been mined, except for the
pond area discussed above.

The Colorado Wetlands inventory indicates that the site is located in the Cache la Poudre River basin.
Riparian Discussion:
The Colorado Wetlands inventory shows riparian areas within the boundaries of this annexation, however
most of the site has been stripped of vegetation for development of a large oil and gas pad built between
2016 and 2021. A small area south of the pad is still treed and the depression that the trees are growing in
appears to be an abandoned loop of the river (oxbow). This feature has been shown on the Site Analysis
Map.
Geologic Discussion: This annexation area is composed of modern alluvial material (sands and gravels)
which have not been mined.

7. The Site Analysis Map has been revised per redlines and per published requirements as outlined below.

No significant vegetation. The existing vegetation can be seen on the aerial. The north
half of the site (Annexation ANX0008) west of Highway 85 by-pass was farmed until
2016 so the only vegetation is north of Eaton Draw and is visible on aerial. The south
half of the site encompassing Annexation ANX0009 and ANX0010 was not farmed but
was cleared for oil and gas operations in 2016. The Colorado Wetland Inventory Map
provided by the Colorado Wetland Information Center shows the area as being a
combination of Riparian vegetation including deciduous, herbaceous, and upland
vegetation. It is apparent that the vegetation followed loops formed by the meandering
of the Cache La Poudre River long before our current history in the area.
d. Areas of Ecological Significance, including wetlands, steep slopes, etc.;
Historically, the north half of the annexation area was farmed. There are very limited
areas of steep slopes on the east side of Highway 85 By-pass, and on the east side
where the Highway 85 By-pass was built up, and north of the Eaton Draw. Very small
areas of steep slopes occur as banks of the old Cache La Poudre River encircling the
low side of the oil and gas pads. No erosion or cliffs were noted. The sloped land is
vegetated. See Appendix I to identify areas of steep slopes.
Annexations 0008, 0009, and 0010 fall mostly in areas that contain significant natural
features per the Ecologically Significant Area map (Appendix C). A small portion of
Annexation 0009 has been impacted by mining (refer to Appendix J). All the maps in
the 2060 Comp plan indicate that this area is to be used for Open or Natural Area
purposes. Section 24-1004 is referenced in the Dev Code Intent is to support Natural
Areas to be used for open lands or trails, preserve drainage patterns, and to discourage
new development. Our site is mostly within a Secondary Riparian area (adjacent to the
Eaton Draw) and the Poudre River Corridor. A proposed future trail is shown on the
parks, Trails and Open Space Map (Appendix K) on the East side of the Highway 85 By-
pass.
The north half of the site was farmland and the south half was considered marsh or
slough prior to development of 3 multi -well oil and gas pads on site between 2016 and
2021. The current oil and gas operations typically have a lifespan of 20 years (implying
that decommissioning could occur between 2036 and 2041). Whenever the wells are
decommissioned the land will be returned to its pre -oil and gas development state per
State laws. The portion of the site located north of the Eaton Draw and East of the
Highway 85 By-pass retain the pre -oil and gas development character and consist of
scrub grass and bushes to the north and fallow farm land to the east.
No wetlands were identified or delineated and a waiver from this requirement is
requested since this site is not proposed for development at this time. See wetlands
discussions on pages 5 and 6 above.
e. Existing structures and land uses; and
• The site is being used for oil and gas operations including oil and gas wells, storage,
and production facilities. The portion of the site located north of the Eaton Draw and
East of the Highway 85 By-pass retain the pre -oil and gas development character and
consist of scrub grass and bushes to the north and fallow farm land to the east.
f. Existing oil and gas facilities and setbacks to such facilities.
• Please refer to the Site Analysis map for setbacks and facility locations.
8. Fire District Petition and Fee
• Western Hills and Eaton Petition were previously submitted and have not changed.

• Holding Agriculture is requested for the site. No development is currently proposed.
Waiver Request:
No wetlands were identified or delineated and a waiver from this requirement is requested since this site is
not proposed for development at this time. With the current oil and gas development in place, length of time
the oil and gas wells are anticipated to continue producing, and the state -level reclamation requirements
post -decommissioning, the identification, status, and location of the wetlands is requested to be deferred to
future development applications. Since the site is in the floodplain, a permit process controlled by the City
will be required and wetlands identification and protection can be addressed prior to any additional site
development. Additionally, a wetland delineation is only considered valid for 5 years, due to changing site
conditions, so any delineation done now would not be valid at time of future development. Because of the
above reasons we requested that the wetlands delineation be deferred until a different use is proposed on
site. In lieu of waiving the requirement entirely, the City of Greeley has requested that we do some wetlands
and soil research using publicly available data and try to give an indication of the current status of the site
without hiring a professional wetlands biologist or Geotech. Information shown was derived from the
Colorado Wetland Information Center as per the Colorado Wetland Inventory Map and from the Geology and
Soil maps provided by the Colorado oil & Gas Conservation Commission. Please see the above discussion
on pages 5 and 6.

Per the City's recommendation draft FEMA flood maps were reviewed on the FEMA website. We understand

PETITION FOR ANNEXATION
Wake Annexation No. 1, No. 2 and No. 3
TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF GREELEY,
COLORADO:
The undersigned, in accordance with Title 31, Article 12, Chapters 101 et. seq., Colorado
Revised Statutes, 1973, as amended, hereby petition the City Council of the City of Greeley for
annexation to the City of Greeley of the territory described herein and described and shown on
the map designated, " Wake Annexation No. 1, No. 2, and No. 3 " The applicable number
of said map (at least four) are submitted herewith and by this reference are incorporated herein.
The description of the territory hereby petitioned for annexation to the City of Greeley is set
forth in Exhibit A attached hereto and incorporated herein by reference.
In support of this petition, the Petitioner(s) allege(s) that:
1. It is desirable and necessary that the above -described territory be annexed to the City of
Greeley.
2. The requirements of Section 31-12-104 and 31-12-105 of the Colorado Revised Statutes
exist or have been met in that:
A. Not less than one -sixth (1/6) of the perimeter of the area proposed to be annexed
is contiguous with the City of Greeley.
B. A community of interest exists between the territory proposed to be annexed and
the City of Greeley.
C. The territory sought to be annexed is urban or will be urbanized in the near
future.
D. The territory sought to be annexed is integrated or is capable of being integrated
with the City of Greeley.
3. In establishing the boundaries of the territory proposed to be annexed, no land held in
identical ownership, whether consisting of one tract or parcel of real estate or two or more
contiguous tracts or parcels of real estate, has/have been divided into separate parts or
parcels of real estate without the written consent of the land owner or land owners thereof,
except and unless where such tracts or parcels are already separated by a dedicated street,
road, or other public way.
4. In establishing the boundaries of the territory proposed to be annexed, no land held in
identical ownership, whether consisting of one tract or parcel of real estate or two or
more contiguous tracts or parcels of real estate comprising twenty (20) acres or more
which, together with the buildings and improvements situated thereon have an assessed
valuation in excess of $200,000 for ad valorem tax purposes for the year next preceding
the filing of the written petition for annexation, has/have been included within the
territory proposed to be annexed without the written consent of the land owner or land
owners.
5. The territory proposed to be annexed does not include any area which is the same or
substantially the same area in which an election for an annexation to the City of Greeley
was held within the twelve months preceding the filing of this petition.
6. The territory proposed to be annexed does not include any area included in another
annexation proceeding involving a city other than the City of Greeley.
7. The territory proposed to be annexed is not presently a part of any incorporated city,
city and county, or town.
8. The property owned by each petitioner is described on each separate signature sheet and,
when needed, described more fully in the exhibits attached hereto and incorporated
herein by reference.
9. The signer(s) of this petition comprise(s) more than fifty percent (50%) of the land
owners and owning more than fifty percent (50%) of the property, excluding public
streets and alleys, and any land owned by the annexing municipality, and are, in fact,
owners of one hundred percent (100%) of the property set forth in Exhibit A attached
hereto and incorporated herein by reference.
Accompanying this petition are the original and four copies of an annexation plat map
containing the following information:
A. A written legal description of the boundaries of the area proposed to be
annexed.
B. A map showing the boundary of the area proposed to be annexed.
C. Within the annexation boundary map, an identification of the location of each
ownership tract in unplatted land and, if part or all of the area is platted, the
boundaries and the plat numbers of plots or of lots and blocks. Also within the
boundary map, identification of any special districts the area proposed to be
annexed may be part of.
Next to the boundary of the area proposed to be annexed, a drawing of the
contiguous boundary of the annexing municipality and the contiguous boundary
of any other municipality abutting the area proposed to be annexed.
E. A surveyor's certificate prepared by a registered land surveyor that attests to
the preparation of the map and certifies at least one -sixth (1/6) contiguity to the
City of Greeley.
F. Acceptance block describing the acceptance action of the City of Greeley in
form and substance as provided in Appendix A of the Subdivision Regulations
of the City of Greeley and providing for the effective date and City Clerk and
Mayor attest signatures.
10. Except as otherwise provided, no part of the territory sought to be annexed is more
than three miles from a point on the municipal boundary, as such was established more
than one year before this annexation will become effective.
11. As an expressed condition of annexation, land owner(s) consent(s) to inclusion into the
Northern Colorado Water Conservancy District and the municipal subdistrict pursuant
to Section 37-45-136 (3.6) C.R.S. Land owner(s) acknowledge(s) that, upon inclusion
into the district and subdistrict, land owner's (s') property will be subject to the same
mill levies and special assessments as are levied or will be levied on other similarly
situated property in the district and subdistrict at the time of inclusion of land
owner' s(s') lands. Land owner(s) agree(s) to waive any right to an election which may
exist to require an election pursuant to Article X, Section 20, of the Colorado
Constitution before the district and subdistrict can impose such mill levies and special
assessments as it has the authority to impose. Land owner(s) also agree(s) to waive,
upon inclusion, any right which may exist to a refund pursuant to Article X, Section
20, of the Colorado Constitution.
THEREFORE, the undersigned respectfully petition(s) and requests the City Council of the
