Dear Weld County Planning Commission:
We are the owners of property adjacent to 4121 Weld County Road 3, Erie which is the subject property
of the above -referenced special use review, set for hearing on June 6, 2023. We write to lodge our strong
opposition to the proposed special uses. We believe the special use application should be denied first
and foremost because the application does not adequately address all aspects of the proposed special
uses. Specifically, the application is for a proposed commercial recreation facility and event center yet
information about the operation of the proposed activities focuses almost exclusively on the recreational
use (railbikes) with almost no information provided about the proposed event center, its design or
operation. The application is also deficient in that applicants clearly contemplate some activities which
are not adequately described, making it impossible to assess the impact of the activity on adjacent
properties and the neighborhood. Even if the application was not deficient, the requested special uses
(railbikes and event center) should be denied as incompatible with the neighborhood and intent of the
agriculture zoning. Moreover, applicants' proposed mitigations measures do not adequately address the
impact of the proposed activities on the neighborhood, adjacent properties, and traffic. We strongly
believe the proposed special uses are not compatible with the neighborhood, but if the Commission is
inclined to recommend approving one or both of the proposed special uses, significant additional
mitigation measures must be required of applicants.

On their application, applicants describe the special use being applied for as "Commercial outdoor
recreation (railbike excursions)." However, elsewhere in their application applicants clearly contemplate
hosting events on the property such as corporate events, weddings, and birthday parties.' We believe
applicants originally planned to operate just a rail tours business out of a location on County Line Road in
Erie but expanded the scope of their proposed business to include an event center when they were able
to purchase the property located at 4121 Weld County Road 3 in late October 2022.2 As discussed
herein, plans for the newly conceived event center are nebulous at best.

Applicants fail to adequately describe the proposed design or use of the event center. Specifically, with
respect to design of the event center, applicants have not yet determined:
whether the proposed event center will be a pavilion, barn, or tent;3
- whether the future event facility will obtain water from Left Hand Water District (or even

whether sewage will be disposed of via a septic system (for which no engineering study
appears to have been completed) or through removal by a sewage service.'
Despite these unknowns, dpplicdrlts seem to be relying on the to -be -designed event center to satisfy
some environmental health requirements related to the railbike activity. It appears that applicants
originally planned to provide water bottles and portable toilets to satisfy the need for water and sewage
management. However, once Environmental Health staff advised applicants that their proposed water
and sewage plans did not meet health requirements, applicants revised their application to indicate that
satisfactory water and sewage facilities would be provided when the proposed event center is
completed. Applicants cannot bootstrap themselves into compliance by promising to meet requirements
with the construction of a future facility when the design of that facility has not yet been determined, let
alone evaluated for feasibility or compliance itself.'
Applicants' description of the use of the event center is similarly deficient. The full extent of the use
information provided by applicants is that the event center may be used for birthday parties, corporate
events, weddings, "and similar group gatherings associated with or outside of railbike operations"' for up
to 150 people.' Applicants do not indicate whether they intend to engage in / allow numerous activities
common to event venues, such as:
- Do applicants intend to apply for an alcohol license;
Will smoking, including marijuana use, be allowed on the property;
Will DJs, live bands, recorded music, and other amplified sound be utilized during
events
Will applicants provide tables, chairs, and other rentals for events or will a rental service
be utilized. If applicants intend to provide tables, chairs, etc., where will they be stored?
If applicants intend to utilize a rental service, where will the rentals be unloaded? How
will rental delivery and pick up coordinate with the flow of people and traffic related to
the railbike activity? How and when will vendors have access for set up and tear down?
Similarly, will applicants provide food (i.e., have a kitchen, prepare, and serve food) or if
planning to use caterers, will applicants provide a kitchen and if not, where will caterers
set up;

- What decor and accessories will guests be permitted? (Think "reveal parties," parties
with sparklers, weddings with artificial flower petals tossed at the departing couple, etc.)
What other parts of the property will special events utilize? (With weddings, couples
often choose to have an outdoor ceremony in one location on a property followed by an
indoor reception.)
What are the days and hours of the event center?' Applicants contemplate a 15-17
hour day for the railbike activity10 but do not specify hours for the event center. Will
event center activities overlap with railbike activity?
Applicants request for a special use permit for an event center simply cannot be approved until
applicants address these basic issues related to the design and use of the event center.
Applicants' railbike application is similarly deficient in detail in several respects. In particular, applicants
indicate they intend to install a 14 ft x 24 ft "Depot and "accessory storage buildings to shelter
equipment."1z Applicants to not indicate in their application or on their site map12 where these storage
units will be located. Nor do they provide information as to how many storage units they plan, their size,
or construction. In the information submitted by applicants in support of the first iteration of this
proposed project (record PRE 21-0135), applicants planned to use shipping containers as storage units.
The location, number, and type of such shipping units is necessary to determine their impact on the
neighborhood and adjacent properties, and thus, what mitigation measures should be required.
Similarly, applicants indicate they plan an "outdoor activity area" with lighting but give no information
about the proposed location of the activity area, the activities planned for the area, or the type of
lighting planned. As with the storage units, applicants must provide more information about this
proposed activity and its location in order to determine what mitigation measures are necessary.
The proposed special use is incompatible with the neighborhood and will negatively impact_surroundEr g
properties.
Very simply, applicants' proposed special uses will have a significant negative impact on the adjacent
properties and the peaceful quiet enjoyment of the neighborhood. Applicants propose a commercial
activity with a billboard sized sign,13 significant additional traffic, large numbers of people, and the
potential for quiet disrupting activities (parties, weddings, and the undefined "outdoor activities") that
may extend for up to 14 hours a day!14 All of this in what is left of a small agricultural zone that is
sandwiched between two large residential subdivisions (Morgan Hill and Collier Hill).

In their Traffic Narrative, applicants predict up to 170 round trips per day. County Road 3 carries a lot of
traffic already due to the Morgan Hill and Colliers Hill subdivisions, and the fact that it connects Hwy 52
to Erie Pkwy while avoiding old downtown Erie. It is also heavily used by bicyclists, runners, and walkers

north which means patrons coming from the north, northwest, or northeast, will add more traffic to an
already overloaded Hwy 52 and will be turning left into or out of Road 3 at an intersection with only a
stop sign on Road 3 - - traffic on Hwy 52 does not stop and there is no left turn lane. This is already a
dangerous and corigesled irrlersection with frequent accidents. Additionally, many of the patrons coming
from the south can be expected to come right thought the Colliers Hill subdivision, driving right past the
community park which is frequently busy with children's activities on weekends.
In addition to the extra traffic, applicants propose to stop traffic on County Road 3 (and Briggs Road in
Erie) each time a railbike tour crosses the road, which presumably will be twice per tour because each
tour is an out and back excursion.' Applicants do not provide information as to how long traffic will be
stopped while one of the tour guides dismounts the railbike, flags traffic, patrons pedal the railbikes
across the road and the tour guide restarts traffic.
In addition to the significant additional vehicular traffic, applicants proposed special uses will result in
the presence of as many as 300 or more people on the property at any one time. Applicants estimate
there will be up to 72 people per railbike tour and that as one tour ends and another begins there may
be as many as 144 people present. The proposed event facility is planned for up to 150 people so
conceivably, with overlapping activities, vendor deliveries, etc., there may be as many as an additional
300 people present creating noise (possibly exceeding the maximum allowed residential noise level even
though unamplified! !) and disruption in the neighborhood.
And finally, what is the projected growth for these businesses? Can we expect a crush of traffic on
holidays as applicants market "pumpkin activities," "Santa visits," "holiday railbike rides," "New Year's
Eve rides and parties," and the like? (Applicants project 170 round trips per day in December!) Applicants
claim that their proposed activities will benefit the town of Erie because their patrons will also visit the
old downtown. Downtown Erie busy as it is and is notorious for lack of parking. Will applicants' patrons
be allowed to leave their cars on applicants' property and walk to Erie, which is dangerous because there
are no sidewalks on the easternmost section of Road 1 /2. Might applicants expand to provide a shuttle
railbike service into downtown Erie? How about bachelor or bachelorette party trains with alcohol,
similar to "pedal pubs?" Where does it stop? We are concerned that if the proposed special uses are
allowed there will be no stopping the expansion of the business resulting in destruction of the quiet
enjoyment of the neighborhood for those of us who reside here.
The neighborhood that will be impacted by the proposed special uses is a very small area of rural
residential properties and the surrounding residential subdivisions. Applicants proposed special uses will
replace a significant portion of the rural residential area with a large, incongruous commercial property
set in close proximity to single family residences. Not only will this "commercialize" the area, it does so
with businesses that are highly dependent on vehicular traffic. The proposed special uses are simply
incompatible with the quiet of the neighborhood and are much better suited to commercial areas, such
as the one in downtown Erie that was originally contemplated by applicants.

Mitigation Measures
For the reasons detailed above, we urge the Commission to deny applicants' special uses request.
However, if the Commission is inclined to recommend approval of applicants' special uses, the
Commission must require mitigation measures sufficient to minimize the negative impact of the special
uses on the neighborhood and adjacent properties. Applicants have proposed minimal mitigation
measures consisting mainly of landscaping along CR 3 to screen the facility from the road and trash cans
for debris. We believe the proposed mitigation measures are grossly inadequate and that, at a minimum,
mitigation measures should include:
- The proposed event center is completely incompatible with the neighborhood, but if the
Commission is considering approving an event center, detailed plans for the event center, as
discussed above, including permanent adequate water supply and sewage disposal must be
provided by applicants prior to any recommendation of approval;
- Detailed information about the "flag and stop" crossings proposed for County Road 3 and Briggs
Road and the impact of that activity on traffic flow on those roads;
- Applicants must conduct a traffic study to determine whether a left turn lane and / or traffic
light is needed on Hwy 52;
- The business sign should be no more than 4 ft by 6 ft with a maximum overall height of 6 ft;
- Installation of evergreen trees around the entire perimeter of applicants' property with a
minimum height at installation of 20 feet and not to exceed 35 feet (min / max height must be
maintained) to minimize the impact of dust, noise, and light on the neighborhood and the
adjacent properties. Installation of trees must be completed prior to issuance of final operating
permit.
- Limitation of the hours of operation to noon to 10 p.m. for railbike activities and noon to 11
p.m. for special events (with all guests and vendors to be off property no later than 11:30 p.m.);
- Limit the number of special events to no more than 2 per month; and
- Prohibit amplified sound at all times (i.e., no megaphones, loudspeakers or amplified music).16
(My daughter and I work in the event industry. It is our experience that venues located
anywhere near residences always create conflict due to noise, congestion, and late hours of
operation. Event venues belong in commercial areas or on properties without neighbors, not
residential / rural residential neighborhoods.)
We apologize for the length of the letter. However, we feel very strongly that applicants' proposed
activities will have a permanent and severely negative impact on the essence of the community in which
we live. It will add congestion, accompanying debris, and noise without providing any benefit
whatsoever to the neighborhood.

live in Morgan Hill and am concerned that a venue of that size will increase traffic significantly as well as cause

Dear Mr. Nader,
I'm writing as a resident of Erie to comment on the proposed Erie Railbike Adventures business that is now seeking
approval from Weld County.
My main concerns are related to traffic management at County Road 1.5 and County Road 3, an intersection that has
been impacted by Erie's growing population and also by industrial truck traffic. In my opinion, the corner is hazardous
and needs a stoplight now, not later to protect public safety.
I ask the County to meaningfully address the concerns of folks living nearby the business, those who stand to be directly
affected by increased traffic in their quiet neighborhoods, and by lights and noise disrupting their peaceful, rural
lifestyles. Those concerns would be amplified, should the business plan also include a venue for weddings, parties and
other private events.
Assuming all issues are satisfactorily resolved, I believe the business can be a popular attraction and an asset to the
Town of Erie and I'm looking forward to riding the rails.

Hi There,
I am reaching out in concern of a potential commercial site at 4121 County Road 3 in Erie.
The proposal is for a event space & 50 car parking lot that is fully lit by 12'+ poles, etc.
I live in a nearby new community (Morgan Hill) and would be very concerned from a noise, lighting and nuisance
perspective. The possibility of bright lights coming from the parking lot late at night or through the night as well as
added traffic & noise for events like weddings, etc. would concern me.
The post I read listed your email to reach out about concerns of nearby residents.

I adamantly oppose the Commerical Event Business at the intersection of County Road 3 and 1 1/2. We live in
the adjacent subdivision and the additional noise and traffic will have a great impact on our daily lives as well
have a negative impact to property values. Both roads 3 and 11/2 were not designed for the added traffic and
greatly increases the risk for accidents. The additional lighting will change the landscape and hinder what
remaining wildlife that uses this area.
The Weld County Planning Commission needs to reject this proposal.

Mr. Nader,
Since it was asked I will voice my opinion on the proposed rail car attraction. I'm new to Colorado but here is my take on
the situation after reviewing some of the documents. I live on the backside of Colliers Hill off of Bear Peak Rd, the reason
I chose Erie over some other more tax friendly towns was because of the openness and country feel. I'm originally from
NJ and left for a job relocation out here, part of the reason Erie was attractive was it was everything NJ wasn't. There is
no traffic, there is sprawling land and old mines, cattle and dairy cows, fresh air and no noise. While I'm a firm believer
in being able to do what you wish with your own property, I think it has to be within reason and fair to your neighbors.
We aren't talking about a property owner shooting his firearms against a backstop out in the back of his property or
even someone riding offroad vehicles on their land. We are at the point of trying to commercialize places in between
residential areas. It would be totally fine if the proposed business was encompassed completely within the owners
property but its not. It is designed to travel through multiple parcels past homes and into old town Erie.
The additional traffic to these small local roads is already building up and will continue to do so when more of the
master builders complete their already approved projects. In my opinion we don't need to add to this already growing
problem, secondly what about the noise and light that will be generated by all of this. I really feel bad for those
n eighbors directly near this attraction and by the parking lot. No one wants to hear or see the customers coming, going,
o r partaking in the attractions on a daily basis. I think if this project is going to be considered there needs to be more
restraints on its operation, some suggestions are operation hours not after dusk, no alcohol beverages, the entrance and
parking areas should be shielded from view with natural vegetation so this doesn't look like a bus stop parking lot was
just erected. Something sort of acoustic barriers should be added to also ensure noise levels aren't affecting the
n eighborhood. The point being other like businesses that operate similarly in Erie out in the country side have the
business area deep within their property (Little Buckaroos), not on the outskirts of the property as being suggested.
Without any of the mentioned concessions I mentioned I would be against this project moving forward for sake of the
residential community. I didn't purchase a $800K home to have side show attractions in our backyard.

We live in Northridge neighborhood in Erie, Colorado. One of our neighbors sent out an email about a
proposed business within a few hundred yards of our neighborhood. We are very concerned about noise, as
well as light pollution, traffic and a host of other things.
I do not know much about the licensing application process. I do know that our neighborhood and this part of
town is currently very quiet.
I am all for people making their own way in the world and starting up new businesses. However, when it
impacts the quality of life of those around us, I think we need to pause and reflect:
Is the desire of one person greater than the hundreds of neighbors nearby?
My questions are:
1. How much noise will there be? Will it go on during certain days/times? Will we be subjected to loud
booming music or other noise at night while we're trying to sleep? Is it basically a large acreage free-
for-all 24/7?
2. Will they be serving alcohol? What about marijuana use? Will they host large concerts or festivals?
3. What about the additional traffic on our two-lane country roads? Will there be traffic lights also
installed? What about widening the roads?
4. My understanding is there will be bright lights on every single night. Is that correct? Because this will
impact the neighbors and wildlife.
5. How will this impact the property value of the hundreds of homes who are located adjacent to this
area?
6. Will the planning commission make a site visit before approving the license?
At this time, my husband and I do not believe this business is a good fit for this location.

Please take into consideration that Special Use application for an event site is NOT in a remote part of Weld County. It is
about '/z mile from the neighborhoods of Northridge, Morgan Hill, and Air Park. It is about a mile from Colliers Hill
neighborhood and old town Erie. This project will effect hundreds of neighbors.
In the Northridge neighborhood, we can clearly hear the bands playing in downtown Erie, a mile away. The neighbors
within a mile of this site will too. So this site for events with loud music, bright lights, large noisy crowds of 150 people
at events, elevated traffic on two lane roads (County Rd. 1 1/2 and County Rd. 3), and possible heavy consumption of
alcohol and marijuana elevating crime in the area is NOT what we want next door.
The 12' high light poles will have an effect on many houses on the east side of Northridge neighborhood and "the nearest
neighbors are the parcels to the north across CR 1-1/2. From the parking lot these homes are 600', 900', and 1000' away.
From the Depot and trackside lighting these homes are 450', 580', and 800' away." People don't want bright lights
shining in their windows all night long.
We bought these homes in a quiet area. Don't ruin our quiet neighborhoods and our property values by allowing this
Special Use project.

The planning commission is having a hearing Tuesday, June 6 at 1:30 and I would like to oppose having it pass due to it

1 was just informed by another neighbor that the new owners of the property located at 4121 County
Rd 3 in Erie Co has submitted an application for a Commercial Recreation and Event Business. The
application states the owners would like to operate a railway pedal car business from this
property. They're also requesting approval to host other events such as weddings, private parties
and/or corporate events with the maximum capacity of 150 people.
I take issue with the fact the applicant was less than forthcoming when completing the
application. The application states there are only a couple of residential houses surrounding the
property. What the applicant failed to mention is there are several very large neighborhoods who
would be greatly impacted should this application be approved. There is Colliers Hill with 2800
residential homes within a stone's throw from this property, Northridge with 287 residential homes
located 1/4 mile away and Morgan Hill with 490 residential homes located 1/2 mile away.
I live in the Northridge neighborhood. When there are home games being held at Erie high school
during football season we can hear the announcers loud and clear at our house. The high school is
located 2.6 miles away. With this said property only being 1/4 mile away we will definitely be
impacted by the noise these large events would create.
Though I respect people's rights to earn a living I do not agree when it comes at the expense of
MANY others. Erie is a quiet town. The noise from these events would greatly impact our quiet
lifestyle. The railway car rides are one thing, hosting other events especially on a narrow county road
is another. Therefore, I sincerely request this application not be approved as it currently stands.

former neighbor, Eleanor Ciriaco, and her family. They were informed that they could only divide their land into two
parcels instead of the desired three, which would have allowed them to keep the land within the family and construct
homes. Consequently, Ms. Ciriaco made the difficult decision to sell her house and land, which were subsequently
acquired by the Rummers. It is important to highlight that the proposed division by the Ciriaco family would not have
significantly altered the aesthetics or character of our area. It is disheartening to witness the County's influence on the
decision -making process for a landowner who was part of our community for 25 years, particularly as they now proceed
with a Use by Special Review that introduces commercial activities into an agricultural zone.
Please do not misconstrue our absence as a lack of concern over this matter. We trust that you will consider our

My husband and I stumbled across the Colorado Railbike while riding our bikes from Louisville to the Briggs St.
restaurants. They gave us a lot of history, it was great! Since then every time we bring people to Erie we look for the
railbike but still nothing.
I've paid a decent chunk of change as a tourist to ride railbikes with friends along (and across) the Hudson River. Now, I
ride the Coal Creek -Rock Creek loop all the time and have for years, bringing friends and visitors to Weld County. It
would be wonderful to extend the visit, highlighting our history.

I have huge concerns about this proposed business.
The proposed business is planned right in the middle of at least four residential areas. The owner doesn't seem to think
he will Impact any of these areas. The roads in the area are already extremely busy. The added traffic alone would be a
detriment to all of these communities.
I see no mention as to how the elements of private parties would be addressed;
Loud music from DJs and bands
Alcohol and marijuana use
Water supply
Waste management
I see nothing relating to a business plan. I t would be helpful if there was a plan that showed some experience in
business. How to effectively manage growth. How to deal with property values of surrounding areas.

witnessed two near misses as individuals traversing CR 10.5 have been distracted by the presence of the
railbike. One case resulted in a near miss head on collision and the second the vehicle actually left the
paved portion of the roadway. I am certain there have been similar occurrences while I have not been
present. Fortunately, no pedestrians were present at the time and yes, this is a popular walking and jogging
route for many of the local residents. While driver inattention is always a concern, the uniqueness of the
railbike in such close proximity to the road was certainly a contributor as well. Because of the novelty of the
railbike, it will likely continue to be a distraction to drivers as time passes.
2. Wildland fire abatement. Twice since I moved into the area, I have witnessed two grass fires along the
railroad tracks. While I do not know the cause of the fires, I can say in each case firefighters had difficulty
accessing the area along the tracks to fight the fires. The most recent fire, the property owner on the north
side of CR 10.5 had to fight the fire himself as the fire department was not able to easily access the grassy
areas north of the railroad tracks. Someone riding the railbike could potentially start a grass fire by simply
dropping a cigarette ash or even by a spark from the braking system.
3. On the west side of CR 3, vegetation on the property and that proposed on the USR creates a visual
obstruction to traffic traversing CR 3. This will result in traffic being obscured while exiting the property on
4121 CR3. Essentially, this creates a second traffic safety issue. As you are probably aware, traffic
northbound on CR 3 cannot see the intersection of CR 3 and CR 10.5 until you are nearly upon the
intersection. The railroad track crossing sign is your best indication you are approaching the intersection
and certainly not the road sign, itself.
4. The lighting, despite the mitigation efforts proposed in the USR, will in fact be visible from many of the
properties on the north side of CR 10.5. This is inconsistent with the reason myself and many of neighbors
purchased property within the neighborhood; to escape the light pollution of metropolitan and business
areas
5. The use of "porta poddies" is not appropriate given the near vicinity of residential housing, even for the
short term. Even if regularly maintained, "porta poddies" typically begin producing noxious orders due to
the heat generated by sunlight and summer temperatures. Clearly, this is not appropriate given the
proximity to developed residential areas.
6. Noise generated by the proposed business events is a significant concern because of how well noise travels
given the topology of the immediate area around the proposed business sight. From my residence I can
routinely hear conversations from the neighbors and sounds of livestock on the northside of CR10.5, as

examples. The summer concerts in old town Erie, are also easily heard as well. Additionally, I would like to
reinforce that many individuals in this neighborhood purchased their properties to escape the noise
pollution of the metropolitan and business areas.
7. Lastly, the zoning of agricultural given the near proximity of the medium density residential housed is
inconsistent with nature of the proposed business.

County. This parcel of land, a home and gentleman's farm is located with a direct line of sight from my home at 417
Baker Ln, Erie, CO 80516, also located in Weld County. I have lived at this property for over 20 years and the
surrounding neighborhoods and other gentleman farms would be negatively impacted by developing this land for
commercial recreational use. The new owners of the land located at 4121 County Road 3 have failed to gain the support
of their surrounding community as part of their business plan, nor have they recognized the impact of operating a busy
recreation site will have on their neighbors and wildlife. To the best of my knowledge, the new owners of this property
have not contacted any of the neighboring houses located in the subdivision located less than 500 yards from their
property to inform or consider the impact of their proposed business operations on the livelihood of home and property
owners in the area.
This area is a busy wildlife corridor. In 2023 alone I have seen eagles, owls, osprey, herons, numerous hawks, bats,
foxes, coyotes, bobcat, deer and snakes move through the fields on and adjacent to this property. Paving a parking lot,
light pollution of a business, noise pollution of an "recreation and event center," as well as increased road traffic on
county roads will cause direct and immediate harm and ultimate removal of wildlife in this part of Weld County.
By way of alternative, I recommend that if the owners desire to move forward with their business idea they do so at a
location within the Town of Erie - still in Weld County. For example, an office/shoppette property located at numbers
51-80 Erie Parkway which is adjacent to the rail line has ample parking, lighting, and current building vacancy ideal Rail -
bike style weddings, events, birthday parties. Utilizing existing yet unoccupied business facilities eliminates the need to
pave another parking lot, light another parking lot, and would provide the Rail Bike "guests" with easy access to
restaurants or urgent care if needed. Another location within the Town of Erie - still in Weld County would be one of
the vacant lots along County Line Road bordering Weld and Boulder counties. These too are adjacent to the rail line, but
have the road and lighting infrastructure to support commercial operations unlike the proposed rural residential area at
4121 County Road 3.
Thank you for supporting the long-time residents in this area of Weld County in denying the business development at
4121 County Road 3.

I felt I had been given a gift from heaven when 1 moved into my house in Northridge. I live on Baker Lane and have a
backyard view of a large, green pasture, and I can see Erie High School beyond. My neighborhood is quiet and peaceful.
I have gladly paid property taxes to live in this lovely area, but should this commercial business be allowed to operate so
close to us it will be a travesty for me and my neighbors. This business will deal in large crowds and noisy events
affecting many families all around them for some distance. I will not be happy with noise filling the night time hours, and I
am certain many other neighbors will feel the same.
Then there is the possibility that our properties will fall in value because of this business. The one good thing will be the
drop in our property taxes, but Weld County will have less to spend on its projects.
Please do not give this business the right to exist.

I spoke on the phone with you earlier today about the upcoming public hearing for USR23-0012, and would like to
follow-up with my feedback to add to your collective report gathering public feedback on the application.
As a Weld County resident living within a half mile of the proposed building site, I am providing my objection to the
application proposing building of an event center (either a tent site or building) to host various events, including
weddings, birthday parties, corporate events, and similar group gatherings for the up to 144 customers that may be
present on the property at any time. I am supportive of the applicants running a business out of their primary residence;
however as the plot of land at 4121 County Road 3 is defined as a Residential Account Type on the Weld County Public
Records, I don't see how it can be justified allowing permitting of such a large commercial event center within close
proximity of so many residential addresses. I, like many of my Weld County neighbors, moved to this community based
on the designation of properties within the immediate area as residential. There are several hundred residential homes
all within a one mile radius of this property who will also be negatively impacted by the additional noise and added
traffic of constructing a commercial event center in such close proximity to these multiple residential neighborhoods.
The applicants failed to address, nor is it feasible to address, the issue of noise containment associated with hosting
large weddings and other events on a regular basis. The additional traffic also poses a major safety risk for the stretch of
County Road 3 between the Morgan Hill and Colliers Hill neighborhoods, which contains no shoulder or walking path. As
the most direct route connecting the two neighborhoods, many pedestrians, including children, are currently found
biking or walking this dangerous stretch of road that will only become more dangerous with an event center placed
directly in between.
Other than the event center, I am fully supportive of the residents running their business out of this address, as it sounds
like a great idea that adds commercial value to the community. I hope that the Weld County Commissioners review
board considers the fact that there are many other mixed use or agricultural zoned properties available in Weld County
that are not in such close proximity to high density residential areas for constructing commercial event centers such as
the one proposed in USR23-0012. I encourage the board to reject this application and recommend the building of large
event centers in these other areas that are properly zoned for that sort of use, as opposed to plots like 4121 County
Road 3 that are currently designated as residential.

at 4039 County Rd 3 prior to dividing the property. We sold a portion of the total property in
2019; we had an offer of a non-residential entity for that property, which would have involved a
great deal of traffic. However in respect of the Agriculture zoning, the neighboring residences
and the desire to keep the area a rural community, we did not sell to them; instead we wanted
an owner who wanted the property for a residence.
Please also keep in mind that the neighboring properties are zoned for livestock. Excessive
traffic and noise levels would have a negative effect on those as well.
No, this would not be an attractive addition to this community. It definitely is an asset for Erie
perhaps the applicant can locate a more suitable property in Erie proper in which to locate a
business/commercial/retail type instead of in a rural setting which will negatively impact this
community.
Although our property is very close to the subject property and would be impacted, we did not
receive any notice of this hearing.

My name is Francis Magurn. My wife, Sabia Magurn, and I live at 4085 County Road 3 in Erie, CO, directly
adjacent to 4121 County Road 3, the site of the proposed event center and recreational facility. I am
writing to express our strong objection to the proposed special uses on the following grounds. First, the
applicants have not considered the significant negative impact that events will have on the
neighborhood and other residents. Adjacent properties, such as ours, will be subjected to amplified
music and crowd noise from mere yards away. Additionally, the application does not consider the impact
on the traffic on County Road 3. CR 3 is a two-lane residential/rural road and is not designed to handle
the significant volume of traffic that recreational facilities, wedding venues, and corporate events create.
As I stated, the applicants are either unaware of or indifferent to the disruption they will cause
to neighbors (even those that live a half mile or more away) with amplified music. My wife and I have
some experience with wedding and event venues; she is a wedding florist, and since I left the Army, I
have been helping her run our family business. Weddings are celebrations, and celebrations are loud. We
have spent many late nights and early mornings cleaning up our floral installations while the music
continues past 1 o'clock in the morning. While this makes for a great party, it does not make for great
neighbors. The negative consequence of this noise is not sufficiently addressed by the applicants and, if
the commission does intend to recommend approval, significant noise restrictions and mitigation
measures should be required on the part of the applicants.
We are also concerned about the safety, usability, and long-term durability of Weld County Road
3 (CR 3.) CR 3 is a two-lane road that provides a residential travel corridor between Erie Parkway and
Highway 52. It is not, at present, capable of handling the large volume of traffic created by either an
event center or a popular recreational facility. Not only does the application not address the issue of
parking (constructing a parking lot and improving the on -site waste management seem to be mutually
exclusive) but it does not account for use by oversized vehicles such as party busses or food
truck/catering vehicles. Buses and vans would be necessary for a wedding venue located in an
agricultural/residential area. The transportation is necessary because of the limited service by popular
rideshare services, taxis, and public transit in the area. As a resident of the area who frequently flies for
work, I know first-hand how challenging it can be to use Uber or Lyftito get to or from Erie. The limited
rideshare services and lack of bus parking means that partygoers will be far more likely to drink and
drive, creating an unsafe environment for those of us who reside here. Further, an addition of a railroad
grade crossing on CR 3 to allow rail -bike travel east of CR 3 will be necessary for the safe operation of rail
bikes, and add additional traffic complications to this small rural road.
Thank you for your time, careful consideration, and service to the county by reading this letter.
We hope that the Planning Commission will equitably weigh the concerns of residents and neighbors, as
well as consider the adverse impacts of granting planning permits.

I am writing on behalf of my mother, Eleanor Ciriaco, and our family members. Eleanor is the previous

This is not a legal letter, but rather a concern of Eleanor Ciriaco's that the proposed commercial venue
would not only degrade the unique beauty of this small community of homes, but also affect those
remaining occupants of this small community.
My mother is still very close friends with all of her previous neighbors and expresses her concern for
their piece of mind. The customer traffic, additional noise pollution, and other conditions associated
with a commercial venue will affect this area negatively for them. They have called this place home
for so many years because of the open space and peacefulness that comes with it.

AND we are hoping that the new proposed
Colorado Rail Bike Adventure for the town of Erie, CO is able to start its own adventure.
We just bought a home nearby in the Colliers Hill planned Community of Erie this spring and are so excited
about bringing friends and family to view this amazing area.
And what better way to share the front range, the history of the area and all it has to offer
then to go on a Rail Bike Adventure as a group.
We can't wait to visit Erie's Old Town this summer, share a meal and then hit the Rails with our own muscle
power. What a unique and fun way to enjoy friendships, the beautiful scenery and learn something along the
way!!
It's all about an appreciation of the past and looking forward to an innovative future.
Hoping the Weld County Planning Commission sees this wonderful potential and creative use of the area Rails
to help foster great activities for both locals and out-of-town guests.

To Maxwell Nader,
We are writing to voice our STRONG opposition to the proposed Colorado RailBike Adventures
at 4121 County Road 3. We live at the far southeast corner of the Northridge subdivision and our
backyard is within view of this property. We were never informed of this proposal until a few days ago
by another concerned neighbor. Why not, as this will directly impact us ? Our concern is the
increased traffic and noise, especially compounded by the proposed long hours of operation.
The massive change to this area in the past 10 1/2 years since we moved here is daunting to say
the least. We came to this area for the peace and tranquility and allowing this proposed venue to
proceed with destroy any remaining quiet in this area. Please take these concerns into consideration.
