Date: 8-1-22 Subject: Nguyen Cluster PUD (Case No. PUDK21-0004) CWS File #22-130 The purpose of this memo is to outline the proposed uses and water demands for the Nguyen Cluster PUD. The property is a 122.64 -acre parcel located in the South 1/2 of the North 1/2 of Section 33, Township 1 North, Range 66 West, 6th P.M. in Weld County. This location is northeast of the City of Brighton and the Brighton Lateral Ditch runs through the center of the property. This property is not being proposed for development as a "subdivision" per Section 30-28-101(10)(a), C.R.S. but as a cluster development under C.R.S. 30-28-401 through 404. Two requirements of a cluster development are: 1. At least 2/3 of the original tract be contiguous open space and cannot be developed for at least 40 years. 2. The density of residential lots cannot exceed more than one lot per 17.5 acres. If these requirements are met, the Division of Water Resources will issue one exempt well permit per lot. The proposed development will have 100.7 acres of open space on the west portion of the property. This is platted as an agricultural lot and will stay undeveloped for a minimum of 40 years. This not only meets but exceeds the required 81.8 acres (2/3 x 122.64 acres) of open space. The property will also meet the required density of less than 17.5 acres per lot. The six lots will range from 3 to 5 acres in size. The water supply determined by the Division of Water Resources rules for cluster developments equates to 122.64 acres divided by 35 -acre increments, rounded down for issuing a residential well permit (GWS- 44). The calculation is (122.64/35 = 3.5 acre-feet), rounded down is 3 acre-feet. For the proposed six lots, the allocation will be 0.5 acre-feet per lot. This water can be used for both indoor and outdoor uses. As homes continue to use more efficient, low water -use fixtures, this amount is decreasing. Using the 0.3 acre- feet for indoor use, this leaves 0.2 acre-feet for outdoor use. The estimate for domestic animal use is determined by the formula that 100 head of livestock requires 1.35 acre-feet of water. This equates to approximately 0.01 acre-feet per animal. The estimate for outdoor irrigation is 0.05 acre-feet for every 1000 square feet of lawn. So, by example, the first option for a lot owner with no livestock can irrigated approximately 4,000 square feet of lawn (0.2 acre-feet/0.05 acre-feet per 1000 square feet of lawn). Another option would be to irrigate 3,000 square feet of lawn and have up to five domestic animals. In our opinion, 0.5 acre-feet per lot is sufficient to meet the indoor use for a single-family home plus outdoors uses including irrigation up to approximately 4,000 square feet of lawn with no domestic animals or a combination of irrigation less than 4,000 square feet and the watering of domestic animals. We want to be clear that these are not hard limits and are general estimates based on our expertise and experience to show the 0.5 acre-feet per lot of water supply is sufficient. The Division of Water Resources will require totalizing flow meters on each well and the Division's requirement will be that the 0.5 acre-feet annual limit is not exceeded. The uses within the 0.5 acre-feet per year is flexible depending on the lot owner's desires. This memo does not provide any information on the potential yield from the wells once drilled. A well driller will assist with that in the future. While the withdrawals from this aquifer are administered based on a 100 year aquifer life, water level declines may prevent this well from diverting the permitted amounts for that 100 years.
