RECOMMENDATION
A. Section 24-9-10.C of the Weld County Code states: "The Resubdivision shall
adhere to Chapters 22 and 23 of the Weld County Code and to the Subdivision
General Provisions, Conformance Standards and Subdivision Design Standards
per Chapter 24, Articles I, II and III of the Weld County Code, as amended."
The Resubdivision is proposing three (3) lots with one (1) lot not having direct
access and frontage to a publicly maintained roadwatand therefore is not
compliant with the following sections of the Weld County Code.
RECOMMENDATION
Section 24-3-20A.1 of the Weld County Code states in part:
"Roads shall be extended to serve each Subdivision lot. All lots shall have access to a public internal roadway.
This internal roadway is a separate parcel and not part of the residential lots. See Appendix 8-Q for design
guidelines for new road construction.'
Section 24-3-50. — Lot size standards of the Weld County Code which states, in part:
"A. All lots within a subdivision shall meet the minimum regulations established by Weld County.
F. Each lot shall be provided an adequate access to a publicly maintained roadway.
H. Lots shall not be less than thirty (30) feet in width at the front property lines.
J. A flagpole lot configuration shall be avoided when possible. The minimum width of a flag lot appendage
shall be thirty (30) feet. This access road shall be a minimum of twenty-six (26) feet wide and clear of all
encumbrances and drained to provide adequate emergency access to the property. For access and culvert
information, see Chapter 8 of the Weld County Code, as amended."
RECOMMENDATION
B. Section 24-9-10.C of the Weld County Code states: "The Resubdivision shall adhere to
Chapters 22 and 23 of the Weld County Code and to the Subdivision General Provisions,
Conformance Standards and Subdivision Design Standards per Chapter 24, Articles I, II and III
of the Weld County Code, as amended."
Section 22-2-10.C — Harmonize development with surrounding land uses
The proposal for two (2) additional lots is the highest number of lots requested within Enchanted Hills at
one time. There have been previous Resubdivision requests approved for just one (1) additional lot. This
request being an increase in two (2) lots resulting into three (3) lots is inconsistent with the functional size
and use of the other lots within the Subdivision and does change the overall design, concept and nature
thereof.
The proposal is not compatible with the existing area. Enchanted Hills Subdivision was established in 1968
and has about thirty-three (33) lots. Currently the smallest lot size is 2.5 acres. The creation of two (2) -
one (1) acre lots is out of character with the area.
Furthermore, the Department of Planning Services received four (4) letters from surrounding property
owners that oppose this request. The general concerns outlined were related to the smaller lot sizes
compared to the rest of Enchanted Hills, which will hinder the property value of the surrounding lots and
will impact the agricultural character of the neighborhood.

The following is our objection to the resubdivision of Lot 11, Enchanted Hills subdivision, RES23-0001.
The Enchanted Hills subdivision was intended to be 2 -acre and 5 -acre lots for rural living. The residents have very
intentionally resisted inclusion into Firestone city limits in order to preserve a more rural neighborhood
environment. Enchanted Hills subdivision was not created with the intention to include businesses of any type -
there are business -zoned areas of Firestone and Weld County that are more appropriate.
ddition, when the Enchanted Hills subdivision was created, further subdivision was intended to be
discouraged. The residents do not want this subdivision to turn into ever -smaller lots with no ability to
experience open space and privacy between properties.
The open spaces where our properties and Maple Street properties back up to each other host a number of
traveling deer, coyotes, eagles, owls, foxes, and hawks. If Weld County further reduces these spaces by allowing
continued subdivisions, they'll yet again be reducing the habitat of these wild animals.
Weld County has already allowed one such division (Cole, on WCR 15/Frontier Street, and the back property
subdivided behind it) without consideration that the open spaces enjoyed by all neighbors would be reduced.
We already live with the exploitation of that shared open space area by the owner of Lot 11 - as he and non-
residents frequently shoot pistols and rifles eastward. He does have a minimal berm but we all run the risk of his
shooters missing that berm and hitting animals or humans.
Please do not allow the further subdivision of Lot 11 in Enchanted Hills, into tiny plots of land that the owner can
exploit for multiple businesses. If his intention is to own more businesses, he should sell this property to
someone who can appreciate the open area and rural living, and buy another location for his businesses.

This layout was Approved by the Town of Firestone, and Mike (former planner that I worked with for years
told me that of Firestone approves the drive entrance, then Weld County will also approve sharing a 30' drivewa
Based on what Weld's former planner told me I spent almost $30,000 on legal fees, and inspections.

Please see photo. This is an actual road off Frontier street going east
like my home. This is not even a private driveway, yet all the side roads
the lead east of Frontier street are only 15 to 20 feet wide.
As you'll see below, all homes including residents that have been here
30+ years like myself, and newer homes within 3 years old do not come
close to the complying to a 30' driveway. Most are using 8' to 12' at
the very most. I measured all. All of the homes have driveways that are
very close to the neighbors. Entry ways are on average 12' wide.
I have lives at my home at 10286 County Road 15 since 1994, That's almost 30 years. Since then, no one
has subdivided until my neighbor to the South of ne has. His driveway also needed waivers. Semi trucks
back into 12' gates and driveways. It's overkill to expect each driveway to be 30' wide when all the driveways
on the east side of Frontier street are 8' to 12 feet. I am asking the Weld County make an exception like they
have dome for my current neighbors, including both older and newer residence.
I have been in the community for almost 30 years, and have paid my dues, taxes, and supported local
businesses. I have also employed many local residence with my businesses. My motivation is to try and
make a little money (like my neighbor to the south), to put toward retirement.
I am requesting that Weld County make an exception (waiver)
by allowing me to share a 30' driveway for 2 lots.

current resident's driveway on the east side of
Frontier street.
