RE: EXPRESSION OF OPPOSITION TO PROPOSITION HH AND STRONGLY URGING
ITS' DEFEAT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, "Proposition HH" ("Prop HH") is on the November 2023 statewide General
Election ballot, and
WHEREAS, the Board previously expressed its' opposition to Prop HH, through
Resolution #2023-1559, dated June 5, 2023, and
WHEREAS, the passage of Prop HH would trigger conditions within Senate Bill 23-303,
authorizing the State of Colorado to circumvent the provisions of the Colorado Constitution,
Article X, Section 20, known as "The Taxpayer's Bill of Rights" or "TABOR," and
WHEREAS, the passage of Prop HH would only bring revenue relief to Weld County local
government entities on their tax losses for one (1) year due to growth provisions in the proposition,
and
WHEREAS, the Colorado General Assembly will have the ability to change, with a simple
majority vote, the use of the withheld TABOR funds to not be used as directed in the proposition,
and
WHEREAS, it is inappropriate to allow the use of income tax to backfill property tax
deficiencies regardless of ownership, and
WHEREAS, Prop HH is an encroachment on the ability of local government to solve,
through existing means, the rapid increase in property assessments, and
WHEREAS, the ballot question for Prop HH does not specify the amount of taxes to be
reduced, does not specify what the expanded property tax relief for seniors consists of, does not
specify the amount of backfill to various local government types or indicate this backfill will not be
perpetual, does not indicate that the "state surplus" consists of tax dollars collected over the
current TABOR cap that would otherwise be refunded, nor does it specify that the new TABOR
cap defined in the measure would allow government to grow at a much greater rate than inflation
and population, and

WHEREAS, the funding of schools in this manner was previously submitted to the people
as Proposition CC, in 2019, and failed to gain voter approval, and
WHEREAS, hiding this previously failed measure behind a vaguely worded promise of a
property tax decrease, which will, in fact, be much smaller than the amount of new tax dollars
collected and kept by the State, is misleading to the voters.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Board opposes Prop HH for the reasons stated above.
BE IT FURTHER RESOLVED that the Board encourages the voters to vote "No" on
Prop HH.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 18th day of October, A.D., 2023.
