Respondent, Weld County Board of Equalization, appeared by Duane Robson That I find in favor of Petitioner (Partial) and against That the property in question, more fully described as: 468 Hart Street, Firestone. 1311-30-1-08-021 Ranch home built 2000, GLA 1,444 SF wl 3 -BR 2 -BA and 2 -Car Garage. Full basement is unfinished. Taxpayer Schedule Number , appeared in person with(out) R7618999 should (not) be adjusted as follows: Petitioner has 3 comps, Assr 5 comps. All are same base home— ranch, 3 -BR 2 -BA, 2 -Car Gar, full basements. Difference=>basement finish. Petit's comps all fully finished bsmnts (Petit agreed are not good comps). Assr 5 comps -3 unfin bsmnts, 1 ltd finish, one fully finished. I find Assr downward adjustments for bsmnt finishes and condition too small; Petit's adjustments for BR and BA far too large. The common comp (528 4th St) is least comparable of all, so disregarded. Based on data and testimony, reconcile at $455,000. Client: Weld County Board of Equalization, 1150 O Street, Greeley, CO 80631 Intended Use: Ad valorem taxation purposes and to serve as an outline for testimony at a binding arbitration hearing. Oral testimony by the appraiser at the hearing is intended to communicate the rationale and methodology employed to develop the assignment results. No other uses of this appraisal are intended by the appraiser. Intended User: Weld County Board of Equalization. No other users of this report are intended by the appraiser. Property Rights: Fee Simple Type of Value: Market Value Assessment Year: 2023 Appraisal Date: June 3e, 2022 Assessment Date: January 1st, 2023 Definition of Market Value: "The most probable price, as of a specified date, in cash, or in terms equivalent to cash, or in other precisely revealed terms, for which the specified property rights should sell after reasonable exposure in a competitive market under all conditions requisite to a fair sale, with the buyer and seller each acting prudently, knowledgeably, and for self-interest, and assuming that neither is under undue duress." {The Appraisal Institute} Conditions of Appraisal: This appraisal is based on the extraordinary assumption that the observed condition of the property on the date of inspection was representative of the condition as of the assessment date for the 2023 tax year. The use of this extraordinary assumption might have affected the assignment results. Property Owner of Record: David Claypool Sale & Listing History: As of the effective date of this appraisal there was no agreement of sale, listing, or option regarding the subject property. There have been no sales or other transfers of the subject property during the three-year period prior to the effective date of this appraisal. Scope of Work: Subject description was obtained from both an interior and exterior inspection and Weld County public records. The scope of this assignment did include a walk-through of the interior of the building improvements on July 19th, 2023. Market data used in the valuation of the property were taken from public records, third -party subscription services, and databases maintained by the assessor's office. Page 3 of 17 In accordance with the Colorado Constitution, Colorado Revised Statutes, and appraisal guidelines of the Division of Property Taxation, only the sales comparison appraisal methodology was applied in this appraisal. State law prohibits ad valorem valuation of residential properties to be based on a cost approach or income approach to value. As such, the appraiser has applied a jurisdictional exception in this analysis and the sales comparison approach is the only valuation methodology developed. OPINIONS AND CONCLUSIONS Highest and Best Use: The existing use is the highest and best use for the property. An adjustment for change in economic condition is made if during the extended sales collection period of July 2020 to June 30, 2022, the sale prices of properties have appreciated or depreciated due to inflation or deflation. We refer to the adjustment as a 'time' adjustment. If market conditions have not changed, no adjustment is required even though considerable time may have elapsed. C.R.S. 39-1-104...said level of value shall be adjusted to the final day of the data -gathering period. Sales and resales of the same or similar properties are a good indication of the changes in market conditions over time. In addition, a simple linear regression based on a graph of sales and the month the sale occurred is used to indicate the trend of the market. This trend is tracked as a monthly rate of change. Since we consider one of the most important aspects of market value to be location, we determine our time trends by location, also known as economic area or neighborhood, and by the use of the property (vacant land, residential, commercial). This appraisal was created for the purpose of ad valorem taxation. "As a general rule, §39-1-106, C.R.S., requires that the fee simple interest in property be valued for property tax purposes." For this reason, it is the appraisal of the fee simple property rights attached and specific to the real property described in this report. These fee simple property rights may differ from the rights of ownership if favorable or unfavorable lease provisions encumber them. The value reported is only applicable to the property rights appraised and this appraisal report should not be used for any other purpose. 2. Information, estimates, and opinions furnished to the Assessor's office, and contained in the report, were obtained from sources considered reliable and believed to be true and correct. Certain information relied upon by the appraisers are submitted to the Assessor's office in confidence and is not part of the public record. These records include Real Property Transfer Declarations (TD -1000's), Subdivision Land Valuation Questionnaires and other Assessor's office questionnaire mailings. Once a hearing comes to a decision by the governing body, the information for that individual property, as provided as part of the discovery process and presented at the open hearing becomes public record and is no longer confidential. Nonetheless, our office is privy to an unparalleled quantity of detailed and encompassing information unavailable to most appraisers and real estate professionals. Jurisdictional Exceptions: Colorado Revised Statutes (C.R.S.) mandates a specific data collection period known as the "base period," which consists of an 18 -month period. This period is January 1, 2021, through June 30, 2022, for purposes of estimating the 2023 taxable value as of June 30, 2022 (market conditions) and January 1, 2023 (physical property characteristics). The C.R.S. also allows consideration of market data from the period of July 1, 2017, through June 30, 2022, should insufficient data be available from the primary "base period." These Jurisdictional Exceptions to the Uniform Standards of Professional Appraisal Practice have been employed in the estimate of fee simple market value in this appraisal report. I engaged Structure Property Group, LLC. to help me unearth what is fair market value C0MPs for my identified period in my neighborhood (Included.). I assert the County Assessor and Weld County Board of Equalization (WCBoE) have unfairly and inappropriately knowingly overvalued my property resulting in an unfair, unjust, and unconscionably excessive property valuation for the purpose of taxation. I seek redress via an unbiased audience for review and fair disposition to secure justice through fair valuation. ISSUES: The County Assessor has unfairly and inappropriately knowingly overvalued my property resulting in an unfair and unconscionably excessive property valuation for the purpose of taxation. During the Weld County Board of Equalization (WCBoE) review, the County Assessor openly confessed that her process is rife with abuse and fraud and that she knowingly discriminated against me and untold others: The County Assessor confessed to knowingly assessing my property unconscionably higher than fair market value. This is not some minor algorithmic anomaly. This is open abuse of office coupled with confessed admission to defraud me for the sole purpose of increasing tax revenue for county government. Page 2 of 7 David Claypool 468 Hart Street Firestone, CO 80520 Account: R7618999 The County Assessor admitted that she knowingly assessed my property at a remarkably higher value than both fair market value of COMPs sold and adjacent properties of dramatically higher investment. The County Assessor confessed that her office cherry -picks peak values of property sold — and calls such a "Comp" — regardless reflection of actual property characteristics and location relative to my property. The County Assessor confessed her assessment process is fraught with discrimination, abuse, and fraud yielding inordinate volumes of inappropriately overvalued property assessments. Through research, I discovered that the County Assessor gives lower assessment values to women and minorities; but, assesses property in the names of white Christian males at a dramatically higher value. I provided an example of this discrimination to the Weld County Board of Equalization (WCBoE): ADDENDUM # 002.00. The Referee asked the County Assessor about this fact — and he forced the County Assessor to respond. The Assessor affirmed stating that property owners within a neighborhood grid might have drastically and dramatically different property valuations from the Assessor's Office, regardless property characteristics; and, the Assessor's Office doesn't take that into consideration. Rather, the Assessor would look back later to see how many people were valued too heavily and thus paying too much — and would make a mental note. The County Assessor further affirmed that even when such gross 'miscalculations' were raised, elevated, made known, or observed — the County Assessor's Office would never subsequently normalize the assessments to an identified proper value to correct the unfair discriminatory practice to disposition justice. When the County Assessor openly admitted this fact — the Referee was taken back, and called for clarification — and the County Assessor doubled down. The County Assessor rejected several properties (COMPs) adjacent to me that were sold in the identified period for over $120K less than what my property is being assessed at by her office. The County Assessor ignored my records of refinance during the period in question, wherein the assessed market value from two banks and a title company identified my property value at $400K. Based upon the foregoing and further augmented by additional supporting information via COMPs from Structure Property Group, LLC— I assert that a maximum ceiling for fair market value of my property during the identified period was $400,000. The Realtors assure me that based on their search of properties sold in my neighborhood during the identified period normalized to the characteristics of my property — the actual fair market value of my property during the identified period was $362,000. (Reference COMPs later in this document.) In summary, I assert the County Assessor and WCBoE have unfairly and inappropriately knowingly overvalued my property resulting in an unfair and unconscionably excessive property valuation for the purpose of taxation. OATH: Promptly after an arbitrator is selected, he or she shall sign, file with the County, and mail to each party the affirmation/oath set forth in tle forms section of these rules. 3. ARBITRATION PROCEDURES: A. FILING: Within thirty (30) days of the County Board of Equalizat on's decision, any taxpayer who plans to pursue arbitration shall notify the Board of kis intent to pursue arbitration. B. Fees have been advanced, or fees are in negotiation with the County and will be advanced to be held in Trust pending the referee's decision. 6. The arbitrator designated by the petitioner. FEES: Residential property -- At the time the taxpayer files his petition requesting arbitration for residential property, said taxpayer shall advance $150.00 to the Clerk to the Board of Weld County to be held in Trust to cover fees and expenses of said arbitration. Said fees will be held in Trust and will be disbursed as provided in the arbitrator's decision. The fee will be either returned to taxpayer or paid to the arbitrator depending on the arbitrator's decision. D. FEES: Other Taxable Property -- For cases concerning any taxable property other than residential real property the taxpayer shall, no later than close of business on the first Monday in October, contact the County Assessor or his/her representative to determine an estimated fee for arbitration. Fees shall be computed at $150.00 per hour rate. Upon agreement and deposit of fees with the Clerk to the Board's Office to be held in Trust pending the arbitrator's decision, the matter will be assigned to the arbitrator. The fees will be either returned to the taxpayer or paid to the arbitrator depending upon the terms of the arbitrator's decision. E. FEES: Waiver -- Any taxpayer who is unable to advance the fees from arbitration can apply for a waiver of this requirement to the Board of County Commissioners. Grounds for granting a waiver will be upon satisfactory documented proof of indigence by the taxpayer. F. HEARINGS: 1. Assignment -- Upon payment of the fees or upon waiver of fees as outlined above and the filing of the petition, the case will be assigned to the arbitrator selected in accordance with these rules. 2. Scheduling --Arbitration hearings shall be held within sixty (60) days from the date the arbitrator was selected. The hearings shall be at a time and place set by the arbitrator with the mutual consent of the taxpayer and the County Board of Equalization's representative, the Assessor. 3. Procedure -- The arbitrator shall preside at the hearing. Arbitration hearing procedures shall be informal and strict rules of evidence shall not apply, except as deemed necessary by the arbitrator in the interest of justice. All questions of law and fact shall be determined by the arbitrator. The arbitrator may determine time limitations or make other decisions in order to conduct a reasonable and fair hearing. 4. Subpoenas -- The arbitrator may issue or cause to be issued subpoenas for attendance or witnesses and for the production of books, records, documents, and other evidence and shall have the power to administer oaths. Subpoenas so issued shall be served and, upon application to the District Court by the taxpayer or County Board of Equalization or the arbitrator, be enforced in a manner provided by law for service and enforcement of subpoenas in civil actions. Parties' attendance -- The taxpayer and County Board of Equalization shall be entitled to attend, personally or with counsel, and participate in the proceedings. Such participation may include the filing of briefs and affidavits. 6. The hearings can be open to the public; however, upon agreement of both parties, the proceeding may be confidential and closed to the public. 7. Record of Proceedings -- No record of the proceedings is required. G. ARBITRATOR'S DECISION: The arbitrator's decision shall be in writing and signed by the arbitrator. The arbitrator shall deliver a copy of his decision to the parties personally or by registered mail within ten (10) days of the hearings. Such decision shall be final and not subject to review or appeal. The arbitrator's decision shall include: 1. The County docket number. 2. The title of the document as "ARBITRATION AWARD" 3. The full case name. 4. The identities of the parties who were present at the hearing, either in person or by counsel. 5. That the arbitrator has found in favor of the taxpayer or the County Board of Equalization and against the other party. 6. The particular schedule number in question or dispute. 7 The amount of change in valuation of the subject property, if any. 8. The amount of the arbitrator's fees and expenses not including counsel's fees incurred in conducting the arbitration and which party or both are to pay those fees. NOTE: Arbitrator's fees for residential real property shall not exceed $150.00. For all other property arbitrator's fees shall be an amount agreed upon by the taxpayer and County. 9. A signature line for the arbitrator and the date of the decision. 10. Witness fees and costs -- Each party shall pay the party's own witness fees, attorney's fees and miscellaneous cost.
