HomeMy WebLinkAbout20233634.tiff HEARING CERTIFICATION DOCKET NO.2023-82 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR23-0026, FOR LIVESTOCK CONFINEMENT OPERATIONS FOR UP TO 25,000 CALVES AND MULTI-FAMILY DWELLING FOR PERSONS PRINCIPALLY EMPLOYED AT OR ENGAGED IN FARMING OUTSIDE OF SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT - ABCD LANDCO,LLC,C/O 5280 CATTLE COMPANY,LLC A public hearing was conducted on December 20,2023,at 10:00 a.m.,with the following present: Commissioner Mike Freeman,Chair Commissioner Perry L.Buck,Pro-Tem Commissioner Scott K.James Commissioner Kevin D.Ross Commissioner Lori Saine Also present: Acting Clerk to the Board,Jess Reid Deputy County Attorney,Karin McDougal Department of Planning Services representative,Kim Ogle Department of Public Health and Environment representative,Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated November 14,2023,and duly published November 17,2023,in the Greeley Tribune,a public hearing was conducted to consider the request of ABCD Landco,LLC,do 5280 Cattle Company,LLC,for a Site Specific Development Plan and Use by Special Review Permit,USR23-0026,for Livestock Confinement Operations for up to 25,000 calves and multi-family dwelling for persons principally employed at or engaged in farming outside of subdivisions and historic townsites in the A(Agricultural) Zone District. Karin McDougal,Deputy County Attorney,made this a matter of record. El Kim Ogle,Department of Planning Services,presented a brief summary of the proposal, provided the general location of the site and mentioned it is within the three(3)mile referral area of the Town of Severance,which sent no referral response. He explained there is one(1) residence within 500 feet of the subject site,notice was sent to seven(7)surrounding property owners(SPOs)and four(4)SPOs expressed concerns at the Planning Commission hearing, which he outlined.He stated there are six(6)USRs within one(1)mile of the subject site and shared,per the Development Review staff,the applicants will be using an existing,permitted access on County Road(CR)84,and the manure trucks will use an access on CR 23,which will require an Access Permit.He discussed the traffic associated with the site,the proposed haul route,mentioned a Road Maintenance Agreement will be required,and noted the site meets an exception to stormwater detention.He described the existing facility,the proposed expansion details and relayed 18 referrals were sent out and five(5)agencies responded.Mr.Ogle entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. cc:PL(ER/MWft4.J/pA/Ko) 2023-3634 PL2899 01/24/24 HEARING CERTIFICATION-ABCD LANDCO, LLC, C/O 5280 CATTLE COMPANY, LLC (USR23-0026) PAGE 2 Lauren Light,Department of Public Health and Environment,stated the site will be served by a commercial septic system,sized for 19 employees,and water will be provided through the North Weld County Water District.She noted there is also a livestock commercial well onsite and the operation is registered as a large Concentrated Animal Feeding Operation(CAFO),through the Colorado Department of Public Health and Environment,Environmental Agriculture program.She relayed the applicant submitted a Nuisance Management Plan,Waste Storage Plan, and a Manure Management Plan. El Travis Hertneky,THEngineering,LLC,represented the applicant and presented a PowerPoint presentation(Exhibit D).He provided an overview of the operation,traffic,access,site plan, wastewater,and lighting.In response to Chair Freeman,Mr.Ogle stated the nearest residence is approximately 800 feet away. El No public testimony was offered concerning this matter. Ei The Board reviewed the proposed Conditions of Approval and Development Standards and made no changes. In response to Chair Freeman,Mr.Hertneky indicated,on behalf of the applicant,he had reviewed,and agreed to abide by,the Conditions of Approval and Development Standards,as presented. Commissioner Buck moved to approve the request of ABCD Landco, LLC, do 5280 Cattle Company,LLC,for a Site Specific Development Plan and Use by Special Review Permit, USR23-0026, for Livestock Confinement Operations for up to 25,000 calves and multi-family dwelling for persons principally employed at or engaged in farming outside of subdivisions and historic townsites in the A(Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards,as presented.The motion was seconded by Commissioner Ross, and it carried unanimously.There being no further discussion,the hearing was completed at 12:01 p.m. 2023-3634 PL2899 HEARING CERTIFICATION -ABCD LANDCO, LLC, 0/O 5280 CATTLE COMPANY, LLC (USR23-0026) PAGE 3 This Certification was approved on the 3rd day of January,2024,by the newly nominated and approved Board of Commissioners for 2024.
