RE: CHANGE OF ZONE,COZ23-0004,FROM THE A(AGRICULTURAL)ZONE DISTRICT
TO THE I-1(LIGHT INDUSTRIAL)ZONE DISTRICT-FRITZLER REAL ESTATE,LLC
A public hearing was conducted on December 6,2023,at 10:00 a.m.,with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated October 23, 2023, and duly published
October 25,2023,in the Greeley Tribune,a public hearing was conducted to consider the request
of Fritzler Real Estate,LLC,for a Change of Zone,COZ23-0004,from the A(Agricultural)Zone
District to the I-1(Light Industrial)Zone District.Bruce Barker,County Attorney,made this a matter
of record.
E'---'Chris Gathman,Department of Planning Services,presented a brief summary of the proposal,
described the location, and relayed 14 referrals were sent out,four(4)were returned with
comments,and seven(7)were returned without comments.He stated the property is not currently
an industrial use,there is an existing structural steel building,which was originally permitted in
2019,for drying hemp and storage as a Use by Right in the A(Agricultural)Zone District,hemp
storage was permitted in 2020,and the property is currently served by a commercial well and
septic permit.He relayed screening requirements for a Use outside of an enclosed building and
described the surrounding uses. Mr. Gathman stated the site is located in a Weld County
Opportunity Zone,is currently identified as regional commercial on the Framework Plan Map,
which was part of the Town of Gilcrest's 2017 Comprehensive Plan Update,and the site is located
to the south side of the City of Evans'Future Land Use map,and the Town of LaSalle's Growth
Boundary.He also stated the site is located within the boundaries of the City of Evans and the
Town of Gilcrest's Cooperative Planning Boundaries;however,both municipalities stated they are
not interested in annexation. He shared, per the Development Review staff,the parcel has
permitted,shared commercial access onto County Road(CR)33,which is a paved road which
meets the criteria specified for a change of zone.Additionally,he relayed there is a Condition of
Approval addressing the comments from the Western Mutual Ditch Company. Mr.Gathman
entered the favorable recommendation of the Planning Commission into the record,as written,
and displayed images of the site and surrounding views.

El Lauren Light,Department of Public Health and Environment,relayed the parcel is served by
a commercial well and a commercial septic system which is permitted for five(5)people,staff
recommended several notes for the plat related to water and sewer,and there are no other items
for this request.
Madison Jurewicz,Kimley-Horn,Association,represented the applicant and presented a slide
show,marked Exhibit E,and she reiterated the site is located within an opportunity zone.In
response to Commissioner Ross,Mr.Gathman confirmed 1-3 zoning was the original request,
and with the existing,surrounding uses,staff believed I-1 to be more appropriate for the request.
No public testimony was offered concerning this matter.
e In response to Commissioner Ross,Mr.Gathman clarified access will be onto CR 33,not
CR 44.The Board reviewed the Conditions of Approval and Development Standards,and no
changes or corrections were made.
El In response to Chair Freeman,Ms.Jurewicz,on behalf of the applicant,indicated they have
reviewed,and agreed to abide by,the Conditions of Approval,as presented.
El Commissioner James moved to approve the request of Fritzler Real Estate, LLC,for a
Change of Zone,COZ23-0004,from the A(Agricultural)Zone District to the I-1(Light Industrial)
Zone District,based on the recommendations of Planning staff and the Planning Commission,
with the Conditions of Approval,as presented.The motion was seconded by Commissioner Buck,
and it carried unanimously.There being no further discussion,the hearing was completed at
10:53 a.m.
This Certification was approved on the 20th day of December,2023.
