RESOLUTION WHEREAS, a public hearing was held on Monday, November 8, 1971 , in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Sam Young, Route 1 , Box 82-B, LaSalle, Colorado, requesting permission to locate a weaner pig operation on the following described property, to-wit: Lot Five (5) and the Bast-half (E 1/2) of Lot Three (3) , Milton Lake Estates, a subdivision in the Northwest Quarter (NW 1/A) of the Southwest Quarter (SW 1/4) of Section Twelve (12) , Town-ship Three (3) North, Range Sixty-five (65) West of the Sixth P. M. , Weld County, Colorado, containing 20 acres , mare or less , and WHEREAS, the petitioner was present, and WHEREAS , there was no opposition to the request of petitioner to locate said weaner pig operation on the above described premises, and, WHEREAS, the said requested weaner pig operation is located in an Agricultural zone as set forth by the Weld County Zoning -Resolution, and, W_HEREAS, according to Section 3 . 3(3)(c) of the Zoning Resolution of Weld County, said weaner pig operation may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners he-ard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE , BE IT -RESO-LVED, by the Board of County Commissioners , that the application of Sam Young, -Route 1 , Box 82-B, LaSalle, Colorado, to locate a weaner pig operation on the premises indicated above be, and it hereby is granted under the conditions following: 1 . That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2 . That said weaner pig operation shall not exceed 100 brood sows at any one time and-there shall be no feeding or finishing of hogs on said premises . 3 . That petitioner shall proceed with due diligence to effect said weaner pig operation and that he shall have upto one year from date hereof to begin construction of said operation. 4. That all applicable subdivision and_zoning regulations shall be followed and complied with in accordance with the Toning Resolutions of Weld County, Colorado. The Health Department has recommended approval , the Extension Agent foresees no problems., it is compatible with sur- rounding land use and lone , there appears to be no drainage prob- - lem. Mr. Lorenson questioned having the proposed 100 sows on a 10 acre parcel . With the offspring , this could be quite a large number. Recommended; it be subject to a- stated number of animals , construction to begin within• one year of; approval by the County Commissioners . Mr. Young stated he did not plan to do any feedin or finishing , that it would be strictly a weener pig operation. This will not be a confined operation . RESOLUTION : - Be. it therefore resolved to recommend approval to the Board of County Commissioners subject to a maximum of 100 brood sows , with no feeding or finishing permitted and construction to begin within one year of approval . APPEARANCE : Mr. Holman DISCUSSION : Mr. Holman explained his present dairy operation is located on rented property. His proposal is to move to another location . He plans to install a lagoon . Mr. Lorenson stated . the staff recommended approval , it is compatible with surrounding land use and zoning , subject to 'a sealed lagoon , a maximum of 150 head of. milk cows and construction to begin within one year of approval by the County Commissioners . The Health Department recommended' approyal . A letter from the Soil Conservation Service was read stating they have only slight limitations for septic tanks but severe limitations for sewage lagoons due to the shallowness of the soil . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County' Commissioners subject to Mr . Lorenson ' s recommendations : Motion by Mr . Watson , second by Mr. Nix . It is compatible with surrounding land use and zoning , favorable comments by the County Extensign Agent. A site plan is being designed by the Soil Conservation Service to solve existing problems . The expansion will allow . relocation of existing, pens which now pollute Lone Tree Creek . If approved , it should be subject to approval by the Health Department , construction to begin within one year of approval by the County Commissioners and a maximum of 1200 head . Mr. Sutter stated this is more of a relocation of pens rather than an expansion , however , it was agreed to include another two pens to take care of any future expansion that might occur. Mr . Paul stated the Health Department had inspected the site and have no objections . RESOLUTION : Be it therefore resolved to recommend approval to the County Commissioners subject to the lagoon specifications as required by the Health Department and a maximum number 1800 head and construct- tion to begin within one year of approval by the County Commissioner Motion by Mr. Nix , second by Mr. Anderson. Mr. Freeze stated these changes will be made on the plat. There is possibly a lateral along 41st Avenue . It was suggested the owner of the • property to the northwest• be contacted regarding the dedication of an additional 20 ' along his north property line . There was discussion regarding 22nd street. Mr. Lorenson recommended that it be 21st Street. MOTION : By Mr. Anderson to take the matter under advisement. Lorenson presented a drawing redesigning some of the lots on part of the northwest portion of Highland Hills which • there will be a proposed zone change for multi -family dwellings and to acquire more. right-of-way for a proposed road along- the west side.. This plan will have to be approved by the City because of recorded covenance regarding multi -family dwellings . This plan would accomodate approximately 10 units per . acre . The pre- vious platting of the lots involved would have to be vacated . APPLICANT : A. Lorenson stated on the 4th filing some changes had been from the preliminary which was approved in 1961 . Some of the streets that were cut through. are now shown with cul -de-sacs , also wider easements . It has been approved by the Utility Board . He recommended approval subject to approval of the septic tanks by the Health Department , a bond for construction of streets , revise the grades on Arrowhead Drive at 75+00 to meet regulations and 5% grade. Mr. Paul stated this has not been presented to the Health Department . The cul -de-sacs are because of the length of the street. According to the County Regulations a street cannot exceed 1250 ft, Mr . Paul stated this has not been presented to the Health Department and he would like to check the area for septic systems . MOTION : By Mr. Watson to table the matter until further information • is received by the Health Department. Second by Mr. Nix: A un- animous vote of "Aye" by Anderson , Bowles , Nix and Watson. Motion carried . DISCUSSION : There was further discussion on the distance this area is from a sewer line . APPLICANTS : , Rieker , Haney and Smith CASE NUMBER: Z-186 tape 377 SUBJECT : Zone change A - E-UD and H=UD APPEARANCE : Russell Haney , Bob Britzman , John Benson , Ed Kelly DISCUSSION : Mr. Lorenson stated it is recommended for conditional approval . The density and use have been approved by the City of • Greeley and agrees with the Greeley Comprehensive Plan, also pro- vides for nearly a 5 acre park . It should be subject to approval of the Utility Board and additional right-of-way as required by the Utility Board and the City of Greeley on . 35th Avenue . There is a request for a statement of developers responsibility on con- struction an 35th Avenue and the finalization of. the Unit Develop- ment plan.. into a recordable form. There are some extreme problems because of -some utilities located there. One of the designs that has been worked out is for a medium to be put down 35th Avenue. Mr. Kelly stated the City proposed the medium with the Public Ser- vice Company line in the medium using - single pole structures . Mr. Britzman stated the medium concept is a good traffic engineering solution to moving traffic on an arterial . The City and the County should consider the problems along the total length of 35th Avenue . Mr. ' Lorenson stated on the written form of the application for a Planned Unit Development it states "additional right-of-way shall be dedicated on 35th Avenue to a maximum of 56 ' easterly of the section line" which would equate into 112 ' if the duplicate on the other side can be obtained;. Mr, Paul inquired if they plan to hook on to Hill ' N Park Sanitation system. Stated he will not approve this until the S. is enlarged . The present facilities are . not adequate . Mr. Benson stated when the improvements on Hill ' N Park Sanitation are completed , they will be able to accept sewage 9/21/71 686 c. from Colony Park and Chalet West. SUBJECT : Septic systems DISCUSSION : Mr . Lorenson presented the Commission with copies of the State rules for site locations of septic tanks . SUBJECT: Road west of Highland Hills Subdivision DISCUSSION : Mr. Lorenson reported on the proposed road on 59th Avenue . This will require some additional right-of-way which will alter some of the lots on the west side of Highland Hills . A plan was presented showing how the area could be used of multi -family dwellings . The road would have 80 ' of right-of-way. The density proposed is approximately 10 units per acre . This will have to be approved by the City of Greeley because of the covenants stating there shall be no multi -family dwellings . Mr. Lorenson was advised to proceed with the plans . SUBJECT : Program with the incorporated towns . DISCUSSION : Jim Ohi presented his work schedule and time table for the work he will be doing with incorporated towns . Hr. Young plans - a hog feeding operation. .-. The soil is mapped as 51-8, Vona loamy sand, 1-3% slope and.72-K Valent sand, hilly. - These are deep, well drained, coarse textured soils. The area has very little runoff, if any, and is not subject to flooding. If a lagoon or holding pond were needed it would necessitate a blanket of impervious material. The soil survey is made on the basis of 40 inch'borings, although in most cases the borings are made to depths of 50 to 60 inches. The soil map should be used for general planning and does not exclude the need for on site investigation for specific engineering purposes. James A.
