RESOLUTION RE: ACTION OF THE BOARD CONCERNING DECISION OF DIRECTOR OF DEPARTMENT OF PLANNING SERVICES ASSESSING ROAD IMPACT FEES ASSOCIATED WITH BUILDING PERMIT, CMN22-0131 - STEVEN WELLS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to the provisions of Weld County Code Sec. 20-1-60. H., the Board of County Commissioners has received an appeal from Steven Wells, 32010 County Road 63, Gill, Colorado 80624, do AGPRO Environmental Services, LLC, dba AGPROfessionals, 3050 67th Avenue, Suite 200, Greeley, Colorado 80634 ("the Appellant"), concerning the decision by the Director of the Department of Planning Services to require Road Impact Fees associated with Building Permit CMN22-0131, in the amount of $25,992.00, on the following described real estate, to -wit: Part of Section 25, Township 7 North, Range 63 West, and part of Section 30, Township 7 North, Range 62 West, of the 6th P.M., Weld County, Colorado WHEREAS, the Appellant argues that the facility, known as the "Crow Creek Events Center," is not an "events center" as that term is referred to in the definition of "Shopping center/commercial" in Weld County Code Sec. 20-1-50; but, rather, is more of an "agri- entertainment facility" within the definition of "Agricultural commercial" as defined in said Weld County Code Sec. 20-1-50, because the facility will primarily serve as a private event center for the property owner, Steven Wells, to hold non-profit functions for groups like the Make -A -Wish Foundation and a small number of private events, and WHEREAS, upon consideration of such appeal, including a review of all information submitted by the Appellant and the Director of the Department of Planning Services, the Board deems it advisable to grant said appeal and to direct the Director of the Department of Planning Services to impose upon Building Permit, CMN22-0131, the Road Impact Fee fitting the category of "Agricultural commercial." The Use by Special Review associated with this building permit, (USR22-0035), which was conditionally approved by the Board of County Commissioners on April 19, 2023. The applicable code section for an appeal is found Chapter 20, Section 20-1-60.H which states, "Administrative appeal. The administrative decision of the Planning Department calculating the fees in accordance with the fee schedule may be appealed to the Director by filing with the Director, within ten (10) days of the date of the written decision, a written position statement stating and specifying briefly the grounds of the appeal. The only grounds for administrative appeal to the Director is an appeal of the Land Use Type. The Director shall then have power to affirm or modify the decision of the Department. The Director shall make written findings of fact and conclusions of law and apply the definitions of the land use categories in this Chapter and the provisions of this Section. The applicant may appeal the decision of the Director to the Board of County Commissioners according to the appeal procedures set forth in Section 2-4- 10 of this Code. Upon receipt of either the Director's or Board of County Commissioners' decision, the applicant may then conduct an Independent Fee Calculation Study as further described in Section 20-1-80 below." On May 26, 2023 the Director conducted a review of the impact fees and determined that the department used the correct land use category, "Shopping Center / Commercial" to calculate the fees. 2023-1645 (P/17, PL 0073 Chapter 20, Section 20-1-50 defines "Shopping Center / Commercial" as the following, "Shopping center/commercial means establishments engaged in the selling or rental of goods, services or entertainment to the general public. Such uses include, but are not limited to, shopping centers. discount stores, supermarkets, home improvement stores, pharmacies, automobile sales and service, maintenance or repair shops, car washes, show rooms, event banks, movie theaters, amusement arcades, bowling alleys, barber shops, Laundromats, funeral homes, vocational or technical schools, dance studios, health clubs and golf courses." centers The USR application materials on file state, "[T]he event facility will primarily host charitable events such as the Make A Wish Foundation, and private events for the landowner, however, weddings and other private events are anticipated". The application goes on to further state that, "the event facility will provide a location to hold private events for the surrounding area. It will provide a unique gathering space which is not a service that is readily available in this remote area of Weld County...A main priority for the operation is the non-profit events held for foundations like Make A Wish Foundation." Breakdown of fees: BUILDING BC -65% BFEE0011 Building ... 10/14/2022 1 NEW BUILDING BUILDING BFEE0211 Facility ... 05/01/2023 $ $5,026.00 BRFEE0130 RIF Area2... 05/01/2023 $ $25;992.00 Total Impact fees (less building permit fees): $31,018.00 Following the Director's written decision, AgProessionals filed an appeal of the Director's decision to the Board of County Commissioners on May 26, 2023 under Chapter 2, Section 2-4-10. The Board of County Commissioners have the following options: Option No.1: Uphold the Director's decision. Option No.2: Overturn the Director's decision. The Board can direct the applicant to apply for an Independent Fee Calculation Study in accordance with the procedures outlined under Section 20-1-80 (copy attached for reference). During the last Impact Fee study that was prepared by Duncan and Associates, "event centers" was added under the definition of "Shopping Center / Commercial". This use was added because the County has approved several event centers like Crow Creek over the last few years. In addition, there will be a small number of private events held on the property annually. The site provides a unique opportunity for those who attend and utilize the site to partake in the rural charm of Weld County. The current Road Impact Fee assessed amounts to $25,992.00 having been classified under the Shopping Center/Commercial land use type. While an event center may be seen as a Commercial land use type, the actual use is more similar to that of an agri- entertainment facility with limited usage on a regular basis. In compliance with the appeal process provided in the Weld County Municipal Code, an appeal of the fee was made within 10 -days as indicated in the timeline below. A written findings of facts and conclusion of law was provided to us on May 26, 2023, from Planning Director Tom Parko, declining the request for a change in land use type. Timeline of Request to Appeal April26, 2023 • The building permit fee for CMN22-0131 located at 37442 Highway 392 was provided by the Weld County Building Department (WCBD) including a summary of the fees assessed. • AGPROfessionals submitted a request to Wendi Inloes, Planning Coordinator, for a review of the road impact fees assessed. May 1, 2023 • Wendi Inloes reviewed the fees assessed and provided a re -assessment of the road impact fee. May 4, 2023 • After further review of the fee, AGPROfessionals formally requested the land -use type be revised from Commercial to Agricultural Commercial. • Tom Parko, Planning Director, provided an emailed response indicating how to proceed with the appeals process. May 15, 2023 A request to the Clerk to the Board to schedule an appeal to the Board of County Commissioners was requested. o Staff indicated that Planning Director Tom Parko needed to provide a formal finding of facts prior to scheduling an appeal hearing with the BOCC. The fees for this building permit were calculated under the category of "Shopping Center / Commercial" which includes the term "event centers" like Crow Creek. Based on the USR application materials on file, the Crow Creek Event Center is used by more than just non-profit organizations and is not necessarily used strictly for "agri- entertainment" as suggested under the definition of "Agricultural / Commercial". Several other event facilities like Crow Creek have been assessed impacts fees under "Shopping Center / Commercial" category. Therefore, I have determined that this department used the correct land use type "Shopping Center / Commercial" to calculate the fees. While an event center may be seen as a Commercial land use type, the actual use of the Crow Creek Event Center is more similar to that of an agri-entertainment facility with limited usage on a regular basis. The site can only be accessed from a public highway. Due to this, there is little expected impact to the nearby county roads.
