USR23-0003, FOR AN EVENTS FACILITY, NOT AGRICULTURE -RELATED, OUTSIDE
OF SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE
DISTRICT - JOSE AND MARISELA AVILA
A public hearing was conducted on April 12, 2023, at 10:00 a.m., with the following present:
Commissioner Mike Freeman, Chair
Commissioner Perry L. Buck, Pro-Tem
Commissioner Scott K. James
Commissioner Kevin D. Ross â EXCUSED
Commissioner Lori Saine â EXCUSED
Also present:

The following business was transacted:
I hereby certify that pursuant to a notice dated February 15, 2023, and duly published
February 17, 2023, in the Greeley Tribune, a public hearing was conducted on March 22, 2023,
to consider the request of Jose and Marisela Avila, for a Site Specific Development Plan and Use
by Special Review Permit, USR23-0003, for an Events Facility, not agriculture -related, outside of
subdivisions and historic townsites in the A (Agricultural) Zone District. At said hearing the Board
continued the matter to April 12, 2023, to allow the case to be heard by the Planning Commission
on April 4, 2023. Karin McDougal, Assistant County Attorney, made this a matter of record.
.= Kim Ogle, Department of Planning Services, stated the applicants have submitted a request
to withdraw the case and in response to Chair Freeman, Mr. Ogle relayed the request is due to
an issue with water.
El Commissioner James moved to accept the request of Jose and Marisela Avila to withdraw
the application for a Site Specific Development Plan and Use by Special Review Permit,
USR23-0003, for an Events Facility, not agriculture -related, outside of subdivisions and historic
townsites in the A (Agricultural) Zone District and dismiss the matter. The motion was seconded
by Commissioner Buck, and it carried unanimously. There being no further discussion, the hearing
was completed at 10:02 a.m.
