Buck, Pro-Tem Commissioner Scott K. James Commissioner Kevin D. Ross Commissioner Lori Saine Also present: Acting Clerk to the Board, Jess Reid Assistant County Attorney, Karin McDougal Department of Planning Services representative, Kim Ogle Department of Public Health and Environment representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated December 12, 2022, and duly published December 14, 2022, in the Greeley Tribune, a public hearing was conducted to consider the request of Jeremy Brown, for a Site Specific Development Plan and Use by Special Review Permit, USR22-0032, to exceed the maximum allowed building coverage (up to 12%) in a subdivision in the A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and the general location of the site. He stated the site is within the three (3) mile of referral area of the Towns of Windsor and Johnstown and the City of Greeley, and read their referral comments. He shared, per the Development Review staff, there are two (2) unpermitted access points onto Lakota Court for which the applicant will need to obtain Access Permits. He relayed traffic will be typical for a residential dwelling, the site meets a drainage exception, and although in an MS4 area, there are no triggers met at this time. He explained the application is for an addition to the home and garage, notice was sent to 21 surrounding property owners, three (3) phone calls were received regarding the application and referrals were sent to 12 referral agencies. Mr. Ogle entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. Lauren Light, Department of Public Health and Environment, stated the residence is served by the Little Thompson Water District and a septic system permitted for four (4) bedrooms, which is not in the vicinity of the construction area. cc: PL (TP/M N /Ko) 0211,1 /23 2023-0238 PL2855 HEARING CERTIFICATION - JEREMY BROWN (USR22-0032) PAGE 2 El Jeremy Brown, applicant, had no additional comments. El No public testimony was offered concerning this matter. '' The Board made no changes to the Conditions of Approval or Development Standards. FM In response to Chair Freeman, Mr. Brown indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as presented. Commissioner James moved to approve the request of Jeremy Brown for a Site Specific Development Plan and Use by Special Review Permit, USR22-0032, to exceed the maximum allowed building coverage (up to 12%) in a subdivision in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as presented. The motion was seconded by Commissioner Ross, and it carried unanimously. There being no further discussion, the hearing was completed at 10:08 a.m. This Certification was approved on the 8th day of February, 2023.
