RESOLUTION /_ ,
WHEREAS, by Resolution adopted February 10, 1971, by the
Board of County Commissioners, Weld County, Colorado, the area
described as follows:
A tract of land situated in the EZ of Section 35, Township
6 North, Range 67 West of the Sixth P. M. , Weld County,
Colorado, being more particularly described as follows:
Considering the East line of the NEI of said Section 35 as
' bearing S 00° 33' 20" E and with all bearings contained
r herein relative thereto. Commencing at the NE corner
of said Section 35, thence S 00° 33' 20" E 1319. 94 feet
to the NE corner of the Sf of the NE4 of said Section 35,
said point also being the true point of beginning, thence
S 00° 33' 20" E, and along the East line of the NE-,1 of
said Section 35, 970. 00 feet, thence S 89° 36' 28" W,
1040. 00 feet, thence S 000 33' 20" E, 352. 00 feet, thence
S 89° 36' 28" W, 555. 00 feet, thence N 00° 33' 20" W,
1322. 00 feet to a point on the North line of the Sf of the
NE4 of said Section 35; thence N 89° 36' 28" E 1595. 00
feet to the true point of beginning, containing 40. 00 acres,
more or less,
was changed from "A" Agricultural District to Mobile Home District,
"MH-UD" with certain conditions, and
WHEREAS, it now has come to the attention of the Board that
said conditions have not been complied with and that the former owner
has sold subject property, and
WHEREAS, the present owners of the land so rezoned have
requested that the present zoning be extended for a period of one year
due to problems in obtaining water and sewer to the premises, and
WHEREAS, the Board has reviewed the facts and circumstances
surrounding the delay in the matter, and
WHEREAS, the Board being fully advised in the premises;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, Weld County, Colorado, that the request of the present
owners of the hereinabove zoned land, be, and it hereby is granted.
BE IT FURTHER RESOLVED, that the present zoning of "MH-UD"
be extended to June 1, 1973 on condition that the present owners of the
land proceed with due diligence to obtain the necessary sewer and water
for the area and to comply with the condition pertaining to building of the
necessary roads; otherwise, the Board may, for good cause shown, on its
own motion, revert the area to its original zoning.

Gentlemen:
Confirming my conversation this date with Mr. Marshall Anderson and Dennis
Scholl concerning roadway along the South boundary line of the Esther Ehrlich
property described as
The North Half (Ni) of the Northeast Quarter (NE4)
of Section Thirty-five (35), Township Six (6) North,
of Range Sixty-seven (67), Weld County, Colorado,
please be advised of the following:
We contemplate that, subject to the condition that we receive
(a) commercial or industrial zoning (preferably industrial) for the North Half
of the Northeast Quarter of 35-6-67 and the North Half of the Southeast Quar-
ter of 26-6-67 (the 80 that lies immediately North of the Hensel Phelps 80,
the latter being immediately North of the North Half of the Northeast Quarter
of 35);
(b) relinquishment by the County of the entitlement to 30 feet off of the Sec-
tion line which is the North boundary of the Ehrlich property described as
the North Half of the Northeast Quarter of 35, and
(c) conveyance from the Hensel Phelps 80 of the 3 0 feet to be relinquished by
the County as it applies to the Hensel Phelps property, and

(d) permission to relocate the feedlot on the North Half of the Northeast
Quarter of 35-6-67, or at or near the Milliken Feedlots of Ehrlich Feedlot,
Inc. ,
Esther Ehrlich, as owner of the North Half of the Northeast Quarter, will
surrender the South 100 feet of the North Half of the Northeast Quarter to
Roger Gump and Associates for the construction of a roadway to match up
with the Kodak roadway, which road will be improved at the expense of Roger
Gump.
It is my understanding that you propose to coordinate this matter with the
Planning Commission and the Town of Windsor, with a view to the possibility
of establishing an industrial park zone for the two Ehrlich 801s and the Hensel
Phelps 80.
Time is of the essence because Gump and Associates may be obliged to lose
their option rights to the Lamp property, and as a consequence it would be
most appreciated, if an indication of your inclination could be rece^ved by
April 15th:
