RESOLUTION
WHEREAS, the Denver Regional Council of Governments, at a meeting
on August 21, 1974, adopted a Water Quality Management Report which outlines
short- and long-tern water quality management plans and a regional sewer plan
which materially affects Weld County and State Planning and Management
Region 2;
WHEREAS, the effects of such location of such sewage transmission,
treatment and disposal facilities may detrimentally affect water rights,
comprehensive land use planning, water quality management planning and
agricultural land use within Weld County;
WHEREAS, the Denver Regional Council of Governments or its agent, at
no time during the course of the study, made any attempt to contact said
affected agencies to coordinate, inform or gather input from these agencies
concerning major waste treatment and disposal facilities contemplated for
location in these jurisdictions;
WHEREAS, the final plan was not made available to the concerned parties
in Weld County and Region 2 until August 14, which was insufficient time to
review the plan in light of the August 21 DRCOG council meeting, of which no
notice was given to the concerned parties in Weld County and Region 2; and

WHEREAS, the EPA standards for meeting the requirements of Water
Quality Management Basin Plans under Section 303 of the Federal Water
Pollution Control Act, said standards being published in the Federal Register
Volume 39, Number 107, Part II, dated June 3, 1974, stipulate in Paragraph
130.10, Item (c), "The process shall provide the method by which the State
shall coordinate all water quality planning, programming, and management";
and Item (d), "The process shall provide the method by which the State shall
coordinate its water quality management planning with related State and local
comprehensive, functional, and project planning activities, including land
use and other natural resources planning activities." Paragraph 130.25,
Item (a), states, "The process shall provide that in the preparation of basin
plans, adequate area wide and local planning inputs will be included in the
basin plan as appropriate"; and Paragraph 131.309, Item (b) , states, "Each
basin plan shall identify the relationship, indicate the current status and
describe the extent of cwmplementary influence of any other water quality or
other applicable resource plan prepared or under preparation which involves
all or any part of the basin including:
(1) Each designated are wide waste treatment management
plan under Section 208 of the Act;
(2) Each facility plan for a proposed project for the
construction of treatment works under Section 301
of the Act;
(3) Each level B basin plan pursuant to Section 209
of the Act on Pub. L. 89-90 and
(4) other applicable resource planning"'
NOW, THEREFORE, BE IT RESOLVED that the County Commissioners of Weld
County hereby request that the Colorado State Department of Health exercise
its coordinative responsibilities and require modifications to the DRCOG

Water Quality Management Plan which will mitigate the detrimental effects
of this plan upon adjoining jurisdictions, and that the United States
Environmental Protection Agency set aside any disbursement of federal funding
which may be associated with this plan until the State and DRCCG comply with
the aforementioned EPA guidelines regarding coordination with all affected
jurisdictions in Weld County and State Planning and Management Region 2.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 28th day of August, 1974.
