In accordance with Colorado Policy Guidance Letter (PGL), WIOA-2017-09 requires the local board to conduct monitoring of its one -stop operator. When the local board is selected as the one -stop operator, an outside entity or a State Agency must conduct the monitoring and report the monitoring results to the Chief Elected Official in the local area. The ACWBC serves as the One -Stop Operator in Adams County and ESWC has agreed to serve as the outside entity to conduct this monitoring. The purpose of the Memorandum of Understanding (MOU) is to establish an agreement between the parties concerning the respective roles and responsibilities for implementation of the provisions of the PGL. The parties' performance under the MOU shall commence on July 1, 2023 and shall terminate June 30, 2026, unless previously terminated or updated by one of the parties pursuant to the terms of the MOU. Ross Lori Saine Schedule Work Session Other/Comments: Pass -Around Memorandum; July 11, 2023 - CMS ID 7236 Page 2 MEMORANDUM OF UNDERSTANDING Between Adams County Workforce and Business Center as the Adams County One -Stop Operator And Employment Services of Weld County EFFECTIVE DATE: 5/17/2023 SUBJECT: Adams County One -Stop Operator Monitoring PURPOSE: To define the relationship between the Adams County Workforce and Business Center (ACWBC) and Employment Services of Weld County (ESWC). BACKGROUND: In accordance with the Workforce Innovation and Opportunity Act (WIOA) statutory framework, partner programs and entities that are jointly responsible for workforce and economic development, educational, and other human resource programs collaborate to create a seamless customer -focused One -Stop Delivery system that integrates service delivery across all programs and enhances access to the programs' services. The ACWBC serving as the One -Stop Operator in the Adams County will ensure that customers have access to connect with the full range of relevant programs, services and activities provided by the required partners in the Adams County One -Stop Service Delivery System as specified in § 121 of the Workforce Innovation and Opportunity Act of 2014, and Colorado Policy Guidance Letter (PGL) WIOA-2016-02. ONE -STOP OPERATOR MONITORING: In accordance with Colorado PGL WIOA-2017-09 requires the local board to conduct monitoring of its one -stop operator. When the local board is selected as the one -stop operator, an outside entity or a State agency must conduct the monitoring and report the monitoring results to the Chief Elected Official in the local area. As the ACWBC serves as the One -Stop Operator in Adams County, ESWC agrees to serve as the outside entity to conduct this monitoring. SCOPE OF WORK AND EXPECTATIONS: ESWC will perform annual monitoring of the Adams County One -Stop Operator to be completed annually, no later than July 31. of each year. This monitoring will be conducted in accordance with PGL- 2017-09 utilizing the One -Stop Operator Monitoring Tool developed in collaboration with the ACWBC and ESWC. The ACWBC will present the results of the One -Stop Operator monitoring to the Chief Elected Official or designee in Adams County. TERM The term of this MOU will be for a period of three (3) years from the date this MOU is executed subject to annual review by the ACWBC and ESWC. g7 O -a/Ov, TERMINATION The ACWBC shall have the right to terminate this MOU with or without cause by giving written notice to ESWC of such termination and specifying the effective date thereof. CHANGES The ACWBC and ESWC may, from time to time, request changes to this MOU. Such changes that are mutually agreed upon shall be in writing, executed by both parties to this MOU. ASSIGNABILITY OR SUBCONTRACTING Any assignment or transfer of this MOU is prohibited, unless agreed upon by both parties, which agreement shall be in writing. NOTICE PROCEDURE All notices required to be given pursuant to this MOU shall be in writing and shall be deemed given when personally served or three (3) days after deposit in the United States Mail, certified mail, return receipt requested and addressed to the following Parties or to such other addressee(s) as may be designated by a notice complying with the foregoing requirements. Notice via email is also valid provided that the receiving party responds to the email message and will be deemed given upon date the initial email is sent and not the date of the response email.
