The purpose of the proposed change of zone is to change the zone from Agricultural to commercial C3 . I have the desire to start a business with my family and this change is required for the business purpose . 2 . The current and previous use for this land has been mostly oil and gas development . The previous owners did not farm or use the land in any other way. It has been vacant and unmaintained for many years . 3 . The nearest residence to the proposed use is roughly 1000 ft. There are only 3 homes nearby the property, all of which are over 1000 ft away. One directly to the North , about 1500 ft . One to the NorthEast , about 1100 ft . And one to the West , about 1000 ft away. All other residences in the area are thousands of feet away and all other buildings nearby are not personal residences . The current zoning of this parcel is not its best use for multiple reasons . First , there is a significant amount of oil and gas development on this property which , for many folks , deters it as a use for a personal residence . Additionally, it is not prime farmland since there is no irrigation . The sandy soil on the property also deters farming since it does not hold moisture or contain any nutrients . These details are further explained in the Soils Report . With the current price of real estate , 43 acres is not enough land to run an economical farm anyway when paired with the poor soil conditions . The many underground pipelines and two wells on the property can also create a hazard for farming . From working in the oil and gas industry personally, I have seen numerous line strikes due to a plow hitting an underground pipeline . The proposed use will be able to operate without disturbing underground pipelines . A benefit of the proposed zoning is that it will give a buffer between the operations of the smelly soil composting facility and other neighbors . When talking to neighbors there were many complaints of flies from the new compost facility, so a buffer from additional homes would be advantageous . Conditions around this parcel , although technically agricultural , have been leaning towards commercial nature for years . The previous owner of this parcel just did not take the opportunity to develop this property. This proposal will fit in with the rapidly growing Firestone area , but not be in the center of the community. The fact that this parcel is in an opportunity zone depicts that the area is planned for development in the future , this proposed change is just one of the initial efforts . The nearby intersection of CR 19 and 20 is heavily traveled , which leads me to believe the nearby area will need to be developed , it's just a matter of time . lt is my goal to be a pioneer of the area . 5 . The uses listed below will be compatible with the surrounding land uses in the ways described below. It is important to note that since the proposed parcel is in an opportunity zone , there is expected to be future development of some kind . This means there will be some businesses that are not the exact same in nature , but still fit together to support the community. For example , when you go to the grocery store you will also find gas stations , car maintenance shops , doctors offices , and other businesses in the immediate area . This proposal is not in an extremely rural area which would make C3 allowable businesses completely dissimilar in nature to the nearby community of those rural areas . If anything , the soil composting facility and dairy farm would deter many of these businesses from building on this parcel to begin with due to the smell and flies . We do not want to come in and completely change the surrounding area . We are looking for a business opportunity that also allows us to live on the property one day and enjoy the country living with the neighbors . We want to be a part of this community that we would be moving into and a welcoming neighbor. Other C3 compatibility uses are listed below. 1 . AGRICULTURAL SUPPORT AND SERVICE . - Many nearby properties are agricultural so service nearby would fit in and benefit folks in the area . 2 . BREW PUBS , BREWERIES , DISTILLERIES , and WINERIES . - These businesses are actually needed in the area due to the rapid growth in the Firestone area . Although this is the case , it is unlikely for this style of business to succeed on this parcel due to the surrounding agricultural businesses . 3 . CAR WASHES and gas stations . - Car washes would have minimal effect on nearby properties . Gas stations many have some benefit if anything due to the significant amount of traffic on CR 19 . 4 . CHILD CARE CENTERS . - Child care is mostly an indoor business and therefore would not have any significant effect on the surrounding area . It would simply be a building with some additional traffic in the morning and evening hours . 5 . CHURCHES . - Church hours of operation are minimal so would not have any significant impact on the nearby community. Sunday morning would create some additional traffic, but the nearby businesses are usually not in operation on Sunday anyway. 6 . COMMERCIAL SCHOOLS . - Commercial schools would mostly operate during normal business hours and would be completely inside . The most significant change would be having more buildings in the immediate area . 7 . COMMERCIAL STORAGE BUILDINGS . - Storage is the least intrusive business . Neighbors mentioned the idea of storage since it would not increase traffic or increase the amount of neighbors in the immediate area . 8 . COMMUNITY BUILDINGS . - Community buildings are similar to businesses mentioned above that are completely inside operations . Having additional buildings in the area will still allow the property to be compatible as the county buildings work operations would not be intrusive . 9 . CONTRACTOR'S SHOPS . - Contractors shops would be one of the more agricultural style businesses as they would store lumber and other supplies on site just to support the business. Their business obviously takes place on the building site and not at their shop so this would be minimally intrusive . 10 . CUSTOM MEAT PROCESSING . - This is also an agricultural style commercial business and would fit in extremely well with a dairy business nearby. 11 . DISTRIBUTION CENTERS . - A distribution center would be most compatible with the oil and gas salt water disposal facility nearby. That business also generates a significant amount of truck traffic in the area which is no different than a distribution center for other products . 12 . EVENT FACILITIES . - The only potential disruption from event facilities would be noise , likely from music, and this scenario is protected by a noise ordinance , which is why most events are required to be shut down by 10 or 11 pm anyway. Additionally, there are other event centers in the area which have proved to be of little concern . 13 . FUNERAL HOMES and mortuaries . - Funeral homes cause minimal disturbance due to their limited hours of operation and quiet nature . 14 . Golf courses . - Golf courses would be unlikely to build in this area due to the amount of noise and limited amount of property. 43 acres is not enough to build any style of golf course . Although , a golf course would be quiet and not disturb any neighbors if one were to be built . 15 . Headquarters or service facilities for taxi services , bus services and other services involving the transportation of people . - There is already a significant amount of trucking traffic in this area due to the salt water trucks , farming trucks , and soil composting trucks traveling nearby. I do not see any compatibility issues with this . 16 . HOSPITALS , nursing homes , rehabilitation centers . - Again , these are mostly inside operations and would be minimally intrusive to neighbors . Nighttime traffic for a hospital is minimal , and two of the three residences nearby are on the north side of the parcel which is opposite to this parcel 's access . 17 . HOTELS/MOTELS . - Hotels would be less compatible but would also be extremely unlikely to build in this area due to being further out of town in an urban area and away from activities. Hotels however, are not loud or noisy and would not likely create any disturbance in the area . 18 . INDOOR SHOOTING RANGES . - Shooting ranges fit in well with agriculture . However, running it commercially would also fit into this area's culture due to the business nature of nearby properties . 19 . LANDSCAPING COMPANIES . - This is an agricultural style business and would fit in well with the surrounding community. 20 . One important goal of the Weld County Comprehensive Plan is to promote economic development and job creation for Weld County. The intent is to set aside specific areas for business , which is one reason this location is great for businesses . This business creates jobs and it conveniences residences in the area , which encourages population growth and therefore brings additional cash flow to other businesses in the area . This business will also support other local businesses in the area . The changing conditions of Weld County, specifically in the Firestone area , warrant a change due to dramatic population growth . With an increased population there will always be a demand for more local businesses . Many businesses are already located near this parcel , many of which are more intrusive . Another intent of the comprehensive plan is to create commercial areas that meet the needs of county residents . Also , an important detail in the code is that the proposed business will be well kept, which is critical to the successful operation of the business . The code encourages development to be located near municipal boundaries , which is exactly where this property is located . This allows open rural land to be farmed and undeveloped . (27- 1 - 10 ) Discusses growing commercial development to meet population demands . It also mentions clean , safe , and pleasant development that puts minimal strain on transportation facilities . The proposed business is one of the least visited commercial spaces . This means minimal additional traffic would be added from this project . Conservation of the value of the land is also discussed and this facility will have minimal impact on the existing land . No significant changes will be made to develop my proposal . (22-2- 10) One of the guiding principles is to promote economic growth and stability. Without conveniences in the area residents are likely to choose other areas to live than Weld County. There are also some local businesses that would benefit from this proposal . (22-2-40 ) Weld County promotes small business and encourages the development of small business owners . My fiance and I are small business owners who also live in the community and are eager to continue creating business within Weld County. (22-2-60) The county obviously has energy development , which also happens to be a priority of ours since I work in the industry. We plan to work with oil and gas companies and support their development on our land or nearby as necessary. 8 . This proposal will be compatible with future development in the surrounding area since this area specifically is in an opportunity zone . Long term this will encourage , and more than likely allow, other businesses to build in this area . The intersection at CR 19 and 20 is likely to be a major intersection within the next 10 years . This is predicted due to the significant amount of traffic traveling on CR 19 daily. Other businesses may also be encouraged to build in this area due to the increasing price of real estate in Weld County. Much of the commercial acreage in the i-25 corridor area is unaffordable for small businesses . Next, this project will be in line with the Firestone Master Plan for multiple reasons . Simply, Firestone considers itself an area of regional growth and therefore adopted the motto of "A Community in Motion . " This plan also discussed a balanced approach to a blend of housing and commercial opportunities . Since this project does not directly interfere with any proposed housing developments , I suspect they would support this project . Fort Lupton is even more friendly to business growth and is openly willing to "support businesses to untap their economic potential . " Upon discussion with Fort Lupton , storage is required to be in industrial zoning , but they would consider a USR under agricultural zoning . This is something to consider if the property is proposed for storage , but will have other available uses under C3 , which is the purpose of this change of zone . Below is the population trend of Firestone showing the dramatic increase in residence in a short amount of time and a map showing that the property is in an opportunity zone . As mentioned before some neighbors discussed this as a benefit to their personal welfare due to the fact this facility is not adding personal neighbors to the immediate area . Also , the fact that we plan to live on the property means we have the same motivation to keep the area compatible , quiet , and non intrusive . 10 . This proposal is not in an Overlay Zoning District . COZ Development Review Questionnaire 1 . The access location will be in the center of the parcel off the north side of CR 20 . There is no existing access so it will need to be developed . The purpose of this access will be for storage customers and personal use of the property. 2 . There are currently two access points to the property from another parcel but are solely for the access to the existing oil wells . Both wells are planned to be plugged and abandoned in the near future so both of those access points will go away . 3 . An access gate is proposed at the entrance of the storage facility on the south side of the property , just north of CR 20 . It would have a keypad and only be accessible to tenants with a signed lease to . 4 . There are three access points North of CR 20 between our property and CR 19 , which is to the west . CR 19 is 2270 ft from our proposed access point, the first access point is 1440 ft from our proposed access point , the second access point is 1250 ft from our proposed access point, and the third access point is 460 ft from our proposed access point. To the east , there are two access points North of CR 20 . The first one is 680 ft from our proposed access point and the second one is 1000 ft from our proposed access point . On the south side of CR 20 , there are two nearby access points . One is 260 ft east from our proposed access point and the other is 700 ft east of our proposed access point. 5 . There is no difficulty seeing oncoming traffic from any existing or proposed access locations . At the proposed access point , CR 20 is flat which makes oncoming traffic extremely visible . 6 . There are no curves anywhere near the proposed access point . CR 20 is perfectly straight in this area . 7 . The topography is flat near the proposed access point . There are no hill at all towards the west of the access point . To the east, there is a slight hill but is at least 1000 ft from the proposed access point . COZ Environmental Health Questionnaire 1 . There is no existing water source but there are two potential water sources . A well can be drilled on the property or there are two water lines that run the full length of the southern border of the property . One 3" is on the North side of CR 20 and one 6" is on the South side of CR 20 . Either line would work for my project, but the 6" may be necessary if the fire department determines this project requires a hydrant. A can serve statement has been provided by the county . 2 . There is no existing sewage . A new on -site wastewater treatment system is proposed .
