MEMORANDUM TO: Diana Aungst, Planning Services FROM: Melissa J King, PE, Development Review DATE: June 30, 2023 1_ G U N r Y _ SUBJECT: USR23-0028 SEF Auburn (Matson) The proposal has been reviewed on behalf of the Weld County Department of Public Works and the Department of Planning and Zoning. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description:A Site-Specific Development Plan and Use by Special Review Permit for a Solar Energy Facility (SEF) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. This project is south of and adjacent to CR 52 and is east of CR 43.5. Parcel number: 096135200001 Lot B RECX17-0143. Access is onto CR 52: AP17-00110 Agricultural and AP18-00367 Commercial. ACCESS Development Review has reviewed the application materials related to access. The parcel has two existing permitted access points onto CR 52 (AP17-00110 Agricultural and AP18-. 00367 Commercial). No additional access points are requested. Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We strongly encourage you to discuss your access location with Development Review prior to laying out your site plan. All "preliminarily approved" accesses are subject to change during the access permitting process. Per Sec. 24-8-40, when feasible, there shall be no net increase in the number of accesses to a public road. Minimum access spacing widths are shown in Weld County Code Sec. 8-14-30. Please refer to Chapter 8 of the Weld County Code for more information regarding access. ROADS AND RIGHTS-OF-WAY This portion of CR 52 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate and label on the site map the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1- 90, the required setback is measured from the future right-of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. The western boundary of the parcel is along unmaintained right-of-way for CR 45. County Road 45 is a section line road. Section line right-of-way does not exist in all sections in Weld County and should be verified before a decision to utilize it is made. Weld County commonly refers to these locations as"Non-Maintained Section Line Right-of-Way."The existence of a physical road does not imply public right-of-way and the road may be located on private property. All right-of-way should be verified and physical roads located in relationship to the public right-of-way to ensure trespassing does not occur. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the site plan or plat. The applicant shall delineate on the site map or plat the existing right-of-way and physical location of existing or proposed roads. If the right-of-way cannot be verified it shall be dedicated or an adequate easement between property owners shall be provided. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware the physical roadway(s) may not be centered in the right-of-way. This road is NOT maintained by Weld County. Per, Sec. 8-13-30.B, a Weld County Right-of-Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights-of-way or easement. Right-of-Way Use Permit instructions and application can be found at https://www.weldgov.com/departments/publicworks/permits/. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. TRAFFIC A recent traffic count (2020) for this portion of CR 52 counted 206 vehicles per day with 19% trucks. Traffic information submitted with the application materials indicates that construction traffic will be 20 roundtrips per day of which 4 may be heavy duty trucks and that the operation traffic would be 3 passenger vehicle roundtrips per quarter. No additional traffic information is needed. TRACKING CONTROL Tracking control is required to prevent tracking from the site onto public roadways. For access to paved roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior to entering publicly maintained roadways. A variance request for alternatives to the tracking control requirement can be submitted to Development Review for review and consideration. This site requires approved tracking control during construction. ROAD MAINTENANCE AGREEMENT (Construction) Development Review is requesting a Road Maintenance Agreement for Construction including, but not limited to, dust control and damage repair to specified haul routes. Improvements/Road Maintenance Agreement: An example agreement is available at: https://www.weldgov.com/Government/Departments/Planning-and-Zoning/Development-Review . It will detail the approved haul routes and include a maintenance agreement for the haul routes. DRAINAGE REQUIREMENTS This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of runoff from the 1-hour, 100-year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1-hour, 5-year storm falling on the undeveloped site for URBANIZING areas. The applicant has submitted a drainage report identifying all the site soils as NRCS hydrologic soil group A. Per Sec 23-4-1030.B.1, the site qualifies for a stormwater detention exception. No additional drainage information is needed. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. CONDITIONS OF APPROVAL A. A Road Maintenance Agreement (Construction) is required at this location. Road maintenance includes, but is not limited to, dust control and damage repair to specified haul routes during construction. (Development Review) B. The USR map shall be amended to delineate the following: 1. CR 52 is a gravel road and is designated on the Weld County Functional Classification Map as a local road which requires 60 feet of right-of-way at full buildout. The applicant shall delineate and label on the site map the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. All setbacks shall be measured from the edge of right-of-way. This road is maintained by Weld County. (Development Review) 2. County Road 45 Section Line is shown to have 60 feet of unmaintained section line right-of-way per the Weld County GIS right-of-way map. The applicant shall delineate the existing right-of-way on the site plan. Show and label the section line Right-of-Way as "CR 45 Section Line Right-Of- Way, not County maintained." All setbacks shall be measured from the edge of right-of-way. (Development Review) 3. Show and label the permitted access point onto CR 52 and the usage types (Agriculture, Residential, Commercial/Industrial, or Oil and Gas). Development Review will review the access location as a part of the plan submittal. (Development Review) 4. Show and label the drainage flow arrows. (Development Review) GRADING PERMIT A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant, Planning Department has reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Development Review for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575. Prior to Construction: A. The approved tracking control shall be constructed prior to on-site construction. (Development Review) B. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required. (Development Review) DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN) 1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. (Development Review) 2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages and/or off-site tracking. (Development Review) 3. Any work that may occupy and or encroach upon any County rights-of-way or easement shall acquire an approved Right-of-Way Use Permit prior to commencement. (Development Review) 4. The Property Owner shall comply with all requirements provided in the executed Road Maintenance Agreement. (Development Review) 5. The historical flow patterns and runoff amounts on the site will be maintained. (Development Review) Weld GOUNTy Department of Public Health and Environment Memorandum To: Diana Aungst From: Lauren Light, Environmental Health Services Date: July 5, 2023 Re: USR23-0028 Applicant: Leslie Matson Environmental Health Services has reviewed this Site-Specific Development Plan and Use by Special Review Permit for a Solar Energy Facility outside of subdivisions and historic townsites in the A (Agricultural) Zone District. As no employees will be located at the site, permanent water and sewer is not required. Screened portable toilets, hand washing units and bottled water can be utilized during construction. Environmental Health Services recommends the following requirements are incorporated into the permit as development standards: 1. During construction, all liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. During construction, no permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 3. During construction, waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 4. Fugitive dust and fugitive particulate emissions shall be controlled throughout the duration of construction and operation of the facility. There are no active or proposed 1041 WOGLA Permits on the associated parcel. There are several oil and gas well sites in the area surrounding the parcel. 2. The parcel includes one(1) active oil and gas well, listed in Table 1 below. OGED requests that the Applicant coordinate operations in proximity to existing wells and production facilities with the operator(s) of the well. The Company owns an exclusive easement across this property as legally described in the Warranty Deed dated September 24, 1898, and recorded November 2, 1898, at Book 454 at Page 155 of the Weld County records. A copy of that Warranty Deed is attached to these comments. The Company also owns additional easement rights across the property included in the development that are not shown on the plat of the property submitted to the County. US Solar Comment: The easement described in Book 155, Page 454 does not specify to be exclusive. 2. The Company has ownership of certain property adjoining the land included in this proposed land use development. The location of the Company's easement is included within the development. The location of the Company's easement is not properly shown on the plat, and the plat should be corrected to show the location of that easement as described in the Deed . US Solar comment: The location of the easement per Book 155, Page 454 is confirmed per recorded exemption No. 0961-35-02 RECX17-0143 recorded at Reception No. 4362387 dated 12/21/2017 (attached for reference.) 3. The plat apparently shows one overhead electric line crossing over the property and easement of the Company. This proposed crossing and any other crossing that may become necessary, whether for roads, utilities, or other facilities, will require prior written approval of the Company for any crossing of its property and easement. US Solar Comment : Lower Latham Reservoir Company has kindly already supplied us with an Overhead Electric Line Easement Crossing Agreement form for US Solar's execution, should the USS Auburn Solar LLC project move forward . We are sincerely appreciative of LLRC's continued communication . 4. The applicant must not place any fence within the property and easement and the applicant shall not install any gates or fences on or across the Company's easement and property without the prior written approval of the Company. US Solar Comment: No proposed project fence pertaining to USS Auburn Solar LLC lies within the easement described in Book 155, Page 454. 5. The Company would identify to the applicant and the County that there may be subsurface waters that arise in this development and that there are periods of time when, due to water flowing within the reservoir and ditch system and otherwise, that portions of the property receive significant amounts of subsurface water that is very near to the surface or resides on the surface. Also, the property lies below the elevation of the Lower Latham Reservoir, and if the spillway on the Reservoir operates at a time of high water, then portions of the property could become inundated by water flowing in the outlet canal of the Reservoir. Due to these matters, the utility of certain portions of the property for construction of structures could potentially be unavailable. The Company has no plans to alter its operations that would cure this surface and subsurface water issues. A note should be inserted on the plat of the development regarding these issues. US Solar Comment: The project area is not located within a FEMA floodplain . No watercourses will be altered by the proposed project. The solar panels and the trackers will be elevated to retain at least one ( 1) foot of freeboard from the water surface elevation. Inverters and the equipment will also be elevated . The medium- voltage cable connecting the solar garden equipment to the point-of-interconnection poles to the north will be buried underground. A third-party licensed engineer completed a Preliminary Drainage Report (attached for reference) that concluded that the site design will adequately protect public health and safety. US Solar will obtain a Stormwater Pollution Prevention Plan Permit prior to construction . 6. The applicant should acknowledge that historic irrigation and drainage patterns should be maintained on the property so that there are no changes in the operation of the Company's facilities . A drainage plan should be prepared by a licensed engineer to analyze and report on any change in drainage patterns caused by the development of the property. The Company should be provided with a copy of that plan and the Company should have the opportunity to review and comment on the plan . The applicant should be required to maintain the existing irrigation and drainage patterns so that the quality of water entering the ditch from irrigation and from precipitation and other sources is maintained, and so that there is no change in point or type of drainage into the ditch that will occur. The applicant should be required to monitor and identify any pollutants or other hazardous materials that enter the ditch and should agree to stop any such deposit in the ditch system . A note should be inserted on the plat of the development regarding these issues. US Solar Comment: No hazardous materials will enter the ditch as a result of our community solar garden . All of the community solar garden 's materials are fully-contained. The solar panel materials 2 consist largely of the same materials as the smartphones in our pockets: silicon, glass, and aluminum. Existing irrigation and drainage patterns will be maintained. We have already conducted a Preliminary Drainage Report (attached) . No watercourses will be altered as a result of our project. We will be planting native vegetation within the fenced area of our project, which will help minimize stormwater erosion and runoff. 7. The Applicant should acknowledge that : 1) No livestock watering, swimming, tubing, canoeing or other use of the ditch or water in the ditch or reservoir is allowed; 2 ) No dumping of refuse, including but not limited to garbage, waste materials, grass clippings, tree and shrub prunings, motor oil, chemicals, pesticides or herbicides is allowed; 3 ) No pumps for irrigation are allowed in the ditch; 4) No use of the ditch easement for hiking, biking, horseback, motorcycle, off road vehicles or other motorized or non-motorized vehicle shall be allowed . A note should be inserted on the plat of the development regarding these issues. US Solar Comment: US Solar and its contractors will not impact the ditch or the water within it during the construction period . None of these activities mentioned above will be conducted on the site. The idea would be for the MVAC line to be buried underground from our solar garden to the north until it reaches our point-of- interconnection poles located on the north end of Les Matson ' s parcel . TBPLS Firm #10074302 Drainage Report I USS Auburn Solar LLC April 21, 2023 Project Site This Drainage Report has been prepared on behalf of United States Solar Corporation, for the proposed construction of the USS Auburn Solar LLC Facility in Weld County, Colorado hereinafter referred to as the project. The proposed development is located in the NW1/4 Quarter of Section 35 , Township 5 North , and Range 65 West of the 6th Prime Meridian. More specifically the Project site is approximately 28 acres of land and is located approximately 3 .5 miles southeast of Garden City and approximately 1/4 mile south of the intersection of Weld County Road (WCR) 52 and WCR 45 in Weld County, Colorado. The site is covered intermittently with agricultural row crops depending on time of year. The ground surface slopes to the west, north, and east at an average slope between i% and 3% . The site is located just north of the Lower Latham Reservoir but is not anticipated to receive any flow from this reservoir and does not contain any FEMA flood hazard zones . General Description of Project It is proposed to develop approximately 28 acres of land for the project for an approximate 5 MW solar array. The solar array will deliver renewable energy under a power purchase agreement (PPA) . The facility is designed for un-manned operation except for bi-annual maintenance. Therefore, this facility will not represent any significant traffic impact to the surrounding county roads. Upon termination of the PPA, the improvements will be removed, and the land will be restored to historic conditions. Drainage Design The area under the solar panels will be planted with a low-maintenance grass seed mix. Very little additional impervious surface will be added to the site . The only new impervious surface is the gravel access roads and concrete inverter pads, totaling i8, i6o ft2 . Per Weld County requirements, solar panels are not considered impervious on Hydrologic Soil Group (HSG) A or B soils. Given this, the site will not need a detention pond per Weld County requirements due to minimal onsite addition of impervious and the access road being disconnected impervious surface. In proposed conditions runoff will continue to sheet flow east, north, and west as it does in existing conditions. When the site is fully vegetated after construction, stormwater will flow off the solar panels, onto the ground, and run through the grass. The onsite soils, which are categorized as HSG A (Attachment 2), are conducive to infiltration. These soil types were also categorized as loamy sand. The fully vegetated site will slow runoff and encourage infiltration . Drainage Improvements There are no proposed drainage improvements onsite . All existing flowpaths will be maintained and perennial vegetation will be planted onsite that will decrease runoff and improve infiltration. Adjacent Areas There is a manmade Reservoir (Lower Latham Reservoir) located south along the upstream side of the proposed project. This Reservoir has not been analyzed as part of the project nor has any calculations or scenarios of the Reservoir failing been taken into account. The reservoir and adjacent creeks are not anticipated to impact the site . onsite Soils The soils for this project site are predominantly classified as hydrologic soil group (HSG) A (Attachment 2) . The soil types found in the project site area are Vona Loamy Sand, 0 to 3 percent slopes . For the sake of this project, all soils onsite have been modeled as HSG type A. This soil information is based on the Natural Resources Conservation Service (NRCS) National Cooperative Soil Survey. Timing/ Phasing Schedule In the initial and interim stages, the contractor shall install silt fence, vehicle traction control and concrete washout at the entrance, and a stabilized staging area. In the final stage of construction, seeding, mulching, and surface roughing shall be done in all disturbed areas, and erosion control blankets shall be installed on all slopes greater than 4 : 1 . The contractor shall also remove the vehicle traction control, concrete washout, stabilized staging area, erosion control blanket, and silt fence in the final stages of construction. BMP Installation, Inspection , and Removal BMPs will be installed prior to project construction, except for the BMPs in the final stage. BMPs will be inspected weekly and as required by the County through project completion by the contractor. BMPs will be maintained and remain in place at least until construction is finished and the site is vegetated. Once all exposed areas have been covered, the BMPs may be removed. Since the project does not include any other disturbance, no additional site stabilization is necessary and/or warranted. Permanent Stabilization The project will be seeded with the Weld County's upland area seed mix to establish permanent stabilization after construction activity has ceased. Reference the Temporary and Permanent Seeding Table on page EC-2 of Chapter 7: Construction BMPs in the USDCM Manual, Volume 3 . As per the USDCM Manual, permanent seeding involves the loosening of soil, applying topsoil, drill seeding the disturbed areas to a depth not less than 1/4 inch and not to more than 3/4 inch, and crimping the seeded areas in straw mulch at a rate of 2 tons per acres to provide immediate erosion protection. Summary The proposed site will be designed to maintain its existing drainage patterns . Due to the limited amount of impervious surface proposed and the proposed conversion of the site from row crops to the vegetated cover under the panels a decrease in runoff rates is expected for the proposed conditions when compared to existing conditions . Water quality treatment will be provided by the disconnected impervious and the proposed vegetation below the panels . Based on the landcover conversion and the addition of the low impact design the site design will adequately protect public health, safety, and general welfare and will have no adverse impacts on public right-of-way or offsite properties . 3 I Confidential and Proprietary. The Company owns an exclusive easement across this property as legally described in the Warranty Deed dated September 24, 1898, and recorded November 2, 1898, at Book 454 at Page 155 of the Weld County records. A copy of that Warranty Deed is attached to these com- ments. The Company also owns additional easement rights across the property included in the development that are not shown on the plat of the property submitted to the County. 2. The Company has ownership of certain property adjoining the land included in this pro- posed land use development. The location of the Company's easement is included within the development. The location of the Company's easement is not properly shown on the plat, and the plat should be corrected to show the location of that easement as described in the Deed. 3. The plat apparently shows one overhead electric line crossing over the property and ease- ment of the Company. This proposed crossing and any other crossing that may become neces- sary,whether for roads,utilities, or other facilities,will require prior written approval of the Company for any crossing of its property and easement. 4. The applicant must not place any fence within the property and easement and the applicant shall not install any gates or fences on or across the Company's easement and property without the prior written approval of the Company. 5. The Company would identify to the applicant and the County that there may be subsurface waters that arise in this development and that there are periods of time when, due to water flow- ing within the reservoir and ditch system and otherwise, that portions of the property receive significant amounts of subsurface water that is very near to the surface or resides on the surface. This referral does not appear to qualify as a "subdivision" as defined in section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. According to the referral, the proposed drinking water supply source for the solar project construction team will be bottled water provided by the contractor.
