A public hearing was conducted on December 6,2023,at 10:00 a.m.,with the following present:
Commissioner Mike Freeman,Chair
Commissioner Perry L.Buck,Pro-Tem
Commissioner Scott K.James
Commissioner Kevin D.Ross
Commissioner Lori Saine—RECUSED
Also present:
Acting Clerk to the Board,Jess Reid
County Attorney,Bruce Barker
Department of Planning Services representative,Kim Ogle
Department of Public Health and Environment representative,Lauren Light
The following business was transacted:
Chair Freeman asked Commissioner Saine to recuse herself,as she was not present for the
original hearing on October 4,2023.
I hereby certify that pursuant to a notice dated August 15, 2023, and duly published
August 18,2023,in the Greeley Tribune,a public hearing was conducted on October 4,2023,to
consider the request of Thomas and Marjorie Brown,do CBEP Solar 27,LLC,for a Site Specific
Development Plan and Use by Special Review Permit,USR23-0023,for a Solar Energy Facility
(SEF)outside of subdivisions and historic townsites in the A(Agricultural)Zone District.At said
hearing the Board continued the matter to December 6,2023,to allow the applicants adequate
time to get a Good Neighbor Agreement and a Crossing Agreement in place.Bruce Barker,
County Attorney,made this a matter of record.
Kim Ogle,Department of Planning Services,referenced an email from the applicant,received
November 30,2023,requesting additional time to get the Good Neighbor Agreement and the
Crossing Agreement with the Union Ditch in place.Mr.Ogle requested the hearing be continued
to January 17,2023.
Zach Bremmer,Cloudbreak Energy,stated the Good Neighbor Agreement was signed by
Cloudbreak Energy yesterday and is just waiting for the neighbor's signature,and the Crossing
Agreement is in the final stages and should be completed by the end of the year.
Et No public testimony was offered concerning the continuance.

Commissioner Ross moved to continue the matter to January 17,2024,at 10:00 a.m.,to
allow the applicant additional time to get a Good Neighbor Agreement and a Crossing Agreement
in place. The motion was seconded by Commissioner James, and it carried unanimously.
Chair Freeman reiterated there were only four(4)commissioners present for the hearing,as
Commissioner Saine was recused.There being no further discussion,the hearing was completed
at 10:35 a.m.
This Certification was approved on the 20th day of December,2023.
