DISTANCES FROM SECTION LINES 50 Ft. from South Section Line 1390 Ft. from West Section Line UTM COORDINATES Northing: Easting: ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT CONDITIONS OF APPROVAL 1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil court action. 2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18. 3) Approved pursuant to CRS 37-90-137(2) for the replacement of an existing well, permit no. 8522-R (decreed by the Division 1 Water Court as Bierig Land Co. well #1 - 8522, case no. W-5531). Upon completion of the new well, the old well must be plugged and abandoned in accordance with Rule 16 of the Water Well Construction Rules. A Well Abandonment Report form must be submitted within sixty (60) days of abandonment of the old well. 4) Approval of this replacement well permit shall not result in an expanded use of ground water. The use of ground water from this well combined with the applicant's surface water rights is restricted to the irrigation of 150 acres in the SW %, Sec. 25, Twp. 4 N, Rng. 66 W, Sixth P.M. 5) The maximum pumping rate of this well shall not exceed 700 GPM (1.55 CFS). 6) The annual amount of ground water to be appropriated shall not exceed 350 acre-feet. 7) Production is limited to the alluvium. The depth of this well shall not exceed 60 feet or the depth at which sandstone or shale is first encountered, whichever comes first. 8) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings. 9) This well shall not be pumped unless included in a court approved plan for augmentation or a substitute water supply plan approved by the State Engineer. 10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request. 11) This replacement well shall not be constructed any closer to any other existing well than the well it is replacing, if such other well is within 600 feet of the replacement, is completed in the same aquifer, and is not owned by the applicant. 12) This well shall be constructed not more than 200 feet from the location specified on this permit and not more than 200 feet from the location decreed for Bierig Land Co. well #1 - 8522 in case no. W-5531 (decreed location is 50 from the south section line and 1380 from the west section line). 13) This well is subject to administration by the Division Engineer in accordance with applicable decrees, statutes, rules, and regulations. ,)1 7J1y/o3 APPROVED JMW State Engineer Receipt No. 0512748 DATE ISSUED 07-15-2003 TION DATE 07-15-2004 Hello
