HomeMy WebLinkAbout20230812.tiffRESOLUTION RE: ACTION OF THE BOARD CONCERNING USE BY SPECIAL REVIEW PERMIT, USR22-0030, FOR OPEN MINING (SAND, GRAVEL, STONE, AND OVERBURDEN) AND PROCESSING OF MINERALS, INCLUDING THE IMPORT OF MATERIAL FROM, AND EXPORT OF MATERIAL TO OTHER SITES, A DRYING AND SCREENING BUILDING AND TWO (2) SILOS, A MINE OFFICE WITH SCALE HOUSE AND SCALE, A FUELING/LUBRICATING STATION, PORTABLE GENERATORS, MOBILE MINING EQUIPMENT PARKING AND STORAGE, AND EMPLOYEE AND VENDOR PARKING OUTSIDE OF SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT - HS LAND AND CATTLE, LLC, C/O MONARCH MOUNTAIN MINERALS AND AGGREGATES, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 29th day of March, 2023, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of hearing the application of HS Land and Cattle, LLC, P.O. Box 366, Gilcrest, Colorado 80623, c/o Monarch Mountain Minerals and Aggregates, LLC, 8308 Colorado Boulevard, Suite 200, Firestone, Colorado 80504, for a Site Specific Development Plan and Use by Special Review Permit, USR22-0030, for Open Mining (sand, gravel, stone, and overburden) and processing of minerals, including the import of material from, and export of material to other sites, a drying and screening building and two (2) silos, a mine office with scale house and scale, a fueling/lubricating station, portable generators, mobile mining equipment parking and storage, and employee and vendor parking outside of subdivisions and historic townsites in the A (Agricultural) Zone District on the following described real estate, to -wit: Multiple parcels being part of the E1/2 of Section 18, Township 4 North, Range 66 West; Lot A and Lot C of Recorded Exemption, RE 2714, Lot A and Lot B of Recorded Exemption, RE -4379, and Lot B of Recorded Exemption, RE 4932, all being part of Section 19, Township 4 North, Range 66 West; and Lot B of Recorded Exemption, RE -4931, and Lot B of Recorded Exemption, RE -4849, both being part of Section 30, Township 4 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board heard all of the testimony and statements of those present and reviewed the request of the applicant for a continuance and, having been fully informed, finds that this request be approved, and the matter should be continued to April 26, 2023, at 10:00 a.m., to allow the case to be heard by the Planning Commission on April 4, 2023. c c : f' L ('rP/rw / Ko) C A (km), A PPL . , APR.. Ross 2023-0812 PL2866 MEMORANDUM TO: Board of County Commissioners DATE: March 29, 2023 FROM: Kim Ogle, Planning Services SUBJECT: USR22-0030, Request for Continuance The Department of Planning Services on behalf of HS Land and Cattle, LLC c/o Monarch Mountain Minerals and Aggregates, LLC are requesting a continuance of this case for a Site Specific Development Plan and Use by Special Review Permit, USR22-0030, for Open Mining (sand, gravel, stone, and overburden) and processing of minerals, including the import of material from, and export of material to other sites, a drying and screening building and two (2) silos, a mine office with scale house and scale, a fueling/lubricating station, portable generators, mobile mining equipment parking and storage, and employee and vendor parking outside of subdivisions and historic townsites in the A (Agricultural) Zone District as a result of the applicant's failure to meet the thirty (30) day Mineral Notice requirement prior to the scheduled March 7, 2023 Planning Commission hearing.
