E'-TC - Ir i I T F - g - .In -L.I . - L 1 •■ T EndofC 220003 November 21, 2022 Case# COZ22-0003 RECEIVED NOV 2 8 2022 WELD COUNTY COMMISSIONERS To: Weld County Planning Commission and Board of County Commissioner, We, Curtis and Katherine Rickart, object to the proposed request to change the current agriculture zone of the property stated in the notice received from the planning department to commercial for the specific use of an RV storage as stated in the application. On a personal basis, our home would be surrounded by an RV storage area on the south half and complete west half, and potentially the entire south half since the entire parcel is being requested for commercial zoning. It would greatly depreciate the value of our home and every home in a wider radius than 500ft. We would completely lose the western farm and mountain view from our home to that of recreational vehicles. It would adversely affect beauty of the area plus the safety and security of our home and all the homes within the area, 500ft and beyond. The Weld County Sheriff department (addendum 1 to this letter), has stated there is a 24% crime increase of RV storage units in Weld County. The storage unit within 2 miles to the west has recently put lines of electric wire on top of their fencing further exemplifying the problem that currently exists. Plus, we have observed that the adjacent road is often become a dumping ground for TV's, sofa's and other large items, creating roadway hazards. There is a high potential for increase in crime at our homes location. We have always felt safe in our home, but that feeling would evaporate with an RV storage and the increase of traffic up and down the access/easement road with the only turn around space ending up within our private driveway and yard. It is unsettling. The number of RV units is not specified nor a planning map provided but from observation of other RV storage places this could run into the hundreds thus no longer a quiet rural environment. Although Mr. Matchett claims this will not affect any of the neighbors in any way, it does. For us, located at the end of the access road proposed for the RV storage and no office unit proposed, people will, logically assume we operate the RV storage and will be coming to our door for information. This pattern was already established when Mr. Matchett built the storage area for his farm equipment and collection of cars. People came to our door asking about the cars in storage. When Mr. Matchett grew hemp people continually asked us about the crop, assuming it was our property, as we are the only home adjacent to the property in this case. Mr. Matchett lives in Greeley, therefore there is no management or even observation of the proposed RV storage from 8pm to 4pm (closed hours), a total of 20 hours each day, every day of the year. Plus the hours of operation proposed 4-8pm is when it is dark (this time of year). Per another article (addendum 2) lighting is the only effective way to reduce the crime for RV storage. I don't know the specific code, but Weld County does have in their planning codes regulations to minimize light pollution that may adversely impact neighbors and the local community. Again, this would need to be 1 reviewed in regards to all the homes adjacent to the'property outlined in.the proposed change We know, -first hand, that road 641/2 is highly traveled with shift changes from the industrial area:- Those shift changes are during -the hours of operation proposed of 4-8pm' when traffic,is at its higheston-road 641/2 There are an'estimated 121 l employees at Vestas, another 100+ jobs at Owen'lllinois, to name just two companies whose employees travel road 641/2 to and from work As a managing partner of Tigges Farm Produce, Roasted Chilies and Pumpkin Patch, the Weld County Sheriff Department was contacted this fall to see if they could increase their patrolling of the road during the fall season when Tigges Farm, located directly across the road, is in full operation, to cut down on the speeding and the passing on the double yellow lines for the distinct purpose of keeping people safe traveling the road to visit this Weld County Agri -tourism Farm In the return call the Weld' County Sheriff Department said it was a very difficult area to patrol because it was between Districts (between the City of Greeley on both ends, I believe) and being a short distance in-between it was nearly impossible because there is no room on the two lane road to safely pull anyone over, so they admitted it is overlooked a lot This lack of patrol is an open invitation to an even higher increase of crime than other RV storage places in Weld County are experiencing. Mr Matchett states there is a clear view both directions entering and exiting the access/easement road Since that is the access road we use to get to and from our home,,, we are well=aware the smallhill to the east can`co`mpletely hide the visibility of headlights at nightsb extreme caution needs to betaken entering and exiting during the'dark especially due the extreme --speeding on the road Extra caution needs to be taken during the daylight hours as well due to the speeding ' It is not uncommon to turn onto road 641/2 and not even shift out of first gear and find a car quickly closing in'behind you We have also encountered, many times, cars passing us on the double yellow lines just before we turned onto the access road or honk at us for slowing down to turn I am not sure patience would be extended to long RV campers that need more time to turn onto or out of the proposed access road The lack of secure fencing of the entire RV proposed area is a concern as it becomes an additional open invitation to increased crime and to the homes that border the property to the north, south, east and west The west and south ends of our property are divided by a ditch going north and the ditch can be jumped easily As stated in addendum 1 the thieves are not after the RV's but what is in the RV's or sterns that can be carried away Lack of complete fencingimakes it very_easy to carry things away. There -is no mention of weed;contr'ol for'theproperty Putting gravel on prime fertile agriculture\ground will not prevent weeds from growing without adequate weed control To be maintenance free of weeds, it would require the killing -of thegrou,nd that would further destroy restoring the property buck to agriculture production for years to come if 2 ( , the RV storage didn't succeed That seems almost like a crime committed against nature J Without weed control, there could be an increase in the danger of fire Although only one side of the ditch that borders between properties is our responsibility, we have maintained weed control on both sides of the.ditch withoutany cost or request for cohipensation front Mr Matchett Thus the location of any fencing we would like to be addressed so wecould continue weed control on Mr Matchett's side of the ditch as well as our side of the ditch. When we purchased our property that is surrounded by Mr Matchett's property on the south and west sides, we selected this parcel because it was not in the existing flood plain Mr Matchett's property, that is proposed for the RV storage, is partially in the flood plain Although he states he will comply with all regulations, he does not address the regulations or the ordinance's set by Weld County My understanding is the Federal Emergency Management-Administration_(FEMA)-sets minimum -standards that -the -County must comply -- with to be eligible for the National Flood Insurance Program, (NFIP), the only program that offers the required flood insurance to residents that build in the flood plain Flood insurance is required if a mortgage is needed in flood plain locations I think wheeled vehicles parked in the flood plain must be moved every 180 days to stay in compliance with the minimum standards, but not sure of that fact NFPI compliance ordinances would need to be checked by the FEMA Administrator for the County and added to the plan and annually reviewed by the county Furthermore, If FEMA, through their accountability program, finds non-compliance it could , Jeopardize the counties eligibility for the'NFIP, thereby the result would be the canceling of all flood insurance policies taken out. For example, if someone has a mortgage for $200,000 on a home, they could wake up finding the remaining amount due immediately because their flood insurance would be canceled There is a possibility developers could find property unsellable because people couldn't qualify for a loan without flood insurance Fencing is also regulated in the flood plain and some areas in the flood plain cannot be fenced This would also need to be reviewed to see if there were any restrictions So my question is, does Mr Matchett's plan comply with the regulations set to insure the County keeps its eligibility,_without any -doubt, ever, of becoming non -compliant and -losing the NFIP? Our home is not in the flood plain and does not have a mortgage on it, so this is a concern we have on behalf of all the residents of Weld County, not us personally Another County concern we have is that Weld County is the 9th largest agriculture producing county in the Nation That's something to be proud of, even brag,about But how long will we keep that status if we continue to rezone agriculture to commercial or non -agriculture development? What is the domino effect if that status it'not' maintained because it was chipped away little by little, thinking it didn't matter? Even small productive agriculture acreages matter so we urge foresight over hindsight. When will it show up on the grocery shelves that we have ignored agriculture production and how vital it is to - everyone's everyday life? Since the start of spring, multiple reports of items like catalytic converters, generators, tools. electronics, batteries, propane tanks and other household items have been stolen from storage lots, according to the release. Storage lots are being targeted because many people store items for weeks, months or even years at these businesses. Let's talk about the other important reasons that this RV Storage facility is not a good choice at this time 1.) Lighting at night. Again, this disrupts not only my parent's house, but other close residents and farms nearby the proposed development. 2.) Increase in theft. It has been researched and documented that theft increases by more than 20% when RV storage facilities are constructed. Might I remind you, again, that my parents will live less than 1000 feet away from this proposed facility. Their safety is a HUGE concern. The safety of all those that live around this proposed facility is a concern. As far as police presence in this part of the county, please see item #4 below. It's rare that they are seen in this area. It is documented even in the "Right to 2 Farm "article on the Weld gov site that police interactions are only done reactively, not proactively ' Meaning, they will normally only respond to complaints and not patrol on a regular basis 3 ) Safety Theft is one concern, but so is fire It only takes a Google search to see that fires in RV Storages are prevalent My parent's and their land is in direct peril Currently, my parents farm the land that they own with pumpkins, gourds and alfalfa 4) Increase in traffic congestion Nbt only is the only access road to my parents (and I'm assuming this proposed facility) the ONE road you see pictured in this map, but increased traffic on this road is not a good thing The road in front is already travelled by large semis and SEVERAL people heavily exceeding the speed limit In fact, it's known that law enforcement do not regularly police thisistretch of the highway This RURAL farm community does not need more traffic 5 ) Increased traffic accidents This is a no-brainer We have seen time and time again while working at the Tigges Farm many times when vehicles are turning slowly into the farm, there have been near - misses from other vehicles exceeding the speed limit Let's see what happens to a truck with a large camper trying to turn into a facility on this road And - in going with item #4, more traffic, more accidents 6 ) Loss of rural character This facility is also directly across from Tigges Farm As you may or may not know, Tigges Farm is a well-known Weld County Agri -Business This farm is a constant agn-attraction for not only Northern Colorado, but Denver and Wyoming People come to the farm for a purely AGRICULTURAL experience, with wonderful, unobstructed views of FARMLAND Not only will this devastate my parents, but will more than likely hurt the Tigges Farm small business 7 ) Decrease in property value Building this proposed facility or even just zoning it as industrial/commercial will 100% decrease the property value of my parent's house, Tigges Farm and of those surrounding My parents are looking at possibly having to MOVE at 80+ years old The prospect of selling their house and property with the SURROUNDING land being zoned industrial/commercial is something that can not be easily sold 8 ) Encroachment'of industrial/commercial land on agricultural use land It is well known that Weld County is #9 in the U S for total Ag Sales Stats indicate that farm land seemed to increase from 2017 I don't see this for the future based on what I heard in the December 6th planning committee meeting where I listened to 6 proposals to zone ag land into industrial They were all approved Where does this stop? At what point will Weld County think that enough is enough? Being 12th, 20th, 35th of total ag sales in the US? From what I see, we actually dropped to 9th in the last census Still a great place in line, but should we consent to this number dropping further? RV storage facilities are prone to fires. After a quick Google search, I found an article from a fire in Colorado Springs, Aspen, Centennial, Broomfield, and the list goes on. The area around the proposed RV park is dry fields that can easily catch on fire and cause devastation to the surrounding areas. 4. This will ruin land that is meant to be used for agriculture. Colorado is 9th in the Nation in Ag Production. Weld is 1st in the State of Colorado. Why are we so determined to take aim at lowering that food security status. This decision doesn't just affect people within 500 ft, this compounds a dangerous direction that affects the whole Nation. Our thinking it doesn't matter needs to change. It does matter. The Weld County Right to Farm states we are to encourage hobby farms (which this property is) and home based businesses to supplement farm income. I am assuming this statement is not just empty words, but something decision makers intend to stand up for and defend. Rezoning agriculture is the same as opposing the Right to Farm. Sounds good on paper, but only means something if you are willing to stand up for it. Keep Colorado Agricultural. Protect the land. I object to the proposed change in this case regarding the request to change zoning from agriculture to commercial . Having been a farmer my entire life, I regret seeing the current trend of prime agriculture ground lost to non -agriculture uses when there is ample ground in Weld County that is not conducive to agriculture production that could be used for non-agricultural purposes such as recreation vehicle (RV) storage. The specific to this case is prime, productive agriculture ground. Mr. Matchett does not own water rights, but the property could be successfully farmed as dry land with wheat or grass crops or with crops that require minimal water with the purchasing of water that flows through the existing ditch that is along the north and east sides of the property outlined in this case. Although Mr. Matchett states this enterprise would not affect the neighboring residences in any way. RV storage would cause depreciation to existing homes on all sides and within the surrounding area. Some homes are new to the area and are well maintained with pleasing landscapes that reflect the rural living character of the area and other homes have been established in the community, including mine, since before 1934 when my farm was bought by my grandparents. It is still continues to be a productive agriculture farm and is in the overlay agriculture district that was initiated by the County Commissioners, specifically to preserve this historically rich agricultural area within Weld County. Three of the farms (including mine) in the overlay district have made a great effort, after mining was done, to restore and return the farm to full production keeping this a historically rich agricultural area that enhances the historic Cache La Poudre river, preserving the natural wildlife habitats that still exist along the river, as well. A recreational storage across from the farm and the agriculture overlay district doesn't compliment the efforts to preserve the historic agriculture for future generations. The paved road between my property and the property in this case is a two lane road posted at 55 miles an hour. There is no merging lane or exit lane to turn into the stated easement/access road in the plan and there have been numerous accidents the entire stretch of road 64 1/2, including one, within the last month, 100 yards from the entrance proposed. O There is no reference in the plan regarding signage and how the position of a sign would not obstruct visibility for exiting the property onto Road 641/2, a two lane road Mr Matchett states that the hours of operation will be from 4-8pm Granted the highest usage of recreational vehicles would be the warmer months, but there are more snow birds with the baby boomers retiring who travel south this time of year to reach their destination by Thanksgiving, and for their stay during the remaining winter months At the date of this letter, it was dark by 4•45pm Mr Matchett does not indicate there will be any lighting so it may be difficult and in some cases impossible to hook up a recreational vehicle in the dark As a member of this agriculture community, I have supported all efforts of the Poudre -_ -Learning Center,_a_true_natural environment educational gem of_Weld-County - Their_future_ plans include an observatory if the night sky can be preserved in this area Knowing that lighting is critical to a secure RV storage this would greatly add to the night sky pollution and possible kill those plans That would be a loss to all the residents of Weld not just the surrounding neighbors O If rezoning is considered, rather than rezoning to commercial use that would be of very little benefit to the developments and families in those developments in the surrounding area (as there are RV storage plots available already in the surrounding area), might Weld County entertain the idea of purchasing the property to keep the area adjacent to the agricultural overlay district compatible by turning the property into a park The developing rural neighborhoods would have a park to enjoy in a rural setting It would complement the agriculture overlay district Planned open space could become an issue with the number of developments in the area that have over 1000 homes in the plans There is an agricultural supply ditch that could be used for non -potable supply for irrigation needs of a park If lighting was needed for a park, it would not be to the extreme that an RV storage would require How many opportunities will there be in the future for open space preservation with the current rise in housing developments in Weld County? Weld County Commissioners, I am writing in regards to case #CO722-0003 which is a request to rezone land on WCR 64 1/2 from Agriculture to Commercial. As a native of this area I see many problems with this: This is already a busy road with traffic and speed problems. The area has several historic farms in the immediate area that would be negatively impacted —we need to preserve our rapidly disappearing farm land and rural character as much as possible. The farms and ag land in this area serve as a buffer between Windsor and Greeley. Northern Colorado is at risk of becoming one congested area with fewer and fewer areas of open space -- Our cities and towns blending together with 125 becoming Main Street. It would negatively impact the value of homes in the immediate area significantly. We have many areas suitable for RV storage on land not usable for agriculture and not in the immediate proximity of homes. Dear Weld County Commissioners, I am apposed to the Planning Commissions recommendation to rezone this property from Agriculture to Commercial: • Rezoning will further erode the nature of the area's agricultural land both around it and across the road to the south. • The rode it is associated with has a significant and problematic amount of traffic - the movement of recreational vehicles into and out of the area for storage will only add to this traffic. • This rezoning will drastically reduce the value and the privacy of the rural home that this RV storage area will nearly surround. The owners of the home would have to share a narrow driveway with the RV Storage area. • Please imagine yourself owning a very private beautiful rural home suddenly surrounded by a mass of RVs - being kept under who knows what kind of physical conditions in terms weed control, etc. Further, I think it would subject one's home to the potential for vandalism, intrustion and safety issures. There are many area in Weld County where an RV Storage Area could be placed without impacting home owners and agricultural buffer zones - Please reject this rezoning request. The subject property is sandwiched between two residential properties and surrounded by six homes The North Greeley Rail Corridor and Weld County Opportunity Zone are being used to justify this change Only 200 feet of the property is adjacent to the railway. (Incorrectly stated in the application as 400 feet) Rail use does not seem possible and would not be needed for a commercial use The nearest industrial use is part of the GWIP located nearly %2 mile from the subject property. This parcel is used for transloading where the property has 1,800 feet of access to the railway. Sec. 22-4-10.A.1 - Areas of opportunity for commercial and industrial development are logically developed based on transportation infrastructure of roads and railways. Sec 22 -4 -10.B.1 —The Weld county Opportunity Zone criteria states that zone changes to commercial and industrial are preferred in select areas of the County. The property is located in unincorporated Weld County. The nearest industrial zoning is 1/4 mile from the subject property to the west of the Christiansen property. There is NO Industrial or Commercial zoning to the east of the Christiansen property. Two residential properties would be swallowed up by industrial and commercial zoning on nearly all sides; they would be cut off from the other residences by this change of zone Sec. 22-2-30.C. People bought property in the area or have lived and worked on the farm property for many years with the expectation it would stay agricultural and did not expect there would be a push to change the area to commercial. B. — Respecting Private Property Rights. One of the basic principles upon which the United States was founded is the right of citizens to own and utilize property so long as that use complies with local regulations and DOES NOT INTERFERE WITH OR INFRINGE UPON THE RIGHTS OF OTHERS. The RV storage moved to a location adjacent to GWIP Sec. 22-2-30.4.a -Right-To Farm Statement - Incentives attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life.
