RESOLUTION ca. \ WHEREAS, a public hearing was held on June 24, 1974, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Fred Althen, 5720 South Pearl, Littleton, Colorado, and Jack Boyer, 836 East 17th Avenue, Denver, Colorado, requesting a change of zone from "A" Agricultural District to "C" Commercial District, Planned Unit Development, and WHEREAS, the petitioners were present, and WHEREAS, there was no opposition to the change of zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request of the petitioners and studied the recommendations of the Weld County Planning Commission as submitted, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the petition of Fred Althen and Jack Boyer, for change of zone from "A" Agricultural District to "C" Commercial District, Planned Unit Development, said area being more particularly described as follows: Part of the Southwest Quarter (SWII-) of Section 23, Township 1 North, Range 68 West of the 6th P. Since this developement is in our Decono Are Fire Prot- ection District, we are interested in it ss far as fire prot- ection is concerned. .7e see no indication of what type of commercial operations may be in this park, but do feel the need to prepare for it at this time. Vie, the Board of Directors of the fire protection_ district, and myself as Fire I:Ta.rshall ask for your co--her etion in this to the extent of planning for us to be able to serve this area with the type of Fire xretectton they will want. I see on the developement plan that a water line from the Left Hand Water Co. runs both to the west ::end south .sides of the planned developement. 10 see no plans , or specifications on the plan for any proposed fire hydrants, but ask your careful and thorough consideration on this matter. Vie have found in the past that a fire hydrant every 600 feet on the property frontages is about maximum that can be successful. The mains to the fire hydrants should not be less than 6. in or largor. The water pressure at the hydrants has got to be a. minimum or 50 lbs or more at all times. It is Ilse extremely important to us to keep these .hydrants in conformation with the otb-r hydrants in our district so that immediate hose connections can be made and so that all apparatus will connect with one standard connection. The requirement of 600 feet between hydrants as a max- imum is also to be considered, a very important fecter as we must also consider the depth' of the property when we go in on a fire. We use one-half of the 600 ft. , srd the depth which is how much hose we must have on board a vehicle and hoe far we may have to puns water efficiently. Consideration as to rear property accesability is also important, but I am sure you will provide all ample accesses. Last but not least we feel that when the actual planning of the types of buildings to be put up are considered we should like to be able to make some suggestions as to possible sprinkler systems or exterior hook-up stand pipes fee fire control as the building and usage may require. In a commer- cial area of the type we could see mere' it is important to consider these facts, as we cannot plan on hauling enough water in to fight fires as we can in the case of a wheat field , etc. When and if it comes to the point of actual installation of Fire Hydrants please feel free to contact me and I will help to be sure that the proper threads are used so -re can readily use then. The developers have a commercial well (Permit No. 015774-F) which is capable of providing approximately 17,000 gallons per day with adequate storage. The developers intend to limit the amount of water available to each tract to not more than 1, 000 gallons per day. This appears reasonable if the potential purchaser does not require considerable water and does not desire lawns or green belts . The report by F. M. Fox and Associates of January 4, 1974, and the addendum to that report on January 22, 1974, discuss the problems of possible subsidence in this portion of the Washington Coal Mine. According to their report, there are evidences on the tract of subsidence which either has occurred or is occurring. "In the western part of the area, a few gentle north-south trough-like depressions are visible." This land form "plus the moderate to severe cracking of the two masonry buildings located in the southwest part of the subject area are suggestive of subsidence problems related to the abandoned mine." As we understand it, these buildings are in the vicinity of lots 3, 4, and 5, which are proposed for light industrial development. Due to this evidence of subsidence on the western portion of the property, we do not recommend approval of development on lots 1-5, unless it can be shown that the proposed construction will not be subject to subsidence or that the type of construction proposed will not be affected significantly by this potential subsidence. Lots 6, 8, 9, and 10 appear to be essentially free of underground mining. The eastern half of lot 7 is shown to be free of under mining. We therefore suggest that perhaps more intensive development would be appropriate on these lots which appear to be free of potential subsidence problems. If the county elects to approve this subdivision at this stage, we recommend that it be done with the condition that all prospective buyers of this property be informed that underground mining has occurred, that the potential for subsidence does exist, and that detailed lot-by-lot evaluations would be required before actual development is advisable. Subsidence over mined-out areas is extremely difficult to predict. It would appear, however, from the evidence submitted by Fox and Associates that subsidence has occurred in the relatively recent GEOLOGY STORY OF THE PAST . . . KEY TO THE FUTURE Weld County Planning Commission Page 2. April 24, 1974 past on the western portion of the proposed development. Without extensive subsurface exploration, it would be impossible to predict whether or not subsidence is likely to occur in the future. And even with a reasonable amount of subsurface exploration, one can never be certain. The suggestions for construction in the F. M. Fox report should be carefully followed if construction is to occur in or around mined-out areas. Critical recommendations include: "Underground utilities should be designed with flexible connections for all bends, junctions, and straight lengths in excess of 200 feet. Structures should not have masonry or block walls; and they should be placed on very rigid foundations that will resist cracking or on floating or adjustable foundations that are flexible enough to absorb movement."
